Town Warrant


THE COMMONWEALTH OF MASSACHUSETTS


ESSEX, SS: To either of the Constables of the Town of Andover, GREETING:


In the name of the Commonwealth you are hereby required to notify and warn the inhabitants of said town who are qualified to vote in Town Affairs to meet and assemble at the Town House in said Andover, on MONDAY, THE TWENTY-FIFTH DAY OF FEB- RUARY, 1935 at 7.30 o'clock P.M., to act on the following articles :


ARTICLE 1 .- To see if the town will vote to raise and appropri- ate a sum of money for the purpose of constructing and originally equipping a Junior High School building and heating plant, a common assembly hall and a gymnasium, said sum to be in addi- tion to the amount authorized by vote of the town under date of December 11, 1933, as amended by vote of the town under date of May 31, 1934; and to authorize the treasurer, with the ap- proval of the selectmen, to borrow the amount voted and to issue bonds or notes of the town therefor under authority of and in accordance with Chapter 366 of the Acts of 1933 as amended, Chapter 44 of the General Laws, and the National Industrial Recovery Act, or take any other action relative thereto.


ARTICLE 2 .- To see if the town will request the Department of Public Works of the Commonwealth of Massachusetts to submit to the Secretary of Agriculture a project for the improvement of Lowell Street from Main Street to the Tewksbury line for con- struction with funds apportioned to the Commonwealth under Section 204 of the National Industrial Recovery Act and will agree with said Department that if such project is approved and constructed by the Department and the Secretary of Agriculture, the Town thereafter, at its own cost and expense, will maintain the project in a manner satisfactory to said Department and Secretary of Agriculture, or their authorized representatives, and will make ample provision each year for such maintenance, and will authorize the Board of Selectmen to sign such a request and

agreement in behalf of the Town, or take any other action relating thereto.


ARTICLE 3 .- To transact any other business that may legally come before the meeting.


And you are directed to serve this warrant by posting attested copies and publication thereof, seven days at least before the time of said meeting as directed by the By-Laws of the town.


Hereof fail not and make return of this warrant with your doings thereon, at the time and place of said meeting.

Pursuant to the foregoing warrant, I, the subscriber, one of the Constables of the Town of Andover, have notified the inhabitants of said town, to meet at the time and place and for the purposes stated in said warrant, by posting a true and attested copy of the same, on the Town House, on each Schoolhouse and in no less than five other public places where bills and notices are usually posted and by publication in the Andover Townsman. Said warrants have been posted and published seven days.

SPECIAL TOWN MEETING, FEBRUARY 25, 1935


At a legal meeting of the inhabitants of the Town of Andover, qualified to vote in Town Affairs, convened in the Town House in said Andover, on Monday the twenty-fifth day of February, 1935 at 7.30 o'clock in the evening agreeably to the requirements of the foregoing warrant. Admittance was checked by use of list of voters.


Moderator Frederick Butler presided and after brief remarks in appreciation to Mr. Hamblin, Mr. Gahan and the boys of manual

training class at High School for speaker's stand and gavel fur- nished by them, took up the following:


Article 1 moved by Frank H. Hardy, seconded by Harold C. Dunn.


Voted at 8.16 P.M .: to raise and appropriate the sum of $98,- 000.00 for the purpose of constructing and originally equipping a Junior High School building and heating plant, a common assembly hall and a gymnasium, said sum to be in addition to the sum appropriated at the meeting held on December 11, 1933, as amended by the vote passed at a meeting held on May 31, 1934 and to be expended by the building committee referred to in the said original vote, and that the treasurer, with the approval of the Selectmen, be authorized to borrow said sum and to issue bonds or notes of the town therefor under authority of and in accordance with the provisions of Chapter 366 of the Acts of 1933 as amended, Chapter 44 of the General Laws, and the National Industrial Recovery Act, so the whole loan shall be paid in not more than twenty years or at such earlier dates as may be approved by the Emergency Finance Board. Any sum received from the Federal Government by way of a grant in addition to sums covered by now existing contracts with the Federal Government shall be applied to the cost of construction in which event the amount of the loan herein authorized shall be reduced by the sum so received and applied or may be applied to the payment of the debt therein authorized.


The three members of Board of Selectmen were appointed as tellers to count the vote, which they reported as follows: Yes, 485; no, 5; total, 490.


Took up Article 2.


