S. Surveyor for the State of California. He received a majority of votes, but never qualified. On the 28th of April Governor Weller appointed A. R. Meloney. George W. Whitman refused to surrender the office, on the ground that he held over until his successor was elected and qualified, and that Mandeville was elected; hence, the Governor had no power to appoint. Meloney appealed to the Courts and final decision in his favor was rendered July Term of the Supreme Court. Meloney was elected at the general election for 1858.


(o) Milton S. Latham resigned on the 14th of January, 1860, to be elected to United States Senate.


. (p) John G. Downey became Governor for balance of the term.


(g) Quinn elected President of the Senate, made vacant by the accession of Lieuten- ant Governor John G. Downey to the Executive Chair.


(r) Meloney refused to surrender the office on the ground that he was elected in 1858, and of right could hold two years. Brooks became relator vs. Moloney, and the Supreme Court decided in favor of Brooks, January Term, 1860.


(s) The Legislature of :861 made the office of State Librarian separate from Secre- tary of State, and gave the appointing power to a Board of Trustees, March 8th, 1861. The Board to consist of five members-the Governor, Chief Justice of the Supreme Court to be ex-officio members; J. R. McConnell, J. W. Winans and Solomon Heydenfeldt appointed members of the Board. That Boasn appointed W. C. Stratton Librarian for four years. The Legislature of 1863-'4 virtually legislated John R. McConnell and Hey- denfeldt out of the Board by appointing Dr. H. W. Harkness and Dr. J. F. Morse in their places. Before Stratton's term had expired, J. F. Morse resigned his position on the Board of Trustees, and the Governor appointed B. B. Redding to fill the vacancy. About the time for the Board to hold an election for Librarian, Stratton raised the question as

to the eligibility of the Chief Justice as a member of the Board of Trustees, and caused proceedings instituted to test the matter. The Court sustained his position; (30 Cal., p. 160). In the mean time the other members of the Board failed to agree upon the ap- pointment of Librarian, and the Governor appointed Jerome Madden; Stratton re- fused to surrender the office, and proceedings were commenced against him in the nature of quo warranto, Madden relator. The Court decided in favor of Stratton (28 Cal., p. 383), and he continued to hold the position. The Legislature of 1865-'6 amended the former statute and appointed the Attorney General ex-officio member of the Board of Trustees, and also J. W. Winans, H. W. Harkness, C. G. W. French and W. C. Belcher. On the 27th March, 1866, the Board re-elected W. C. Stratton for the term of four years. The Legislature of 1865-'6 created the office of Deputy Librarian, and Albert Hart was by the Board of Trustees appointed to the position.


(t) W. H. Weeks died in Summer of 1863, and A. A. H. Tuttle appointed to the va- cancy.


(u) Appointed Adjutant General by Governor Low, Ist of May, 1864; resigned 30th of November, 1865. Robert Robinson appointed Ist of December, 1865. Robinson held the position till Evans served his term out as Senator, and he resigned. The Governor appointed Evans again, and he has been acting ever since. Whether Gov. Haight will reappoint him remains for the future to determine.


(Note 2.) Edward R. Campbell appointed and commissioned State Registrar the 10th of May, 1858. The law relative to the office was amended 1859, and finally repealed 1860. He resigned, however, before the repeal of the law.
