VOTED: (Unanimously) That the laying out of a town way from Old Colony Road to #20 and #21, substantially in the location of the private way known as Old Middlesex Path, as more particularly described in Article 32 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the purpose of said way.

Article 38. (Alteration of Mill Street.)


VOTED: (Unanimously) That the alteration of the way known as Mill Street, on the northeasterly corner of Massachusetts Avenue, substantially in the location as made and reported by the Board of Selectmen, in its capa- city as a Board of Survey, and as more particularly described in Article 38 of the Warrant be accepted and said way as altered be established and used under the provisions of law as a public way; and that the sum of seven thousand five hundred (7,500) dollars be and hereby is appropriated for the alteration of, construction of, and specific repairs upon said way; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 38, the Moderator de- clared it disposed of.


Article 39. (Alteration of Jason Street.)


By consent of the meeting, the motion of the Finance Committee as ap- pearing in its printed report was considered withdrawn, and on the new mo- tion of Mr. Kermit C. Streng, Chairman of the Finance Committee, duly seconded, it was


VOTED: (Unanimously) That the alteration of the way known as Jason Street, on the southwesterly corner of Massachusetts Avenue, substantially in the location as made and reported by the Board of Selectmen, in its capa- city as a Board of Survey, and as more particularly described in Article 39 of the Warrant be accepted and said way as altered be established and used under the provisions of law as a public way; and that the sum of two thousand (2,000) dollars be and hereby is appropriated for the alteration of, con-

VOTED: (Unanimously) That the laying out of a town way from Wash- ington Street to King Street, substantially in the location of the private way known as Candia Street, as more particularly described in Article 40 of the Warrant, under the provisions of law authorizing the assessment of better- ments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the purpose of said way.


There being no further business under Article 40, the Moderator de- clared it disposed of.


Article 41. (Appropriation for Construction of Ways.)


VOTED: (Unanimously) That the sum of two hundred five thousand four hundred (205,400) dollars be and hereby is appropriated for the original con- struction of public ways, the laying out of which is accepted at this meeting under Articles 30 to 37 inclusive and Article 40, including land damages and the cost of pavements and sidewalks laid at the time of such construction, all under the provisions of law authorizing the assessment of betterments; that for this purpose the sum of twenty-seven thousand two hundred eighteen and 19/100 (27,218.19) dollars be raised by general tax, and seventy-eight thou- sand one hundred eighty-one and 81/100 (78,181.81) dollars be taken from unexpended balances in the treasury as follows:

and for the balance one hundred thousand (100,000) dollars, the Treasurer, with the approval of the Board of Selectmen, be and hereby is authorized to borrow the said sum of one hundred thousand (100,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in addition thereto or amendment thereof, so that the whole loan shall be paid in not more than ten (10) years from the issue of the first bond or note or at such earlier date as the Treasurer and Select- men may determine; and further that the sum of two hundred five thousand four hundred (205,400) dollars be expended under the direction of the Town Manager substantially as follows:

Article 42. (Easements in Land.)


VOTED: (Unanimously) That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town, to purchase or take by eminent domain or otherwise acquire, easements in land adjoining the loca- tion of ways, the laying out of which is accepted at this meeting under Article 30 to 37 inclusive and Article 40, consisting of the right to have the land of said location protected by having the surface of such adjoining land slope from the boundaries of said locations; that for this purpose the sum of eight hundred (800) dollars be and hereby is appropriated; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 42, the Moderator de- clared it disposed of.


Article 43. (Laying Out of Windmill Lane.)


VOTED: (Unanimously) That the laying out of a town way from Morn- ingside Drive to Old Colony Road, substantially inthe location of the private way known as Windmill Lane, as more particularly described in Article 43 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the purpose of said way.

Article 44. (Laying Out of Clyde Terrace.)


VOTED: (Unanimously) That the laying out of a town way from Forest Street to Washington Street, substantially in the location of the private way known as Clyde Terrace, as more particularly described in Article 44 of the Warrant, under the provisions of law authorizing the assessment of better- ments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the purpose of said way.

