MISCELLANEOUS
ARTICLE 74. (At Request of Donald C. McMillan and Others). To see if the Town will vote to raise and appropriate $50,000.00 and that the Board of Selectmen are hereby instructed to acquire for a public gym- nasium and recreation center by purchase, gift, or lease, or take by right of eminent domain in fee to maintain and supervise the present parish house of the Union Congregational Church, South Weymouth, with ap- proximately 50,000 square feet of property on which it stands beginning at a point at the intersection of the tangents of the corner curve at the junction of Columbian Street and Fogg Road, thence running northwesterly by said Columbian Street about 200 feet to other land of the Union Con- gregational Society of Weymouth; thence turning and running south- westerly by said other land of the Union Congregational Society by a line parallel with the northwesterly side line of the main church building to land formerly of Jessie K. Newbert; thence turning and running in a southerly direction by said land formerly of the said Jessie K. Newbert to Fogg Road; thence turning and running in a general northeasterly direction by the northwesterly side line of Fogg Road to the point of beginning or take any other action in relation thereto.
ARTICLE 75. (By Direction of Selectmen). To see if the Town will vote to purchase or take by right of eminent domain in fee property at 161 North Street, or take any other action in relation thereto.
ARTICLE 76. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $1,500.00 to restore Ashwood Cemetery, or take any other action in relation thereto.
ARTICLE 77. (By Direction of Selectmen). To see what disposition the Town desires to make with money in Ashwood Cemetery Account.
ARTICLE 78. (At Request of Highway Department Building Com- mittee). To see what sum of money the Town will vote to raise and appropriate for the purpose of, or take by right of eminent domain, part of land owned by the New York, New Haven and Hartford Railroad Com- pany at or near 1580 Commercial Street, and to erect a Street Depart- ment garage thereon, or take any other action in relation thereto.
ARTICLE 79. (At Request of Tree Warden). To see if the Town will vote to raise and appropriate the sum of $5,000.00 for Dutch Elm Disease Inspections and removal of infected trees, or take any other ac- tion in relation thereto.
ARTICLE 80. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate a sum of $3,000.00 for the establishment of the Data Sheet System, so-called, for the filing of pertinent data in re- lation to building construction, or take any other action in relation thereto.
ARTICLE 81. (On Petition of Graydon L. Abbott and Others). To see what sum of money the Town will vote to raise and appropriate to publish, in booklet form for sale to the public for $1.50 each, the current assessed valuations of all property in the Town, provided further that such booklets be completed and offered for sale by November 1, 1950, 01 take any other action in relation thereto.

ARTICLE 82. (On Petition of Graydon L. Abbott and Others). To see if the Town will authorize the inclusion, in the annual report of the Town of Weymouth, the attendance record of Town Meeting members at each session of regular and special town meetings, provided further, that the full names and precincts of such persons shall be given, or take any other action in relation thereto.
ARTICLE 83. (By Direction of Selectmen). To see what action the Town will take relative to the collection of rubbish throughout the Town by a private contractor, or take any other action in relation thereto.
ARTICLE 84. (By Direction of Selectmen). To see if the Town will vote to use any unexpended balances from the Sea Wall Appropriation for the construction of additional sea walls along the Fore River shore, provided the Commonwealth contributes a similar amount, or take any other action in relation thereto.
ARTICLE 85. (At Request of Tree Warden). To see if the Town will vote to raise and appropriate the sum of $2,575.00 for aerial spraying for the control of mosquitos and other insect pests, or take any other action in relation thereto.
ARTICLE 86. (By Direction of Selectmen). To see what action the Town will take in acquiring land at rear of Washington and Commercial Streets for parking purposes, or take any other action in relation thereto.
ARTICLE 87. (On Petition of Paul C. Cleaves and Others). To see if the Town will vote to plant shade and ornamental trees along Abigail Adams Circle and John Quincy Lane, or take any other action in relation thereto.
ARTICLE 88. (By Direction of Board of Selectmen). To see if the Town will vote to authorize the Board of Selectmen in its behalf to ac- cept as a gift from the Estate of Mary Fifield King the sum of $2,000.00 for the benefit of the Tufts Library in memory of Doctors Noah Fifield, George F. Fifield and W. C. B. Fifield.
ARTICLE 89. (By Direction of Selectmen). To see if the Town will vote to authorize the Board of Selectmen in its behalf to accept as a gift from the Estate of Mary Fifield King the sum of $5,000.00 to be given in memory of Doctors Noah Fifield, George F. Fifield and W. C. B. Fifield.
ARTICLE 90. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $500.00 for the purpose of main- taining during the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931, or take any other action in re- lation thereto.
ARTICLE 91. (By Direction of Selectmen). To see what action the Town will take relative to authorizing the Board of Selectmen to establish parking meters in such streets as they may determine proper, or take any other action in relation thereto.
ARTICLE 92. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate the sum of $200.00 to be expended under the direction of the Board of Selectmen for the purpose of stocking ponds and inland waters, located within the Town limits, with fish and of liberating game all in accordance with General Laws (Ter.Ed.) Chapter 40, Section 5, Clause 41, or take any other action in relation thereto.

ARTICLE 93. (By Direction of Selectmen). To see if the Town will vote to transfer ownership and maintenance of the Massachusetts Depart- ment of Public Works of town owned traffic signal systems now in opera- tion on state highways, Routes 18 and 128 at Main and Columbian Streets, Washington and Pleasant Streets, and at Park Avenue West and Pleasant Street, or take any other action in relation thereto.

