Tewksbury March 5, 1960
At the Annual Town Meeting this day of the qualified voters of the Town of Tewksbury, called to order by the Moderator, Alan M. Qua, it was declared adjourned for lack of quorum until March 19, 1960. The adjourned meeting was properly posted throughout its continuance according to law.
Art. 1 - Adopted March 12, 1960 - Annual Town Election.
ART. 2-To hear and act upon the reports of the various town officers.
Voted: Waived 'to hear' and adopted as submitted.
ART. 3-To fix the salaries of the several elective officers of the Town and determine whether such salaries shall be retroactive to January Ist. (Refer to Salary Schedule).
Voted: To adopt as per schedule and that all salaries be retro- active to January 1, 1960.

ART. 5- To determine what sum the town will authorize and direct the Assessors to take from available funds to reduce the tax levy for the current year, or take any action relative thereto.
VOTED: In Artcle 5 to direct the Assessors to take from E & D the sum of $30,000.
ART. 6 - To see what sum of money the town will vote to raise and appropriate and/or transfer from Overlay Reserve for a reserve fund, pursuant to the provisions of Chapter 40, Section 6.
VOTED: To raise and appropriate, per Art. 6 the sum of $20,000 for a reserve fund, pursuant to provisions of Chap. 40, Section 6.
ART. 7- To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1960, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in ac- cordance with Section 17, Chapter 44, of the General Laws.
VOTED: To authorize the Town Treasurer, with the approval of the Board of Selectmen, to borrow against anticipated 1960 revenues on short term notes, and to renew as stated above.
ART. 8- To see if the town will authorize the Selectmen to insti- tute suits on behalf of the town or defend any suits that are, or may be brought against the town, and to sign any contracts or agreements in behalf of the town.
VOTED: To Adopt Art. 8.
ART. 9-To see if the Town will vote to authorize the Board of Selectmen and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioner of Corporations and Taxation, any tax title held by the Town for more than two years, and see what sum of money the Town will vote to raise and appropriate therefor.
VOTED: To adopt Art. 9 with no funds to be appropriated at this time.
ART. 10- To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town at least fourteen days before the sale, property taken by the Town under tax title procedure, provided that the Selectmen or whomsoever they may authorize to hold such

public auction may reject any bid which they deem inadequate, or take any action relative thereto.
VOTED: To adopt Art. 10 with amendment that such notice shall also be posted in a local paper at least three consecutive times.
ART. 11 - To see if the Town will vote the money arising from licensing dogs for the ensuing year to aid in support of the Public Library.
VOTED: To adopt Art. 11.
ART. 12- To see if the Town will vote to raise and appropriate the sum of $300.00 in support of the trustees for county aid to agriculture to be expended by 4-H club agent, home demonstra- tion agent and club leader in conjunction with the extension service and the town director. Board of Selectmen.
VOTED: To raise and appropriate the sum of $300.00 in adoption of Art. 12.
ART. 13- To see if the Town will vote to accept Chapter 493 of the Acts of 1959 which provides for an increase of $100.00 an- nually in the amount of pensions payable to former employees who at the time of retirement had reached the age of sixty and had at least twenty years of creditable service or who, at the time of retirement, had at least twenty-five years of creditable service, regardless of age. VOTED: By secret ballot 267 to 40, to accept Chapter 493, Acts of 1959, for the purpose of Art. 13.
ART. 14- To see if the Town will vote to raise and appropriate the sum of $500.00 for the purpose of purchasing traffic signs. Board of Selectmen

