This office processed all claims filed by City employees under the Workmen's Compensation law and forwarded these claims to our Workmen's Compensation insurer and to the Industrial Accident Board. In addition, I investigated all claims brought against the City for injuries resulting from street and sidewalk defects and as well as claims arising from accidents in which the City vehicles were involved. I forwarded my recommendations to the City Council concerning settle- ment or other disposition of these matters.
Uron request of the various City departments I prepared contracts, and other legal ropers and rendered written opinions on numerous occasions.
During the year 1960 a survey of dangerous and dilapidated build- ings ves made by the Fublic Safety Committee of the City Council and by the Building Inspector. Legal notices were forwarded to the owners of these buildings directing them to abate these dangerous conditions.
Together with the Mayor I attended several conferences regarding Urban Renewal programs. Upon submission of the required legal docu- ments to the Secretary of the Commonwealth a Certification of Organi- zation vas issued establishing the Newburyport Redevelopment Authority for the purpose of carrying out urban renewal, land assembly and re- development projects.
During the year 1960 cight tax arpeel cases brought against the Newburyport Board of Assessors were presented for hearing before the Massachusetts Appellate Tax Board. I obtained dismissal in four of these cases. A trial was held in the four remaining cases. In each' case the Tax Board rendered its decision in favor of the Board of Assessors.
Since 1887 when the city acquired the Horton Home property at the corner of North Atkinson and Low Streets, the title to this property was encumbered with certain charitable trust provisions making it impossible for the City to use these premises for other than a poor farm or some similar use. Upon the request of the Mayor I instituted proceedings in the Probate Court to free this property of these restri- ctions. These proceedings resulted in a court decree authorizing a general use of these premises. This decree enabled the City to convey a portion of this property to the Newburyport Housing Authority as the site for an Elderly Housing Development.
During the year 1960 the case of John J. Welch of the City of Newburyport came before the Essex County Superior Court: this action was brought by Mr. Welch as a result of a land taking of approximately 9800 square feet made by the City for the construction of Beacon Avenue Extension. An agreed settlement of this claim was made in the amount

of $3,950.00. This settlement was submitted to and approved by the City Council.
During the year it became necessary for the Building Inspector's Department to apply to the Superior Court for enforcement of a Court order restraining the use of the premises at 376 High Street as a drug store. This property is located in a residential zone. After trial the Superior Court entered a decree permanently enjoining the owners of this property from using these premises for drug store pur- poses. An action brought in the United States District Court by the owners of this property was discontinued before it was reached for trial.
At the end of 1960 two cases are pending against the City of Newburyport. The first is a land damage action brought by George P. Poor and Marion S. Poor resulting from a taking by the City in 1957 of approximately 16 acres of land located near Ferry Road for water department purposes.
The second case pending is a claim for personal injuries brought by Robert W. Russell in the amount of $4,000.00. Mr. Russell suffered injuries when he fell on the sidewalk on Green Street, and he alleges that a defective condition in the sidewalk was the cause of this accident.
