GREETINGS :


In the name of the Commonwealth you are required to notify and warn the inhabitants of said Town qualified to vote in town election to meet at their respective polling places on


MONDAY, MARCH 6, 1939


at six o'clock in the forenoon, there and then to bring in their ballots for a Moderator, Town Clerk, three Selectmen, a Treas- urer, a Collector of Taxes, a Surveyor of Highways, a Tree Warden, seven Constables, all for one year.


One Assessor, one member of the School Commitee, one member of the Board of Public Welfare, one member of the Board of Health, one Cemetery Commissioner, one Water Com- missioner, one member of the Park Board, two members of the Planning Board, two Trustees of Public Library, one Commis- sioner of Trust Funds, all for three years.


Also to bring in your "yes" or "no" on the following ques- tion :


"Shall an act passed by the General Court in the year Nine- teen Hundred and Thirty-Eight, entitled, 'An Act to authorize the placing of the office of Chief of Police of the Town of Way- land under the civil service laws,' be accepted ?"


All the foregoing to be voted on the official ballot. The polls will be open at 6:15 o'clock in the forenoon and will remain open continuously until 4:00 in the afternoon, when they shall be closed.


And you are required to notify and warn the inhabitants of said Town qualified to vote in Town affairs to meet at the Town Hall on

at 7 :45 P. M., then and there to act on the following articles.


Article 1. To hear reports of the Town officers, agents and committees, and act thereon.


Article 2. To choose all necessary Town officers, agents and committees not elected by the official ballot.


Article 3. To grant money for necessary Town purposes. See Finance Committee's Report.


Article 4. To see if the Town will authorize the Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than a year in accordance with Sec- tion 17, Chapter 44, General Laws.


The Finance Committee recommends the approval of this article.


Article 5. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for municipal purposes, under authority of, and in accordance with, the provisions of Chapter 49, of the Acts of 1933, as amended by Section 2, Chapter 300, of the Acts of 1935, and as amended by Chapter 281, Acts of 1936, or take any action there- to.


The Finance Committee recommends the approval of this article.


Article 6. To see if the Town will accept the following gift of $44.00 collected by the Ladies' Auxiliary of the Charles H. Alward Post, American Legion, for the purchase and erection of a flag pole at the High School, the money having been turned over to the Town Treasurer by the School Com- mitee.


The Finance Committee recommends the approval of this article, and suggests that the Town Treasurer be directed to gratefully accept the gift.


Article 7. To see if the Town will appropriate $125.00 for general improvement in any of the cemeteries, same to be taken from money in the Town Treasury received from the sale of

Burial Lots in 1938 in accordance with Chapter 114, Section 15, of the General Laws, or do or act.


The Finance Committee recommends the approval of this article.


Article 8. To see if the Town will appropriate for pay- ment of "Water Main Extension Notes maturing in 1939" the sum of $4,500, and appropriate for payment of "Water De- partment Equipment Note maturing in 1939" the sum of $875.30 the entire sum $5,375.30 to be taken from "Water Available Surplus," or do or act.


The Finance Committee recommends the approval of this article.


Article 9. To see if the Town will authorize the appro- priation, by transfer from "Pumping Station 18-inch Well" account, for the payment of "Water Department Equipment Note maturing in 1939," the sum of $624.70, or do or act.


The Finance Committee recommends the approval of this article.


Article 10. To see if the Town will appropriate for pay- ment of interest due in 1939 on "Water Extension Notes" and "Water Department Equipment Notes" the sum of $1,002.50, same to be taken from "Water Available Surplus," or do or act.

Article 11. To see if the Town will appropriate for "Water Department Maintenance" the sum of $5,554.34 to be taken from "Water Available Surplus," or do or act.

The Finance Committee recommends the approval of this article.


Article 13. To see if the Town will appropriate and assess a sum of money, and transfer other monies from available funds for the reconstruction and improvement of Chapter 90 roads, said money to be used in conjunction with any money which may be allotted by the State and County, or both, for this purpose, or do or act.


The Finance Committee understands that Old Connecticut Path is to be approved as a Chapter 90 road and that the work will be done on the road this year.


The Finance Committee recommends that the sum of $2,000 be appropriated and assessed, and that there be appropriated and transferred from "Chapter 90, 1938 Construction, Concord Road" $848.02 and from "Chapter 90 Construction, 1938" $350, all of said monies to be used for "Chapter 90 Construction" in conjunction with any money which may be allotted by the County or State, or both.


