ARTICLE 6 .- To see if the Town will authorize the Board of Public Works to erect a wire fence on the westerly side of the Andover Playstead from the property line of Samuel Gilliard to the property line of Mary W. and Alice L. Bell and appropriate

ARTICLE 7 .- To see if the Town will vote to appropriate the sum of $750.00 to be used for supervised play at the playstead to be expended under the direction of a committee of three appointed by the Moderator.


ARTICLE 8 .- To see if the town will vote to appropriate $1,000 .- 00 for supervised play and playground equipment in Ballardvale and Shawsheen Village, this amount to be expended under the direction of the playground committee to be appointed by the Moderator, on petition of Stafford A. Lindsay and others.


ARTICLE 9 .- To see if the town will vote a sum of money to purchase and improve land for use as a school yard at the West Center School the purchase to be made by the Board of Selectmen on petition of Saul Shtrumpfman and others.


ARTICLE 10 .- To see if the town will vote to accept as public ways as laid out by the Board of Survey and name them as follows:


Coolidge Road :--


Southerly line :- Beginning at a stone bound on the easterly line of Johnson Road; said bound being located 736.91' northerly from a bound marking the intersection of said line with the northerly line of Elm Street; thence S 57°-25'-55" W, 290.9' to a stone bound on the westerly line of Cedar Road at its intersection with the line herein described.


Northerly line :- Beginning at a point on the easterly line of Johnson Road extended; said point being located 786.91' north- erly from a point marking the intersection of said line with the northerly line of Elm Street; thence S 57º-20'-55" W, 281.35' to a point on the westerly line of Cedar Road extended, at its inter- section with the line herein described.


Said street being 50' in width throughout its entire length.


Cedar Road :-


Easterly line :- Beginning at a point on the northerly line of Walnut Avenue, a County Road; said point being 358.20' west- erly from a stone bound marking the intersection of said northerly

Westerly line :- Beginning at a point on the northerly line of Walnut Avenue, a County Road; said point being 59.64' easterly from a stone bound marking said northerly line at a point of curvature; thence by a curve to the left of 23.54' radius, 32.91' to a stone bound; thence by a curve to the left of 89.49' radius, 51.94' to a stone bound; thence N 21°-50'-05" W, 385.45' to a point; thence by a curve to the left of 15.8' radius, 21.83' to a point on the southerly line of Coolidge Road extended.


Said street being 50' in width throughout its entire length excepting at its extremities where it joins Walnut Avenue and Coolidge Road.

Westerly line :- Beginning at a stone bound on the northerly line of Elm Street, said bound being 85.68' northeasterly from a stone bound marking the junction of the northerly line of Walnut Avenue with the northerly line of said Elm Street; thence by a curve to the left having a radius of 26.0', a distance of 33.85' to a stone bound; thence N 32°-39'-05" W, 710.19' to a stone bound; thence by a curve to the left having a radius of 20.0', a distance of 31.42' to a stone bound on the southerly line of Coolidge Road.


Easterly line :- Beginning at a stone bound on the northerly line of Elm Street, said bound being 177.17' northeasterly from a stone bound marking the junction of the northerly line of Walnut Avenue with the northerly line of said Elm Street; thence by a curve to the left having a radius of 16.0', a distance of 28.62' to a stone bound; thence N 32°-39'-05" W, 716.97' to a stone bound marking the junction of the southerly line of Coolidge Road with said easterly line of Johnson Road.


Said street being 50' in width throughout its entire length excepting at its extremities where it joins said Elm Street and said Coolidge Road.


Reference is hereby made to a plan entitled, "Acceptance Plan of a portion of Johnson Acres, Andover, Mass." made

December 1935 by Morse & Dickinson and Goodwin, Engineers, Haverhill, Massachusetts-from which a more particular descrip- tion of said street may be obtained.


ARTICLE 11 .- To see if the town will vote to purchase of Fred E. Cheever, the water mains, with appurtenances thereto belong- ing, now laid in Coolidge Road, Cedar Road and Johnson Road, provided the town votes to accept said roads as Public Ways, and to appropriate the sum of three thousand four hundred and six dollars for said purpose, on petition of Fred E. Cheever.


ARTICLE 12 .- To see if the town will vote to appropriate the sum of five thousand dollars to be expended under the direction of the Board of Assessors for legal services, for services for experts, and for other expenses in defence of the petitions for abatement of taxes filed with the Board of Tax Appeals by the American Woolen Company and the Textile Realty Company vs. Board of Assessors of the Town of Andover.


ARTICLE 13 .- To see if the town will vote to authorize the Board of Selectmen to issue a permit to the Society of the Friars Minor of the order of St. Francis of Boston, to use a portion of their land in Andover for burial purposes, as approved by the Board of Health, as shown on plan filed with said Board.


