Annual Town Meeting


FEBRUARY 8, 1936


Annual Town Meeting assembled in the Auditorium of the High School at one o'clock P. M. according to call of Warrant, which was read by the Town Clerk, and under


Article 1. To choose two or more Fence Viewers and two or more Field Drivers.


Willard C. Crouss and James W. Cesan were chosen as Fence Viewers.


William S. Halladay and Charles W. Hull were chosen as Field Drivers.


Article 2. To hear and act upon the reports of the town officers.


Voted: To accept the reports of the town officers as printed, typographical errors and omissions accepted.


Article 3. To see what method the town will adopt for the support of Public Welfare for the ensuing year.


Voted: To leave the method of support of Public Wel- fare in the hands of the Board of Welfare.


Article 4. To see if the Town will appropriate a sum of money for the proper Observance of Memorial Day and provide for its expenditure.

Voted: To appropriate the sum of $150 for the proper observance of Memorial Day to be expended in the usual manner.


Article 5. To see if the Town will appropriate a sum of money for the payment of a proper charge of an Insur- ance Company for acting as surety on the official bond of its officers.


Voted: To appropriate the sum of $615 for payment of a proper charge of an Insurance Company for acting as sureties on the official bond of town officials.


Article 6. To see if the Town will appropriate a sum of money for Liability Insurance of its employees.


Voted: To appropriate the sum of $940 for liability insurance of the town employees.


Article 7. To see if the Town will appropriate a sum of money for diphtheria immunization.


Voted: To appropriate the sum of $65 for Diphtheria Immunization.


Article 8. To see if the Town will appropriate a sum of money for enforcement of the dog law.


Voted: To appropriate the sum of $500 for enforce- ment of the dog law.


Article 9. To see if the Town will appropriate a sum of money for overdrafts of 1935 in Water Department.


Voted: To appropriate the sum of $4,241.57 for over- drafts in the Water Department in 1935.


Article 10. To see if the Town will reappropriate from the Town Treasury the sum of $60, balance of 1935 appro- priation for construction of fence around High School property.

Voted: To appropriate the sum of $60 of balance of 1935 appropriation for construction of fence around High School lot.


Article 11. To see if the Town will appropriate a sum of money for employment of a District Nurse.


Voted: To appropriate the sum of $2,350 for support of a District Nurse.


Article 12. To see if the Town will appropriate the sum of $75 to be expended in the Town by the Hampden County Trustees for Aid to Agriculture in accordance with the provisions of the laws of the Commonwealth.


Voted: To appropriate the sum of $75 to be expended in the Town by the Hampden County Trustees for Aid to Agriculture, in accordance with the provisions of the laws of the Commonwealth.


Article 13. To see if the Town will appropriate any sum of money for the construction of permanent road on Adams Street, beginning at Main Street, work to be done by the Relief Department in conjunction with the W. P. A. if possible. Said sum to be raised by 1935 taxation.


Voted: To refer this matter to the Board of Selectmen, with instructions to proceed with the work under a W. P. A. project if advisable.


Article 14. To see if the Town will raise and appro- priate a sum of money for the preservation, care and main- tenance of and for the further protection, by insurance or otherwise, of the town's interest in real estate held by it under purchase and takings for non-payment of taxes, as authorized by Clause 38 of Section 5 of Chapter 40 of the General Laws; and authorize the selectmen to do all things necessary to protect the town's interest therein, or take any action relative thereto.

Voted: That the Town raise and appropriate the sum of $500 for the preservation, care and maintenance of and for the further protection by insurance or otherwise of the Town's interest in real estate held by the Town under pur- chasings and takings for non-payment of taxes, as author- ized by Clause 38 of Section 5 of Chapter 40 of the General Laws; and that the selectmen be hereby authorized to do all things necessary to protect the Town's interest therein.


Article 15. To see if the Town will vote to authorize the selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale, property taken by the Town under Tax Title procedure provided that the selectmen or whom- soever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto.


Voted: That the Town authorize the selectmen and Town Treasurer to sell after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale of property taken by the Town under Tax Title procedure; the selectmen and Treasurer being given full authority to reject any bid which they deem inadequate.


Article 16. To see if the Town will vote to accept Royal and Randall Streets, according to plans in file in the Town Clerk's Office, as public streets.


Voted: To pass over.


Article 17. To see if the Town will vote to give per- mission to the Feeding Hills Cemetery Association to en- large their present cemetery by adding a certain tract of land situated easterly of said cemetery on Springfield Street, said description being on file in Town Clerk's office.

Voted: That the Town hereby grant permission to the Feeding Hills Cemetery Association to enlarge its present cemetery by adding a certain tract of land situated easterly of said cemetery on Springfield Street described as fol- lows: Starting at the South-east corner of said cemetery on Springfield Street running Northerly along the east boundary of said cemetery 506 feet to a stone: thence Easterly 100 feet along land of Nelson G. King to a stone : thence Southerly along land of said King and parallel to the east boundary of the cemetery 195 feet to a stone: thence South-easterly along land of said King 281 feet to a stone at Springfield Street, and thence along Springfield Street 441 feet to the point of beginning, said tract con- taining about two and one-half acres.