Article 14. To see if the Town will appropriate and assess a sum of money to be used under the direction of the Selectmen

in connection with WPA, and, whether in connection therewith, the Town will transfer other money from available funds to meet any of the appropriation, or do or act.


The Finance Committee feels that the WPA work now contemplated for this year can be carried out through a total expenditure of about $17,000 and since $896.65 is available for use on WPA, an appropriation of $16,000 appears adequate.


The Finance Committee therefore recommends that there be appropriated and assessed the sum of $16,000, and that there be transferred from "Reeves Hill Road to Standpipe" account $896.65, the entire sum, 16,896.65, to be used as the Town's share on WPA projects under the direction of the Selectmen.


Article 15. To see if the Town will extend a six-inch water main with four hydrants, gates and fittings along Rice Road, be- ginning at Commonwealth Road, for a distance of 3,000 feet, at an estimated cost of $4,000 to the Town, labor to be supplied by the Federal Government under a Federal Project.


Substantially this same article came before the Annual Town Meeting in 1936, 1937 and 1938, and each time was not approved by the Meeting. As prev- iously reported to the Town by the Finance Committee, the Town's share of the cost, even though the work were done as a WPA project, would be far in excess of the amount estimated in this article. In addition to the cost of pipe, there would be a large expenditure for blasting, removal of rock and back filling of trench with gravel, the best estimate obtained for which would bring the cost to the Town to something over $8,000. Furthermore, the Water Board would require the in- stallation of at least eight-inch pipe in this location, which would involve a still greater expense to the Town. There are fourteen houses on this piece of road, and provided each house were connected to the main, the total posible income would not amount to $100. This would represent a return of 1%, or less, on the Town's investment.


The Finance Committee therefore does not recom- mend the approval of this article.


Article 16. To see if the Town will vote to appropriate a

sum of money for a water main on Rice Road from Old Con- necticut Path to Commonwealth Road.


The work here requested includes the line covered by the previous article, and, in addition, calls for a fur- ther extension of about 11,000 feet. This article was submitted without any estimate of cost or of method by which the work should be done. However, an estimate obtained indicates that the cost of pipe and fittings alone would be about $18,900. If the work were car- ried through as a WPA project, there would be very substantial additional costs to the Town for trucking, blasting and gravel back fill. And if the work were done entirely at the Town's expense, the further cost for installation would probably be from $15,000 to $20,000. The expense involved seems to the Finance Committee prohibitive.


The Finance Committee therefore does not recom- mend the approval of this article.


Article 17. To see if the Town will vote to appropriate a sum of money for a resurface and tar finish on Rice Road from Old Connecticut Path to Commonwealth Road.


This article, like the next previous one, was sub- mitted without any estimate as to cost. Since this road is about 14,000 feet in length, it is self-evident that the cost of the work here asked is out of all proportion to the total amount of money appropriated for all high- way purposes in the Town.


The Finance Committee therefore does not recom- mend the approval of this article.


Article 18. To see if the Town will appropriate and assess the sum of $250.00 to replace approximately 200 feet of fencing at the North Cemetery, which was destroyed in the September hurricane, or do or act.


The Finance Committee understands that the fence at the North Cemetery was demolished by the hurricane, and feels that this request by the Cemetery Commissioners is a reasonable one.


The Finance Committee recommends the approval of this article.


Article 19. To see if the Town will vote to appropriate

and assess the sum of $2,657.23 for the purpose of meeting the assessments for the Middlesex County Tuberculosis Hospital made on the Town for its share of the expense involved.


(1) $1,000 for principal of Funding Loan, Acts of 1932 bonds maturing in 1939, issued in compliance with Chapter 10, Acts of 1932.


(2) $148.75 for cost and interest of Funding Loan, Acts of 1932 bonds maturing in 1939, issued in compliance with Chapter 10, Acts of 1932.


(3) $1,508.48 for net cost of care, maintenance and repairs of the Hospital, including interest on temporary notes issued therefor, in accordance with sections of Chapter 111 of the General Laws applicable thereto, including Chapter 400, Section 25 G (6) (a) of the Acts of 1936, or do or act.


These items are in the nature of an assessment by the County. The appropriation is thus compulsory.


The Finance Committee recommends the approval of this article.


Article 20. To see if the Town will vote to authorize the appointment of a committee for the purpose of considering and reporting upon the advisability of adopting the Junior High School Plan as a branch of the present High School System, in- cluding the space necessary therefor and approximate cost there- of, and to appropriate and assess a sum of money to be expended by said committee to obtain necessary advice, and for the ex- penses thereof, or do or act.


