City of Newburyport In City Council February 1, 1960


Ordinance: Be it Ordained by the City Council, City of Newburyport that Chapter 19, Sections (1) and (4) of the Revised Ordinances of 1937 be amended as follows:


Section (1). The first two lines of Section (1) shall be amended to read as follows: "That Police Department of the City shall con- sist of a City Marshal, Two Captains, and (15) Patrolmen" Line (14) of Section (1) shall be amended to read as follows: "for two days off in every seven days" The rest of said section to remain unchang- ed.


Section (4). Lines one and two of Section (4) shall be amended to read as follows: "All members shall be relieved from duty two days out of every seven days, without loss of pay". The fifth sentence of said section shall be amended to read as follows: "In cases of Public Emergency or of any unusual demand for the services of the Police, the City Marshal shall have the authority to prevent any member from taking two days off in seven days, but these days off shall be granted as soon as practicable thereafter". The sixth sentence of said section is hereby deleted.

Be it ordained by the City Council that the Zoning Ordinance of the City of Newburyport, as amended, be hereby amended as follows: The following herein described areas be changed from the present zoning namely, residen- tial and road side to general business.


Area A Consisting of Land on the southerly side of Storey Avenue and the southerly side of High Street commen- cing at the easterly sideline of Route 95 and contin- uing easterly along Storey Avenue and High Street to the southerly property line of land now or formerly of the Val Mar Corp., and said land being contiguous with land of the Newburyport Housing Authority. CHAP. 514


THE COMMONWEALTH OF MASSACHUSETTS


In the Year One Thousand Nine Hundred and Sixty AN ACT Authorizing The City of Newburyport To Make A New Division Of Its Territory Into Six Wards.


Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


SECTION 1. The city of Newburyport may, in December, nineteen hundred and sixty, make a new division of its territory into six wards. Except as otherwise provided herein, the provisions of sections one to five, inclusive, of chapter fifty-four of the General Laws shall be applicable to said new division.


SECTION 2. Any member of the city council who is a candidate for election to said council at the first municipal election following said new division shall, for the purposes of ballot information and of arrangement of names on the ballot under sections forty-one and forty-two, respectively, of said chapter fifty-four, be deemed to be an elected incumbent of and a candidate for re-election to such office.


SECTION 3. This act shall take effect upon its passage.

An Ordinance Relating To The Highland And Old Hill Cemeteries. Be it ordained by the City Council of the City of Newburyport as follows:


Section 1. The following schedule of fees is hereby established for services performed by the City of Newburyport in the Highland and Old Hill Cemeteries of the city.


Digging of graves $35.00 Rental of lowering device and greens $ 5.00


Section 2. Receipts from the above services shall be placed in a special account of the city to be reserved for appropriation by the Mayor and City Council for the care, imporvement, embellishment or enlargement of the public cemeteries of the city.


Section 3. This special account is to be designated "Cemetery Receipts, Reserved".
