Article 17. To see if the Town will appropriate the sum of $1,250.00 for Chapter 90 Maintenance on Spring- field Street.


Voted: To appropriate the sum of $1,250.00 as 25 percent of the cost for Chapter 90 Maintenance on Spring- field Street, in conjunction with appropriations from the State and County.


Article 18. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation the revenue of the financial year beginning January 1, 1938, and to issue a note or notes therefor, payable within one

year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.


Voted: That the Town Treasurer with the approval of the Selectmen be and hereby is authorized to borrow money from time to time, in anticipation of the revenue of the financial year beginning January 1, 1938, and to issue a note or notes therefor, payable within one year. and to renew any note or notes as may be given for a period of less than one year, in accordance with section 17, Chapter 44 of the General Laws.


Article 19. To hear and act upon the report of a Building Committee appointed at a Special Town Meeting held May 13, 1937, to bring in plans and estimates for an addition to the present school building at Agawam Center, or a new building.


B. J. Phelps reported for the building Committee, rec- ommending the erection of a new building.


Voted: To accept the report as a report of progress and the Committee be continued in power.


Article 20. To see if the Town will vote to construct, equip and furnish a new building at Agawam Center, or an addition to the present building with needed altera- tions therein as outlined by plans presented by a special committee on school house needs, or take any action re- garding the same.


Voted : To pass over.


Article 21. To see if the Town will vote to appropri- ate the sum of $145,000.00 or any part thereof for the pur- pose of construction, equiping and furnishing a new school building at Agawam Center, or an addition to the present building with the necessary alterations therein, and auth- orize the Treasurer, with the approval of the Selectmen, to borrow said sum or any part thereof, or act in way re- lating to the same .

Voted: That the sum of $2500.00 be appropriated for the use of the Center School Building Committee to enable the committee to carry on the work of preparing plans and estimates for altering or making an addition to the present school building on the construction of a new school building at Agawam Center. Said committee to report at a subsequent town meeting.


Article 22. To see if the Town will appoint a com- mittee to consider the improvement of mail facilities of the Town and report at a future Town meeting.


Voted: That a committee of five be appointed by the Moderator to investigate mail facilities of the Town and report at a Special Town Meeting.

Voted: That the Moderator appoint a committee of three citizens to draw up a suitable testimonial of Select- man Rocco Cascella and Superintendent of Streets, Clark B. Jones, who met their death in discharge of their duties to this town: That they be placed on the records of the Town and copies sent to their families, and printed in the Springfield papers. (John G. Dutton, Joseph J. Borgatti and William D. Rising appointed as the committee.)


The Committee appointed on mail service is as fol- lows : George H. Reed, Warren E. Jewett. James F. Kirby. Arthur E. Carr and James W. Cesan.


Voted to adjourn.


RESOLUTIONS


Whereas: Selectman Rocco Cascella and Supervisor of Roads, Clark B. Jones, lost their lives in an accident in the month of December 1937, while in discharge of service for the Town of Agawam.


We hereby express our respect for their upright char- acters and our appreciation of the excellent work they rendered our town in their respective offices.

They were good citizens and interested in all that was best for the Town of Agawam. We regret their death and the loss of their service. We hold them in honorable remembrance.


It is also resolved: that these resolutions be placed on the records of the Town of Agawam and a copy of them shall be presented to their respective families and that they be printed in the Springfield newspapers.

Special Town Meeting


MAY 9. 1938


Article 1. To hear and act upon a report by a Special Committee appointed at the last annual Town Meeting concerning mail facilities of the Town.


Voted: To accept report, the Committee thanked, and continued in power. Also to endeavor to secure action concerning improvement of mail facilities with Congress- man Clason.


Article 2. To see if the Town will appropriate the sum of $200.00 or any other sum for a recreational W. P. A. Project.


Voted: To appropriate the sum of $125.00 for a Recreational W. P. A. Project with the condition that the project be completed by September 15, 1938.


Article 3. To hear and act upon the report of a spe- cial committee appointed at the May 1937 Town Meeting to investigate the need of additional school accommoda- tions at Agawam Center.


Committee reported that a new school building was badly needed in Agawam Center, recommending a build- ing be erected. Voted: To accept the report of the Com- mittee with thanks and they be discharged from further service.

Article 4. . To see if the Town will vote to construct, equip and furnish a new building at Agawam Center, or an addition to the present building with needed alterations therein, as outlined by plans presented by a special com- mittee on school house needs, raise and appropriate money therefor, or take any other action regarding the same.