Voted at 8.19 P.M .: that the Town will request the Department of Public Works of the Commonwealth of Massachusetts to sub- mit to the Secretary of Agriculture a project for the improvement of Lowell Street from Main Street to the Tewksbury line for construction with funds apportioned to the Commonwealth under Section 204 of the National Industrial Recovery Act and will agree with said Department that if such project is approved and constructed by the Department and the Secretary of Agriculture the Town thereafter, at its own cost and expense, will maintain the project in a manner satisfactory to said Department and

In the name of the Commonwealth you are hereby required to notify and warn the inhabitants of said town who are qualified to vote in Elections and Town Affairs to meet and assemble at the designated polling places in Precincts One, Two, Three and Four, viz: The Town House in Precinct One; the Old School House, Ballard Vale, in Precinct Two; the Administration Building, Shawsheen Village, in Precinct Three; and the Phillips Club House, School Street, in Precinct Four, in said Andover, on MONDAY, THE FOURTH DAY OF MARCH, 1935 at 6:00 o'clock A.M., to act on the following articles :


ARTICLE 1 .- To elect a Moderator for one year, Town Clerk for one year, Treasurer for one year, Collector of Taxes for one year, one member of the Board of Selectmen for three years, one member of the Board of Assessors for three years, three members of the School Committee for three years, one member of the Board of Public Works for three years, one member of the Board of Health for three years, three Constables for one year, one Trustee of Memorial Hall Library for seven years, one Tree Warden for one year, one member of the Planning Board for five years, one member of the Planning Board for four years, to fill a vacancy, one member of the Planning Board for three years, to fill a vacancy; one member of the Planning Board for one year, to fill a vacancy; and all town officers required by law to be elected by ballot.


All the above candidates to be voted on one ballot. The polls will be open from 6 o'clock a.m. to 6.30 o'clock p.m.


After final action on the preceding Article One, the said meet- ing shall stand adjourned by virtue of Section 20, Chapter 39, of General Laws, to Monday, March 11, at 1.30 o'clock p.m. at the Town Hall, then and there to act upon the following articles. namely :

ARTICLE 2 .- To elect all other officers not required by law to be elected by ballot.


ARTICLE 3 .- To establish the salary of elected Town Officers for the ensuing year.


ARTICLE 4 .- To determine what sums of money shall be appro- priated for the following purposes.


Appropriation for the Assessors, Board of Selectmen, and all Depart- ments under their control.


American Legion, Veterans of Foreign Wars, Armistice Day, Memorial Day, Mothers' Aid, Soldiers' Relief, State Aid, Old Age Assistance, Public Welfare, Damages to Persons and Pro- perty, Elections and Registrations, Insurance, Essex County Tuberculosis Hospital, Pomps Pond, Public Dump, Printing Town Report, Town Officers, Town Scales, Inspector of Wires, Sealer of Weights and Measures, Assessors Survey, Municipal Buildings, Infirmary, Moth Suppression, Tree Warden, Police Department, Fire Department, Brush Fires, Interest, and Re- tirement of Bonds.


Appropriation for the Board of Health: Care of Tubercular patients. Appropriation for Trustees of Memorial Hall Library.


Appropriation for Trustees of Spring Grove Cemetery.


Appropriation for Street Lighting Committee.


Appropriation for School Committee.


Appropriation for all departments under the control of the Board of Public Works.


Highway Maintenance, Highway Construction, Water Main- tenance, Water Construction, Sewer Maintenance, Park and Playgrounds, Snow Removal.


Appropriations for any other Town Charges and Expenses.


ARTICLE 5 .- To see if the Town will vote to authorize the town treasurer, with the approval of the selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1935, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in ac- cordance with Section 17, Chapter 44, General Laws.


ARTICLE 6 .- To determine what disposition shall be made of unexpended appropriations and free cash in treasury.

ARTICLE 7 .- To see if the Town will vote to appropriate a sum of money to be expended in conjunction with Emergency Relief Administration labor for the purchase of materials and for truck hire on approved projects.


ARTICLE 8 .- To see if the Town will adopt the Zoning Plan presented by the Town Planning Board and enact the Zoning By- Law recommended by the Board; as postponed at Special Town Meeting, October 1st, 1934.


ARTICLE 9 .- To receive and act upon the report of the Police Investigation Committee.


ARTICLE 10 .- To see if the Town will vote to appropriate a sum of money not in excess of $850.00 and authorize the Select- men to purchase an automobile and an auto radio for the use of the Police Department as recommended by the Police Investiga- tion Committee.


