GOVERNMENTAL AND ADMINISTRATION CHANGES


ARTICLE 17. (At the request of the Planning Board) To see if the Town will vote to adopt Chapter 211 of the Acts of 1936 now General Laws (Ter. Ed.) Chapter 41, Sections 70 to 81J inclusive which is entitled "An Act providing an improved method of Municipal Planning" and which re-establishes the Planning Board, or take any other action in relation thereto.


ARTICLE 18. (At the request of the Planning Board) To see if the Town will adopt the following regulation as an amendment to the Town By-Laws; "When the Town has accepted a street and immediately enters thereon for the purpose of constructing said street, then the Town shall not be responsible for nor install any wall or other method of holding the land of the abutters in place where the proposed construction will result in a cut not exceeding 4 ft. in mean average height above the center grade of the proposed street," or take any other action in relation. thereto.

ARTICLE 19. (At the request of the Planning Board) To see if the Town will adopt the following regulations as an amendment to the Town By-Laws or take any other action in relation thereto.


Section 607A. No new license of any building, structure or land for the keeping, storage, manufacture or sale for public distribution of any of the articles named in General Laws, (Ter. Ed.) Chapter 148, Section 13, as amended, except fireworks, fire crackers and torpedoes, shall be granted by the Board of Selectmen, as local licensing authority of the Town of Weymouth, until the popula- tion of said Town of Weymouth shall have reached 25,000 persons as determined by the last State or Federal census.


"Section 607B. At the time when the population of said Town of Weymouth as determined by the last State or Federal census, has reached 25.000 persons. then one new license for the keeping, storage, manufacture or sale for public use or public distribution of any of the articles named in General Laws (Ter. Ed.) Chapter 148, Section 13, as amended, except fireworks, firecrackers or torpedoes, may be issued and thereafter, one new license for each additional 3,000 persons in excess of said 25,000 persons.


ARTICLE 20. (At the request of the Zoning Committee) To see what action the Town will take on the report of the Zoning Committee ap- pointed to study the needs and advantages of zoning in the Town of Weymouth, and to see what sum of money the Town will vote to raise and appropriate to continue the work of said Committee.


ARTICLE 21. To see if the Town will vote to instruct its Selectmen to make regulations governing the taking of eels, all kinds of shellfish and sea worms and for issuing permits therefor conformably to the pro- visions of the Acts of 1933, Chapter 329 as amended, or take any other action in relation thereto.


ARTICLE 22. (On petition of Everett E. Callahan) To see what action the Town will take relative to the establishment of a Purchasing Department.


ARTICLE 23. (At the request of the Planning Board) To see if the Town will vote to instruct its Representative and Senator in the Legislature to file a petition requesting legislation sufficient to establish a Licensing Board or Commission, said Board or Commission to consist of the Chief of Police, Chairman of the Board of Selectmen and Chairman of the Planning Board or take any other action in relation thereto.


ARTICLE 24. (By Direction of the Selectmen) To see whether the Town will vote to accept the provisions of Chapter 7 of the Acts of 1938 being "An Act authorizing the Board of Public Welfare of Weymouth to appoint a Welfare Agent, and establishing the powers and duties of said Agent;" or take any other action in relation thereto.


SCHOOLS


ARTICLE 25. (On petition of Arthur E. Heinstrom and others) To see what sum of money the Town will vote to raise or borrow and appro- priate to erect an eight grade school at the site of the present Center School, corner of Washington and Middle Streets and to see if the Town will vote to authorize the Board of Selectmen to take by purchase, gift or eminent domain in fee whatever land may be necessary for this purpose or take any other action in relation thereto.


ARTICLE 26. (On petition of the Committee to whom was referred the question of addition to the Nevin School) To see what sum of money the Town will vote to raise by loan or otherwise, and to appropriate for the purpose of building and equipping an addition to the Nevin School, the same to be used primarily as an assembly hall and gymnasium or take any other action in relation thereto.

ARTICLE 27. (At the request of the Planning Board) To see if the 'Town will vote to authorize the Selectmen to acquire by purchase or take by right of eminent domain in fee or otherwise for the benefit of and . development of the Athens School property and Athens Street Fire Station the whole or any portion of the land situated on Athens Street between the two above named Town properties, and to see what sum of money the Town will vote to raise or borrow and appropriate for the acquisition of said land and building or take any other action in relation thereto.


