ANNUAL ELECTION FEBRUARY 15, 1960


The annual election of Town Officers was held this day in the Eastham Town Hall, the meeting being called to order by the presiding election officer Fred G. Lapiana Jr., at 10:00 A.M.


The following persons having been appointed to act as election officers and tellers, were sworn to the faithful performance of their duties by the Town Clerk :


Johanna S. Brooks, Henry McCone, Aurore King. Maurice W. Wiley and Harvey T. Moore.


The ballot box was examined and found to register zero and the Polls were declared open at 10:00 A.M.


At 6:10 P.M., the Polls were declared closed. There were 31 absent votes cast making a total of 404 cast for the day. The ballot box registered 404 and the voting list showed a like number as having voted.

MINUTES ANNUAL TOWN MEETING


February 15, 1960


The annual town meeting was called to order at 7:00 P.M. by the Moderator, Fred G. Lapiana Jr. The call and service of the warrant were read, by the Town Clerk, the reading of the articles being omitted by consent of the meeting. James R. Davis and Walter E. Gavin were ap- pointed as tellers and duly sworn by the Town Clerk.


Article 1. Voted: to have a blackboard at the front of the hall showing the effect on the tax rate of the various articles in the warrant. Unanimous Voice Vote.


Article 2. Voted to accept Chapter 493 of the Acts of 1959 pertaining to County pensions and retirement allowances. Unanimous Voice Vote.


Article 8. Voted: that the town place the refunded dog tax at the disposal of the Public Library Trustees. Unanimous Voice Vote.


Article 4. Voted: to authorize the treasurer with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1960, and issue a note or notes there- fore payable in one year and to renew any note or notes as may be given for a period of less than one year in ac- cordance with Section 17, Chapter 44 General Laws. Unanimous Voice Vote.


Article 5. Voted: to authorize the treasurer, with the approval of the Selectmen to borrow money from time to time in anticipation of re-imbursement for the financial year beginning January 1, 1960, and to issue a note or notes therefore payable in one year, and to renew any note

or notes as may be given for a period of less than a year in accordance with Section 17, Chapter 44, General Laws. Unanimous Voice Vote.


Article 6. Voted to raise and appropriate the sum of $500.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass. for the care and treatment of persons certified by the Selectmen to be residents of the town and unable to pay for such care and treatment in accordance with Chapter III Section 74, General Laws. Unanimous Voice Vote.


Article 7. Voted: to authorize the Selectmen to sell property taken under Tax Title procedure by the Town, and raise and appropriate the sum of $500.00 for this pur- pose. Unanimous Voice Vote.


Article 8. Voted : to pay a bounty of fifty cents (.50) each for woodchucks killed within its boundaries during the ensuing year and raise and appropriate the sum of $30.00 for this purpose. Unanimous Voice Vote.


Article 9. Voted : to raise and appropriate the sum of $4,000.00 to meet the Town's share of Chapter 81 High- ways work and that in addition the sum of $11,000.00 be transferred from available funds in the treasury to meet the State's share of the work, the re-imbursement from the State to be restored upon receipt to unappropriated funds in the treasury. Unanimous Voice Vote.


Article 10. Voted: to raise and appropriate the sum of $900.00 for the purchase of a police cruiser, the present cruiser to be traded in as a credit towards the new one. Unanimous Voice Vote.


Article 11. Voted: to raise and appropriate the sum of $2,000.00 to be paid to the Town of Orleans for Ambu- lance hire and police dispatcher service for the year 1960. Unanimous Voice Vote.

Article 19. Voted : to raise and appropriate the sum of 490.00 to pay the operating charge of five (5) lunen mercury street lights on the state highway in front of the town hall. Unanimous Voice Vote.

Article 21. Voted: to transfer from available funds in the treasury the sum of 20,000.00 for the purpose of building a new 6 stall fire station the present building to be used for town storage a committee of five members to be appointed by the fire chief. 87 yes 22 no.