ARTICLE 11 .- To see if the Town will vote to appropriate a sum of money not in excess of $500.00 and authorize the Select- men to purchase and install a pretimed set of traffic signals at or near the junction of North Main, Lowell, Poor and Haverhill Streets in Shawsheen Village Square so called, with the provision that the State Department of Public Works will furnish a like amount, as recommended by the Police Investigation Committee.


ARTICLE 12 .- To see if the Town will vote to purchase and in- stall six Button traffic signs to be placed on streets entering Ando- ver Square and appropriate the sum of $300.00 to cover the cost of same as recommended by the Police Investigation Committee.


ARTICLE 13 .- To see if the Town will vote to appropriate the sum of $750.00 to be used for supervised play at the playstead to be expended under the direction of a committee of three to be ap- pointed by the Moderator, on petition of Samuel P. Hulme and others.


ARTICLE 14 .- To see if the Town will authorize the Board of Public Works to extend the water main from the corner of Lowell Street and Greenwood Road, along Greenwood Road to the pro- perty of J. H. Bourdelais, and appropriate the sum of $25,000.00 to care for this work, on petition of Anna Peterson and others.

ARTICLE 15 .- To see if the Town will authorize the Board of Public Works to extend the water main from the present dead end at the Disbrow farm on Chandler Rd. along Chandler Rd. to the residence of Charles Garabedian and appropriate the sum of $6700.00 to care for this work, on petition of Charles Garabedian and others.


ARTICLE 16 .- To see if the Town will authorize the Board of Public Works to extend the water main from the corner of Greenwood Rd. and Chandler Rd. along Chandler Rd. to the residence of Charles Garabedian and also extend the existing water main at the corner of Chandler Rd. and Greenwood Rd. a distance of 840 feet along Greenwood Rd. and appropriate the sum of $19,500.00 to care for this work, on petition of Ovagen Arakelian and others.


ARTICLE 17 .- To see if the Town will authorize the Board of Public Works to extend the water main from the present dead end on Salem St. near Wildwood Road along Salem St. to Jenkins Road thence along Jenkins Road northerly to the North Andover line and appropriate the sum of $15,010.00 therefor, on petition of John J. Sweeney and others.


ARTICLE 18 .- To see if the Town will vote to place the police and fire departments under Civil Service Rules by accepting sec- tions 48 and 49 of Chapter 31 of the General Laws without the pension provision, on petition of William F. Barron and others.


ARTICLE 19 .- To see if the Town will vote to appoint a com- mittee to investigate the procedure and cost of installing a munici- pal light, heat, and power plant and report to the next annual Town Meeting, and that the sum of $25.00 be appropriated for said purpose, on petition of William F. Barron and others.


ARTICLE 20 .- To see if the Town will vote that all expenditures for materials amounting to $50.00 or over shall be made on a competitive bid, on petition of Roger H. Lewis and others.


ARTICLE 21 .- To see if the Town will vote that the purchase of all truck hire and materials used on the water system, highways, parks and playgrounds and sewer department be made by the Board of Public Works, on petition of Charles B. Roberts and others.

ARTICLE 22 .- To see if the Town will authorize the Board of Public Works to construct a hard surface road and care for grass plots on Dufton Rd. and appropriate the sum of $2700.00, on pe- tition of George Dufton and others.


ARTICLE 23 .- To see if the Town will vote to accept Tantallon Road from Haverhill Street running north to a line three hundred and seventy-five (375) feet north of the northerly line of said Haverhill Street, on petition of A. Norman Warhurst and others.


ARTICLE 24 .- To see if the Town will vote to acquire by emin- ent domain a certain piece of land on the northeasterly corner of Haverhill Street and Hillside Avenue for the purpose of widening said approach of entrance from Haverhill Street to Hillside Ave- nue and appropriate the sum of $200.00 for this purpose, on peti- tion of Edward Fleming and others.


ARTICLE 25 .- To see if the Town will authorize the Board of Public Works to widen Hillside Avenue at the lower end and apply a hard surface road the entire length and appropriate the sum of $400.00 therefor, on petition of Edward H. Fleming and others.


ARTICLE 26 .- To see if the Town will instruct the Street Light- ing Committee to arrange for two lights on Corbett Street, one at curve in road near Topping's ledge and one, half way between Juliette Street and Lawrence line and appropriate $45.00 to cover cost of same, on petition of George R. Cairns and others.
