Voted that the Town appropriate and assess the sum of $3,500 for the purpose of installing a new sewage disposal sys- tem at the Cochituate School, the work to be done as private contract on the basis of the plans and specifications already ob- tained by the Planning Board, the entire sum to be expended under the supervision of the School Committee.


Article 45. To see if the Town will appropriate and assess a sum of money for sanitary and surface drainage purposes, including the expense of land damages, if any, and authorize the Selectmen to take by eminent domain, or otherwise acquire, any such land or easements as may be necessary or proper in connection therewith, or do or act.


Voted that the Town construct a surface water drainage system for that portion of Cochituate located south of West Plain Street and east of Main Street as per plans on file with the Selectmen, and that the sum of $1,500 be allocated for this purpose including the cost of the eminent domain taking under Article 43 from the general WPA funds provided in Article 15, the work to be done as a WPA project, with the qualification that in the event that the work has not been started by August 1, 1938, or for any reason suspended prior to September 15, 1938, the Highway Surveyor, with the approval of the Board of Selectmen, be authorized and directed to let out the work at private contract at an expense not exceeding $2,500.


Article 46. To see if the Town will vote to amend the

By-laws by adding at the end of Article 4 a new section to be numbered Section 7, as hereinafter set forth, or do or act:


"Section 7. (a) The Collector of Taxes shall collect, under the title "Town Collector," all accounts due the Town, except income or principal of trust funds.


(b) If the Collector deems it advisable that suit should be brought on behalf of the Town for the establishment or col- lection of any account due the Town, he shall so notify the Selectmen, and he shall report to them semi-annually, and at such other times as they may direct, upon all uncollected accounts in his hands. The Selectmen shall take such action with respect to all such accounts as they deem expedient and consistent with the best interests of the Town."


Voted that the Town Treasurer, Tax Collector and Town Counsel be added to the membership of the present special com- mittee investigating the advisability of amending the by-laws to provide for a Town Collector, and that the committee as then constituted proceed with its study, draft an amendment to the by-laws and work out the details of the set-up, and transfer from the present system, and report at the next annual town meeting.


Article 47. To see if the Town will appropriate and assess the sum of $850.00 to purchase a truck for the Highway De- partment, or do or act.

Article 48. To see if the Town will authorize the Sur- veyor of Highways, with the approval of the Board of Select- men, to sell, trade, or otherwise dispose of the 1934 Ford 11/2 ton truck, or do or act.

Article 49. To see if the Town will appropriate and assess the sum of two hundred fifty ($250) dollars to erect a dam and screen at the outlet of Dudley Pond, or do or act.

Article 50. To see if the Town will appropriate and assess the sum of $370.00 to pay 1934, 1935 and 1936 bills presented by the Estate of Dr. Earle F. Prior, for services rendered wel- fare patients, or do or act.

Voted that there be a committee of three appointed com- posed of one member of the Welfare Board selected by the Wel- fare Board, one Selectman chosen by the Board of Selectmen and the Town Counsel with authority to make such adjustment, if any, as it finds proper in connection with the unpaid 1934, 1935 and 1936 bills presented by the Estate of Dr. Earle F. Prior, any money necessary to be taken from the general welfare budget appropriation.


Article 51. To see if the Town will appropriate a sum not exceeding two hundred ($200) dollars for repairs on High Street and Brackett Road.

Article 52. To see if the Town will authorize the Moth Superintendent, with the approval of the Board of Selectmen, to sell, trade, or otherwise dispose of the present tree spraying equipment.

VOTES ENACTED AT THE SPECIAL TOWN MEETING, DECEMBER 14, 1938


Town Clerk's Office. Wayland, Massachusetts. December 14, 1938.


Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and owing to the absence of the Moderator the Town Clerk called the meeting to order. Mr. J. Fred Wheeler was elected Temporary Moderator.


Article 1. To see if the Town will vote to raise and appropriate or transfer from available funds a sum of money for the removal of tree stumps left along the highways after the recent hurricane, the work to be done under the supervision of the Selectmen, or do or act.