Voted: Unanimously that a new school house be constructed, equipped and furnished at Agawam Center, substantially in accordance with the plans presented by the special committee on school house needs, by the Town and that the sum of $145,000 be and hereby is appropriated to be spent under the direction of a Building Committee hereinafter designated, in said construction; that to meet such appropriation there be raised in the tax levy of the current year the sum of $5,000 and the Treasurer, with the approval of the Selectmen, be and is hereby authorized to borrow the sum of $140,000 and to issue bonds of the Town therefor, said bonds to be payable in accordance with the provisions of Chapter 44 of General Laws and Acts in amendment thereof and in addition thereto, so that the whole loan shall be paid in not more than 20 years from date of issue of the first bond or at such earlier dates as the Treasurer and Selectmen may determine. It is further


voted that a Building Committee consisting of the Board of Selectmen and five others, to be appointed by the Moderator, with full authority to contract for and to con- struct and equip the school building, all within the sums herein above appropriated. The Building Committee is also authorized to seek a Federal grant to assist in the con- struction of the school and to accept such grant, but if the grant is not made within three months, the Committee may proceed as above authorized.


Article 5. To see if the Town will appropriate a sum of money to defray the expense of foreclosure of Tax Title Liens.


Voted: To appropriate the sum of $1,000 to defray expenses of foreclosure of Tax Title Liens.

Article 6. To see if the Town will accept Chapter 118 Acts of 1938 relating to the payment of certain bills on account of deaths and injuries suffered by certain officers of the Town in the discharge of their special duties and appropriate money therefor.


Voted: That the Town hereby accept Chapter 118. Acts of 1938, relating to the payment of certain bills on account of deaths and injuries suffered by certain officers of the Town in the discharge of their official duties, and that we appropriate the sum of $2500 therefor.


Article 7. To see if the Town will accept Chapter 227, Acts of 1938 relating to the payment of annuities to the widows of Rocco Cascella and Clark B. Jones and appropriate money therefor.


Voted: That the Town hereby accept Chapter 227, Acts of 1938, relating to the payment of annuities to the widows of Rocco Casella and Clark B. Jones and that we appropriate the sum of $700 for payment of such annuities commencing June 1, 1938.


Article 8. To see if the Town will authorize and (lirect the Assessors to use such amount, not in excess of $13,000, as may be approved by the Commissioner of Cor- porations and Taxation, toward the reduction of the 1938 tax rate.


Voted: That the Assessors be hereby authorized and directed to use such amount of money, not in excess of $13,000, from available funds as may be approved by the Commissioner of Corporations and Taxation toward the reduction of the 1938 tax rate.


Article 9. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to bor- row a sum not exceeding $10,000, under the provisions of Chapter 49 of the Acts of 1933 as amended, to meet appro-

priations voted for ordinary maintenance expenses, and . authorize the Assessors to use such amount in determina- tion of the 1938 tax levy.


Voted : That the Treasurer is hereby authorized with the approval of the Selectmen, to borrow a sum of money, not exceeding $10.000, under the provisions of Chapter 49 of the Acts of 1933, as amended, to meet appropriations voted for ordinary maintenance expenses, and also authorize the Assessors to use said amount in determina- tion of the 1938 tax rate.


Article 10. To transact any other business that may legally come before said meeting.

Special Town Meeting


JULY 25. 1938


Article 1. To see if the Town will appropriate any sums of money for various W. P. A. Projects and pro- vide for the payment of the same.


Voted: To appropriate the sum of $23,000 for W. P. A. Projects and to provide for the payment of the same the Treasurer, with the approval of the Selectmen, is here- by authorized to borrow the said amount of $23,000 under the provisions of Chapter 49 of the Acts of 1933 as amended.


Article 2. To see if the Town will vote to appropriate a sum of money for the purpose of making a survey for sewer constructions and disposal plant throughout the Town and provide for raising of said sum.


Voted: To appropriate the sum of $900 for the pur- pose of making a survey for construction of sewers throughout the town and a disposal plant, the said sum of $900 to be taken from the Reserve Fund.


Article 3. To see if the Town will appropriate a sum of money for the purchase of additional land for building of school house and for school play ground purposes in Agawam Center and provide for the payment of the same.


