TOWN WARRANT For Town Meeting, March 2, 1959


COMMONWEALTH OF MASSACHUSETTS


To either of the Constables of Town of Rutland in the County of Worcester.


Worcester, SS.


Greeting:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Community Hall in said Rutland on Monday the second day of March next, at 12:00 o'clock noon, then and there to act on the following articles:


ARTICLE 1. To bring in and deposit their ballots for a Moderator for one year; for one Selectman for three years; for one Assessor for three years; for one Assessor for two years; for one Water and Sewer Commissioner for three years; for one member of the School Committee for three years; for one member of the Board of Health for three years; for one member of the Board of Public Welfare for three years, for one member of the Board of Public Welfare for two years; for one Park Commissioner for three years; for two Library Trustees for three years; for a Tree Warden for one year, for one mem- ber of the Planning Board for five years; for one member of the Planning Board for four years, for two Constables for one year, for one member of the Wachusett Regional School Com- mittee for three years; Each to specify the person voted for by placing a cross (x) against the name. The polls will be opened at 12:00 o'clock noon, and may be closed at 8:00 o'clock P.M.


ARTICLE 2. To hear the Annual Reports of the Town Officers and Committees.

ARTICLE 3. To see if the Town will vote to fix the salaries or compensation of the elected Town Officers for the year 1959 in accordance with Section 108-Chapter 41- General Laws and to determine whether any Town Board shall be authorized to employ for additional salary or compensa- tion any of its members and to fix such salary or compensa- tion.


(The Finance Committee recommends that the salary of the Town Treasurer shall be increased by $300.00 and the salary of the Town Collector be increased by $200.00.


The Finance Committee also suggests that a Com- mittee be appointed to study the salaries of the elected town officers and recommend any revision thereof at the next Annual Town Meeting.)


ARTICLE 4. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1,1959, and to issue a note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


ARTICLE 5. To raise such sums of money as may be nec- essary to defray the expenses of the several Town departments for the year 1959 and to determine whether the Town will ap- propriate money therefor to be provided by taxation or by ap- propriation from available funds, or take any action in re- lation thereto.


ARTICLE 6. To see if the Town will vote to raise and appropriate a sum of money to pay prior year bills of the Board of Registrars or take any action in relation thereto.


(The Finance Committee recommends that the sum of $62.00 be raised and appropriated to pay prior bills of the Board of Registrars.)

ARTICLE 7. To see if the Town will vote to raise and appropriate, transfer from available funds in the treasury or borrow a sum of money to purchase a new police cruiser, and to authorize the Selectmen to sell the cruiser presently owned by the Town, the proceeds of said sale to be applied toward the purchase of the new cruiser, or take any action in relation thereto.


(The Finance Committee recommends that the town purchase a new Police Cruiser, and that a sum of money be raised and appropriated, transfer from available funds in the treasury or borrow a sum of money for said purchase.)


ARTICLE 8. To see if the Town will vote to raise and appropriate, transfer from available funds in the treasury or borrow a sum of money to purchase a new one-half ton pick-up truck for the Water & Sewer Department and to au- thorize the Water & Sewer Commissioners to sell the truck presently owned by the Town, the proceeds of said sale to be applied toward the purchase of the new truck, or take any action in relation thereto.


(The Finance Committee recommends that the Town purchase a new one-half ton pick-up truck for the Water & Sewer Department, and that a sum of money be raised and appropriated, transfer from available funds in the treasury or borrow a sum of money for said purchase.)


ARTICLE 9. To see if the Town will vote to raise and appropriate a sum of money to purchase an office desk for the use of the Town Clerk or take any action in relation thereto.


(The Finance Committee recommends that the Town raise and appropriate a sum not to exceed $200.00 to pur- chase an office desk for the use of the Town Clerk.)

ARTICLE 10. To see if the Town will vote to raise and appropriate a sum of money to purchase a tract of land of approximately 92 acres on Pommogussett Road presently owned by Harry E. Dow to be used for the purpose of a public dump and to authorize the Selectmen to accept a deed thereof in behalf of the Town to take any action in relation thereto.


(The Finance Committee does not recommend the ap- proval of this Article.)


ARTICLE 11. To see if the Town will vote to raise and appropriate a sum of money to be used with matching funds for the purchase of Civil Defense equipment, or take any action in relation thereto.


(The Finance Committee does not recommend the ap- proval of this Article.)


ARTICLE 12. To see if the Town will vote to authorize the Board of Health to contract for garbage collection in the Town of Rutland and to raise a sum of money for same or take any action in relation thereto.


(The Finance Committee does not recommend the ap- proval of this Article.)


ARTICLE 13. To see if the Town will vote to install four street lights on Prescott Street, or take any action in relation thereto.


(The Finance Committee recommends that four street lights be installed on Prescott Street and that the Town raise and appropriate the sum of $70.00 for this purpose. )


ARTICLE 14. To see if the Town will vote to install four street lights on Kenwood Drive starting from Maple Avenue, or take any action in relation thereto.

(The Finance Committee recommends that four street lights be installed on Kenwood Drive starting from Maple Avenue and that the town raise and appropriate the sum of $70.00 for this purpose.)


ARTICLE 15. To see if the Town will vote to install a street light on the corner of Wachusett Street and East County Road, or take any action in relation thereto.


(The Finance Committee does not recommend at this time the approval of this Article.)


