ADJOURNED ANNUAL TOWN MEETING-MARCH 27, 1961


Pursuant to the vote of adjournment of March 22, 1961, and written notices sent by mail by the Town Clerk, the town meeting members met in the Town Hall on Monday evening, March 27, 1961, to act upon the remaining articles set forth in the Warrant for the Annual Town Meeting.


A Certificate was filed with the Town Clerk by the Chairman and Clerk of Precinct 9 relative to the meeting held on this date and of the election to fill a town meeting vacancy until the next annual election, as follows:


Precinct 9 - Aubrey C. Tobey, 36 Fox Meadow Lane, to fill the vacancy arising from the resignation of Allan Roy Kingston, whose term was to expire in 1963.


Lists of the duly qualified town meeting members were used at the en- trances of the meeting place and were in charge of Mary A. Farrington and James E. Sweeney. The lists contained the names of two hundred forty- three (243) elected town meeting members and nine (9) town meeting mem- bers at large qualified to participate in and vote in town meetings in Ar- lington.


The check lists filed with the Town Clerk at the close of the meeting by the checkers showed that two hundred seven (207) elected town meeting mem- bers and nine (9) town meeting members at large (85.7% of total 252) at- tended the meeting.


The Moderator, Lawrence E. Corcoran, declaring a quorum present, called the meeting to order at 8:00 o'clock P.M.


The meeting was opened with the singing of the "Star Spangled Banner" by the Assembly, accompanied by Mr. Anton Kovar, pianist, and Mr. Richard Laman, trumpeter, both of the School Department.


The invocation was given by Rabbi Herbert Rosenbloom of the Temple Emunah Center in Lexington.


A town meeting member who had not previously been sworn was there- upon sworn by the Moderator.


There being no objection to the request of Selectman Parker, permission was granted by general consent for Mr. Robert F. Roland, consultant to the Planning Board, to sit within the town meeting enclosure.

There being no objection to the request of Selectmen Parker, he was granted permission to address the meeting and make an announcement in connection with the Metropolitan Transit Authority.


On motion of Selectman Parker, duly seconded, it was


VOTED: That if all the business of the meeting as set forth in the War- rant is not disposed of at this session, when the meeting adjourns, it adjourns to Wednesday evening, March 29, 1961, at 8:00 o'clock.


The Moderator declared Article 65 to be now before the meeting.


Article 65. ZONING (Area bounded in part by Spy Pond and Spy Pond Lane.)

Miss Campbell then presented the motion of the Planning Board which was seconded. A substitute motion offered by John P. Kedian, town meeting member from Precinct 12, which was seconded, was declared lost by the Moderator on a voice vote. Thereupon, on the motion of Miss Campbell, it was

There being no further business under Article 65, the Moderator de- clared it disposed of.


Article 66. ZONING (Area bounded in part by Broadway and Oxford Street.)

Thereupon, on the motion of Miss Campbell, duly made and seconded, it was


VOTED: (Unanimously) That the Town amend its Zoning By-Laws by altering the Zoning Map therein referred to so as to include in the Residence C District the area now included in the Residence B District, bounded and described as follows:


Beginning at a point on the center line of Oxford Street, said point being 101.45 feet southwesterly along said center line from the point of inter- section of said center line and the southwesterly side line of Broadway, thence northwesterly across Oxford Street, and through a Lot marked "Puffer" on a Plan entitled "Land in Arlington, Mass." dated November 6, 1909, H. S Adams, C. E., recorded with Middlesex South District Registry of Deeds in Plan Book 182, Plan 37, on the southwesterly boundary line of the Business A District shown on said Zoning Map a distance of 116.86 feet to a point on the northwesterly boundary of said Lot marked "Puffer" thence southwesterly on the southeasterly boundary of Lot 109 shown on said Plan now or formerly of Everett H. Mains a distance of 23.97 feet to an angle point, thence south- easterly on the northeasterly boundary of Lot 110 shown on said Plan now or formerly of Phillip G. VOTED: (Unanimously) That the Town amend its Zoning By-Law by altering the Zoning Map therein referred to so as to include in the Residence A District the area now included in the Residence D District, and bounded and described as follows:


1. Southeasterly side of Pleasant Street


Beginning at a point on the division line between the Residence D District and the Residence A District between Lombard Road and Wel- lington Street, said point being 200 feet southeasterly of the southeaster ly side line of Pleasant Street thence southwesterly and southerly on said division line across Wellington Street, Addison Street, Hopkins Road, Peabody Road and Lakeview to an angle point at the center line of Spring Valley, thence northwesterly on said center line of Spring Valley a distance of 60 feet more or less to a point on said center line of Spring Valley, thence northerly and northeasterly through said Residence D District and on a line 200 feet southeasterly of, parallel to and con- centric with the southeasterly side line of Pleasant Street across Lake- view, Peabody Road, Hopkins Road, Addison Street and Wellington Street to the point of beginning.


