ARTICLE 8. (On petition of the Board of Water Commissioners). To see what sum of money the Town will vote to appropriate from the Surplus Funds of the Water Department for the purpose of defraying the expenses of the Water Department for the balance of 1950, or take any other action in relation thereto.


ARTICLE 9. (At request of Malcolm T. Shaw and others). To see if the Town will vote to raise and appropriate the sum of $1,000,000.00 for the express purpose of extending the main trunk sewer to Columbian Square and constructing as many laterals from that point as these funds will permit, said funds to be raised by a bond issue extending over a period of twenty-five (25) years.


ARTICLE 10. (By direction of Selectmen). To see what sum of money the Town will vote to raise and appropriate or transfer from nvailable funds for the construction of a check valve at the culvert near No. 113 Pearl Street, or take any other action in relation thereto.


ARTICLE 11. (On petition of Carl A. Zollin and others). To see if the Town will vote to restrict the Board of Health and any other officials from issuing licenses for garbage collection to any individual or concern except the person or persons contracted with the Board of Selectmen for the public collection of garbage in the Town of Weymouth or take any other action in relation thereto.


ARTICLE 12. (By direction of Selectmen). To see if the Town will' vote to accept by gift from George Puopolo land adjacent to his building at the corner of Broad and Middle Street for street purposes, or take any other action in relation thereto.


ARTICLE 13. By direction of Selectmen). To see if the Town will accept the report of the Selectmen the following designated private way and part of way, to wit:


(a) A parcel of land on Vine Street owned by Grace L. Rinaldi or any portion of said way and will authorize the Board of Selectmen to acquire by gift or purchase or take by right of eminent domain in fee or other- wise for all purposes of a public street and highway in and over said street as so laid out and accepted, and to see what sum of money the Town will

vote to raise and appropriate or transfer from available funds for the working of the above named street including the acquisition of the fee above referred to and for the building of any bridges, drains and conduits or securing easements which may be necessary in connection therewith and to see whether the Town will authorize the Board of Selectmen to accept deeds of any reservation strips existing in connection with said street, or take any other action in relation thereto.


You are hereby required to notify and warn said inhabitants of Wey- mouth qualified to vote in Town Affairs, in case all the articles in the foregoing warrant shall not be acted upon at the meeting called for the twentieth day of November, to meet in adjourned session at the hall of the Weymouth High School

SPECIAL TOWN MEETING


November 20, 1950


Pursuant to a Warrant duly issued, the Special Meeting of the in- habitants of the Town of Weymouth, represented by its duly elected and qualified Town Meeting Members, was held in the hall of the Weymouth High School, East Weymouth, Monday, November 20, 1950.


158 Town Meeting Members were present.


The meeting was called to order at 7:50 o'clock in the evening by Mr. Daniel L. O'Donnell, Annual Moderator.


The attested copy of the warrant was read by Town Clerk, Miss Nellie Greaney.


MOVED: That we dispense with the reading of the Articles in the Warrant. SO VOTED UNANIMOUSLY.


Prayer was offered by the Rev. Fr. John N. Donelin, Asst. Pastor of the Immaculate Conception RC Church, East Weymouth, followed by mass recitation of the Lord's Prayer.


There were no new Town Meeting Members to be sworn in.


There being no objection, we now continue with consideration of the Articles in the Warrant.


MOVED:


ARTICLE 1. That the sum of $467,000.00 be. appropriated for the con- struction of a 12 room elementary school on a so-called Pearl Street site, and to purchase necessary equipment for this school. Of this sum $18,000.00 shall be appropriated from available funds, (Excess and Deficiency Fund) and the treasurer, with the approval of the Board of Selectmen, is hereby authorized to borrow a sum of money not to exceed $449.000 and to issue bonds to be payable in accordance with General Laws (Ter.Ed) Chapter 44, Section 19, so that the entire sum shall be payable in not more than fifteen (15) years from date of issue of the first bond. The sums appropriated shall be expended under the direction of the committee of seven appointed in accordance with Article 51 in the warrant for the Annual Town Meeting March 6, 1950

ARTICLE 2. That the Board of Selectmen be authorized to acquire by gift, purchase or take by right of eminent domain for school purposes in fee parts of lots 3, 6 and 7, Block 326, and part of lot 30, Block 371, Sheet 28, as appears in the Atlas of the Town of Weymouth for the year 1949 all in accordance with plan of Russell H. Whiting, Town Engineer, dated October 26, 1950, and that the sum of $11,400.00 be appropriated from available funds (Excess and Deficiency Fund) for this purpose. UNANIMOUSLY ADOPTED.

