Article 31. To determine whether the Town will vote to amend its By-Laws by adding a new section as follows: "No person shall construct, reconstruct, or alter the con- nection of any private driveway or road with any public way until he has obtained a permit therefor from the Super- intendent of Streets. The application for such a permit shall be submitted on a form prescribed by the Selectmen and shall be accompanied by a plan of the proposed drive- way connection showing elevations of the proposed driveway in sufficient detail to permit the Superintendent of Streets to determine the drainage characteristics thereof, and the effect, if any, of such proposed connection upon the ex- isting surface drainage of the travelled way. The pro-


posed connection shall be designed so as not to interfere with the existing drainage of the public way nor to dump excessive additional surface water on the travelled way, nor to serve as a drain for the existing way except in so far as alteration of the existing drainage pattern is de- sirable as determined by the Superintendent of Streets with such engineering advice as he may deem necessary. The Superintendent of Streets shall, upon notification from the permittee that the work upon the proposed connection is complete, inspect the condition of the connection. In the event that the Superintendent determines that the work has not been satisfactorily completed he shall furnish written notice to the permittee stating the particulars in which the work is unsatisfactory, and demanding that the necessary corrective measures be taken within sixty (60)


days of the receipt of such notice. The Superintendent of Streets may likewise be permitted to give written no- tice to the permittee at any time that he may find that as a result of work on the proposed connection an unsafe con- dition exists or a condition which, if not corrected, will cause or permit damage to the pavement or drainage system of the public road, and to set in such notice a time, rea- sonable in relation to the hazard, within which the con- dition shall be corrected. In the event that the permit- tee does not take or cause to be taken the necessary cor- rective measures within the stated time, the Town may cause such measures to be taken at the expense of the permittee. Where a driveway is used for access to a construction site, the final inspection of the work by the Superintendent of Streets shall not be made until the construction is com- plete. Each permit granted by the Superintendent of Streets pursuant to the provisions of this by-law shall re- quire that the work permitted to be done thereunder shall be commenced not later than sixty (60) days after the date of the permit and shall be completed as soon as practicable thereafter. Each applicant for a permit issued under this

by-law shall pay a fee of $1.00 to the Town upon sub- mission of his application". VOTED : To amend Article 11 of its By-Laws, by


adding a new Section 3 (c), as follows: "Any person in- tending to construct, reconstruct, or alter the connection of any private driveway or road with any public way shall give written notice of such intent to the Board of Select- men. The Selectmen shall cause an inspection of the lo- cation of the connection to be made. If, in their judg- ment, the proposed work may reduce the safety of pedestrian or vehicular traffic on the public way or alter the drain- age of the public way in an undesirable manner or affect the integrity of pavement or shoulders, they may require that said person present plans showing the proposed con- nection in sufficient detail to permit the Selectmen to determine the adequacy of the proposed connection from the point of view of safety, drainage and construction. No driveway shall be constructed in such a way as to interfere with the normal flow of traffic or the drainage on any pub-


lic way. Upon completion of such work affecting entry on to a public way, the Selectmen may cause an inspection to


be made. In the event that said connection has been so constructed that there exists an unsafe condition or a condition which, if not corrected, might cause or permit damage to the pavement or drainage system of the public road, they may give written notice to the owner of the property setting in such notice a time, reasonable in re- lation to the hazard, within which the condition shall be corrected. In the event that the owner does not take or cause to be taken the necessary corrective measures within the stated time, the Town may cause such measures to be taken at the expense of the owner."


Article 32. To determine whether the Town will vote to amend its By-Laws by adding a new section, as follows: "Section 1: No motor boat shall be operated upon any por- tion of the Concord River or its tributaries or of any in- land lake other than Walden Pond lying within the town in a manner which endangers the safety of the public or is detrimental or injurious to the neighborhood or to the value of property thereon. Section 2: It shall be prima facie evidence of the violation of this by-law if such boat is operated by a motor not having an underwater exhaust, or in a noisy or obnoxious manner, or at any un- reasonable rate of speed, or without slowing down and ex- ercising due caution while approaching and passing persons bathing or any other watercraft, or at any speed in excess of ten miles per hour. Section 3: Any person violating any provision of this by-law shall be subject to a fine not

exceeding $20.00 for each offense. Section 4: The town may join with any other town through which said Concord River or any of its tributaries flows in the enforcement of this by-law or a similar by-law adopted by such other town insofar as such by-laws relate to said river or its tributaries, and may appropriate money for the enforcement in whole or in part of any and all such by-laws. VOTED : That the Town amend its By-Laws by add- ing a section 9 to Article 11, as follows : (a) No motor- boat shall be operated upon any portion of the Concord River or its tributaries or of any inland lake or pond ly- ing within the Town in a manner which endangers the safety of the public or is detrimental or injurious to the neigh- borhood or to the value of the property thereon. SPECIAL TOWN MEETING June 4, 1962


In accordance with a Warrant duly served, the Meeting was called to order at 7:35 P. M., by the Moderator, Mr. Charles Y. Wadsworth. The Return of the Warrant was read, and the invocation was given by Rev. Morris R. Robinson. A quorum being present, the following business was trans- acted :


