Article 50 taken up. (Acquisition of Land for Municipal Improvements)


On motion duly made and seconded, it was


Voted : (136 voting YES and none NO, the Moderator declared it a unanimous vote : )


That the Board of Selectmen be and hereby is author- ized and empowered on behalf of the Town; to purchase or take in fee by eminent domain or otherwise acquire for any purpose for which a city or town is or may hereafter be authorized to acquire land not authorized or directed by statute, or for any municipal purpose so authorized, the land within the Town, hereinafter described, any interest or ease- ments therein and any rights or easements of way or other- wise as appurtenant thereto and subject to or with any reservations of any rights or easements therein. Said parcel of land being bounded and described as follows :--


Beginning at the point of intersection of the northwest- erly side line of Mystic Street and the southwesterly side line of Winslow Street, thence northwesterly along said southwesterly side line of Winslow Street a distance of 259.7 feet to an angle point in said southwesterly side line of Winslow Street, thence continuing northwesterly along said southwesterly side line of Winslow Street a distance of 219.2 feet to the point of intersection of said southwesterly side line of Winslow Street and the southeasterly side line of Russell Terrace, thence southwesterly along said south- easterly side line of Russell Terrace a distance of 51.0 feet to a point on the northeasterly property line of the Boston and Maine Railroad, thence southerly and southwesterly along said northeasterly property line of the Boston and Maine Railroad on a curve to the right with a radius of 1232.5 ft. a distance of 340+ or __ ft. to a point on said northeasterly property line of the Boston and Maine Rail-

That for the purpose of said purchase, taking or acquisi- tion the sum of fifty-eight thousand one hundred eighty seven ($58,187.00) dollars be and hereby is appropriated ; said sum to be taken from available funds now in the Treas- ury and expended under the direction of the Board of Select- men.


There being no further business under Article 50, the Moderator declared it disposed of.


Article 51 taken up. (Removal of Structures)


On motion duly made and seconded, it was unanimously


Voted: That the sum of five thousand ($5,000.00) dol- lars be and hereby is appropriated for the purpose of re- moving, demolishing and disposing of the structures located on the land in the Town of Arlington or any other lawful purpose, said land being more particularly bounded and described in Article 50 of this warrant; said sum to be taken from available funds now in the Treasury and ex- pended under the direction of the Board of Selectmen.


There being no further business under Article 51, the Moderator declared it disposed of.


Article 52 taken up. (Acquisition of Land for War Memorial)

The Finance Committee recommended the following : That no action be taken under Article 52 of the Warrant. Mr. Allison reported Progress for the Committee.


Mr. Hauser offered the following substitute motion, which was duly seconded,


That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to purchase or take in fee by eminent domain or otherwise acquire for the pur- pose of providing a site for the erection of a building or edifice to be used for a War Memorial and other municipal purposes, or for any other lawful purpose, the land situated within the Town and bounded and described as follows :-


Beginning at the point of intersection of the northeast- erly side line of Broadway and the southeasterly side line of Franklin Street and running northeasterly along said south- easterly side line of Franklin Street a distance of 465.20 feet to a point on said southeasterly side line of Franklin Street, thence southeasterly by Lot "D" a distance of 78.0 feet to a point on the northwesterly property line of land now or formerly of Frederick W. Damon et al, thence north- easterly along said northwesterly property line of Frederick W. Damon et al a distance of 224.56 feet to a point on the southwesterly side line of Warren Street, thence southeast- erly along said southwesterly side line of Warren Street a distance of 162.65 feet to a point on said southwesterly side line of Warren Street, thence southwesterly along the south- easterly property line of said Frederick W. Damon et al, a distance of 340.14 feet to a point on said southeasterly prop- erty line of Frederick W. Damon et al, thence southeasterly along property line of land belonging now or formerly to Thomas F. & Gertrude M. Moroney a distance of 91.9 feet to a point on the northwesterly side line of Webster Street, thence southwesterly along said northwesterly side line of Webster Street a distance of 253.52 feet to the point of intersection of the northwesterly side line of Webster Street and the northeasterly side line of Broadway, thence north- westerly along said northeasterly side line of Broadway a

That for the purpose of such purchase, taking or acqui- sition the sum of sixty seven thousand sixty-two dollars ($67,062.00) be and hereby is appropriated; said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


And being put to a vote the Moderator declared the mo- tion lost. Thereupon, on motion duly made and seconded, it was


Voted: That no action be taken under Article 52 of the Warrant.


There being no further business under Article 52, the Moderator declared it disposed of.


Article 53 taken up. (Memorial Building)


The Finance Committee recommended the following :


That no action be taken under Article 53 of the Warrant.


Mr. Cutler offered a substitute motion which the Mod- erator declared out of order.


There was considerable discussion; it was moved and seconded that Article 53 be laid on the table; a voice vote was taken, and the Moderator being in doubt as to the result called for a rising vote which resulted in 61 voting YES and 70 voting NO, and he declared the motion lost. The Previous Question was moved and seconded and carried.


Thereupon a vote was taken and it was


Voted : That no action be taken under Article 53 of the Warrant.

At this point (11:10 p. m.), it was moved and seconded that the Meeting adjourn, and a vote being taken the Mod- erator declared it lost. The presence of a Quorum was doubted ; the Moderator called for a count, and being taken the Moderator declared there were 157 members present, and more than a Quorum.


Article 54 taken up. (Addition to and Alterations- Robbins Memorial Town Hall)


The Finance Committee recommended the following:


That the sum of one hundred twenty five thousand (125,000) dollars be and hereby is appropriated for the pur- pose of erecting an addition or additions to the present Rob- bins Memorial Town Hall and the alteration or reconstruc- tion of the present interior of said Robbins Memorial Town Hall, to provide for the rearrangement of town depart- mental quarters ; said sum to be taken from available funds now in the Treasury and expended under the direction of the Board of Selectmen.