MISCELLANEOUS


ARTICLE 28. (By Direction of the Selectmen) To see if the Town will vote to raise and appropriate the sum of $600 for the purpose of main- taining during the ensuing year the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931, or take any other action in re- lation thereto.


ARTICLE 29. (By Direction of the Selectmen) To see what sum of money the Town will vote to raise and appropriate to be expended by .the Tree Warden for the removal of dead trees, their replacement with new trees and aerating of the soil in the vicinity of Sea and Athens Streets, North Weymouth, such money to be expended only for the purpose specified or take any other action in relation thereto.


ARTICLE 30. (On petition of Weymouth Post No. 79 of the American Legion) To see what sum of money the Town will vote to raise and appropriate for the observance of Armistice Day, or take any other action in relation thereto. .


ARTICLE 31. (On petition of the Lovell's Corner Men's Social Club) To see if the Town will vote to raise and appropriate the sum of two hundred dollars for the purpose of celebrating the 4th of July 1938 at the Bradford Hawes Playground or take any other action in relation thereto.


ARTICLE 32. (On petition of the Veterans of Foreign Wars) To see if the Town will vote to instruct its Board of Selectmen to contract with Wessagusset Post No. 1399 of the Veterans of Foreign Wars of the United States for the care and maintenance of certain cemeteries in the Town: namely, Old Cemetery off Park Avenue; Old Cemetery opposite Fair- mount Cemetery on Pleasant Street; Old Cemetery on Pleasant Street at Pine Street and one located off Randolph Street, and that the sum of $400 be raised and appropriated to be paid to Wessagusset Post, V. F. W. No. 1399 for said care of these cemeteries, or take any other action in relation thereto.


ARTICLE 33. (On petition of the North Weymouth Cemetery Asso- ciation) To see what sum of money the Town will vote to raise and appropriate for resurfacing with asphalt concrete the driveway from North Street to and surrounding the Soldier's Monument located in the North Weymouth Cemetery or take any other action in relation thereto.


You are further required to notify and warn the inhabitants of Wey- mouth qualified to vote in Town affairs, in case all the articles in the foregoing Warrant shall not have been acted upon at the meeting called for the seventh day of March, to meet in adjourned session at the hall of the Weymouth High School on

ANNUAL TOWN MEETING March 7, 1938


Pursuant to the within warrant the annual meeting of the inhabitants of the town of Weymouth represented by its duly elected and qualified town meeting members, was held at the hall of the Weymouth High School, East Weymouth, on Monday evening, March 7, 1938. 259 town meeting members names being checked by police stationed at the doors for that purpose, out of 322 town meeting members eligible.


The meeting was called to order at 7:48 o'clock in the evening by Daniel L. O'Donnell, annual moderator, who requested the town clerk to read the warrant for the meeting, after reading the call for the meet- ing, on motion of Burgess H. Spinney, it was voted that the further reading of the articles in the warrant be dispensed with. The town clerk then read the paragraph relating to the time of adjournment, and the last three paragraphs of the warrant and the attestation of the constable who served the warrant.


The Moderator then called upon Rev. Ralph F. Sawyer, Jr., pastor of the Porter Methodist Church of Lovell's Corner, East Weymouth, to in- voke the Blessing of the Ruler of the Universe upon the deliberations of this meeting.


Before proceeding to the business of the meeting the following were sworn as Town Meeting Member. Arthur C. Anderson, Roy A. Cass, Harold A. Desmond, Charles A. Dobson, Francis N. Dodge, Forrester Eisenhauer, Ferdinand A. Gosselin, George B. Marden, Leo Mccarthy, William P. Morganstern, Vernon O. Neslon, Hebert B. Shaftoe, Willis M. Wight, Toivo E. Matson.


