VOTED: That the sum of thirty-five thousand ($35,000.00) Dollars be and hereby is appropriated to be expended under the direction of the Library Trustees, for the enlargement, alteration, improvement and re- construction of the present East Arlington Branch of the Robbins Memorial Library, for the purpose of providing for additional library fa- cilities in said East Arlington Branch Library, and to provide furniture, equipment, lighting and other facilities for the said East Arlington Branch Library; that for this purpose the sum of One thousand and five hundred ($1,500.00) Dollars be taken from unexpended balances now in the Treasury as follows:

VOTED: That the laying out of a town way from Massachusetts Avenue to Paul Revere Road, substantially in the location of the private way known as Davis Road, as more particularly described in Article 31 of the warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works, be accepted, said way established and said Joint Board authorized to take land for the purpose of said way.


There being no further business under Article 31, the Moderator declared it disposed of.


Reconsideration of Article 13. (Town Outlays and Expenses.)

VOTED: That the figures $7540.00, as they appear in Budget No. 13, under the item, "Expenses", be amended to read $11,866.00, and that the figures $26,585.00, as they appear under the item, "Total", be amend- ed to read $30,911.00.

Article 50. (Acquisition of Land for Public Playground Purposes.)


On the substitute motion of Edward D. Buckley, Chairman of the Board of Park Commissioners, to amend the motion of the Finance Committee, which was seconded and, following extended discussion, was declared by the Moderator to have carried on a standing vote, 167 in favor, 4 opposed, it was unanimously


VOTED: That the Board of Park Commissioners be, and hereby is authorized and empowered on behalf of the Town to purchase or take

in fee by eminent domain or otherwise acquire for the purpose of a public playground or recreation center, the parcel of land within the Town hereinafter described, any interests or easements therein and any rights or easements of way or otherwise as appurtenant thereto and subject to or with any reservations of any rights or easements therein.


This parcel of land is bounded and described as follows:


Beginning at a point on the proposed northwesterly side line of Stowecroft Road at the northeasterly boundary line of land of Town of Arlington taken for school purposes, thence northwesterly by said land of Town of Arlington taken for school purposes a distance of 307.72 feet to an angle point thence N 26° - 07' - 00" E by said land of Town of Arlington and by land now or formerly of the General Construction Co. Inc., a distance of 463.70 feet, to land now or formerly of John Gomatos et al, thence southeasterly by land now or formerly of John Gomatos et al, a distance of 147.9 feet more or less to a point at the division line between land now or formerly of John Gomatos et al and land now or formerly of Daisy A. Crosby, thence continuing southeasterly by land now or formerly of Daisy A. Crosby, a distance of 290 feet more or less to the proposed northwesterly side line of Stowecroft Road, thence southwesterly on said proposed northwesterly side line of Stowecroft Road, and on a line 260 feet northwesterly of, concentric with and par- allel to the northwesterly side line of Mystic Street, a distance of 365 feet more or less to the point of beginning and containing approximate- ly 158,100 square feet as shown on plans on file in the office of the Town Engineer, Arlington, Mass .; that for the purpose of such purchase, tak- ing or acquisition the sum of three thousand nine hundred fifty-two dollars and 50/100 (3,952.50) be and hereby is appropriated; said sum to be raised by general tax and expended under the direction of the Board of Park Commissioners.


Edward John Doherty served notice of intention to move to recon- sider the vote under Article 50 of the Warrant.

Article 51. (Acceptance of General Laws-Re-Payroll Deduction on Account of Union Dues.)

VOTED: That the Town Meeting Members of the Town of Arling- ton in annual meeting assembled respectfully request the members of the General Court of Massachusetts to enact legislation permitting the voters of Arlington to adopt or reject the Town Manager Form of Gov- ernment, as embodied in the provisions of Senate Bill 456.

Proposed Reconsideration of Article 40. (Central Purchasing De- partment.)

Reconsideration of Article 32. (For Construction of Ways.)


On motion of Frederick Stanley Glynn, Jr., duly seconded, it was


VOTED: That the vote on the motion of the Finance Committee as amended under Article 32 be reconsidered.