ARTICLE 16. To see if the Town will vote to accept Laurelwood Road in accordance with the layout of the Select- men duly filed with the Town Clerk and approved by the Plan- ning Board and to authorize and direct the Selectmen to make a taking of easement in accordance with said layout and to accept a deed of the water pipe and other facilities in said layout, or take any action thereto.


ARTICLE 17. To see if the Town will vote to adopt the following By-Laws :


(1) The Selectmen may sell or otherwise dispose of obsolete personal property belonging to the town, provided that no such property with an estimated value of at least fifty dollars, shall be sold unless proposals for the same shall have been invited by advertisement in a newspaper of general circulation in the Town of Rutland.


(2) That no contract for the purchase of equipment, supplies, materials or labor estimated to cost $500.00 or more shall be awarded unless proposals for the same shall have been invited by advertisement in a newspaper of gen- eral circulation in the Town of Rutland.


(3) The Selectmen shall be authorized to establish rules and regulations to control power boats on lakes, ponds and rivers in the Town of Rutland.

(4) No person shall use or permit to be used for dwelling purposes within the town, any automotive type trail- er, whether mobile or immobile, but mobile trailers may be used for temporary dwelling purposes, provided such use is licensed by the Selectmen, said license to be applied for by the occupant within three days after the unit is located in the town, and no license granted hereunder to be for a period in excess of thirty days.


ARTICLE 18. To see if the Town will vote to appropriate from available funds a sum of money to reduce the tax levy for the current year, or take any action in relation thereto.


(No recommendation has been made by the Finance Com- mittee on this Article.)


ARTICLE 19. To choose all necessary Town Officers and Committees.


All business contained in this Warrant with the excep- tion of Article 1, will be considered at an adjourned meet- ing to be held in the School Auditorium Saturday evening, March 7, 1959 at eight o'clock in accordance to the Town By-Laws .


And you are directed to serve this Warrant, by post- ing up attested copies thereof at each of the five places in said Town, seven days at least before the time of hold- ing said meeting.


HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.

REPORT OF THE FINANCE COMMITTEE


The Finance Committee organized for the year with George M. Campbell as Chairman and Roger L. Culver as Clerk.


As customary, numerous meetings and conferences were held during the year with the various town department heads, mem- bers of the committees and boards, and we wish to extend our appreciation for their cooperation.


As anticipated, the total budget is considerable more than that of 1958. However, we feel that the budget as pre- sented is necessary to efficiently fulfill the requirements of the various departments. It is gratifying to note that several departments have not made any request for an increase in their budgets over last years.


The following transfers from the Reserve Fund to the various 1958 accounts were authorized by this Committee:

The Finance Committee also suggests that a Com- mittee be appointed to study the salaries of the elected town officers and recommend any revision thereof at the next Annual Town Meeting.


Article 6 - The Finance Committee recommends that the sum of $62.00 be raised and appropriated to pay prior bills of the Board of Registrars.


Article 7 - The Finance Committee recommends that the town purchase a new Police Cruiser, and that a sum of money be raised and appropriated, transfer from available funds in the treasury or borrow a sum of money for said purchase.


Article 8 - The Finance Committee recommends that the town purchase a new one-half ton Pickup truck for the Water and Sewer Department, and that a sum of money be raised and appropriated, transfer from available funds in the treasury or borrow a sum of money for said purchase.


Article 9 - The Finance Committee recommends that the town raise and appropriate a sum not to exceed $200.00 to purchase an office desk for the use of the Town Clerk.


Article 10- The Finance Committee does not recommend the approval of this article.


Article 11- The Finance Committee does not recommend the approval of this article.

Article 13 - The Finance Committee recommends that four street lights be installed on Prescott Street and that the town raise and appropriate the sum of $70.00 for this purpose.


Article 14 - The Finance Committee recommends that four street lights be installed on Kenwood Drive starting from Maple Avenue and that the town raise and appropriate the sum of $70.00 for this purpose.


Article 15 - The Finance Committee does not recommend at this time the approval of this article.


Article 18 - No recommendation has been made by the Finance Committee on this article.


28 REPORT OF SELECTMEN


To the Citizens of Rutland:


The 1958 Board of Selectmen was organized with Lloyd H. Campbell, Chairman, James L. Wood, Clerk, and Frank J. Brooks, the third member.


The regular meetings were held as usual bi-weekly on Monday evenings .


An Auxiliary Police force was formed during the year. We believe this will be a valuable addition to our regular force particularly in time of emergency or disaster.


The Chapter 90 Highway program was continued with the completion of Maple Avenue to the entrance of the Veterans Hospital and the continuation of the improvement of Wachusett Street. We plan to continue on Wachusett Street in 1959.


The program of oiling of our Chapter 81 gravel roads was continued, completing about la miles in 1958. With your approval we plan to continue this work this year.


At the request of a number of voters the Board is working on traffic regulations which we hope will be com- pleted and become effective in the near future.


We would like to explain to the voters that articles placed in the town warrant do not necessarily express the feeling of the Selectmen. While we draw up the warrant, most of the articles are originated by other Town Boards or by groups of individuals and we feel that where enough interest is shown on a particular subject that the final decision should rest with the voters at the town meeting. By state law any article requested to be inserted in the warrant for the Annual Town Meeting must be in writing and signed by ten voters. When this is done, the article must be placed in the warrant.