Mr. Frederick J. Coyle, town meeting member from precinct 3 offered the following petition:


We the representatives of the town people of Weymouth in town meet- ing assembled do hereby petition the United States Government through our duly elected representative, the grant of a Federal Building that would suitably house the Postal facilities of this town. We feel that the con- struction of such a building would not only provide work, be a measure of sound economy, but due to the centralization of the postal business of this town a building on adequate proportions is necessary in order to efficiently serve the people of this community. Having in mind the in- terests of the people as a whole, we feel that the question of the location of such a building should be left in the hands of the postal authorities. Their experts have made a study of the conditions and are therefore better qualified to choose the proper site for such a building. We strongly urge your support of this petition and trust that you will see that this town gets proper recognition.


In the event of the adoption of this petition by the meeting, I move that the Town Moderator be authorized to appoint a committee to further action on said petition.


No action was taken on this petition.


ARTICLE 1


Budget


Mr. John W. Field. Secretary of the Appropriation Committee moved: To provide for the salaries, operation and expenses during the fiscal year of the several Town's departments and activities; for certain improvements, and to meet certain requirements of the law, the several sums hereinafter set forth are hereby appropriated for the several purposes and subject

to the conditions hereinafter set forth, all such sums to be raised by taxation in the levy of the current year unless some other source of revenue is specified.


This motion was unanimously tentatively adopted.


Item 1 Mr. Field moved: For all expenses of the Appropria-


$ 600.00 tion Committee. Of this sum $100. is reserved and is not to be used except in case of a special Town Meeting. This motion was unanimously tentatively adopted.


Item 2 Mr. Field moved: For salaries and expenses of the Selectmen's Department. Of this sum $4,600. shall be for the salaries of the Selectmen to be divided as follows: $900. for the Chairman, $1,600. for the Clerk, and $700. each for the three remaining members of the Board; $200. shall be for miscellaneous expenses; $500. shall be for printing and advertising. This motion was unanimously tentatively adopted.

Item 3 Mr. Field moved: For the salary and all expenses of the Town Accountant's Department. This motion was unanimously tentatively adopted.

Item 4 Mr. Field moved: For the salary of the Town Treasurer and all expenses of the Treasurer's De- partment. Mr. George E. Curtin moved as an amendment the following: That the sum of $125. be added to the Treasurer's Budget for the purchase of a Check Signer. Not a vote.

The motion of the Appropriation Committee was unanimously tentatively adopted.


Item 5 Mr. Field moved: For the compensation of the Tax Collector and all expenses of the Tax Collector's Department.

The compensation of the Tax Collector shall be five and one-half mills on each dollar of taxes collected and the Selectmen shall be authorized to insure the Tax Collector in the sum of $15,000. for Robbery Insurance.


This motion was unanimously tentatively adopted.


Item 6 Mr. Field moved: For the salaries and all expenses of the Assessors' Department. This motion was unanimously tentatively adopted.

Item 7 Mr. Field moved: For the salaries and all expenses of the Legal Department. $3,000.00


Of this sum $100. shall be paid to the Town Counsel for preparing the Annual Town Warrant. This motion was unanimously tentatively adopted.


Item 8 Mr. Field moved: For the payment of Damages. Of this sum $3,000. in addition to $2,000. already set up on the books of the Town shall be paid to the owners of the real estate taken for school purposes in completing the Hunt School grounds. This motion was unanimously tentatively adopted.

Item 13 Mr. Field moved: For the maintenance and upkeep of the Town Hall and War Memorials at the Civic Center including the grounds to be expended under the direction of the Selectmen.

Of this sum $7,578, shall be raised by taxation in the levy of the current year and the remaining $250. is hereby appropriated from the balance remaining unexpended under Article 29 of the Annual Town Warrant of 1937; provided that all toll calls of the Water Department and for the agencies set up under Article 2 shall be paid out of their respective ap- propriations.


Mr. William M. Hughes moved the following two motions:


1st The sum of $1,500. shall be appropriated for improving the heating system of the Town Hall. This sum shall be taken from the reserve Fund.


2nd. That a committee be appointed to consider plans, costs and specifications for improving the system in the Town Hall, consisting of the Ap- propriation Committee, the Custodian of the Town Hall, the Janitor of the Town Hall, Mr. Leslie Clough and Mr. Edward C. Pottle.


This committee shall cause to be placed an article in the town warrant and report at the next town meeting.