Article 22. Voted: to raise and appropriate the sum of 4,300.00 for the purpose of purchasing land at Rock Harbor Creek and Cape Cod Bay which adjoins town owned land. Unanimous Voice Vote.


Article 23. Voted: to raise and appropriate the sum of 500.00, said sum to be used to initiate a program of re- pairing and restoring the old graves in the town's ceme- teries under the Board of Selectmen. Unanimous Voice Vote.


Article 24. Voted: to amend the zoning by-law as adopted February 18, 1952 by adding the following phrase to paragraph 10, section III, after the words "12 square feet" and provided that said signs are not of the type or style employing or using flashing neon or fluorescent light- ing or any lighting similar thereto. Unanimous Voice Vote.


Article 25. Voted: to amend Article 25 by deleting the words "northerly side line of Meeting House Road" and substituting the words "Old Colony Railroad right of way" and after the words "Westerly side of the highway taking" the words "from the Northerly boundary of the Evergreen Cemetery so-called." Voted: to amend the zoning by-law of the Town of Eastham adopted February 18, 1952 and as amended February 24, 1958 by striking out under Section IX in the paragraph beginning "description of Permissive Use area" all words after "area" and substituting therefore "from the intersection of the Old Colony Railroad right of way and Route 6, to the Eastham-Wellfleet town line, along Route 6 to a depth of 500 feet on the Westerly side of the highway taking from the Northerly boundary of the Ever-

green cemetery so-called, and a depth of 500 feet on the Easterly side of the highway taking or to the westerly side of the Old Colony Railroad right of way whichever distance is greater." 98 Yes 4 No.


Article 26. Voted: to amend the zoning by law as adopted February 18, 1952 and amended February 16. 1959, by adding the following sentence to paragraph 7 Section IV "except that no cottage rental unit shall be erected upon any existing lot as shown on any subdivision or recorded plan that has been combined with any other such lot for the purpose of creating a lot for subdivision into cottage rental units under the provisions of this sec- tion." Unanimous Vote.


Article 27. Voted: to transfer from available funds in the treasury 4,000.00 for Chapter 90 Highways construc- tion on Hemenway road 1,000.00 being the Town's share, 2,000.00 the State's share and 1,000.00 the County's share. the reimbursement from the State and County to be re- stored upon receipt to unappropriated available funds in the treasury. Unanimous Voice Vote.


Article 28. Under this article, Mr. Edwin Johnson reported for the committee appointed to investigate the need for traffic signs in the town, stating that certain recommendations had been made by his committee and the Board of Selectmen, and the State has them uncon- sideration. The report was accepted and placed on file.

In the name of the Commonwealth of Massachusetts, you are hereby directed to warn and notify the inhabitants of said Town qualified to vote in elections and Town af- fairs to meet at the Town Hall on Thursday, the Twenty- Eighth (28) day of April at 8:00 o'clock in the evening, then and there to act on the following articles in this War- rant.


Article 1. To see if the Town will accept the amend- ments of the agreement establishing a regional school dis- triet for the towns of Eastham, Orleans and Wellfleet, Massachusetts, initiated by the regional district school com mittee on April 1, 1960, and providing for the admission of the Town of Brewster.


Article 2. To see if the Town will vote to accept by gift or purchase the land of Nauset Enterprises, Inc., a Massachusetts corporation duly enacted by law and having a principal place of business at No. 28 Barnstable Road. Barnstable, (Hyannis), Massachusetts, shown as lots 85. 86, 87. 88, 89, 90, 91, 92, 97, 98, 99, 100, 101, such portion of lots 82, 83, 84 and 102 as lies Easterly of the Easterly side line of Ocean View Drive, 115 and 116, Section 4, on the plan of Eastham Land Co., see Assessors' Map, page 4A, subject to the restriction that said lots shall forever re- main within the public domain and shall not be sold to private individuals, or take any action relative thereto.