Article 1. To see if the Town will vote to acquire in fee for school purposes by eminent domain, purchase, or any other way, a certain parcel of land now or formerly of Sandy Pond Trust and formerly of Sumner Smith, located on the southwesterly side of Sandy Pond Road and other land now or formerly of Sandy Pond Trust and formerly of Sumner Smith, between land now of Rouner, and land now of Emmons, and land now of the Town of Lincoln, and land now or for- merly of Eleanor M. Palmer, for the use of schools, con- taining 15 acres, more or less, raise and appropriate a sum of money therefor, or take any action relative thereto. VOTED : That the Selectmen be, and they hereby are, authorized and empowered in the name and on behalf of the Town to acquire in fee by eminent domain, purchase, or any other way, for school purposes, a certain parcel of land in Lincoln, Massachusetts, on the southwesterly side

Easement; and that there be and there is hereby appropriated for this purpose the sum of fifty- one thousand dollars ($51,000), and to meet said appropria- tion that the sum of one thousand dollars ($1,000) be raised and appropriated from available funds in the Treas- ury, and that the Treasurer, with the approval of the Se- lectmen, be and hereby is authorized to borrow the sum of fifty thousand dollars ($50,000), and to issue bonds or notes of the Town therefor under Chapter 645 of the Acts of 1948, as amended.


Article 2. To see if the Town will vote to acquire in fee for school purposes by eminent domain, purchase, or any other way, a certain parcel of land south and west of the Tennessee Natural Gas pipe now or formerly of Eleanor M. Palmer, bounded by land now of A. Bradlee Emmons and land now of the Town of Lincoln, and land now of Sandy Pond Trust and formerly of Sumner Smith, containing 1.3 acres, more or less, raise and appropriate a sum of money there- for, or take any action relative thereto. VOTED : That the Selectmen be and they hereby are authorized and empowered in the name and on behalf of the Town to acquire in fee by eminent domain, purchase, or

Emmons, situated to the south and west of the Tennessee Natural Gas Pipe between land now or former- ly of the Sandy Pond Trust and formerly of Sumner Smith and land now or formerly of Eleanor Palmer, containing 0.3 acres, more or less; raise and appropriate a sum of money therefor, or take any action relative thereto. VOTED : That the Selectmen be and they hereby are authorized and empowered in the name and on behalf of the Town to acquire in fee by eminent domain, purchase, or any other way, for school purposes, a certain parcel of land in Lincoln, Massachusetts, containing thirty-five hun- dredths (0.35) of an acre, more or less, as shown on a plan entitled "Plan of Land in Lincoln, Massachusetts, to be conveyed to the Town of Lincoln, Massachusetts", dated June, 1962, Rowland H. Article 4. To determine whether the Town will vote to extend the business zoned area to include the new build- ing site of the American Legion that parallels the rail- road track on the N. E. side and to the S. E. side of Lin- coln Road, in order to expedite the erection of a new, larger, more attractive and costly legion home.


VOTED : A motion "to determine whether the town will vote to extend the B-1 (business) district along the railroad track a distance of 350 feet by 1 foot wide to the American Legion Post #84 lot, then expanding to in- clude the Legion lot, containing approximately 23,000 square feet, which parallels the railroad track 156.9 feet in a S. E. direction; thence turning and running in a N.E. direction 143.09 feet; thence in a N. W. direction 113.51 feet to Ridge Road; thence running along Ridge Road in a westerly direction 100.82 feet; thence bearing slightly in a southerly direction 60.76 feet to the point of begin- ning" was lost.


Article 5. To determine whether the Town will vote to raise and appropriate from taxation, borrowing, the Stabilization Fund established pursuant to the vote of the Town under Article 23 of the Annual Meeting on March 16, 1959, available funds, or any combination thereof, a sum of money sufficient to construct and originally equip and furnish elementary school buildings and facilities on the site of the Smith and Hartwell Schools or on the site of land acquired pursuant to other Articles of this Warrant, or take any action relative thereto.


VOTED : That the sum of $900,000 be raised and appropriated for the purpose of constructing and original- ly equipping and furnishing elementary school buildings and appurtenant facilities on the site of the Smith and Hartwell Schools and on the site of land acquired pursuant to other Articles of this Warrant; that to meet said appro- priation: (a) the sum of $100,000 shall be transferred and expended from the Stabilization Fund established pursuant to the vote of the Town under Article 23 of the Annual Town Meeting on March 16, 1959; (b) the Treasurer, with the approval of the Selectmen, be and he hereby is author- ized, at one time or from time to time, to borrow the sum

of $700,000, and to issue bonds or notes of the Town there- for, under the authority of and in accordance with the pro- visions of Chapter 645 of the Acts of 1948, as amended and supplemented, and the bonds or notes of such issue or issues shall be payable in accordance with Chapter 44 of the General Laws (Ter. Ed. ), so that each issue of said bonds or notes shall be paid in not more than twenty (20) years from the date thereof, and shall bear such date, and shall be sold in such manner (except as herein or by law otherwise provided) as shall be determined by the Town Treasurer, with the approval of the Selectmen; (c) the committee appointed by the Moderator in accordance with the vote under Article 27 at the Annual Meeting on March 21, 1961, is hereby continued, and is hereby authorized and empowered to enter into contracts and do or cause to be done all things necessary or desirable to construct and originally equip and furnish said elementary school build- ings and appurtenant facilities, and is hereby authorized and directed to apply to the School Building Assistance Commission of the Commonwealth of Massachusetts for a school construction grant under Section 7 of Chapter 645 of the Acts of 1948, as amended and supplemented, and the portion of said grant representing an accelerated matching payment under Chapter 591 of the Acts of 1959, as amended by Chapter 377 of the Acts of 1961 (estimated to be $100,000), when received, shall be used to meet to that extent the aforesaid appropriation.
