ANNUAL TOWN MEETING WARRANT
THE COMMONWEALTH OF MASSACHUSETTS
Barnstable, ss.
To Harvey T. Moore, Constable of the Town of Eastham, in the County of Barnstable :
In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabi- tants of said Town qualified to vote in elections and Town affairs to meet at the Town Hall on Monday, the Nineteenth (19) day of February next at 7:00 o'clock in the evening, then and there to act on the following articles in this Warrant and to meet in the Town Hall at 10:00 o'clock in the morning on Tuesday, the Twentieth (20) day of February next, then and there to elect, all necessary officers.
POLLS TO OPEN AT 10:00 A.M. AND MAY CLOSE AT 6:00 P.M.
Article 1. To see in what manner the Town will vote to dispose of it's refunded dog tax.
Recommended that the Town place the refunded dog tax at the disposal of the Public Library.
Article 2. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1962, and issue a note or notes therefore, payable in one year and renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.
Recommended.
Article 3. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of reim-

bursement for the financial year beginning January 1, 1962, and to issue a note or notes therefore, payable in one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.
Recommended.
Article 4. To see if the Town will vote to raise and appropriate a sum of money not to exceed $1,000.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treatment, in accordance with Chapter III, Section 74, General Laws, or take any action relative thereto.
Recommended $500.00.
Article 5. To see if the Town will vote to authorize the Selectmen to sell property taken under Tax Title procedure by the Town, and raise and appropriate the sum of $500.00 for this purpose, or take any action rela- tive thereto.
Recommended.
Article 6. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 81 Highways, or take any action relative thereto.
Recommended $4,000.00.
Article 7. To see if the Town will vote to raise and appropriate the sum of $950.00 for the purchase of a Police Cruiser, and the present Cruiser to be traded in as a credit towards the new.
Recommended.
Article 8. To see if the Town will vote to raise and appropriate the sum of $2,000.00 to be paid to the Town of Orleans for Ambulance, Fire and Police Dispatcher Service for the year 1962.

Article 10. To see if the Town will vote to raise and appropriate a sum of money for the purpose of holding Band Concerts in the ensuing year, or take any action relative thereto.

Article 11. To see if the Town will vote to raise and appropriate, or transfer from available funds in the Treasury, the sum of $346.40 for Greenhead Fly Control, as authorized by Section 24, Chapter 252, General Laws, and authorize the Town Treasurer to pay said appropri- ation into the State Treasury.

appropriate, or transfer from unappropriated available funds in the Treasury, a sum of money for the purpose of purchasing and equipping a Rescue Truck, or take any action relative thereto. By Request.

Article 16. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section II of Chapter 91 of the General Laws, and author- ize the Selectmen to execute and deliver a bond of in- demnity therefor to the Commonwealth.

Article 17. To see if the Town will vote to accept the provisions of Sections 7-A through 7-D of Chapter 58 of the General Laws, as amended, or take any action relative thereto.

Article 18. To see if the Town will vote to raise and apppropriate, or transfer from unappropriated available funds in the Treasury, a sum of money for the purpose of painting white traffic lines on the town roads and for the purchase and erection of signs, under direction of the Police Department, or take any action relative thereto. Article 20. To see if the Town will vote to amend the Zoning By-Law by extending Commercial District C, as shown on the official Zoning Map dated February 14, 1952, as amended February 17, 1958, as follows :
Beginning at Route 6 at the Southerly side of Com- mercial District C; Thence Westerly 500 feet by Com- mercial District C; Thence Southerly by a line parallel to and distant 500 feet from the Westerly side line of Route 6 to the drainage diteli which separates the property of Obed Fulcher, Clayton Horton and Mary Chase; Thence Easterly by said drainage ditch to Route 6 and Thence Northerly by Route 6 to the point of beginning. Begin- ning again at Route 6 at the Southerly side of Com- mercial District C; Thence Easterly 500 feet by Com- mercial District C; Thence Southerly to a line parallel to and distant 500 feet from the Easterly side line of Route 6 to the Southerly side of Old County Road; Thence Southerly by the Westerly side line of Old County Road to the aforesaid drainage ditch; Thence Westerly by said drainage ditch to Route 6; and Thence Northerly to the point of beginning. Article 21. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $10,000.00 to be used for the purpose of dredging Rock Harbor, in conjunction with funds from Orleans and the State. or take any action relative thereto.