2. Section on northwesterly side of Pleasant Street


Beginning at a point on the northeasterly boundary line of the Par- menter School property said point being 200 feet northwesterly of the northwesterly side line of Pleasant Street, thence northwesterly by said northeasterly boundary line of the Parmenter School property a distance of 50 feet to an angle point, thence northeasterly by the boundary line be- tween the Residence D District and the Residence A District and on a line 250 feet northwesterly of and parallel to the northwesterly side line of Pleasant Street across Jak Knoll, Pelham Terrace and Maple Street, to a point on the southwesterly boundary line of land of Town of Arlington, thence southeasterly on said boundary line of the land of Town of Arlington a distance of 50 feet more or less to an angle point, thence southwesterly through said Residence D District and on a line 200 feet northwesterly of and parallel to the northwesterly side line of Pleasant Street across Maple Street, Pelham Terrace and Oak Knoll to the point of beginning.


There being no further business under Article 67, the Moderator de- clared it disposed of.

Thereupon, on the motion of Miss Campbell, duly made and seconded, it was


VOTED: (Unanimously) That the Town amend its Zoning By-Law by striking out the definition of "Story" appearing in Section 6 and inserting the following definition:


"Story" -- That part of a building between any floor and the floor or roof next above.


For the purpose of this by-law, where a building is not divided into stories, a story shall be considered fifteen feet in height, provided that steeples, penthouses, cupolas, stage lofts, etc., shall not be considered as additional stories. A basement or cellar, the ceiling of which extends more than four feet, six inches above the average finished grade, shall be a story within the meaning of this by-law. However, a basement or first floor which is not occupied by any family for dwelling purposes, except by a janitor and his family, but is used for parking, lobby, stairwell, elevator well, laundry, storage or like purposes, shall not be a story within the meaning of this by- law.


There being no further business under Article 68, the Moderator de- clared it disposed of.


Article 69. ZONING (Area bounded in part by Norcross Street.)

Remmert, town meeting member from Precinct 4, which was seconded and declaredby the Moderator to have carried on a standing vote, 99 having voted in the affirmative and 42 in the negative, it was

That the Town amend its Zoning By-Laws by altering the zoning map therein referred to so as to include in the Residence C District the area now in- cluded partly in the Business A District and partly in the Residence B Dis- trict, and bounded and described as follows:

WESTERLY by Mystic Street, 144.91 feet; NORTHWESTERLY by Rangely Road, 170 feet;


NORTHEASTERLY by Lot 17 on a plan hereinafter mentioned, 157.5 feet; and


SOUTHEASTERLY by land of the Commonwealth of Massachusetts 206.06 feet, said parcel being shown as Lots Nos. 1 and 2 on Assessors' Block Plan 64, Section B, and being numbered 147 and 151 Mystic Street, in the present numbering of said street.


There being no further business under Article 70, the Moderator de- clared it disposed of.


Article 71. (Amendment in Terms and Conditions of A Deed.)


VOTED: (Unanimously) That the Town does hereby authorize and direct the Board of Selectmen to amend the terms and conditions of a deed given by the Town to the Roman Catholic Archbishop of Boston, conveying certain land on Summer Street, which deed is dated September 30, 1957, recorded with the Middlesex South District Registry of Deeds in Book 9035, Page 466, by striking out the condition number 2 in said deed, reading as follows:


"2) Said land shall be used by St. Agnes Catholic Church and School of Arlington for High School purposes only and said school shall be built within five (5) years from the date of transfer of the land, or title to same shall revert to the Town as part of its public parks upon reimbursement to the grantee of the purchase price of said land;"


and in place thereof substituting the following:


"2) Said land shall be used by St. Agnes Catholic Church and High School of Arlington for educational and/or athletic purposes, including use of said land for an athletic field and athletic activities of Arlington Catholic High School, such use to commence within five (5) years from the date of the transfer of the land, or title to the same shall revert to the Town as part of its public parks upon reimbursement to the grantee of the purchase price of said land;"


and does authorize and direct the said Board of Selectmen to execute, ac- knowledge and deliver in the name and behalf of the Town any and all instru- ments necessary or convenient to carry out the purposes of this Article.


