Article 22. To see if the Town will authorize the Board of Selectmen acting as a Board of Sewer Commis- sioners, under and pursuant to Chapter 79 of General Laws and Acts and Amendments thereof and in addition thereto, to take on behalf of the Town an easement 16 feet in width in and over the following described parcels of land, 1 to 9, both inclusive, as shown on the plan entitled "Easement Plan of Westfield River Trunk Sewer, for the Town of Agawam, Mass., Tighe & Bond, Consulting Engineers, Holyoke, Mass., Scale: 1" = 200', Dec. 22, 1939" on file with the Town Clerk, for a public purpose, to wit, the construction and maintenance of a public sewer, or take any action relative thereto.


Article 23. To see if the Town will raise and appro- priate a sum of money for the payment of damages in con- nection with the taking of an easement in land for the con- struction and maintenance of Westfield River Trunk Sewer, in accordance with plans and specifications pre-

pared by Tighe and Bond, Consulting Engineers, made December 22, 1939, or take any action relative thereto.


Article 22 and 23. Voted that the Board of Select- men be and are hereby authorized under and pursuant to Chapter 79 of General Laws and Acts in amendment there- of and in addition thereto, to take on behalf of the Town an easement in a strip of land 16 feet in width, in and over the lands hereinafter described and designated as Parcels 1 to 9, both inclusive, not otherwise used for a public pur- pose, all of said parcels being the same as located and shown on plan entitled "Easement Plan of Westfield River Trunk Sewer, for the Town of Agawam, Mass., Tighe & Bond, Consulting Engineers, Holyoke, Mass., Scale 1" = 200', Dec. 22, 1939", which plan is filed in the office of the Town Clerk in the said Town of Agawam.


Said easement or right of way over said parcels 1 to 9, both inclusive, to be an easement to lay, operate and for- ever maintain an underground main drain or common sewer and to alter, replace, repair, renew, inspect and ex- amine the same and to pass freely over the same in any manner with teams, motor vehicles or other vehicles and to construct and maintain any concrete masonry work, manholes or structures, and to change the grade of the land, and to make fills and build and maintain any other thing reasonably necessary for the construction and main- tenance of said main drain or common sewer and to place upon said lands materials and apparatus during such con- struction, replacement or repair, and the same to be for a public purpose, to wit, the construction and general main- tenance of a main drain or common sewer. Parcels 1 to 9 over which said right of way is taken are described as follows :

Special Town Meeting


June 10, 1940


Article 1. To hear and act upon the report of the committee appointed at the last annual Town Meeting to submit a Plumbing Code for the Town of Agawam.


The committee appointed to submit a Plumbing Code reported as follows :


BOARD OF HEALTH REGULATIONS


Section 1. No pipes, tanks, faucets, valves, or fixtures by and through which waste water or sewage is used or carried, shall be placed in any building except upon such terms and conditions as the Board of Health may pre- scribe, and upon a permit being first issued therefor by said Board of Health, or such person or persons as the board may designate. Application for such permits shall be made to the Board of Health upon blanks provided for the pur- pose by said board, which shall contain a statement of the work to be performed, location of building, and names of the persons for and by whom the work is to be done. Each permit issued by the Board of Health shall be sub- ject to the express conditions to be set forth in such per- mit, that all work done under it shall be done in a thor- ough and workmanlike manner, and all directions of the Board of Health relating to such work and all provisions of statute or ordinance relating to plumbing shall be com- plied with.


Section 2. In all cases where the drainage system of any building is required to be or has been constructed un- der a permit issued by the Board of Health, no person

shall proceed to construct, add to or alter any portion of the drainage system of such building (except solely by way of repairs) until there be filed in the office of the Board of Health a notice or written description of the work to be performed. No person shall commence work upon such drainage or plumbing until the plans are approved by said board. After a plan has been approved under the provisions of this ordinance, no alteration of the same shall be made without permission in writing from the Board of Health.


Section 3. An inspector of plumbing who shall be called upon to examine any work under the statutes or ordinances relating to plumbing, shall be notified when such work is ready for inspection, and all work must be left uncovered and convenient for examination until ex- amined and approved.


RULE 1.


Every plumber, before doing any work in a building, shall, except in the case of repair of leaks, file in the office of the Board of Health, upon blanks for that purpose, an application for a permit, and, if required by the Board of Health, a plan or sketch of the work to be performed ; and no such work shall be done in any building without a written permit from the Board of Health, or authorized agent. "Repair of leaks" shall mean such repairs as are necessary to protect property, but do not involve any extensive change in construction.


RULE 2.


A. The plumbing of every building shall be separate- ly and independently connected outside the building with the public sewer, if such sewer is provided, or with a proper and sufficient private drain or sewer laid outside of the building, and, if a sewer is not accessible, with a proper cesspool. Several buildings may have a common sewer connection if such connection is approved by the Board of Health and the Superintendent of sewers.

B. Pipes or other fixtures shall not be covered or concealed from view until approved by the Inspector of Plumbing, who shall examine or test the same within two working days after notice that they are ready for in- spection. Plumbing shall not be used unless, when rough- ed in, the wastes, vents, and back-air pipes and traps are first tested by water or sufficient air pressure in the presence of an inspector, when such testing is practicable.


RULE 3.