To see if the Town will vote to authorize the Selectmen to execute a deed conveying all in- terests and titles of the Town of Eastham in Lots No. 1 to 6 inclusive. 9 to 81 inclusive, such portion of Lots Nos. 82, 83, 84 and 102 as lies Westerly of the Westerly side line of Ocean View Drive, 103 to 113 inclusive, and such por- tion of Lots No. 114 and 115 as lies Westerly of the Wes- terly side line of Ocean View Drive, together with the fee in the streets and ways lying within the perimeter of the filed Petitioner's Plan in Land Court Case No. 26336, B. Article 7. To see if the Town will vote to amend the Zoning By-Law as adopted February 18, 1952, and as amended February 16, 1959, by adding the following sen- tence to paragraph 7, Section IV "Except that, no cottage rental unit shall be erected upon any existing lot as shown on any subdivision or recorded plan, that has been com- bined with any other such lot for the purpose of creating one lot for subdivision into cottage rental units under the provisions of this section."


Article 8. To see if the Town will vote to amend the Zoning By-Law of the Town of Eastham adopted February 18, 1952, and as amended February 23, 1958, by adding to section V, paragraph 5 as follows :

Pursuant to the conditions of the foregoing warrant, the Special Town meeting was called to order at 8 P.M. by the Moderator, Fred G. LaPiana Jr. There being a quorum present, the call of the meeting was read by the Town Clerk. David L. Mead and Maurice A. Moore were appointed as tellers and duly sworn by the Town Clerk. Loring Young, Petitioner, i. e., Freeman Street, Monroe Street, Madison Street, Jackson Street, Columbus Avenue, Maple Street, Beech Street, Warren Avenue and Norfolk Avenue, Section 4, on the Plan of Eastham Land Co., see Assessors' Map, page 4A; and all the right, title and interest in and to a certain parcel of land lying Northerly and Westerly of the land shown on said filed Petitioner's Plan, and in said Section 4, East- ham Land Company Plan, bounded Easterly by Ocean View Drive; Northerly by Atlantic Avenue, Westerly by Farleigh Street and Southerly by the Northerly boundary line of said filed Petitioner's Plan, and containing Lots Nos. 6 to 9 inclusive, 23, 24, 39, 40, 53, 54, 67. 109 to 113 inclusive, and such portion of Lot No. 114 as lies Westerly of the Westerly side line of Ocean View Drive; and an unplotted portion Easterly of Farleigh Street, together with the fee in Freeman Street, Monroe Street, Madison Street, Jackson Street, Columbus Avenue and Warren Avenue adjacent and contiguous to the said delineated Lots and all in said Section 4. Unanimous Vote.


Article 4. Vote to appropriate from available funds in the Treasury a sum of 2000.00 to be spent in conjunction with State funds for work now being done at Rock Harbor Creek. Unanimous Vote.


Article 5. Vote to amend the Zoning By-Law as adopted February 18, 1952, by adding the following phrase to paragraph 10, section III, after the words "12 square feet"-"and provided that said sign or signs are not of

the type or style employing or using flashing neon or fluorescent lighting or any lighting similar thereto." Unanimous Vote.


"5. The display of not more than one sign which shall pertain to the use of such property as herein above authorized which shall be a free standing sign and may have a base not exceeding 3 feet in height above road grade and shall not exceed 10 feet in any direction and shall read from both sides for a total sign area of 40 sq. feet, or if reading from only one side shall not exceed 20 square feet exclusive of supports therefore, backing and supports of masonry or other materials shall present an area to the reading side of not more than 80% of the reading sign area provided further that such sign employs only in- direct lighting from the ground with a set back of 15 feet from the nearest street or highway sideline shall be au- thorized. Signs on a commercial building may read only from one side and shall have no more than 40 square feet total area. A sign displayed under this paragraph shall then be allowed only upon a permit issued by the Build- ing Inspector." Yes 34 No 5.