Article 22. To see if the Town will vote to amend the Zoning By-Law by extending Commercial District D as shown on the Official Zoning Map dated February 14. 1952, as amended February 17, 1958, as follows :- By in-

cluding in Commercial District D located on the West side of Route 6 an extension of the Westerly bound of said Commercial District D at a width of 200 feet running parallel to and along the North side of Oak Road to Massasoit Road. By Request.

Article 23. To see if the Town will vote to amend the Zoning By-Law by extending Commercial District C as shown on the official Zoning Map dated February 14, 1952, as amended February 17, 1958, as follows :- By in- cluding in Commercial District C that portion of the property of Walter and Margaret G. Gavin, Sr., bounded Easterly by County Road, Route 6, a distance of Seventy- Nine (79) feet, more or less; Northerly by property of Wes- ley Moore, a distance of One Hundred Eighty (180) feet, more or less; Westerly by property of Stillman D. Covell, a distance of Eighty-Five (85) feet, more or less; and Southerly by other land of said Walter and Margaret G. Gavin, Sr., now designated as Commercial District C.

Article 24. To see if the Town will vote to adopt the following By-Law :
Before the Board of Selectmen shall act upon any petition for the laying out, relocation or alteration of a publie way over privately owned property, the petitioners shall have prepared by a competent engineer, designer or surveyor, specifications and a clear and legibly drawn plan in black India ink upon tracing cloth in suitable overall dimensions showing the details of the road peti- tioned for, location and name of owners, abuttors, existing, street lines, length and width of the proposed way, drain- age disposal, width of turning areas, surface materials and estimated costs, and such other details, services and specifications as the Selectmen may require. The minimum width of said road layout shall be 33 feet of which the

minimum clearance and hardened surface shall be 22 feet. The Board of Selectmen will take into consideration the requirements of the community and if in their opinion, common convenience and necessity require the same, they shall take the usual steps as provided in Eminent Domain takings. All costs of the foregoing shall be borne by the petitioners, and if the vote of the Town is in the affirma- tive, approving the doings of the Selectmen thereunto, it shall be a condition of said vote that such owners or peti- tioners shall post a suitable bond with the Board of Select- men, assuring the completion of said way as prescribed in the plans and specifications, and the Board of Select- men together with the Surveyor of Highways shall deter- mine that all conditions of this By-Law have been com- plied with, before said bond shall be deemed to have been satisfied.

Article 25. To see if the Town will vote to authorize the Eastham School Committee to dispose of certain out- dated textbooks and take any other action relative thereto.

Article 26. To see if the Town will vote to authorize the Board of Selectmen to establish an area for swim- ming, marked by buoys, and area for moored or anchored boats and a landing for water skiers on Great Pond and to further establish the following Rules and Regulations governing Motor Boating on Great Pond in the Town of Eastham :
a. Whoever operates upon the waters within the boundaries of the Town of Eastham a boat propelled by an internal combustion engine, recklessly or negligently, so that the lives or safety of the public might be en- dangered, shall be punished by a fine of not, more than twenty dollars ($20.00).
b. No motor boat shall be used to tow persons on water skis or aquaplanes unless said boat shall be oc-

cupied by two persons, one of whom shall give his full attention to the operation of the boat, and the other of whom shall give his full attention to the person or persons being towed.
c. All boats shall keep a distance of one hundred and fifty feet from the swimming area marked by buoys and from moored or anchored boats except when leaving or returning to their mooring, or the landing.
d. No water skiing shall be allowed on Salt Pond or any fresh water pond other than Great Pond.
e. Hours for water skiing shall be from 7 A.M. to one-half hour after sunset.
f. The above rules and regulations are to be en- forced by any police officer authorized to make arrests in the Town of Eastham, and the violations of the above rules and regulations shall, for each offense, be punished by a fine of not more than twenty dollars ($20.00).