Voted that the Town appropriate the sum of $1,000 for the removal of tree stumps left along the highways after the recent hurricane, the work, after receipt of competitive bids, to be let out by the Tree Warden, with the approval of the Selectmen, and that to meet this appropriation the sum of $1,000 be trans- ferred to Tree Warden from Available Surplus Revenue.


Article 2. To see if the Town will vote to authorize the Park Board, the Highway Surveyor and the Cemetery Commis- sioners, with the approval of the Selectmen, to make such dis- position of fallen timber now on town land as a result of the hurricane as in their judgment seems best, or do or act.

Voted unanimously that the Town appropriate the sum of $1,000 for snow removal, and that to meet the appropriation, the sum of $1,000 be transferred from Avaliable Surplus Revenue.


Article 6. To see if the Town will vote to abolish the office of Highway Surveyor, said vote to take effect at the next Annual Town Meeting, and authorize the Board of Selectmen to appoint a Superintendent of Streets, or do or act.

Article 7. To see if the Town will accept Section 3 of Chapter 143 of the General Laws and or Sections 6 and the six following sections to permit the adoption of building laws and the appointment by the Selectmen of an inspector of buildings, all as provided in said statutes, or do or act.


Voted that the Town adopt Section 3 of Chapter 143 of the General Laws, and that a committee of three be appointed, the committee to be composed of one member of the Board of Se- lectmen to be designated by the Board, one member of the Plan- ning Board to be designated by that Board, and the Chief of the Fire Department, this committee to draft a set of simple build- ing by-laws and make its recommendations at the next Annual Town Meeting.


Voted to dissolve the meeting 9:30 P. M.

Question No. 1 .- Proposed Amendment to Constitution


Shall an amendment to the Constitution providing for bien- nial sessions of the General Court and for a biennial budget which is further described as follows :-


This amendment annuls all existing provisions of the Con- stitution and its prior amendments which require annual sessions of the General Court, commonly known as the Legislature, and provides for biennial sessions in their place. It also provides that the budget of all proposed expenditures of the Common- wealth shall be so prepared as to cover two fiscal years instead of only one as at present required,-which proposed amendment was approved by the General Court and in a joint session of the two branches held May 27, 1936, received 141 votes in the af- firmative and 117 in the negative, and in a joint session of the two branches held May 19, 1937, received 158 votes in the af- firmative and 112 in the negative,-be approved ?

Question No. 2 .- Law Proposed by Initiative Petition


Shall the proposed meaure which provides that in any city or town which accepts its terms, the licensing authorities shall establish free public taxicab stands for the use of all taxicabs and motor vehicles for hire whose owners are licensed within such city or town, and shall abolish all other forms of taxicab stands on any public highway within such city and town,-which was disapproved in the House of Representatives by a vote of 96 in the affirmative and 109 in the negative and in the Senate by a vote of 4 in the affirmative and 35 in the negative,-be ap- proved ?

To obtain a full expression of opinion, voters should vote on all three of the following questions :-


(a) If a voter desires to permit the sale in this city (or town) of any and all alcoholic beverages to be drunk on and off the premises where sold, he will vote "YES" on all three ques- tions.


(b) If he desires to permit the sale herein of wines and malt beverages only to be drunk on and off the premises where sold, he will vote "NO" on question one, "YES" on question two and "NO" on question three.


(c) If he desires to permit the sale herein of all alcoholic beverages but only in packages, so called, not to be drunk on the premises where sold, he will vote "NO" on questions one and two and "YES" on question three.


(d) If he desires to permit the sale herein of wines and malt beverages to be drung on and off the premises where sold and in addition other alcoholic beverages but only in packages, so called, not to be drunk on the premises where sold, he will vote "NO" on question one and "YES" on questions two and three.


(e) If he desires to prohobit the sale herein of any and all alcoholic beverages whether to be drunk on or off the premises where sold, he will vote "NO" on all three questions.
