Arlington is situated six miles northwest of Boston, in latitude 42 deg., 25 min. north; longitude 71 deg., 09 min. west, at an elevation above mean tide of from 4 to 377 feet.

Gentlemen:
I herewith submit my report for the year 1952 in compliance with Section 3 of Chapter 3 of the By-Laws of the Town.
There have been twenty-two claims against the Town this year. Three have been settled as authorized by the Selectmen, six have brought suit and seventeen are in abeyance. Of the previous years' claims and suits, eleven were abandoned by the claimants without suit, one at the time it was reached for trial, and three were settled as authorized by the Selectmen. There was one verdict against the Town in the amount of $156.71, but the Town's position in all other claims was successfully defended. There were no cases in the Supreme Judicial Court.
The position of the Board of Assessors before the Board of Tax Ap- peals, the Arlington Board of Appeals before the Emergency Housing Commission and the Inspector of Buildings and Board of Selectmen before the Outdoor Advertising Authority, has been defended.
Substantial amounts of money for aid rendered by the Board of Health and by the Symmes Arlington Hospital have been collected and turned over to the Town Collector.
The Town Counsel has been available at regular and special meet- ings of the Board of Selectmen and regular and special meetings of the Board of Public Works, has rendered opinions as requested by said Boards as well as other Boards, Departments, Committees and Officers, has attended hearings at State Boards and Commissions, and has been vigilant in all other matters affecting the interests of the Town.
At the biennial state election in the current year, the Town of Arlington accepted Chapter 503 of the Acts of 1952, being "An act es- tablishing a Town Manager Form of Government for the Town of Arl- ington." Prior to the acceptance thereof, your Counsel issued no form- al or official statements or rules thereon.
Since the acceptance of said Act, your Counsel has been subjected to many and varied questions as to its operation, not only by the sev- eral Boards and Heads of Departments but also by the Employees and Townspeople. While your Counsel realizes that he is employed pri- marily for consultation and advice to officials, he has not only spent many hours going over said act and the law relating thereto but has

also taken a great deal of time with Boards, Committees and individ- uals particularly interested therein.
Your Counsel has endeavored, in the interest of the Town, to answer such queries as they arise, according to his best judgment, in order that the operation of said Act may not be handicapped by as- sumptions and misinterpretations. There are lawyers and laymen who would disagree with certain rulings and opinions; however, your Coun- sel is confident that if the rules and opinions are followed, no harm will fall upon the Town under the operation of said Act. Your Counsel has admittedly been cautious but has been so for the best interests of the Town. Thus, in the event any ruling or interpretation of the wording of said Act is submitted to a Court of Law, your Counsel is again con- fident that as to all official rulings and opinions made by him, the ac- tions of the Town Officials, the Town Employees and the Town Meeting up to that point will not be illegal, regardless of the decision of the Court.
For the kind consideration and cooperation extended to me by all the officials of the Town during the past year, and especially to the Board of Selectmen and Board of Public Works, I desire to record my sincere appreciation.

DISABILITY ASSISTANCE was granted to 50 persons.
Our Annual Report for 1951 contained a brief analysis of the new category commonly called Disability Assistance, Chapter 118 D of the General Laws, as enacted by Chapter 741 of the Acts of 1951. This new aid program became effective November 1, 1951.
Disability Assistance was referred to as an additional category of assistance with Federal and State participation which would ease the burden of cities and towns in respect to their General Relief costs. Fed- eral and State reimbursement combined is 75% with 25% to be borne by the community granting the aid. The provisions of the Settlement Law, Chapter 116 of the General Laws, are not applicable to Disability As- sistance.
This agency estimated a year ago that 33 1/3% to 50% of the Gen- eral Relief or Welfare Aid case load would eventually qualify for Dis- ability Assistance. After one year and two months of operation the General Relief load has decreased by 29% in number of cases and by

about 16% in total costs. Meanwhile the Disability Assistance rolls have climbed steadily from 18 to 37 due largely to new applicants who would not have been eligible for General Relief, but who have qualified for Disability Assistance because of its more liberal eligibility require- ments with respect to resources. The net gain to the Town of Arling- ton so far has been approximately 1%, or $605.96, the difference between $54,095.07, the Welfare Aid net cost for 1951, and $53,489.11, the com- bined net cost of Welfare Aid and Disability Assistance for 1952.
The largest expenditure, of course, was for Old Age Assistance. The lien law against the property of any applicant or recipient was mainly responsible for a drop in case load of about 8%. However, at the same time State Budget Adjustments which are mandatory for cities and towns, have been responsible for an over-all increase in expenditure of about 12%. It is anticipated there will be further increase in State budgetary standards during 1953.
The Agent wishes to express his sincere appreciation to the Honor- able Board of Selectmen, and to Town Officials and employees for their friendly cooperation throughout the year. Report of the Inspector of Animals

Subject: Annual Report of Inspector of Animals
To: Board of Selectmen
A total of 140 animals in Arlington were examined and quarantined for biting during the past year.
There were no cases of rabies in Arlington in 1952.
It was necessary to remove the head from one animal, and deliver it to the Wasserman Laboratory in Jamaica Plain to be examined. It was found to be free of rabies.

REPORT OF THE BOARD OF HEALTH
Report of the Board of Health
The Board of Health herewith submits its Annual Report together with the reports of its appointed officers for the year ending December 31, 1952.
At this time the co-members with Dr. Ernest R. Brooks on the Arl- lington Board of Health wish to express appropriate and fitting rec- ognition of the long and faithful service that he has performed for the Town of Arlington in the capacity as a member of the Board of Health.
Seldom, if ever, does an individual devote his time and service over such a long period of time in the interest of his Town.
March 1, 1920, Dr. Ernest R. Brooks was elected a member of the Arlington Board of Health. From that time at each election when he sought re-election, he was returned to the office. This year he has announced his intention of not being a candidate when his term ex- pires in March. It was with great reluctance that we accepted this decision, for to be deprived of the services of one who has given so whole-heartedly and unstintingly to the interest of the Town of Arling- ton is surely a great loss.
