In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, to meet and assemble at Tewksbury Memorial High School in said Tewksbury on Saturday, March 3, 1962 at 10:00 o'clock A.M. to act on the following articles, except Article 1, and you are also hereby further required and directed to notify and warn the said inhabitants of the Town of Tewksbury, who are qualified to vote on elections and town affairs therein, to assemble subsequently and meet in town meeting at the

At 10:00 A. M. the Annual Town Meeting was called to order by Moderator Alan M. Qua. Although called to order at 10:19 and 10:38, a quorum was lacking and stood adjourned until 10:52 A.M. when the Annual Meeting convened with 341 present. (Quorum 333). Reverend Robert W. Hannum of the South Tewksbury Methodist Church pronounced invocation, and a minute of silence was ob- served in memory of George J. McCoy, Mark W. Roper, Rex O. Read, and John J. Gray, former Town officials now deceased. Tellers were sworn by the Moderator for the duration of the meeting. 553 voters attended.


VOTED: To suspend reading of the Articles by the Moderator.


VOTED: To act on Articles in sequence as printed in Warrant.


ART. 1 - To choose all necessary Town Officers, to choose by ballot, two Selectmen for three years, two members Board of Public Welfare for three years, one member Board of Health for three years, one Assessor for three years, one Moderator for one year, one Park Commissioner for three years, one Planning Board member for five years, one Planning Board member for two years, one Road Commissioner for three years, two members School Committee for three years, one Trust Fund Commis- sioner for three years, two Trustees for Public Library for three years, one Water Commissioner for three years. therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws.


VOTED: To authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipa- tion of the revenue of the financial year beginning January 1, 1962, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws. Voice majority, no dissents.


ART. 8- To see if the town will authorize the Selectmen to insti- tute suits on behalf of the town or defend any suits that are, or may be brought against the town, and to sign any contracts or agreements in behalf of the town.


VOTED: To authorize the Selectmen to act for the purposes of Article 8.


ART. 9-To see if the Town will vote to authorize the Board of Selectmen and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioner of Corporations and Taxation, any tax title held by the Town for more than two years, and vote to raise and appropriate the sum of $1132.00 therefor.


VOTED: To raise and appropriate $1,132.00 for the purposes of Article 9.


ART. 10- To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town at least fourteen days before the sale, property taken by the Town under tax title procedure, provided that the Selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto.

§42G. Special Assessments to Meet Cost of Laying Water Pipes in Certain Ways.


Any city, town or district having a water supply or water distributing system which, in the case of a city or town, accepts this section and the two following sections in cities other than Plan E cities by vote of the city council subject to the city charter, or Plan E cities by vote of the city council, in towns or districts by vote of its inhabitants at an annual town or district meeting called therefor, may provide by ordinance, by-law or vote for the levy of special assessments to meet the whole or part of the cost thereafter incurred of laying pipes in public and private ways for the conveyance or distribution of water to its inhabitants .: Such city, town or district may provide that an owner of land which receives benefit from the laying of water pipes in public and private ways upon which his land abuts or which by more remote means receives benefit through the supply of water to his land or buildings shall pay a propor- tionate part of the cost not already assessed of extending such water supply to his land.


The amount to be charged against each parcel of land re- ceiving such benefit shall include the cost of the pipes and other material and of the labor in laying them and other expenses incidental thereto and shall be ascertained, assessed and certified by the water commissioners or the other officers in charge of the supply and distribution of water in such city, town or district. ART. 18- To see if the Town will vote to raise and appropriate the sum of $3500.00 for the purpose of operating the school dental clinic for this year. Board of Health


VOTED: On motion by Mr. Corliss it was voted to raise and appropriate the sum of $2,500.00 for the purposes of Article 18.


ART. 19- To see if the Town will vote to raise and appropriate the sum of $15,000.00 for the purpose of establishing a sanitary land fill operation at the Town dump as recommended by the Statte Department of Public Health. Board of Health

ART. 20- To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $5,800.00 for the pur- pose of taking in the name of the Town of Tewksbury all parcels of land on which taxes remain unpaid through 1955.

Carter and Peter Zontanos, which parcels of land were voted to be accepted by the Town of Tewks- bury from said owners under Article 22 of the Annual Town Meeting called for March 4, 1961 and Articles 55 and 56 of the Annual Town Meeting called for March 5, 1960, and for the purpose of clearing the outstanding tax accounts which accrued after the votes of acceptance, or take any other relative action.