The present growth in school population will in- volve within a relatively short time certain changes or additions in school plant facilities. The solution of this problem needs careful thought and study. Considera- tion of the problem should be placed in the hands of a special committee for report to the Town at a future Annual Meeting.


The Finance Committee therefore recommends the appointment of a committee of five ; one member from the School Committee, one member from the Board of Selectmen, one member from the Planning Board, one member from the Finance Committee, the fifth mem- ber to be chosen by the four members recommended above, said Committee to report at a future Annual Town Meeting. The Finance Committee further rec-

ommends that there be appropriated the sum of $200 for the expenses of this committee.


Article 21. To see if the Town will vote to raise and ap- propriate a sum of money not to exceed $15,200 for the repair and renovation of the basements of the Grammar Schools in Cochituate and Wayland Center, and for the installation of coverings over the areaways at the Center Grammar School, or do or act.


No expenditure for repairs to town buildings can be financed by borrowing, but must be made from cur- rent appropriations. Figures presented by the School Committee to the Finance Committee showed an esti- mated expenditure of about $14,500 under this article, $5,500 to be spent in the Cochituate School and $9,000 in the Center School. On the basis of this estimate, the cost of doing all of the work included would mean about $2.65 per thousand on the tax rate. Much of this expense is for the construction of new pupils' toilets in both schools, an expenditure which the Finance Committee feels should be postponed due to the fact that it will involve a substantial increase in the tax rate. After viewing both buildings, the Finance Committee is of the opinion that the situation at Co- chituate could be greatly improved if the toilet rooms were painted and new lighting provided. In addition, a new fixture should be installed in the upstairs toilet. In the Center School, there are certain alterations in- cluded in the work contemplated under this article which were requested by the Inspector of the State Department of Public Safety. The cost of doing the work in both schools, which appears to be of present necessity, would be, on the basis of the School Com- mittee's estimate, about $1,500.


The Finance Committee therefore recommends that there be appropriated and assessed under this article the sum of $1,500.


Article 22. To see if the Town will vote to accept as a public town way under the Betterment Act the way known as Lake Road, situated in Lakewood development so called, in that part of the Town known as Cochituate, as laid out by the Board of Selectmen, and shown on a plan or plans on file with the Town Clerk : to authorize the Board of Selectmen to acquire

any necessary land by eminent domain, purchase, or otherwise : and to appropriate and assess a sum of money to cover the ac- quisition of such land and the construction of said public town way, or do or act.


This article is similar to one which came before the Annual Meeting last year. It is for work to be done on a street which leads south, toward Lake Co- chituate off West Plain Street, and on which there has been a desirable development in the past few years, with the result that there are now sixteen houses with an assessed value of about $21,500. As outlined last year, the road is 1,350 feet in length, has never been surfaced, and suffers from overflow of surface drain- age from West Plain Street. A WPA project is con- templated by which a drainage system will be installed to take care of Lake Road itself, and to remove a bad drainage condition for a considerable distance along West Plain Street. In connection with acceptance, no takings or land damages are involved, hearings have been held, legal requirements met. and the abutters have agreed in writing to have the work done under the Betterment Act, under which they will assume a share of the cost. An adequate roadway, with oiled top, can be constructed at an estimated cost of about $1,600. As a part of what it is hoped will be an or- derly program for street development in the Town, the Finance Committee feels that the work should be done.


The Finance Committee therefore recommends the approval of this article and the appropriation of $1,600 for the construction of the street as a town way.


Article 23. To see if the Town will vote to accept as a public town way under the Betterment Act the ways known as High Street and Brackett Road, situated in that part of the Town known as Wayland Center, as laid out by order of the Board of Selectmen, and shown on a plan or plans on file with the Town Clerk : to authorize the Board of Selectmen to ac- quire any necessary land by right of eminent domain, purchase, or otherwise, and to appropriate and assess a sum of money to cover the acquisition of such land and the construction of said public town ways, or do or act.