Voted: To appropriate the sum of $4,000 for the purpose of purchasing a certain tract of land contiguous

to the Center School ground for school purposes. Said tract described as follows: Commencing at a point on the southerly boundary line of land of one Howe, which point is three hundred and six and 80/100 (306.80) feet measuring westerly from a stone bound at the southwest- erly corner of land now or formerly of said Howe, and running thence easterly along land now or formerly of said Howe eleven hundred sixty-four and 89/100 (1164.89) feet to land of one Taylor, thence southerly along land of said Taylor five hundred ninety eight and 81/100 (598.81) feet to School Street : thence running westerly along School Street four hundred twenty and 8/100 (420.08) feet to land of one Perry: thence running northerly along land of said Perry one hundred and fifty (150) feet to an iron pipe : thence westerly along land of said Perry, one Ken- dall, and one Hastings six hundred (600) feet to an iron pipe : thence running southerly one hundred fifty (150) feet along land of said Hastings to School Street: thence westerly along School Street one hundred forty-five and 25/100 (145.25) feet to land belonging to the Town of Agawam: thence northerly along said land of the Town of Agawam three hundred two (302) feet to an iron pipe : thence continuing northerly to the place of Beginning. Said sum of $4,000 to be paid from the sum appropriated for school house construction at a special town meeting on May 9, 1938. (unanimous vote)


Article 4. To transact any other business that may legally come before said meeting.


Voted: That the Selectmen and Chairman of the Finance Committee be authorized to enter into an agree- ment with the city of Springfield in regard to sewage dis- posal. Voted to adjourn.

Special Town Meeting


SEPTEMBER 7, 1938


Article 1. To see if the Town will vote to amend the vote passed under Article 4 of the Warrant for the Special Town Meeting held May 9, 1938 by striking out $145,000 wherever it occurs in said vote and inserting in place thereof $186,200 and by adding at the end of the first para- graph of said vote the words, "Any funds received from the Federal Government as a grant shall be applied to the cost of the project, or to the loan herein authorized", all other provisions of the vote to remain unchanged.


Voted : That a new schoolhouse be constructed, equipped and furnished at Agawam Center substan- tially in accordance with plans presented by the Special Committee on school house needs, by the Town, and the sum of $186,200 be and hereby is appropriated to be spent under the directions of a Building Committee hereinafter designated in said construction, that to meet such appropriation there be raised in the Tax Levy of the current year the sum of $5,000 and the Treasurer with the approval of the Selectmen be and is hereby authorized to borrow the sum of $140,000 and to issue bonds of the Town therefor, said bonds to be payable in accordance with the provisions of Chapter 4+ of the General Laws and Acts in amendment thereof and in addition thereto so that the whole loan shall be paid in not more than 20 years from the date of issue of the first bond or at such earlier dates as the Treasurer and Selectmen may determine. Any funds received from the Federal Government as a grant

shall be applied to the cost of the project or to the loan herein authorized. It is further voted that a Building Committee consisting of the Board of Selectmen and five others, to be appointed by the Moderator, and with full authority to contract for and to construct and equip the school building all with the sum herein above appropriated. Special Town Meeting


DECEMBER 19, 1938


Article 1. To see if the Town will vote to appropriate a cetrain sum of money for Soldiers' Relief and provide for raising said sum.


Voted: To appropriate the sum of $2500 for an addi- tional sum to the amount already appropriated for Soldiers' Relief and that the sum of $2500 be transferred from School House Plans account to said Soldiers' Relief De- partment.


Article 2. To see if the Town will vote to appropriate a certain sum of money for Hurricane damage and pro- vide for payment of same.


Voted: To appropriate the sum of $2500 for Hurri- cane damage and that the said amount be taken from the Overlay Reserve Account.


Article 3. To see if the Town will vote to restore property described as follows, which was changed to busi- ness under date of February 12, 1938 to Residence A: Said property designated as lots No. 11 and No. 12 as shown on a plan in Hampden County Registry of Deeds, book G of plans, page 44, with the exception of the Southerly 50 feet of said lots; beginning at the intersection of the South- easterly line of Adams Street with the westerly line of Ridge Avenue, and running thence Southwesterly on said Adams Street 142.80 feet; thence Southerly by lot No. 13 on said plan 110.66 feet : thence Easterly by the remaining

portions of said lots No. 11 and No. 12 on said plan 100 feet : and thence Northerly by Ridge Avenue 212.60 feet.


Lot designated No. 13 on said plan : beginning at the point where it joins lot No. 12 on Adams Street and run- ning Southwesterly on said Adams Street 81.79 feet : thence Southerly 93.48 feet : thence Easterly 50 feet to lot No 12 as shown on said plan and thence Northerly by lot No. 12 as shown on said plan 160.66 feet.