VOTED: (Unanimously) That the sum of fifty thousand (50,000) dollars be and hereby is appropriated for the conversion of the Town's Radio Broadcasting and Receiving System in accordance with the directive con- tained in Docket #12295 of the Federal Communications Commission; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 55, the Moderator de- clared it disposed of.


Article 56. (Air Conditioning in Town Engineering Department.)


VOTED: (Unanimously) That no action be taken under Article 56 of the Warrant.

Article 57. (Urban Renewal.)


A substitute motion offered by Russell T. Eckel, town meeting member from Precinct 12, duly seconded, was amended by a substitute motion of- fered by John O. Parker, Chairman of the Board of Selectmen, which was seconded and declared to have carried on a standing vote, 125 having voted in the affirmative and 75 in the negative. Thereupon, on the motion of the Finance Committee, as substituted, it was


VOTED: That an appointing authority consisting of the Moderator, the Chairman of the Board of Selectmen and the Town Manager be and hereby is authorized and directed to appoint a committee of nine persons, comprised of one member of the Planning Board, one member of the Arlington Develop- ment Commission, one member of the Arlington Housing Authority, one member of the Finance Committee and five registered voters of the Town to investigate, consider and make recommendations relative to the question of whether or not there is a need for Urban Renewal in the Town; said com- mittee to report not later than the 1962 Annual Town Meeting; and that the sum of one hundred (100) dollars be and hereby is appropriated for the use of said committee, said sum to be raised by general tax.


There being no further business under Article 57, the Moderator de- clared it disposed of.


Article 58. (Sanitary Sewer -- Madison Avenue.)


VOTED: (Unanimously) That the sum of six thousand six hundred (6,600) dollars be and hereby is appropriated for the installation of a sanitary sewer to service a portion of Madison Avenue, including an outlet sewer through private lands to connect with an existing sanitary sewer; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 58, the Moderator de- clared it disposed of.

Article 59. (Abandonment of Easement.)


VOTED: (Unanimously) That the Town does hereby abandon a portion of an easement over Private Lands taken by the Board of Selectmen for storm drain purposes, dated April 11, 1960, and duly recorded with Middle- sex South District Registry of Deeds in Book 9575, Page 100; said portion of said easement to be abandoned being bounded and described as follows:


Beginning at a point on said southerly side line of Day Street, at the westerly boundary line of Lot 43, thence southwesterly through Lot 44 a dis- tance of 74 feet more or less to a point on the westerly boundary line of Lot 44, thence southeasterly on the division line between Lots 44 and 45 a dis- tance of 15 feet more or less to the division line between Lots 45 and 28, thence southwesterly through Lot 28 a distance of 80 feet more or less to a point on the northerly side line of Dow Avenue, said point being 16 feet southwesterly of the easterly boundary line of Lot 28, thence southwesterly on said northerly boundary line of Dow Avenue, a distance of 10 feet more or less to a point, thence northeasterly through Lot 28 a distance of 80 feet more or less to a point on the division line between Lots 28 and 45, thence northwesterly through Lot 45 a distance of 16 feet more or less to an angle point, thence northeasterly through Lot 45 and Lot 44 a distance of 73 feet more or less to a point on the southerly side line of Day Street, thence northeasterly on said southerly side line of Day Street, 10 feet more or less to the point of beginning.


There being no further business under Article 59, the Moderator de- clared it disposed of.


Article 60. (Storm Drain Day Street -- Dow Avenue.)


VOTED: (Unanimously) That the sum of two thousand eight hundred fifty (2,850) dollars be and hereby is appropriated for the construction of a storm drain culvert or main through private lands from Day Street to Dow Avenue, to replace and eliminate the natural waterway and open ditch now existing in this area; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 60, the Moderator de- clared it disposed of.

NORTHERLY by land of the Town of Arlington, as shown on plan hereinafter mentioned, 240 feet;


EASTERLY by land of the Boston and Maine Railroad, as shown or. said plan, in seven courses together measuring 847.90 feet;


SOUTHEASTERLY by land of William H.& Marilyn H. Hamilton, as shown on said plan, 66 feet;


SOUTHWESTERLY and