And on being put to a vote the Moderator declared the motion carried.


There being no further business under Article 54, the Moderator declared it disposed of.


Article 55 taken up. (Reclamation Plant)


The Finance Committee recommended the following :


That no action be taken under Article 55 of the Warrant.


Chairman Wallace offered the following substitute mo- tion':


That the sum of one hundred eighty thousand five hun- dred ($180,500) dollars be and is hereby appropriated for the construction of a building to be used for the purposes of the Board of Public Works as a plant for the disposal of rubbish and waste materials and otherwise, upon the land of the Town known as the Town Yard at Hobbs Court,

including the cost of original equipment and furnishings thereof, substantially in accordance with plans, copies of which are contained in the report of the committee ap- pointed under vote of the Town passed under Article 36 of the Warrant for Annual Meeting of 1936, Article 3 of the Warrant for the Annual Meeting of 1937, Article 39 of the Warrant for the Annual Meeting of 1938, Article 57 of the Warrant of the Annual Meeting of 1939, Article 56 of Warrant of the Annual Meeting of 1940, and Article 37 of the Warrant of the Annual Meeting of 1945, presented at this meeting; that for said purpose the sum of thirty thou- sand five hundred ($30,500) dollars be raised by general tax, and for the balance, one hundred fifty thousand ($150,000) dollars, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of one hun- dred fifty thousand .($150,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all acts in addition thereto or in amendment thereof, so that the whole loan will be paid in not more than ten (10) years from the date of the issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine; and fur- ther, that said appropriation be expended under the direc- tion of the said committee with the addition thereto of the present chairman of the Board of Public Works, any va- cancy therein to be filled by the Moderator, said committee to have full charge of said construction and full authority so to construct said building within the sum herein appro- priated."


He called upon Mr. Phillips and Mr. Marsh to explain conditions which necessitate a Reclamation Plant, and they were permitted so to do. Discussion followed; the Previous Question was moved and seconded and carried; and a vote being taken, the Moderator declared the substitute motion lost.

Article 56 taken up. (Annual Rental for Arlington Post 1775, V.F.W.)


On motion duly made and seconded, it was unanimously


Voted: That in accordance with Chapter 40, Section 9 under the General Laws of Massachusetts, the sum of six hundred (600) dollars be and hereby is appropriated for the purpose of providing headquarters for Arlington Post, 1775, Veterans of Foreign Wars of the United States; and that said sum be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 56, the Moderator declared it disposed of.


Article 57 taken up. (Appointment of Committee- Town Manager Form of Charter)


The Finance Committee recommended the following :


That no action be taken under Article 57 of the Warrant. Mr. Corcoran offered the following substitute motion :


That the Moderator be and hereby is instructed to ap- point a committee of seven to investigate, consider and make recommendations as to the advisability of adopting a Town Manager form of charter, said committee to report its re- commendations to the Town at the Annual Town Meeting of 1947; and that the sum of one thousand (1,000) dollars be and hereby is appropriated for the necessary expenses to be incurred by said committee; said sum to be raised by general tax.


The Moderator called for a rising vote which resulted in 41 voting YES and 86 voting NO, and the motion was declared lost, and it was

By virtue of this warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and places and for the purpose herein specified by causing a printed attested copy of said warrant to be left at every dwelling house in the town previous to the day of the meeting for the nomination of candidates of political parties and by posting an attested copy of said warrant at the doors of the Town Hall and in two or more conspicuous places in each of the fourteen precincts of the Town, seven days at least before the day of said meeting. A notice of the time, places and object of the meeting was published in the local papers.

STATE PRIMARY


Arlington, Mass., June 18, 1946


In pursuance of the foregoing Warrant the legal voters of the Town of Arlington met in their respective voting . places in said Town on Tuesday, the eighteenth day of June in the year of our Lord one thousand nine hundred and forty-six at seven o'clock in the forenoon.


The following places were designated as the voting places for the various precincts.


Precinct One, Crosby School, entrance on Winter Street; Precincts Two and Four, Hardy School, entrance on Lake Street; Precincts Three and Five, Junior High School East, entrance on Tufts Street; Precincts Six and Eight, Town Hall, entrance on Massachusetts Avenue; Precinct Seven, Russell School, entrance on Medford Street; Precinct Nine, Russell School, entrance on Mystic Street; Precincts Ten and Twelve, Cutter School, entrance on Robbins Road; Pre- cinct 11, Highland Hose House, entrance on Massachusetts Avenue; Precinct Thirteen, Peirce School, entrance on Park Avenue North; Precinct Fourteen, Locke School, entrance on Park Avenue.


The Election Officers, having been duly appointed by the Selectmen, and sworn to the faithful performance of their duties, were assigned to the various precincts.


All laws governing Primary Elections were observed.


The ballots and all paraphernalia for the proper conduct of the election was supplied by the Town Clerk and turned over to the officers of the various precincts.


The polls were declared open at seven o'clock A. M. and remained open until eight o'clock P. M., at which time, after due notice, they were declared closed.


The ballots were counted by the election officers and en- cased in boxes which were locked and sealed, and same delivered by direction of the Town Clerk to the Police Sta-

tion where they were placed under police guard until after the expiration of the time within which a petition for re- count might be filed.


The returns and keys to the ballot boxes from each pre- cinct were turned over to the Town Clerk and with the assistance of the Registrars of Voters and Mr. Clarence Needham, the returns were canvassed and the result an- nounced.