This committee shall also file the Engineer's report of cost and specifications in the annual town warrant.


The moderator declared the first motion out of order. The second motion of Mr. Hughes was voted.


The motion as offered by the Appropriation Com- mittee as thus amended was unanimously tentatively adopted.


Item 14 Mr. Field moved: For the maintenance of the Civil War Soldiers' Monument and the King Phillips War Memorial including the grounds; to be expended under the direction of the Selectmen. This motion was unanimously tentatively adopted.

Item 15 For the salaries and all other expenses of the Police Department.


From this sum provision is made for the disposition of one automobile and the purchase of another. This motion was unanimously tentatively adopted.


Item 16 Mr. Field moved: For the salaries and all other expenses of the Fire Department.


The rate of wages and personnel of the permanent men of the Department shall remain as in 1937; $2,400 shall be for the services of call men at the rate of $1.00 per hour; $300. shall be for the rental of church bells as heretofore; $550. for the renewal of old fire alarm boxes; and $1,578. for the maintenance of buildings and grounds. In this aggregate amount $1,300. is provided for the disposition of one auto- mobile and one truck for the fire alarm system and their replacement.


Mr. Melville F. Cate moved as an amendment: That a committee of five (5) of which the Represen- tative and Senator shall be members shall be appoint- ed by the Moderator instructed to petition the Legisla- ture at this session for legislation creating the position of Commissioner of Public Safety and making such position subject to the Civil Service laws and regula- tions and providing that the present Chief of the Police Department may be appointed said Com- missioner cf Public Safety without taking a civil service examination and the Board of Selectmen are hereby instructed not to make any permanent ap- pointments in the position of either Chief of the Fire Department or Chief of the Police Department in the case of any vacancy occurring in either of aforesaid offices until after the enabling legislation to be petitioned for herewith has been finally de- termined.


The amendment of Mr. Cate was declared not a vote. Mr. William T. Wyman moved to amend: By making the sum for the maintenance of buildings and grounds $900. instead of $1,578. This amendment was declared not a vote.


The motion as offered by Mr. Field of the Appro- priation Committee was unanimously tentatively adopted.


Item 17 Mr. Field moved: For the salary and all other expenses of the Building Inspector's Department. Of this sum $45. shall be for the Board of Appeal. This motion was unanimously tentatively adopted.


Item 18 Mr. Field moved: For the salary of the Sealer of Weights and Measures and all other expenses of the Department .. This motion was unanimously tentatively adopted.

Of this sum the following specific appropriations are made: $1,000. shall be for the supplies and services of dentists; $450. for the salaries of the elected mem- bers of the Board; $5,600. for the payments as re- quired to the Norfolk County Tuberculosis Hospital; $1,040. for services of a dental hygienist; $1,700. shall be for maintenance of the Town Dumps and from this amount $1,560 shall be for the dump attendant paid at the rate of 621/2 cents per hour; and the services and expenses of the Plumbing Inspector and for all plumbing inspections shall not exceed $1.500. This motion was unanimously tentatively adopted.

Item 24 Mr. Field moved: For the employment of Nurses. The Board of Selectmen are hereby authorized to contract with the Weymouth Visiting Nurse Associa- tion the services of one or more nurses in case such services are a proper charge against the Town. This motion was unanimously tentatively adopted.

Item 25 Mr. Field moved: For the maintenance of the Norfolk County Tuberculosis Hospital. This motion was unanimously tentatively adopted.

Item 26 Mr. Field moved: For Garbage Removal. The Selectmen are authorized to contract for the disposal of garbage from April 1, 1938 to April 1, 1939; of this total amount $3,500. shall be raised by taxes in the current year and in addition to this sum the Selectmen may use whatever unexpended balance re- mains in the existing appropriation from prior years for the same purpose. This motion was unanimously tentatively adopted.

As the By-Laws require all articles relating to the Budget be finished before any other article can be acted upon the Moderator asked unanimous consent of the meeting to take up Article 24 before Item 27 of the warrant, unanimous consent not being given the Moderator appointed as tellers Carlton Chambers, Edward A. Hunt and Olindo Garofalo and they were sworn to the faithful performance of that duty.