ART. 15 - To see if the Town will vote to raise and appropriate the sum of $1,000.00 for the purpose of repairing or replacing the town hall sewage system. Board of Selectmen.
VOTED: To raise and appropriate the sum of $1,000.00 for the purpose of Art. 15.
ART. 16- To see if the Town will vote to establish a permanent Memorial Day Committee to administer and expend the annual Memorial Day appropriation, said committee to consist of the Commanders of the American Legion, Veterans of Foreign Wars, Amvets and Disabled American Veterans. ART. 17- To see if the Town will vote to raise and appropriate the sum of $1,300.00 to indemnify Robert Haines from the property damage and personal injuries claims arising from an accident on April 3, 1958, while operating a police cruiser; in favor of Joseph Killeen, or take any action in relation thereto. VOTED: To raise and appropriate $1,300.00 for the purpose of Art. 17.
ART. 18- To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $1,090.32 to indemnify Robert Haines and Richard Mackey for hospital and medical expenses incurred as a result of injuries sustained while opera- ting the police cruiser on April 3, 1958, or take any action in relation thereto. Board of Selectmen.
VOTED: To raise and appropriate the sum of $1,090.32 for the purpose of Art. 18.
ART. 19 - To see if the Town will vote to convey to Merrimack- Essex Electric Company, a Massachusetts corporation, for the sum of Eleven Hundred Eighty-five Dollars $1,185.00), all its rights, title and interest in and to a line of eight (8) poles, together with all wires, cables, equipment and appurtenances connected therewith, located on Easement Road, Tewksbury, Middlesex County, Massachusetts, and authorize the Selectmen to execute and deliver, in the name and on behalf of the Town, a good and sufficient Bill of Sale of the same; or act in relation thereto. Board of Selectmen.
VOTED: To adopt Art. 19 as stated.
ART. 20- To see if the Town will accept Section 103A of Chapter 54 of the General Laws which provides for absentee voting at town elections. Board of Selectmen.
VOTED: By secret ballot 237 to 30 to accept Article 20.
ART. 21 - To see if the Town will vote under the provisions of Chapter 41, Section 1 of the General Laws to authorize the town treasurer to act as town collector or take any other relative action. Board of Selectmen.

ART. 22- To see if the Town will vote to accept Section 103 of Chapter 41 of the General Laws which provides for the estab- lishing of a purchasing department under the direction of a purchasing agent who shall purchase all supplies for the Town and for every department thereof. Board of Selectmen.

ART. 23 - To see if the Town will vote to raise and appropriate a sum of money for the purpose of carrying out the preceding article.

ART. 24 - To see if the Town will vote, under the provisions of Section 52 of Chapter 41 of the General Laws, to appoint a town accountant who shall perform the duties and possess the powers of the town auditor, and will vote further to abolish the office of town auditor upon the appointment of a town accountant. ART. 25 - To see if the Town will vote to accept Section 8C of Chapter 40 of the General Laws which provides for the estab- lishing of a conservation commission for the promotion and development of the natural resources of the Town, and further, to see what sum of money the Town will vote to raise and appropriate for this purpose. VOTED: To adopt Article 25, as amended, by deleting the provisions for funds. Secret ballot vote 240 in favor, 60 opposed.

ART. 38 - To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524 Acts of 1950, for all damages that may be incurred by work to be performed by the Depart- ment of Public Works of Massachusetts for the improvement, development, maintenance, and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth. Water Commissioners.
This article was adopted at the Annual Town Meeting called March 7, 1959 under Article 44.
ART. 39- To see if the Town will vote to expend the sum of $2,450.00 from the Installation Account, for the purpose of installing approximately 700 feet of water pipe in South Oliver Street, provided that cost of said water installation has been first deposited with the Town Treasurer and applied to esti- mated receipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in rela- tion thereto. Water Commissioners.
VOTED: To expend $2,450.00 from the Installation Account for the purpose of Article 39.
ART. 40- To see if the Town will vote to expend the sum of $3,335.00 from the Installation Account, for the purpose of installing approximately 667 feet of water pipe in Mill Road, provided that cost of said water installation has been first de- posited with the Town Treasurer and applied to estimated receipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in relation thereto. Water Commissioners.
VOTED: To indefinitely postpone Article 40.
ART. 41 - To see if the Town will vote to expend the sum of $500.00 from the Installation Account, for the purpose of in- stalling approximately 100 feet of water pipe in Lowe Street, provided that cost of said water installation has been first de-

posited with the Town Treasurer and applied to estimated re- ceipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in relation thereto. Water Commissioners.
VOTED: to expend the sum of $500.00 from the Installation Account for the purpose of Article 41.
ART. 42- To see if the Town will vote to expend the sum of $7,000.00 from the Installation Account, for the purpose of in- stalling approximately 1750 feet of water pipe in Mount Joy Drive, provided that cost of said water installation has been first deposited with the Town Treasurer and applied to estimated receipts and to authorize the Water Commissioners to do such work and expend such money, or take any action in relation thereto.
