ARCHIVES OF CONNECTICUT.


Archives of Connecticut.


BESIDES the Records of the State, and the various manuscript volumes in the office of Secretary of State, there is a great quantity of papers which have been accumulating since the settlement of the Colony of Connecticut, some of which were filed, and others in disorder. About fifty thousand of these have been ar- ranged and pasted into books, where they are easily accessible. This was done under the direction of the Connecticut Historical Society, by Sylvester Judd of Northampton, who indexed a few volumes ; for the ex- penses of which, the General Assembly made an ap- propriation to the Society. To complete the work of indexing, the Assembly authorised the Secretary of State to employ a clerk. Two or three volumes were indexed under direction of Mr. Secr'y Tyler, by a clerk who was incompetent to the task. In the fall of 1846, Mr. Secretary Bradley, who well understood the char- acter of the work to be done, employed and gave suita- ble directions to Wm. S. Porter of Farmington, to con- tinue the indexing, who has been continued by the present Secretary, Mr. Robertson.


The papers were arranged under heads as follows. Militia, 5 volumes.


War, 10 volumes, including Indian, French, Span- ish wars, &c.


Revolutionary War, 37 volumes, of great interest and importance.


Indians, 2 volumes.


Private Controversies, 6 volumes; useful in tracing family histories.


Ecclesiastical, 15 volumes, giving a history of socie- ties and eccleciastical affairs, as yet but little explored.


Towns & Lands, 10 volumes; of great value in compiling the histories of the several towns, their set- tlement, organization, &c., &c.


Susquehanna and Western Lands, 1 volume, showing our claims in Pennsylvania, and the Western Reserve, &c.


Colonial Boundaries, 3 volumes, in which are copies of many valuable early historical documents.

Foreign Correspondence, 2 volumes, of great inter- est. The first contains original letters from Kings, Queens, Dukes, Lords, &c, and the second, letters on foreign affairs, &c., many of which relate to the Charter and rights and privileges of the colony.

These 138 volumes, embracing about 50,000 papers, are by no means the whole. They include very few papers of a more recent date than 1790; and from that date back to 1706, are many papers still in files, most of which should be arranged in volumes and indexed.


The indexes are full and complete. Every paper is carefully read, and an analysis given under appropri- ate heads in the general index, and alphabetical lists are given of the names of all important persons and places. And on a page preceding the index of each volume, is given a synopsis of the index; so that, at a

single glance, the contents or subjects of the volume may be seen.


Thus facilities are rendered to any who wish to in- vestigate any subject pertaining to the history of this commonwealth ; or town or family histories ; for here are many papers relating to the history of every town and almost every ancient family in the state. Indeed, there is scarcely a family among us, descended from an early settler, who will not find something in these vol- umes relating to his ancestors. And every town ought to employ an agent to investigate their town history, as here set forth. And if our statesmen would more es- chew party politics, and study these volumes, they would be wiser, and better qualified to discharge their several duties.


Superior Court,


AND ADMINISTRATION OF JUSTICE IN CONNECTICUT.


At the first organization of the government in 1639, the Gen- eral Court exercised judicial functions. The history and time of the organization of Courts is given in the following extracts from the records :-


Oct. 1665. To prevent further trouble and charge to the court; It is ordered that 2 Courts of Assistants, consisting of 7 Assist- ants, at least, be held at Hartford yearly, the one on Tuesday be- fore the General Assembly in May, the other on Tuesday before the General Assembly in October; unto which Courts there shall be liberty of appeal from the respective County Courts: which said Courts of Assistants are impowered to hear and determine such appeals as shall be orderly presented as before : and likewise, all capital crimes respecting life, limb, or banishment, shall be tried at those said Courts of Assistants : and it is also ordered that in all appeals to the Court of Assistants, these shall be by a jury, if the nature of the case require. [The Oct. Court -was afterwards held in New Haven.]


The Governor presided at the Court.


Oct. 1681. The Court of Assistants was vested with Admi- ralty powers.


May, 1703. Ordered and enacted that the Courts of Assist- ants * * shall consist of 7 Assistants, or 5 at least to make a quorum. * And the Assistants to attend the said Courts to be, from time to time, appointed by the General Assembly.

Under this arrangement, the Assistants in New Haven and Fairfield Counties, &c. held the Court in New Haven ; and those in Hartford and New London Counties, the Court in Hartford.


Oct. 1704. Ordered and enacted, that the Governor or Deputy Governor, with 6 of the Assistants, shall hold the Courts of Assist- ants, &c.


May, 1711. Act for establishing SUPERIOR COURTS, &c.


Whereas, it has been found, in many respects, very inexpedi- ent and chargeable, to have but 2 places, as well as but 2 terms, annually, for holding the Superior Courts of Common pleas, com- monly Called the Court of Assistants : for the prevention of which, be it


Enacted, &c. that there shall be a Superior Court of Judicature, over this colony, to be held and kept annually at the respective times and places in this act hereafter mentioned, by one Chief Judge, and 4 other Judges, any 3 of whom to be a quorum, who shall have cognizance of all pleas real, personal, or mixed, as well all pleas of the Crown, and all matters relating to the conservation of the peace, and punishment of offenders ; as civil causes or ac- tions between party and party, and between her majesty and any of her subjects ; whether the same do concern the realty, and re- late to any right of freehold and inheritance, or whether the same do concern the personalty, and relate to matters of debt, contract, damage, or personal injury ; and also all mixed actions which concern both realty and personalty ; brought before them by ap- peal or review, writ of error, or otherwise, as the law directs, &c.


The act fixes the times and places of holding the Courts in the counties of Hartford, New Haven, New London and Fairfield. The judges were compensated by the day.


May, 1714. Judges were not allowed to sit in judgment in Counties where they were Judges of County or Probate Courts ; and subsequently in cases of appeals from their own decisions in said Courts.
