The balance, although about $12000. less than at the beginning of the year, is satisfactory, considering the fact that $30000. was voted the assessors, from free cash, to reduce the 1937 tax rate.
The figures above include $125000., borrowed in anticipation of taxes, and repaid in November, which was $25000. less than in 1936.
Disbursements again were 3% larger than the previous year and were in accordance with 96 selectmen's warrants. The num- ber of checks issued was practically the same as in 1936-just under 1000 a month.
Summarized statements of the 730 cemetery perpetual care accounts and 12 other trust funds in the custody of the treasurer, amounting to $87727.09, or 4% more than last year, will be found elsewhere in the Town Report. A new fund, which increases each week, is due to the adoption by the town of the contributory re- tirement system for town employees and officials. The condition of this fund may be summarized as follows:

Report of Planning Board
Various matters relating to town planning and within the jurisdiction of the Board have been under consideration during the past year. The most important matters were proposed amend- ments to the Zoning By-Laws. In accordance with the statutory provisions relating to such amendments public hearings have been held after due notice was given and final reports containing the Board's recommendations have been filed separately and apart from this report for consideration at the town meeting.

Final report of Planning Board upon proposed amendment to the Zoning By-Law as requested by Frederick E. Cheever and others.
A public hearing, after due notice given, was held upon the proposed amendment at the Town House Friday, December 17, 1937, at 7:30 P.M. and after said hearing at a meeting of this board at which a quorum was present and voting, it was
Voted: That the board does not recommend the adoption of the article filed by Frederick E. Cheever and others which would amend Section IX, Paragraph 1 of Article VIII, being the Zoning By-Law, by striking out the words "10,000 square feet" and in- serting in place thereof, the words "8500 square feet."
The Board further reports that it considered all factors per- taining to such proposed change and it feels that such an amend- ment would permit lots to contain areas insufficient for proper building in single residence and educational districts. We there- fore report to the town meeting that we do not recommend the adoption of said article.

Final report of Planning Board upon proposed amendments to the Zoning By-Law as presented by the Board of Appeals.
A public hearing, after due notice given, was held upon the four proposed amendments at the Town House Friday, February 4, 1938 at 7:30 P.M., and after said hearing at a meeting of this board at which a quorum was present and voting, it was
Voted: That the board recommend the adoption of the four articles filed by the Board of Appeals which would amend the Zon- ing By-Law so that the Board of Appeals may permit land in certain cases to be subdivided with lot areas not less than 9500 square feet; so that Section IX would be amended by adding at the end of paragraph 4 the following new sentence, "on corner lots no part of any building shall extend within 20 feet of either street line"; Section IX would be amended by adding at the end of paragraph 5 thereof, "provided, however, that on corner lots no part of any building shall extend within 20 feet of either street line"; and Section XII would be amended by inserting at the end thereof a new paragraph whereby the Board of Selectmen may appoint one or more associate members of the Board of Appeals for terms of such length as shall be determined by the Board of Selectmen; and in case of vacancy, inability to act or interest on the part of a member of the Board of Appeals, his place may be taken by an associate member designated by the Board of Select- men, all in accordance with existing statutory provisions relating thereto.
The board reports therefore, that it has considered all factors pertaining to such proposed changes and recommends the adop- tion of all four articles.

Board of Appeals Report
The Board of Appeals under the Zoning By-Law of the Town of Andover is made up of the following members: James S. Eastham, Chairman, term expiring May 1, 1940; Roy E. Hardy, Secretary, term expiring May 1, 1938; Walter M. Lamont, term expiring May 1, 1939.
These three members made up the Board during the entire year 1937 with the exception of the month of January, during which Mr. Edward P. Hall served in place of Mr. Hardy, and of the period from September 27 to October 4, 1937, when Mr. Hall again served in substitution for Mr. Hardy.
During the year 1937 the Board heard and decided seventeen cases as follows :
Petition of Albert E. Knowles, heard on January 27, 1937, for a permit to have a 20-foot rear yard, on account of unusual topography, on lot numbered 90, Johnson Acres, existing at the time the Zoning By-Law was adopted .- Granted
Petition of John J. Fleming, heard on February 27, 1937, for a permit for a lot subdivision at 39 Maple Avenue with a front- age of less than 75 feet, the lot not being an existing lot of record at the time the Zoning By-Law was adopted .- Denied
Petition of Sarah E. Bodwell, heard on March 6, 1937, for a permit to maintain a tearoom on South Main Street .- Granted
Petition of Emil J. Muehlig, heard on March 6, 1937, for a permit to have side yards of 111/2 and 10 feet respectively, at 19 Avon Street, on a narrow lot existing at the time the Zoning By-Law was adopted .- Granted
Petition of Joseph P. Comeau, heard on April 4, 1937, for a permit to have a side yard of 10 feet on each side and a 23-foot rear yard at 12 Juliette Street on a narrow and shallow lot existing at the time the Zoning By-Law was adopted .- Granted
Petition of Sarah A. Smith, heard on June 18, 1937, for a permit to maintain a tearoom on Mill Street .- Granted
Petition of Alice E. Batcheller, heard on June 29, 1937, for a permit to maintain a tearoom at the corner of Shawsheen Road and Lowell Street .- Granted

Petition of Charles H. Dufton, heard on July 9, 1937, for a permit to have 10 feet and 1212 feet side yards, respectively, on lot numbered 11 on Canterbury Street on a narrow lot existing at the time the Zoning By-Law was adopted .- Granted
Petition of John F. Glynn, dated July 27, 1937, for a permit to have a side yard of 12 feet on Summer Street east of Pine Street on a narrow lot existing at the time the Zoning By-Law was adopted .- Granted
Petition of Teresa A. Fleming, and appeal from refusal of the Building Inspector to grant a building permit, heard on July 30, 1937, for a variance of the Zoning By-Law to permit a lot subdivision at 37 Maple Avenue with a frontage of less than seventy-five feet, the lot not being an existing lot of record at the time the Zoning By-Law was adopted .- Denied
Petition of Fred E. Cheever, heard on July 30, for a variance of the Zoning By-Law to permit a subdivision of two lots at Johnson Acres with areas of less than 10,000 square feet each, the lots not being existing lots of record at the time the Zoning By-Law was adopted .- Denied
