City of Newburyport In City Council May 1, 1961
On Ordinance Entitled "An Ordinance to Establish The Office of Inspector of Gas Piping and Gas Appliances in the City of Newburyport". Be it or- dained by the City Council of the City of Newburyport as follows:
Section 1. The Mayor, subject to the confirmation of the City Council shall appoint an Inspector of Gas Piping and Gas Appli- ances who shall hold office for a term of three years and until his successor is appointed, unless sooner removed. He may be re- moved for cause by the Mayor with the approval of a majority of the members of the City Council.
Section 2. It shall be the duty of the inspector of Gas Piping and Gas Appliances to enforce the rules and regulations adopted by the Board established under the provisions of General Laws (Ter.Ed. ) Chapter 25, Section 12H.
Section 3. The Inspector of Gas Piping and Gas Appliances shall receive an annual salary of One Hundred Dollars in full compen- sation for his services.
Section 4. The following schedule of fees is hereby established for inspection services performed by said inspector. Inspection per gas installation .50₺ Inspection per alteration :50€ Minimum inspection charge $1.00

An Ordinance Relating To Field Drivers: Be it ordained by the City Coun- cil of the City of Newburyport as follows:
Section 1. The following schedule of fees is hereby estab- lished for services performed by personsappointed as Field Drivers in the City of Newburyport.
One Dollar for each sheep,goat and other beast taken up by said Field Driver.
One Dollar per day for each sheep, goat and other beast impounded by said Field Driver.
Section 2. Each Field Driver shall maintain a complete
record of all beasts taken up by him and all beasts im- pounded by him which record shall set forth the names of the owners of said beasts and the amount of fees received by him pursuant to this ordinance.
Each Field Driver shall annually make a report in writing to the May r and the City Council of the doings of his office for the preceding year.

CITY SOLICITOR
The Honorable Mayor and Members of the City Council City Hall Newburyport, Massachusetts
Gentlemen:
I submit herewith my annual report as City Solicitor for the year 1961.
During the year 1961 the Law Department rendered opinions to members of the City Council, drafted City Ordinances and Resolutions and attended regular and special meetings of the City Council. On numerous occasions I rendered legal opinions to the School Department, Water Commissioners, Welfare Department, City Auditor, Building In- spector, Board of Health, Planning Board, Board of Appeals and other City departments. In addition, this Department drafted a large num- ber of contracts for the purchase of materials and equipment.
During the year 1961 the City issued Water Bonds in the amount of $210,000.00. I drafted necessary resolutions and documents in connection with this Bond Issue, conferred with representatives of the New England Merchants National Bank of Boston and reviewed per- tinent contract documents covering the work to be performed.
In addition to the Water Department improvements during 1961 the City initiated plans for the construction of an addition to Newburyport High School. In this regard, together with his Honor the Mayor, I attended numerous meetings with the School Committee, School Building Needs Committee and with the Architects. I drafted the necessary contract documents between the City of Newburyport and Desmond and Lord, Inc., for the preparation of preliminary cost stud- ies and reports and preparation of preliminary plans.
During the year 1961 the City instituted legal action to compel the demolition of the brick structure located at 30-36 Moseley Avenue. Legal notices were followed by court action. This case involved sev- eral court appearances and resulted in the Essex County Superior Court ordering the owner of these premises to demolish this building. This department wishes to acknowledge the splendid cooperation it received from Building Inspector Edward A. Hewett in achieving this favorable court ruling.
The program of demolishing other dangerous and dilapidated buildings commenced in 1960 by His Honor the Mayor, the Public Safety Committee and Building Inspector Edward A. Hewett continued during the year 1961. During the year I prepared legal documents and papers re- garding the razing of properties located at 6 School Street, 5, 7, 9, 11, 13 Lime Street, 2 to 4 and 6 to 8 Center Street.
The Law Department investigated all claims brought against the City arising from defective conditions in the public ways and from accidents involving City owned vehicles. Following my investigation of these matters, I submitted my recommendations to the City Council regarding disposition of these claims.
I also processed all claims brought by City employees under the Workmens Compensation Act and forwarded them to the City's Insurance Company and to the Industrial Accident Board.
In addition to the above, I represented the City in court

proceedings in the following cases during 1961:
Board of Health action to abate nuisance resulting from certain decaying matter in the area of Storey Avenue.
Claim for personal injuries resulting from a sidewalk defect brought by Robert W. Russell in the amount of $4,000.00. This case was settled by the City for $750.00.
Land damage petition brought by George P. Poor et ux for damage sustained as a result of a land taking of approximately 16 acres by the City for Water Depart- ment purposes. This action was settled for $18,750.00.
Petition brought by Richard Walsh against the Board of Appeals to set aside a variance granted by the Appeal Board to allow the conduct of a beauty shop in the premises located at 428 Merrimac Street.
I also instituted and finalized proceedings in the Massachusetts Land Court for the purpose of clearing a long existing title defect in the Curtis School Premises, thus allowing the City to carry out the sale of this property.
The City of Newburyport instituted Anti-Trust Proceedings in the United States District Court against ten Companies engaged in selling asphalt oil to the Commonwealth and the various cities and towns in Massachusetts. These actions are based on a theory of price fixing and bid rigging by these companies in the sale of asphalt materials in violation of Anti-Trust Laws. These cases have required my filing voluminous court pleadings and other legal documents in the Federal Court and conferences with Attorney General Edward J. McCormick, Jr. and representatives of other cities and towns involved in these pro- ceedings . At the close of 1961 these cases are still pending before the Court.
At the conclusion of the year 1961 the only other court action pending is a claim brought by Juanita Keplinger for personal injuries alleged to have been sustained from a defective condition in the side- walk on Milk Street.
