MINUTES ANNUAL TOWN MEETING
February 20, 1961
Pursuant to the provisions of the foregoing warrant, the voters assembled in the Eastham auditorium, and, there being a quorum present, the meeting was called to order at 7:00 P.M. by the Moderator, Fred G. Lapiana Jr. Charles F. Atwood, Jr. and Earle K. Horton were appointed to act as tellers, and were duly sworn by the Town Clerk.
The call and service of the meeting were read by the Town Clerk and, no objections being raised, the reading of the Articles in the warrant was omitted.
Article 1. Indefinitely postponed.
Article 2. Voted to accept Chapter 647 of the Acts of 1960, pertaining to County pensions and retirement allowances. Unanimous Voice Vote.
Article 3. Voted that the Town place the refunded dog tax at the disposal of the Public Library. Unanimous Voice Vote.
Article 4. Voted to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1961, and issue a note or notes therefore, payable in one year and renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws. Unanimous Voice Vote.
Article 5. Voted to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time

to time in anticipation of reimbursement for the financial year beginning January 1, 1961, and to issue a note or notes therefore, payable in one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.
Unanimous Voice Vote.
Article 6. Voted to raise and appropriate a sum of $500.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treatment, in accordance with Chapter 111, Section 74, General Laws. Unanimous Voice Vote.
Article 7. Voted to authorize the Selectmen to sell property taken under Tax Title procedure by the Town, and raise and appropriate the sum of $500.00 for this purpose. Unanimous Voice Vote.
Article 8. Voted to pay a bounty of fifty cents (50c) each for woodchucks killed within its' boundaries during the ensuing year and raise and appropriate the sum of $30.00 for this purpose. Unanimous Voice Vote.
Article 9. Voted : to raise and appropriate the sum of $4,000.00 to meet the Town's share of Chapter 81 High- ways work, and that in addition, the sum of $11,000.00 be transferred from Available Funds in the Treasury to meet the State's share of the work, the reimbursement from the State to be restored upon receipt to unappropriated funds in the Treasury. Unanimous Voice Vote.
Article 10. Voted to raise and appropriate the sun of $900.00 for the purchase of a Police Cruiser, and the present Cruiser to be traded in as a credit towards the new one. Unanimous Voice Vote.

Article 11. Voted to raise and appropriate the sum of $2,000.00 to be paid to the Town of Orleans for Ambulance, Fire and Police Dispatcher Service for the year 1961. Unanimous Voice Vote.
Article 12. Voted: to accept the Annual Report, with the recommendations and reports of the Selectmen in- cluded, with the exception of the Snow Account and Police Account, in the amount of $283,654.34, and to raise and appropriate the sum of $278,654.34, and transfer the sum of $5,000.00 from Overlay Surplus to the Reserve Account. Voted that the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, mainten- ance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Select- men to execute and deliver a bond of indemnity therefor to the Commonwealth. Unanimous Voice Vote.
Article 18. Voted to raise and appropriate the sum of $2,400.00; $1,900 to be used in conjunction with $1,900.00 from school funds for a salary of $3,800.00 for a Nurse, and the other $500.00 to be used for expenses, said nurse to be working both as a School and Town Nurse.

Article 19. Voted to raise and appropriate the sum of $490.00 to pay the operating charge of five (5) lumen Mercury street lights, on the State Highway in front of the Town Hall, Unanimous Voice Vote.
Article 20. Voted to accept the following by-law ; "No member of the Planning Board and/or the Board of Ap- peals, employed by or representing an applicant before said boards shall have a vote on any decision directly con- cerning his client". 34 Yes 24 No
Article 21. Voted to appropriate from available funds in the Treasury the sum of $13,500.00 for the purpose of constructing and originally equipping and furnishing an

addition to the present Publc Library, and that a build- ing committee of five (5) be appointed by the Moderator, consisting of the 1961 Board of Library Trustees, one builder and one member of the Finance Committee, with full power to enter into all contracts and agreements necessary to con- struct, equip and furnish said building.

Article 22. Voted to transfer from unappropriated available funds in the Treasury, a sum of $2,000.00 for the purpose of purchasing land at Boat Meadow Creek and Cape Cod Bay which adjoins Town owned land, for public use, and authorize the Selectmen to take any action rela- tive thereto. Article 23. Voted to amend paragraph One of Article Eleven of the Building Code by deleting the word "public" so that paragraph One shall read: The building lines of structures for human habitation shall not be nearer to the nearest boundary of any way than 30 feet, nor nearer to the interior side and rear lot lines than 25 feet; and if on land of single ownership, they shall not be nearer to each other than 50 feet. The building lines of structures which are necessary to wood framed structures for human habita- tion shall not be nearer to side and rear lot lines than 12 feet, nor nearer to the nearest boundary of any way than 30 feet. 83 Yes 1 No

(d) Signs shall mean all advertising devices or insignia whether lettered or not, designed to promote a business, the sale of a product or of a service.
(e) The area of a sign shall be determined by the multi- plication of the width and height including borders or moulding without deductions for open spaces or other irregularities.

A free-standing sign may have a base not exceed- ing three (3) feet in height above road grade and shall not have a dimension exceeding ten (10) feet in any direc- tion and shall road from both sides for a total sign area of forty (40) square feet or if reading from one (1) side only shall not exceed twenty (20) square feet exclusive of

supports therefor. A setback of fifteen (15) feet from the nearest street or highway sideline shall be required. Signs on a commercial building may read from one (1) side only and shall have no more than forty (40) square feet total area. Illuminated signs shall not have any glare distracting to drivers nor shall there be any exposed neon or gas filled type signs or illumination in colors that will conflict with the ability to readily see traffic lights or cause any hazard- ous condition therefrom and there shall be no flashing, rotating or oscillating supplementary lighting. Gasoline sta- tions and garages will be allowed the standard permanent oil company signs in addition to the name sign plus the customary lubrication, washing and service signs displayed in the positions to which they apply. And further, where the need for and use of a sign with a larger reading area would not substantially derogate from the amenities of the Town, permission may be granted for the erection and maintenance thereof upon authorization of the Board of Appeals only, and provided further that such sign would not be injurious, noxious or offensive to the neighborhood. 74 Yes; 3 No. (Unanimous Voice Vote.)
Article 27. Voted to amend the Zoning By-Law by de- leting paragraph 5, Section V, and substitute therefor the following so that paragraph 5 shall read :
The display of not more than two (2) signs, as herein above authorized, on a property and which shall pertain to the use of such property only. Where two (2) signs as here- in authorized are displayed, one (1) shall be permanently affixed to the building to which the use of the property pertains.