There being no further business under Article 71, the Moderator de- clared it disposed of.


Article 72. (Change in By-Laws.)


A substitute motion offered by John J. Bilafer, town meeting member from Precinct 11, duly seconded, was declared lost by the Moderator on a roll call vote, 90 having voted in the affirmative and 110 in the negative. Thereupon, on the motion of the Finance Committee, it was


VOTED: That no action be taken under Article 72 of the Warrant.


There being no further business under Article 72, the Moderator de- clared it disposed of.


Article 73. (Change the Name of Monument Park.)


A substitute motion offered by Joseph S. Daly town meeting member from Precinct 11, duly seconded, was declared lost by the Moderator on a voice vote. Thereupon, on the motion of the Finance Committee, it was

Article 74. (Transfer of Cemetery Funds.)


VOTED: That the sum of five thousand (5,000) dollars be and hereby is transferred from Mount Pleasant Cemetery Sale of Lots and Graves Fund to the Cemetery Commissioners for the improvement of the Town Cemetery.


There being no further business under Article 74, the Moderator de- clared it disposed of.


Article 75. (Review of Precinct Boundaries of the Town.)


VOTED: That the Town does hereby instruct the Board of Selectmen to review the precinct boundaries of the Town.


There being no further business under Article 75, the Moderator de- clared it disposed of.


Article 76. (Converting from Coal to Oil -- Junior High School West.)


VOTED: That no action be taken under Article 76 of the Warrant.


There being no further business under Article 76, the Moderator de- clared it disposed of.


Article 77. (Architectual and Engineering Survey.)


VOTED: That the sum of five thousand (5,000) dollars be and hereby is appropriated for the purpose of obtaining architectural and engineering serv- ices in connection with a survey of possible remodeling work in the old sec- tion of the High School, the Cutter and Locke elementary schools and any other school buildings in the Town of Arlington; said sum to be raised by general tax, and expended under the direction of the committee appointed under Article 8 of the Warrant for the Special Town Meeting held on March 15, 1954.


There being no further business under Article 77, the Moderator de- clared it disposed of.


Article 78. (Alterations and Improvements to Robbins Library.)


VOTED: That the sum of thirty thousand (30,000) dollars be and hereby is appropriated for further alterations and improvement to, and reconstruc- tion of part of the Robbins Library to restore, increase and improve existing library facilities; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 78, the Moderator de- clared it disposed of.


Article 79. (Conveyance of the Railroad Station to the V.F.W.)


A substitute motion offered by Valentine T. Chisholm, town meeting member from Precinct 14, duly seconded, was declared lost by the Modera- tor on a voice vote. Thereupon, on the motion of the Finance Committee, it was

Article 80. (Conveyance of Land.)

Article 81. (Advertising Town By-Laws.)


VOTED: That the sum of three hundred seventy-five (375) dollars be and hereby is appropriated for the purpose of defraying the expense of advertising and other costs relating to the By-Laws voted at this meeting; said sum to be raised by general tax and expended under the direction of the Town Clerk.


There being no further business under Article 81, the Moderator de- clared it disposed of.


Article 82. (Ornamental Lighting -- Christmas Holiday Season.)


VOTED: That the sum of three thousand eight hundred (3,800) dollars be and hereby is appropriated for the purpose of providing ornamental and additional light to the Town during the Christmas Holiday Season; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 82, the Moderator de- clared it disposed of.


Article 83. (Headquarters for Lt. Stanley G. Benner Detachment Marine Corps League of Arlington.)


VOTED: That in accordance with Chapter 40 Section 9 under the Gen- eral Laws of Massachusetts, as amended by Chapter 409 of the Acts of 1946, the sum of one thousand two hundred (1,200) dollars be and hereby is appro- priated for the purpose of providing headquarters for the "Lt. Stanley G. Benner Detachment, Marine Corps League of Arlington"; and that said sum be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 83, the Moderator de- clared it disposed of.


Article 84. (Addition to the Stabilization Fund.)


VOTED: (Unanimously) That the sum of fifty thousand (50,000) dollars be and hereby is appropriated to be added to the Stabilization Fund estab- lished by vote of the Town Meeting under Article 73 of the Warrant for the Annual Town Meeting of 1958; said sum to be raised by general tax.


There being no further business under Article 84, the Moderator de- clared it disposed of.


Article 85. (Appropriation of Available Funds.)