ARTICLE 14 .- To see if the town will vote to appropriate a sum of $3300.00 and authorize the Board of Selectmen to expend same in the purchase of an Ambulance to be used by the Fire Department.


ARTICLE 15 .- To see if the town will vote to appropriate $175 .- 00 to be expended by the Fire Department in the purchase of a fire alarm box to be located at Shawsheen School house.


ARTICLE 16 .- To see if the town will vote to appropriate the sum of $1,785.00 to be spent by the Moth Department for the following equipment: Truck $400.00, Orchard Sprayer $285.00, Shade Tree Sprayer $1100.00.


ARTICLE 17 .- To see if the town will adopt the Zoning Plan presented by the Town Planning Board and enact the Zoning By-Law recommended by the Board.

ARTICLE 18 .- To see if the town will vote to rescind the vote establishing interim zoning, empowering the Selectmen to enforce certain restrictions therein, as set forth in Article 25 in the Town Warrant for annual Town Meeting, March 14, 1927, on petition of William F. Barron and others.


ARTICLE 19 .- To see if the town will vote to authorize the building of a sewer beginning at the corner of Pine and Summer Streets and extending along Pine Street a distance of 225 feet, and appropriate the sum of $650.00 therefor, and assess better- ments upon the estates benefitted by the above extension, said work to be done under the direction of Board of Public Works, on petition of Daniel J. Haggerty and others.


ARTICLE 20 .- To see if the town will vote to extend the six (6) inch sewer westward on William Street for a distance of six hundred (600) feet, and appropriate the sum of Twelve Hundred ($1200.00) Dollars therefor, and assess betterments upon the estates benefitted by the above extension, said work to be done under the direction of the Board of Public Works, on petition of James H. Eaton and others.


ARTICLE 21 .- To see if the town will authorize the Board of Public Works to purchase a truck and appropriate the sum of $1200.00 therefor, on petition of said Board, and the price allowed for the old truck to be used as part payment for the new truck.


ARTICLE 22 .- To see if the town will vote to raise and ap- propriate a sum of money for the improvement of River Road; said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose; or take any other action in relation thereto.


ARTICLE 23 .- To see if the town will vote to authorize and instruct the Board of Selectmen to sell the Richardson School with land and buildings for such sum or sums as the Board of Selectmen may deem best and to authorize the Board of Select- men to give a good and sufficient quit claim deed in the name of the town for the aforesaid lands and buildings.


ARTICLE 24 .- To see if the town will vote to authorize and instruct the Board of Selectmen to sell the Bailey District School

with land and buildings for such sum or sums as the Board of Selectmen may deem best and to authorize the Board of Select- men to give a good and sufficient quit claim deed in the name of the town for the aforesaid lands and buildings.


ARTICLE 25 .- To see if the town will vote to authorize and instruct the Board of Selectmen to sell the Osgood District School with land and buildings for such sum or sums as the Board of Selectmen may deem best and to authorize the Board of Selectmen to give a good and sufficient quit claim deed in the name of the town for the aforesaid lands and buildings.


ARTICLE 26 .- To see if the town will authorize the Board of Public Works to shape up and tar Chandler Road, and appropri- ate the sum of $5,070.00 therefor on petition of Rudolph Johnson and others.


ARTICLE 27 .- To see if the town will authorize the Board of Public Works to shape up and tar North Street and appropriate the sum of $2,670.00 therefor on petition of Rudolph Johnson and others.


ARTICLE 28 .- To see if the town will authorize the Board of Public Works to shape up and tar Haggetts Pond Road and ap- propriate the sum of $3,935.00 therefor, on petition of Rudolph G. Johnson and others.


ARTICLE 29 .- To see if the town will authorize the Board of Public Works to extend the water main on Chandler Road from a point in front of the residence of Charles Garabedian, along Chandler Road a distance of 4100 feet, and appropriate the sum of $11,275.00 on petition of Hovagen Arakelian and others.


ARTICLE 30 .- To see if the town will authorize the Board of Public Works to extend the water main from the corner of Lowell Street and Greenwood Road, along Greenwood Road to the corner of High Plain Road and appropriate the sum of $13,375.00 to care for this work on petition of Anna C. Peterson and others.


ARTICLE 31 .- To see if the town will authorize the Board of Public Works to extend the water main from the corner of High Plain Road and Greenwood Road along Greenwood Road to the property of Mr. J. H. Bourdelais and appropriate the sum of

$11,450.00 to care for this work on petition of Anna C. Peterson and others.


ARTICLE 32 .- To see if the town will authorize the Board of Public Works to extend the water main from the corner of River Road and Brundrett Avenue along Brundrett Avenue a distance of 1600 feet to the property of Jacob Shlakis and appropriate the sum of $4,000.00 on petition of Arthur Maddox and others.