ARTICLE 3. That the Board of Selectmen be authorized to acquire by gift, purchase or take by right of eminent domain in fee, for school purposes, part of Lot 12, Block 286, Sheet 21 and Lot 19, Block 221, Sheet 17, as appears in the Atlas of the Town of Weymouth for the year 1949, all in accordance with plans of Town Engineer, Russell H. Whiting, dated October 30, 1950; and that the sum of $3,850.00 be appropriated from avail- able sums (Excess and Deficiency Fund) for this purpose. UNANIMOUSLY ADOPTED.

ARTICLE 4. That the sum of $30,000.00 be appropriated from avail- able funds (Excess and Deficiency Fund) for the purpose of preparing plans, working drawings and specifications for a Elementary School near the junction of Front Street and Homestead Avenue, and for the construc- tion of an addition to the James Humphrey School; and that the Annual Moderator shall appoint a committee of seven, which shall include the Superintendent of Schools and the Chairman of the School Committee and that said committee shall supervise the preparation of plans, draw- ings and specifications of the building of future additions to the Bicknell School and the Edward B. Nevin School.


Mr. Abbott suggested the following amendment:


That the next-to-the last line and last line read as follows: "specifica- tions of this building and future additions to the Bicknell School and the Edward B. Nevin School".


Unanimously adopted.


Comes the question on the Appropriation Committee's motion as thus amended.

ARTICLE 5. That the sum of $1,800.00 be appropriated from avail- able funds (Overlay Reserve) for the purchase of a three-quarter ton pick- up truck and an emergency generator for the Fire Department and that the Chief of the Fire Department be authorized to purchase such a truck. UNANIMOUSLY ADOPTED.

ARTICLE 6. That the sum of $1,320.75 be appropriated from available funds (Overlay Reserve) for payment of fire insurance on town buildings. SO VOTED UNANIMOUSLY.

ARTICLE 7. Appropriation for paying 6 months interest on Junior High School bonds.

ARTICLE 8. That the sum of $10,000.00 be provided to defray the expenses of the Water Department for the balance of 1950. Of this sum $8,500.00 is to be appropriated from current revenue; and $1,500.00 from the General Fund of the department to be used for private work, pay- ment for such work to revert to the General Fund of the Water Depart- ment; provided further that no part of the sums appropriated shall be used for administrative purposes.


UNANIMOUSLY ADOPTED.

ARTICLE 9. No action.


Mr. Shaw's request to insert words "or take any other action in re- lation thereto" at the end of Article 9 was ruled out of order by the Chair.


Mr. Hoffman presented the following substitute motion:


That the sum of $500,000.00 be appropriated for the purpose of ex- tending main sewers and laterals from North Weymouth, to the vicinity of Jackson Square, East Weymouth, and to service that area of the town. Of the above sum $117,000.00 shall be transferred from available funds (Excess and Deficiency Account) and that the Treasurer with the ap- proval of the Board of Selectmen is hereby authorized to borrow a sum of money not to exceed $383,000.00 and to issue bonds to be payable in ac- cordanace with General Laws, Chapter 44, S7, C1, so that the entire sum shall be payable in not more than 30 years from the date of issuance of the first bond; all sums appropriated shall be expressed under the direc- tion of the Sewer Commissioners.


This motion was ruled out of order by the Chair under this Article as it does not cover the subject matter under discussion referring as it does to Jackson Square, East Weymouth.


Comes the question on the recommendation of the Appropriation Com- mittee.


Mr. Shaw stressed the urgent need for sewerage at vital spots in the South Weymouth Columbian Square area and presented the following Substitute Motion:


That the sum of $1,000,000.00 be appropriated for constructing an ex- tension to the Central and South Weymouth Trunk Sewer to a point in or adjacent to Columbian Square, and for the construction of as many laterals from this point as the funds will permit,


Of this sum, $25,000.00 shall be appropriated from available funds ( ) and the Treasurer, with the approval of the Board of Selectmen, is hereby authorized to borrow a sum of money not to exceed $975,000.00 and to issue bonds to be payable in accordance with General Laws (Ter.Ed.) Chapter 44, Section 19, so that the entire sum shall be payable in not more than twenty years from the date of issue of the first bond. The sums appropriated shall be expended under the direction of the Board of Sewer Commissioners.


Mr. Thaxter, as spokesman for the Tax Payers Association-a non- political group working toward sound, economical government- said the

Association had been asked to make a survey of the sewerage situation and had received cooperation of local Sewer Commission, other town of- ficials and department heads and had conferred with the State Depart- ment of Sanitation, and urged an affirmative vote for the subject Article. He asked the Sewer Commission's point of view.