VOTED: That the sum of three hundred twenty-five thousand (325,000) dollars voted for appropriations heretofore made under the Warrant for this meeting, and not to be borrowed or to be taken from available funds or from balances of special appropriations made in other years, shall be taken from

any available funds in the Treasury; and that the Assessors be instructed to use free cash in the Treasury in any available funds to that amount in the determination of the 1961 tax rate.

GREETING:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Arlington, to meet in the

MONDAY, THE 21ST DAY OF AUGUST, 1961


at 8 o'clock P.M., at which time and place the following articles are to be acted upon and determined exclusively by town meeting members, in ac- cordance with, and subject to, the referenda provided for by Chapter 43A of the General Laws.

TOWN RECORDS


Article 1. To hear and act upon the reports of the Finance and other committees heretofore appointed.


Article 2. To see if the Town will amend Schedule A of the Classifica- tion Plan, as established by Article 7C of the By-Laws, by adding the classification of Telephone Operator and Clerk and Typist, Grade CG 1.

Article 3. To see if the Town will vote to amend the By-Laws of the Town by adding thereto a new Article to be known as Article 9B establishing rules and regulations for the use of areas under control of the School De- partment; or take any action relating thereto; said new By-Law to read as follows:


ARTICLE 9B USE OF AREAS UNDER CONTROL OF THE SCHOOL DEPARTMENT


Section 1. No person shall injure, mutilate, or destroy any property or equipment, real or personal, belonging to the Town of Arlington under the jurisdiction of the School Department.


Section 2. No person shall park a vehicle on property under the jurisdiction of the School Department except while attending functions at or doing busi- ness in the adjoining school building; such parking shall be only at designated locations and not in conflict with faculty or school personnel parking and not in violation of Fire Department regulations governing parking adjacent to school buildings. There shall be no overnight parking of vehicles on any School Department property except for vehicles under the direct control of the School Department, or by special permit issued by the Superintendent of Schools.


Section 3. No person shall refuse or neglect to obey any rule, posted by sign, concerning the use of any area under the jurisdiction of the School Department; nor shall they refuse or neglect to obey any reasonable direc- tion of a police officer, custodian or School Department employee during the time they are on School Department property.


Section 4. No person shall cause or permit any animal owned by him or in his custody or under his controlto roam or be at large in or on any property under the care and control of the School Department, except a dog when re- strained by a leash not exceeding six feet in length.


Section 5. No person shall remain upon school grounds, including play- grounds, during the periods when school is in session except when under the direct supervision of school personnel.


Section 6. No person or persons shall congregate in doorways or recess areas of school buildings for purposes of loitering, card playing or any other activity not specifically authorized by the School or Park Department.


Section 7. Motor cycles and motor scooters are not permitted on school property including the roadway in the rear of the Arlington Senior High School building.


Section 8. Any person violating any of the foregoing sections shall, for each offense, be punished by a fine of not more than twenty (20) dollars.

Article 4. To see if the Town will make an appropriation for the pur- chase of addressing and billing machines and related equipment for the Board of Assessors; determine in what manner the money shall be raised and expended; or take any action relating thereto.

Article 5. To see if the Town will amend its Zoning By-Laws by alter- ing the Zoning Map therein referred to so as to include in the Residence B District the area now included in the Residence C District and bounded and described as follows:


WESTERLY by Spy Pond by five courses together measuring 808.86 feet;


NORTHERLY by land of the Town of Arlington, as shown on plan hereinafter mentioned 240 feet;


EASTERLY by land of the Boston and Maine Railroad, as shown on said plan, in seven courses together measuring 847.90 feet;


SOUTHEASTERLY by land of William H. and Marilyn H. Hamilton, as shown on said plan, 66 feet;


SOUTHWESTERLY and SOUTHEASTERLY by land of Frederico Boraschi and Bruno Pedrelli, as shown on said plan, in two courses measuring respectively 63.60 feet and 48.50 feet.


Said parcel being shown on a plan entitled "Plot Plan of Land in Ar- lington, Mass.", dated Sept. 21, 1960, by Albert A. Miller and Wilbur C. Nylander, Civil Engineers and Surveyors.

Article 6. To see if the Town will make an appropriation of a sum or sums of money to be expended under the direction of the Committee appoint- ed under Article 88 of the Warrant for the 1959 Annual Town Meeting, said appropriation to be for the purpose of completing and equipping the elemen- tary school building situated on Pheasant Avenue and Mountain Avenue and to be added to the appropriation under Article 82 of the Warrant for the 1960 Annual Town Meeting for the construction of said school; determine in what manner the money shall be raised; or take any action relating thereto.