Article 18. To see if the Town will vote to raise and appropriate a sum of money for the improvement of Wal- nut Street, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, or take any other action in relation thereto.


Voted: That the Town raise and appropriate the sum of $5,000 for the improvement of Walnut Street : said sum or any portion therein to be used in conjunction with any money which may be allotted by the State or County or both, for this purpose.


Article 19. To see if the Town will vote to accept sections 32-47 of Chapter 147 of the Tercentenary Edition of General Laws referring to licensed boxing matches.


Voted: To pass over.


Article 20. To see if the Town will appropriate any sum of money for W. P. A. projects and provide for the raising of said sum.

To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen to borrow money from time to time, in anticipation of the revenue of the financial year beginning January 1, 1936 and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17 Chapter 44 of the General Laws.


Voted: That the Town Treasurer, with the approval of the Selectmen be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1936, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17 Chapter 44 of the General Laws.

Article 23. To transact any other business that may legally come before said meeting.


Voted: That the Board of Selectmen be hereby in- structed to obtain definite knowledge concerning prospect of removing the overpass on Springfield Street and approximate cost to the town.


Voted: That the Moderator appoint a committee of six, two from each Precinct to investigate the insurance situa- tion pertaining to our town buildings, and report their findings and recommendations at the first special town meeting held during the year 1936. Giles W. Halladay, Sidney F. Atwood, H. Preston Worden, James P. Kane, James Snell and John J. Caldon were appointed as such committee.


Voted: To adjourn.

Special Town Meeting


MAY 12, 1936


Article 1. To see whether the Town will adopt a by- law for the purpose of licensing, limiting, regulating, or otherwise controlling the erection and display of bill- boards, or other advertising devices in public places with- in the limits of the Town, not inconsistent with Sections 29 to 33 inclusive of Chapter 93 of General Laws, pass any vote or take any action relative thereto.


A set of by-laws was moved for adoption relative to bill- boards, signs, etc. and was referred to a committee of three appointed by Moderator, committee appointed con- sisted of Thomas H. Stapleton, James H. Kerr, and Elsie W. Hastings.


Article 2. To see if the Town will vote to appropriate any sum of money for W. P. A. Projects.


Voted: To appropriate the sum of $20,871.08 for W. P. A. Projects as follows :

Article 3. To see if the Town will authorize its Treas- urer with the approval of the Selectmen to borrow a sum of money under authority of and in accordance with Chap- ter 80 Acts of 1936, the said sum to meet appropriations for W. P. A. Projects, or take any action relative thereto.


Voted: That of the amount appropriated for W. P. A. Projects the sum of $871.08 be raised by taxation during the present municipal year of 1936.


Voted: That the Treasurer with the approval of the Se- lectmen be and is authorized to borrow a sum of money not exceeding $20,000 under authority of and in accordance with the provisions of Chapter 80, Acts of 1936 and to issue bonds or notes of the Town therefor payable within 10 years from date. The said amount to be used to meet appropriations made for W. P. A. Projects. Unanimous vote.


Article 4. To see if the Town will appropriate any additional sum of money for Highway, Police, and Fire Departments.


Voted: To appropriate the sum of $5,300 for Highways as follows : Snow removal $1,000, Flood Relief Work $3,500, Tools $800, and the sum of $200 for Police Department to meet expenses of Flood conditions.


Article 5. To see if the Town will authorize the Treasurer with the approval of the Selectmen to borrow money for appropriations made for Highway, Police and Fire Departments, under authority of and in accordance with the provisions of Chapter 49 of Acts of 1933, or take any action relative thereto.

Voted: That the Treasurer with the approval of the Selectmen be and is hereby authorized to borrow the sum of $5500 to meet appropriations made for Highway and Police, and to issue a note or notes of the Town therefor, all in accordance with the provisions of Chapter 49 Acts of 1933. (Vote unanimous).


Article 6. To see if the Town will appoint a committee to consider the advisability of purchasing or taking addi- tional land contiguous to the High School grounds for Athletic purposes, and report to a future meeting with estimated costs.


Voted: That a committee of five be appointed by the Moderator to consider the advisability of acquiring land contiguous to the High School field for Athletic purposes, and report their findings to the next Town meeting.


Article 7. To see if the Town will appropriate the sum of $1,000 for expenses of foreclosure of Tax Title Liens.


Voted: To appropriate the sum of $1,000 for expenses of foreclosure of Tax Title Liens, said sums to be raised by taxation.


Article 8. To see if the Town will appropriate the sum of $1,500 for refinancing Insurance on School buildings and contents.


Voted: To refer the subject matter to the next annual town meeting.


Article 9. To transact any other business that may legally come before this meeting.


Voted: That the Selectmen be instructed to locate suit- able property to be used as a Town Dump, and for the next annual town meeting have an article inserted in the warrant for the purchasing and maintenance of the same.