ARTICLE 33 .- To see if the town will authorize the Board of Public Works to extend the water main from the corner of River Road along Boutwell Road to the corner of Haggetts Pond Road thence along Haggetts Pond Road to a point opposite the prop- erty of Frederick J. Kearn and appropriate the sum of $10,350.00 on petition of Frederick J. Kearn and others.


ARTICLE 34 .- To see if the town will authorize the Board of Public Works to extend the water main from the property of Frederick J. Kearn on Haggetts Pond Road along Haggetts Pond Road to the property of Frederick C. Hardy and appropri- ate the sum of $15,360.00 on petition of Frederick C. Hardy and others.


ARTICLE 35 .- To see if the town will authorize the Board of Public Works to extend the water main along Sunset Rock Road southerly from Ballardvale Road a distance of 600 feet and ap- propriate the sum of $1,500.00 therefor, on petition of Ruth M. Jenkins and others.


ARTICLE 36 .- To see if the town will vote to appropriate a sum of money for the purpose of putting in a floor and completing electrical work in the gymnasium room in the Shawsheen School, upon petition of Frederick C. Smith and others.


ARTICLE 37 .- To see if the town will vote to appropriate $990 .- 50 to be expended by the Trustees of Spring Grove Cemetery for the purchase of materials and equipment to be used in con- junction with W.P.A. labor on accepted projects.


ARTICLE 38 .- To see if the town will accept legacies from the estate of the late Emma J. Lincoln, (one) of $300 for the use of Memorial Hall Library and (two) of $300, the net income thereof

to be expended in furtherance of the purposes of the Andover Village Improvement Society.


ARTICLE 39 .- To see if the town will vote to accept devises from the will of Martina A. Gage late of Lowell, reading as fol- lows: "I give, devise and bequeath all my real estate situated outside of Lowell to the city or town in which the same may be situated."


ARTICLE 40 .- To see if the town will vote to appoint a com- mittee of five citizens to investigate the procedure and cost of installing a municipal light, heat and power plant, and report to the next Town Meeting. The committee to be appointed from the floor, on petition of William F. Barron and others.


ARTICLE 41 .- To see if the Town of Andover will vote to ap- propriate the sum of $175.00 to build a granolithic sidewalk in front of the Town Hall to replace the present gravel sidewalk, under supervision of Board of Public Works, on petition of J. Augustus Remington and others.


ARTICLE 42 .- To see if the town will vote to accept as a public way, a way laid out 40' wide, northerly from Dufton Road, at corner of Enmore Street, for a distance of 400 feet, on petition of George C. H. Dufton and others.


ARTICLE 43 .- To see if the town will vote to appropriate the sum of $1000.00 to cover the following matters: for the payment of taxes outstanding against the property situate at 88 North Main Street, which has been taken over by the town for taxes; for damages resulting from the closing of an apartment on the same premises; for damages resulting from housing of the unem- ployed of the town; and for damages for land unjustly acquired by the town, on petition of Bridget T. Hurley and others.


ARTICLE 44 .- To determine what disposition shall be made of unexpended appropriations and free cash in the treasury.


ARTICLE 45 .- To act upon the report of the Town Officers.


ARTICLE 46 .- To transact any other business that may legally come before the meeting.

Pursuant to the foregoing warrant, I, the subscriber, one of the Constables of the Town of Andover, have notified the inhabitants of said town, to meet at the time and place and for the purposes stated in said warrant, by posting a true and attested copy of the same on the Town House, on each Schoolhouse and in no less than five other public places where bills and notices are usually posted and by publication in the Andover Townsman. Said warrants have been posted and published seven days.

At a legal meeting of the inhabitants of the Town of Andover, qualified to vote in Town Affairs convened in Precincts One, Two, Three, Four, Five and Six in said Andover on Monday the second day of March, 1936 at six o'clock in the forenoon agreeably to the requirements of the foregoing warrant-took up Article One and proceeded to vote for town affairs. The ballot boxes were found to be empty and registered 0000. The polls were opened at six o'clock a.m. and closed at six thirty o'clock p.m.


The total number of ballots cast was 4516.

After unanimous consent of the meeting the following resolu- tion was read by J. Augustus Remington and voted :


"Whereas: We, the citizens of Andover, desirous of expressing in some public form our sense of loss suffered by the death of Andrew McTernen do hereby


"Resolve: That we deeply appreciate the long and varied services of Mr. McTernen : as a member of our Fire Department, a mem- ber of the Board of Public Works, our representative to the General Court and recently our Selectman. In all these endeavors he has shown a chivalrous sense of honor, a fidelity to duty and a high sense of moral rectitude. To an extraordinary degree he has

enjoyed the confidence and affection of his fellow citizens. His conduct both in public and in private life furnishes an example well fitted to inspire our townspeople to a nobility of purpose and to a lofty patriotism. The memory of him must always be associ- ated with those qualities that mark an upright and useful life and we further