Comes the question on Mr. Shaw's substitute motion.


Mr. Libby, for the Sewer Commission, stated his Committee had met with the Appropriation Committee a week ago and had arrived at a com- promise figure of $400,000, $100,000 of which would be allocated to the Pearl St. School, North Weymouth, where high tides posed a difficult drain- age and sewage disposal problem.


Comes the question on Mr. Shaw's substitute motion.


Rev. Jack Leather backed the proponents of the substitute motion under Art. 9, and urged Town Meeting members to go along with the group in the interests of public health.


Discussion followed with Messrs. Ingram and Field. Mr. Lane for the Appropriation Committee, while agreeing with the Tax Payers Association as to the vital need for sewerage, outlined the financial picture as it per- tains to the cost of school construction and briefly sketched the back- ground of sewerage construction for the benefit of new Town Meeting members.


Mr. Record and Mr. Gunn joined the controversy and Mr. Gunn asked the Moderator and members to consider a 10 minute recess to allow pro- ponents of this Article to confer further.


Comes the question on Mr. Gunn's motion. The nayes have it and it is LOST.


Comes the question on Mr. Shaw's substitute motion.


Mr. Fern of the Board of Selectmen cited the letter the Selectmen had received from the Department of Sanitation re filthy conditions in South Weymouth. Followed a lengthy discussion as to costs, availability of materials and time required to complete the extension to Columbian Sq .; and arguments pro and con as to the urgent need for such an exten- sion involving Messrs. Libby, Lane, Gunn and O'Donnell. As requested by Mr. Ditchett Mr. Shaw read a copy of letter, dated May 19, 1950, sent to the Board of Selectmen by the State Board of Sanitation, and spoke in rebuttal to previous comments.


Discussion continued with Messrs. Gunn, Shaw, Field, Factor and Mahoney, the latter remarking that the School Committee is naturally vitally interested in the sewage situation as it pertains to the school build- ing program. Mr. Libby commented the subject article refers to South Weymouth and not the entire town. The Chair ruled the Article under consideration refers only to South Weymouth construction.


Further discussion continued with Messrs. Hoffman, Lane, Record, MacMillan, Call, O'Donnell, Cunniff and Libby. Mr. Cunniff MOVED the previous question.


Mr. Dizer, Town Accountant, at the request of the Chair, clarified bond issuance for Mr. O'Donnell.


Comes the question on Mr. Shaw's substitute motion.


Mr. Cunniff raised a point of order - does the previous question take precedence ?

Mr. Shaw read a letter from Andrew Chisholm, Building Inspector, outlining the need for sewage disposal because of the ever expanding build- ing program.

The Chair stated it was unable to accept a motion from other than a Town Meeting Member.


Mr. Cunniff received a negative reply to his query if this was part of the previous question.


Comes the question on Mr. Gunn's motion for Mr. MacMillan. The nayes have it and it is LOST.


Comes the question on the Appropriation Committee's motion - No Action - under this Article.


Mr. Heald presented the following substitute motion:


It is the consensus of this meeting that the rate of construction of the sewerage system of this town of Weymouth shall be considerably accel- erated and further MOVED:

That the Appropriation Committee is hereby instructed to recommend the amount of $500,000. for sewerage construction to the Town Meeting members at the Annual Town Meeting of March 1951, and that this amount or more be recommended each year thereafter by that Committee until such time as the Board of Sewer Commissioners may determine that suf- ficient mains and laterals have been installed to properly service a num- ber greater than half of the homes, industrial establishments, public build- ings institutions, etc. of this town.


And further MOVED:


That the Appropriation Committee shall recommend the ways and means of financing this sewerage construction each year to the Annual Town Meeting.


The Chair ruled this motion out of order because


1. Of words "it is the consensus of this meeting, etc." forming a resolution


2. It goes beyond the scope of Art. under the Warrant

Rinaldi; and that the Board of Selectmen be authorized to acquire by gift, or purchase or take by right of eminent domain in fee or otherwise for all purposes of a public street or highway in and over said street as so laid out and accepted and that the sum of $25.00 be appropriated from available funds (Overlay Reserve) for the acquisition of the foregoing taking, gift or purchase including all damages; provided further, that they may build bridges, drains or con- duits and secure any easements which may be necessary and the Board of Selectmen are hereby authorized to accept deeds of any reservation strips existing in connection with any of said streets.