A. Drain and connecting ventilation pipes, vents, and back-air pipes shall be sufficient size, and made of medium or extra heavy cast-iron pipe if under ground, and if above ground shall be made of medium or extra heavy cast-iron, galvanized wrought iron of standard weight, or of brass pipe, within the building, except that lead pipes may be used for short connections when exposed to view. Cast- iron drains shall extend not less than five (5) feet from the inside face of wall, beyond and away from the build- ing. Cast-iron pipes shall be sound, cylindrical, and smooth, free from cracks and other defects, of uniform thickness, and of the grade known to commerce as "medium or extra heavy".


B. Fittings on wrought-iron vent or back-air pipes shall be galvanized, recessed, cast-iron threaded fittings. Fittings for waste or soil or refrigerator waste pipes of wrought-iron, or brass pipe shall be galvanized cast-iron, or brass recessed and threaded drainage fittings, with smooth interior waterway and threads tapped, so as to give a uniform grade to branches of not less than one-quarter of an inch per foot. All joints on wrought-iron or brass pipe shall be screwed joints made up with red lead, and any burr formed in cutting shall be carefully reamed out.


C. Drain pipes above ground shall be secured by irons to walls, suspended from floor timbers by strong iron hangers, or supported on brick piers. Proper clean- out should be flush with floor level to reach cleanouts and traps. Every drain pipe shall have a fall of not less

than one-quarter inch per foot, and shall be extended from a point five feet outside the inside face of the wall, un- obstructed, to and through the roof, undiminished in size, and to a height not less than two feet above the roof, and not less than one foot above the top of any window with- in ten feet, and not less than eight feet above the roof if the roof is used for drying clothes, or as a roof garden. The drain pipe shall be supplied with a Y-fitting and a taper screw clean-out or with an iron stopper, on the di- rect run, at or near the point where the drain leaves the building. All connections with horizontal or vertical pipes shall be made with Y-branches. Saddle hubs shall be used only if welded. At the base of each vertical pipe line, and in both old and new work, a Y-fitting shall be placed, provided with a taper screw clean-out, approved by the Board of Health.


RULE 4


A. Where soil-pipe extensions or other vent pipes pass through the roof, such pipes, if less than four inches in diameter, shall be increased to four inches below the roof, and a durable and tight roof connection made of 16 ounce copper or lead. No pipe extensions on the drainage system shall be less than four inches when passing through the roof. All vents, four inches or larger in diameter, will require no increaser.


B. The minimum diameter of soil pipes permitted is four inches. A vertical waste pipe into which a line of sinks discharges shall be at least two inches in diameter. Joints on cast-iron pipes shall be packed with oakum, run with molten lead, thoroughly caulked, and made gas and water tight.


C. Each drainage system shall have at least one four- inch extension through and above the roof, but other ex- tensions may be of suitable size, not less than one and one-half inches, to amply protect traps from back-pressure or siphonage. Connections with lead pipes to waste, soil, or vent pipes of iron shall be made with brass connections properly soldered, screwed, or caulked to the iron.

RULE 5.


Every building used for habitation shall have such number of water closets as the Board of Health may re- quire; every building where persons are employed, shall have at least one water closet for every fifteen persons em- ployed therein, and in any building where persons of both sexes are employed, separate accommodations shall be furnished for both men and women. Every inclosure con- taining one or more water closets shall be provided with adequate ventilation to the outer air, either by window or by a suitable air shaft. No water closet shall be set in any room or apartment that has not a window having an area of at least three square feet opening directly to the external air or air shaft, unless there is a vent pipe not less than six inches in diameter. All water closets here- after constructed shall be supplied with water from a spe- cial tank not used for any other purpose, unless permission to use special apparatus has been first obtained from the Board of Health. Water closets requiring a lead bend connection under the floor shall have a cast-brass floor plate, properly soldered to the bend. Such water closets shall not be set up on connected until the soldered joint on floor plate has been examined and approved by the in- spector of plumbing.


RULE 6.


A. Each fixture shall have an effectual trap placed within three feet six inches of its outlet, and which, if of a kind and in a position liable to be siphoned or rendered ineffectual by air pressure, shall be protected therefrom by a properly constructed vent pipe satisfactory to the Board of Health. The use of a single trap, if efficient, may be permitted for two adjoining fixtures consisting of two sinks, two sets of wash trays, a wash bowl or bath tub, or one set of wash trays and sink. The outlet from each fixture shall enter the trap separately. All traps shall be easily accessible and provided with a cleaning screw. Traps with covers depending upon putty connec-

tions to make them water or gas tight are prohibited. Every fixture trap, except those for water closets and slop hoppers, shall have a seal of at least three inches. Round traps shall not be less than four inches in diameter and eight inches long and made of eight-pound lead. Where alterations or additions are made, if the traps already in- stalled lack a two inch seal, new traps shall be installed with the required seals, unless the old ones are back- vented. In case of fixtures situated in a position where the traps are subject to siphonage or back-pressure, a special back-air pipe shall be installed subject to the ap- proval of the Board of Health. All water closets except those situated as an upper fixture shall be provided with a relief pipe to prevent siphonage, said pipe to be of two- inch bore if thirty feet or less in length, and shall be increased one diameter for each thirty feet in excess or fraction thereof. The continuation of a soil-pipe stack past an upper water closet or any single isolated fixture, shall be deemed to be trap ventilation.