On motion duly made and seconded, it was unanimously


VOTED: That the sum of one hundred thirty five thousand two hundred ten and 80/100 (135,210.80) dollars be and hereby is appropri- ated for the original construction of public ways, the laying out of which is accepted at this meeting, including land damages, and the cost of pavements and sidewalks laid at the time of such construction, all under the provisions of law authorizing the assessment of better- ments; that for this purpose the sum of twenty-five thousand two hun- dred ten and 80/100 (25,210.80) dollars be raised by general tax, and for the balance one hundred ten thousand (110,000) dollars the Treasurer, with the approval of the Selectmen, be and hereby is authorized to bor- row the said sum of one hundred ten thousand (110,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in addition thereto or amendment thereof, so that the whole loan shall be paid in not more than ten (10) years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine; and further that the said sum of one hundred thirty five thousand two hundred ten and 80/100 (135,210.80) dollars be expended under the direction of the Board of Public Works, substantially as follows:

Article 54. (Release and Transfer of Town Owned Land.)


On motion duly made and seconded, it was


VOTED: That the Selectmen direct the Town Counsel to investi- gate the title of the Town in the property known as Spy Pond Field, and obtain such releases or other instruments of law from the heirs of Hattie F. Hornblower as may be possible, or make such recommendation of action to the proper authorities as may be expedient, to the end that the said Spy Pond Field be administered or maintained, or both, so far as the law and the circumstances may allow, by the Park Department of the Town.


There being no further business under Article 54, the Moderator declared it disposed of.


Article 55. (Appointment of Committee-Re-Pennsylvania Real Estate Plan.)


On the substitute motion of Robert H. Zwicker to amend the motion of the Finance Committee, which was seconded and, after discussion, was declared by the Moderator to have carried on a voice vote, it was unanimously


VOTED: That the Moderator be and hereby is instructed to ap- point a committee of five to consist of three Town Meeting Members, one citizen and one member of the Planning Board, to investigate and consider the Pennsylvania Real Estate Tax Plan, known as the Pitts- burgh Plan, and its recent extension as it may apply to Arlington, and

to report not later than the Annual Town Meeting of 1953; that for the use of said Committee the sum of $50.00 be and hereby is appropriated; to be raised by general tax and expended under the direction of said Committee.

Article 56. (Amendment of Town By-Laws-Re-Town Meeting Members.)

Article 57. (Headquarters for Lt. Stanley G. Benner Detachment, Marine Corps League of Arlington.)

VOTED: That in accordance with Chapter 40, Section 9 under the General Laws of Massachusetts, as amended by Chapter 409 of the Acts of 1946, the sum of six hundred (600) dollars be and hereby is appropri- ated for the purpose of providing headquarters for the "Lt. Stanley G. Benner Detachment, Marine Corps League of Arlington"; and that said sum be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 57, the Moderator declared it disposed of.


Article 58. (Appropriation of Available Funds.)


On the substitute motion of George A. Harris to amend the motion of the Finance Committee, which was seconded and was declared by the Moderator to have been carried on a voice vote, it was


VOTED: That the sum of three hundred twenty-five thousand ($325,000) Dollars voted for appropriations heretofore made under the Warrant for this meeting, and not to be borrowed or to be taken from available funds or from balances of special appropriations made in other years, shall be taken from any available funds in the Treasury; and that the Assessors be instructed to use free cash in the Treasury in any available funds to that amount in the determination of the 1952 tax rate.


There being no further business under Article 58, the Moderator declared it disposed of.

VOTED: That the reports of the Selectmen and of the various Town Officers and the committees heretofore appointed, together with the statistics of the Assessors as printed in the Town Report, including also the Supplementary Report of the Town Accountant's Department, be received.


On motion of George A. Harris, duly seconded, it was unanimously


VOTED: That the permanent committee under vote of the Town passed March 24, 1919, on the Town Yard, be discharged.


On motion of Hallam T. Ring, duly seconded, it was


VOTED: That the committee under vote of the Town passed March 28, 1951, to investigate and consider the advisability of the erec- tion and maintenance of a central garage for Town vehicles, be dis- charged.

By virtue of this warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and places and for the purposes herein specified by causing a printed attested copy of said warrant to be left at every dwelling house in the Town previous to said day of the meeting for the election of candidates of political parties and by posting an attested copy of said warrant at the doors of the Town Hall and in five or more conspicuous places in each of the fourteen precincts of the Town, seven days at least before said day of said meeting. A notice of the time, places and objects of the meeting was published in the local papers.