This article in various forms came before the An- nual Meeting in 1937 and in 1938. At that time, the

Finance Committee advised against any expenditure of money until such time as these roads were ready for acceptance. The Finance Committee has been in- formed that since then, the abutters have agreed in writing to have the work done under the Betterment Act, that no takings or land damages are involved, that hearings have been held, and necessary requirements met. These roads are off Millbrook Road on Nob Hill. The roadway involved is on High Street and on Brackett Road, and a satisfactory road with oil top and adequate drainage can be built at an estimated cost of $1,700. The roads have opened up one of the Town's better real estate developments, the abutting properties now having an assessed value of about $56,000. The Finance Committee feels that this is a worthy project, approximately half the cost of which will be reimbursed to the Town.


The Finance Committee therefore recommends the approval of this article and the appropriation of $1,700 for the construction of these roads as town ways.


Article 24. To see if the Town will vote to appropriate and assess a sum of money for the installation of a six-inch water main on Lakeview Road, at the same time to install two hydrants, place to be determined by Chief Harrington. The distance is approximately 1,000 feet.


Lakeview Road is not an accepted street, and since it is no longer possible to do this type of work as a WPA project on private ways, the Finance Committee feels that the work should be done only in connection with the acceptance of the road by the Town. Until such time as steps are taken by the abutters to present the road for acceptance, the Finance Committee is of the opinion that the substitution of six-inch pipe for the two-inch pipe now in the street serving the abutters should be postponed, particularly in view of the fact that if now done, the work would be entirely at the Town's expense, and would cost about $2,000.


The Finance Committee therefore does not recom- mend the approval of this article.


Article 25. To see if the Town will vote to amend the existing zoning by-law, Section IX, Paragraphs E and F so as

to increase the present minimum lot size from 10,000 sq. ft. to not exceeding 40,000 sq. ft. and/or the present minimum lot frontage from 80 feet to not exceeding 150 feet in certain areas of the Town as recommended in a report of the Planning Board and as shown on a plan prepared by said Board on file with the Town Clerk, or take all or any part of the action recommended, or act in any manner thereon.


The Finance Committee understands that the recommendations in connection with this article affects only such portions of the Town as have not yet been fully developed.


The Finance Committee recommends the approval of this article.


Article 26. To see if the Town will vote to amend Section V, Paragraph C of the existing zoning by-law as it relates to conducting a tea room in single residence districts according to the recommendations contained in a report of the Planning Board on file with the Town Clerk, or act in any manner there- on.


The Finance Committee recommends the approval of this article.


Article 27. To see if the Town will appropriate for "Road Machinery Account" a sum of money, the money to be taken from "Road Machinery Fund," or do or act.


The "Road Machinery Account" was set up to provide for the maintenance of road equipment when in use on either Chapter 90 Maintenance or New Con- struction work. The Finance Committee feels that $800 will be sufficient for this purpose in connection with the work to be done in 1939.


The Finance Committee therefore recommends that there be appropriated for "Road Machinery Ac- count" for use on equipment maintenance only, the sum of $800, this amount to be transferred from "Road Machinery Fund."


Article 28. To see if the Town will authorize the Board of Selectmen to make such agreements in behalf of the Town with the Metropolitan District Commission as may to them seem necessary or proper and for the welfare of the Town in con- nection with the proposed new viaduct or pressure aqueduct to be constructed by said commission in the Town of Wayland, in-

cluding, without otherwise limiting their authority, the right to make agreements in regard to rights of way for highway pur- poses or otherwise and the right to call upon the Highway Sur- veyor to do such work as may be needed to make any such way suitable for public use, and the right to permit the use of any land owned by the Town in exchange for such privileges over land controlled by said Commission as may be agreed upon by the two Boards, or otherwise do or act.


The pressure aqueduct which is to be constructed by the Metropolitan District Commission through a considerable portion of the Town will involve changes in location of rights of way and water lines and make necessary certain negotiations in connection therewith. The Finance Committee feels that the Selectmen should be empowered to make such agreements with the Met- ropolitan District Commission as may be necessary. Since the Metropolitan District Commission, alone, will be the cause of such changes as may be made, the en- tire costs should be borne by the Commission, and the Town put to no expense.


The Finance Committee therefore recommends that the Board of Selectmen be authorized to make such agreements in behalf of the Town with the Metropoli- tan District Commission as may to them seem necessary or proper and for the welfare of the Town in connec- tion with the proposed pressure aqueduct to be con- structed by said Commission in the Town of Wayland, including the right to make agreements in regard to rights of way for highway purposes or otherwise and the right to permit the use of any land owned by the Town in exchange for such privileges over land con- trolled by said Commission as may be agreed upon by the two Boards and that the cost, if any, involved in such agreement be borne by the Metropolitan District Commission.
