That the vote taken under Article 35 at the adjourned annual meeting of the Town of Arlington, held April 15, 1936, relating to the disposition of lands and buildings ac- quired by tax sales, be and hereby is amended by author- izing the Treasurer, with the approval of the Board of Selectmen, for the time being until May 1, 1949, to sell or lease any and all vacant lands, title to which has been or hereafter may be acquired by the Town by tax sales, by foreclosure of liens for taxes or otherwise through proceed- ings for the collection of taxes, to Arlington veterans of World War II for amounts less than the said Treasurer and the said Board of Selectmen shall deem to be the fair market value, for dwelling purposes.


There being no further business under Article 3, the Moderator declared it disposed of.


Article 4 taken up. (Removal of Snow and Ice)


On motion duly made and seconded, it was unanimously


Voted: That no action be taken under Article 4 of the Warrant.

ARLINGTON TOWN REPORT


Ryan of the Police Department for expenses incurred by them in the defense of actions brought against them for acts done while acting as police officers; that for this pur- pose the sum of Four Hundred Fifty Dollars ($450.00) be and hereby is transferred from the free cash now in the treasury of the town and expended under the direction of the Board of Selectmen.


There being no further business under Article 5, the Moderator declared it disposed of.


Article 6 taken up. (Sale of Land)


On motion duly made and seconded, it was unanimously


Voted: (rising vote 133 voting YES and None voting NO)


That the Board of Selectmen, be and hereby is authorized and empowered in the name and on behalf of the Town to sell and convey at public auction or private sale the parcel of land situated on the Southwesterly side of Summer Street, Southeasterly of Franklin Avenue, and particularly described in Article 6 of the warrant, or the Town's interest therein, and upon such terms and conditions as the Select- men may consider proper.


There being no further business under Article 6, the Moderator declared it disposed of.


Article 7. (Amendment Zoning By-Law-Massachusetts Avenue at Highland Avenue)


Chairman Abbott presented "The Report of the Plan- ning Board," and on motion duly made and seconded, it was unanimously received.

Article 8. (Amendment Zoning By-Law - Pleasant Street)


On motion duly made and seconded, "The Report of the Planning Board" was unanimously received.


On motion duly made and seconded, Chairman Abbott offered the following:


That the Town does not amend its Zoning By-Law by altering the Zoning Map therein referred to so as to include in the Residence "C" District the area now in the Residence "A" District, described in Article No. 8 of the Warrant for the Town Meeting, Monday, December 2, 1946.


On motion duly made and seconded, Mr. Murphy offered the following substitute motion:


That the Town amend its Zoning By-Law by altering the Zoning Map therein referred to so as to include in the Residence C District the area, now included in the Residence A District, described in Article No. 8 of the Warrant for Town Meeting, Monday, December 2, 1946.


Following lengthy discussion, the Previous Question was moved, seconded and carried. Thereupon the Moderator called for a vote on the acceptance of Mr. Murphy's motion, and being in doubt as to the result he asked for a rising vote which showed that 138 voted YES and None NO, and the Moderator declared the motion carried.


On motion of Mr. Murphy, duly seconded, it was


Voted: To lay Article 8 on the table until the next Annual Meeting.


There being no further business under Article 8, the Moderator declared it disposed of.

On motion duly made and seconded, it was unanimously


Voted: That in accordance with Chapter 40, Section 9 under the General Laws of Massachusetts, as amended by Chapter 409 of the Acts of 1946, the sum of fifty (50) dol- lars be and hereby is appropriated for the purpose of pro- viding headquarters for the Lt. Stanley G. Benner Detach- ment, Marine Corps League of Arlington; and that said sum be and hereby is transferred from the free cash now in the treasury of the town and expended under the direc- tion of the Board of Selectmen.


There being no further business under Article 9, the Moderator declared it disposed of.


Article 10 taken up. (Acceptance of General Laws)


The Finance Committee recommended the following:


That no action be taken under Article 10 of the warrant.


Mr. Murphy offered the following which was duly sec- onded :


That section thirty of chapter 149 of the general laws as amended by section one of chapter 367 of the Acts of 1936, entitled "An act establishing a six day week, so called, for certain public employees and persons employed on public works, be and hereby is accepted.


There was considerable discussion, and the Previous Question being moved and seconded and carried, the Mod- erator called for a vote; on being taken, he was in doubt as to the result and called for a rising vote.


The count showed 108 voting YES and 36 voting NO; and the Moderator declared the motion carried. And there- upon it was

The Finance Committee recommended the following :


That effective July 1, 1946, there be paid to each full time employee who was still employed by the Town as of November 1, 1946 the sum of One Hundred Four ($104.00) Dollars as special compensation for the last six months of the year 1946, to be paid pro rata of the amount earned by him, in installments in accordance with the various payroll periods now in effect in the town and to each part time or seasonal employee of the Town who was employed during the last six months of the year 1946 and who was an em- ployee on November 1, 1946, there be paid an amount in such proportion to the time worked as the various depart- ments shall determine; all elected officials are hereby spe- cifically excluded from receiving any payments hereunder except the Town Clerk and the Town Treasurer; this action shall not be construed as permanently increasing salary or wages, nor shall any payments hereunder be deemed to be part of the regular compensation of any town employee or town officer.


That the sum of Seventy-five Thousand ($75,000.00) Dollars be and hereby is appropriated for the purpose of this article, said sum to be taken from the available funds now in the treasury of the town and expended under the direction of the various Boards and Heads of Departments of the Town and charged to the appropriation made under this article.


Mr. Harris offered the following substitute motion which was duly seconded :


That effective for the year of 1946, there be paid to each full time employee of the Town who was still employed by the Town as of November 1, 1946, the sum of $208. as

special compensation, to be paid pro rata of the amount. earned by him, in installments in accordance with the vari- ous payroll periods now in effect in the Town; and to each part time or seasonal employee of the Town who was em- ployed during the year 1946 and who was an employee of the Town on Nov. 1, 1946, an amount in such proportion to the time worked as the various departments shall deter- mine; all elected officials are hereby specifically excluded from receiving any payments hereunder except the Town Clerk and the Town Treasurer; this action shall not be construed as permanently increasing salary or wages, nor shall any payments made hereunder be deemed to be part of the regular compensation of any Town employee or Town officer.


That the sum of one hundred thirty-four thousand, six hundred and forty-five Dollars ($134,645.) be and hereby is appropriated for the purpose of this Article, said sum to be taken from available funds now in the treasury and expended under the direction of the various Boards and Heads of Departments of the Town and charged to the appropriation made under this Article.


After much discussion, the Previous Question was moved, seconded and carried, and the Moderator called for a vote; being in doubt as to the result he called for a rising vote, 85 voting YES and 55 voting NO; and he declared the motion carried, and it was

RECOUNT


Arlington, December 11, 1946.


In accordance with an Order received from the Secre- tary of State, a Recount of the votes cast for the office of Lieutenant Governor and for the office of Auditor of the Commonwealth, was held December 11, 1946 in the Robbins Memorial Town Hall, Arlington.


The Meeting was called to order by Timothy J. Buckley, Chairman of the Board of Registrars at 6:45 P.M., and the Order of the State Secretary was read by him.


All of the candidates were duly notified by the Town Clerk by registered mail. None of the candidates were pre- sent, but were duly represented.


Fourteen tables were used in the Recount.

Honorable Board of Selectmen Arlington, Mass.


Gentlemen :


We beg to submit our report for 1946:


On January 1st the Board appointed Assistant Regis- trars to take a census of all persons in the Town, twenty years of age and over. The list was duly prepared and printed according to law. Preparing this list of January 1st each year continues to be difficult; the cold weather and ice and snow and dangerous condition of travel, make it distasteful for those who undertake it; it is not as well done as it should be, and takes longer and costs more to accomplish.


In February the Board held five evening sessions for registering voters prior to the Town Election, at which time 148 persons qualified to appear on the voting list; in May three evening sessions were held prior to the State Primary and 251 persons qualified as voters; in October five evening sessions were held prior to the State Election and 2013 persons qualified as voters. Throughout the year during regular business hours 731 persons were registered as voters in the Town Clerk's Department. The total num- ber of persons registered during the year being 3143.


A recount of the votes cast at the State Election held November 5th for the offices of Lieutenant Governor and Auditor was held in the Robbins Memorial Town Hall on Wednesday evening, December 11, 1946 at 6:30 p. m. and concluded at 11 o'clock.


Below is a list showing a total of 22,945 registered voters in the fourteen precincts as of October 16, 1946.