SPECIAL TOWN MEETING March 6, 1950
Pursuant to a Warrant duly issued, a Special Town Meeting of the inhabitants of the Town of Weymouth, represented by its duly elected and qualified Town Meeting Members, was held in the hall of the Wey- mouth High School, Monday evening, March 6. 1950.
The Meeting was called to order at 7:30 in the evening by the Annual Moderator Mr. Daniel L. O'Donnell.
The Town Clerk, Chester L. Boyle, read the call of the Special Meeting. MOVED
To suspend with the reading of the Article in the Warrant. SO VOTED
Mr. Callahan challenged the legality of the Warrant. The Chair ruled the point of order not well taken and that if the Warrant has been posted the real intent to notify the Town Meeting Members has been complied with and the return of service by the Constable would show that notice was given in proper time. The Meeting sustained the ruling of the Moderator.
Prayer was offered by the Rev. Jack Leather, Pastor of the Holy Nativity Episcopal Church, South Weymouth.
The Chair requested Town Meeting Members not sworn to rise. There were 6 who were duly sworn.
MR. LANE FOR THE APPROPRIATION COMMITTEE submitted the following Substitute Motion: $45,000.00
That the sum of $45,000 be raised and appropriated for the develop- ment of additional emergency well fields, including wells, pipes, pumping station, and original pumping station equipment, to be located on Lot 9, Block 376 as shown on Sheets 29 and 33 of the Weymouth, Mass. Town Atlas, as revised to January 1, 1949 by Russell H. Whiting, Town Engineer, and to include the laying of 10 in. and 12 in. water mains to Washington Street and to Front Street all to be under the supervision of the Water Department, and to meet said appropriation that the Treasurer, with the approval of the Board of Selectmen, be and hereby is authorized to borrow $45,000 and issued bonds or notes of the Town therefore, in accordance with the provisions of Chapter 44, General Laws, so that the whole loan shall be paid in not more than 15 years from the date of the first bond or note, or such earlier date as the Treasurer, Selectmen and Water Com- missioners may determine.

Mr. Callahan asked information as to the location of the land under consideration and its owners. Mr. Beane for the Water Department replied.
Town Counsel, Judge Kenneth L. Nash, was called upon by the Modera- tor for his opinion as to the legality of the Warrant and the Town Coun- sel agreed with the ruling of the Moderator.
Comes now the question on the Substitute Motion as offered by the Appropriation Committee:

ANNUAL TOWN MEETING March 6, 1950
Pursuant to a Warrant duly issued, the Annual Meeting of the in- habitants of the Town of Weymouth, represented by their duly elected and qualified Town Meeting Members was held in the hall of the Wey- mouth High School on Monday, March 6, 1950.
208 Town Meeting Members were present.
The Meeting was called to order at 7:50 in the evening by the An- nual Moderator, Mr. Daniel L. O'Donnell.
The attested copy of the Warrant was read by Town Clerk, Chester L. Boyle. Articles not taken up at this Meeting will be considered at an adjourned meeting on Wednesday, March 8, or at a subsequent adjourned Meeting.
MR. LANE MOVED:
That we suspend with the reading of the Articles in the Warrant. UNANIMOUSLY VOTED.
The Moderator declared that we would now proceed with considera- tion of the Articles in the Warrant.
MR. LANE MOVED:
That Art. 29 be considered prior to Art. 1.
The Chair advised that under the by-laws, in order to take up any Article ahead of Art. 1, a 34 vote is necessary.

Speaking from the floor. Mr. Franklin Pratt for the Board of Trustees, Tufts Library, asked that the library employees, who sohuld be regarded as professionals as are teachers, be exempted from the provisions of Art. 29. The Chair accepted Mr. Pratt's motion that
Sec. 1 of Art. 29 be amended to include the following clause: - "and also except those under the direction and control of the Board of Trus- tees of Tufts Library".

Comes now the question on Art. 29 as recommended by the Appropria- tion Committee and Sec. 1 as amended:
That the by-laws of the Town be amended under authority of Sec- tion 108A of Chapter 41 of the General Laws by the adoption of Section 409 to read as follows:
Sec. 1 - The Classification Plan :- The official classification plan for positions in the service of the Town shall consist of the classes listed by titles in Schedule A which is made a part hereof (Classes by Services) and shall apply to all positions in the service of the Town except those filled by popular election and those under the direction and control of the School Committee.
Section 2 - The Pay Plan :- the official pay plan shall consist of the scales of pay for the several classes set forth in Schedule B (Salary and Wage Scales) which is made a part hereof
Section 3 - Amendment of the Plans: - The classification plan and the provisions included herein may be amended in the manner provided by law, or in the manner provided by the by-laws of the Town, whichever is applicable. The pay plan may be established or changed by vote of the Town, at a Town Meeting, or as provided by law, whichever is applicable.
In case of urgent necessity, the personnel officer, after consultation with the appointing authority and with the approval of the personnel Board, may anticipate formal action by the Town, by tentatively adding a new classification to the classification plan and establishing the salary or wage therefor, subject to subsequent early ratification of such action by the Town at a Town Meeting and further subject to the approval of the Division of Civil Service when so required.
Section 4 - Personnel Board :- There shall be a personnel Board consisting of three members to be appointed by the moderator, as follows:
(a) An elected town official who shall be the chairman
(b) A Town employee
(c) A citizen and registered voter of the town
The members of the personnel Board shall be appointed one (A) for a period of one (1) year; and (B) for a period of two (2) years; and one (C) for a period of three (3) years and thereafter as their terms expire for a period of three years.

The personnel Board shall be vested with the authority to promul- gate such rules and regulations as are necessary for the proper administra- tion of the classification and pay plans. Nothing in such rules and regula- tions shall conflict with the provisions contained herein.
Section 5 - Personnel Officer :- There shall be appointed, by the Board of Selectmen, a personnel officer who shall be responsible for the administration of the classification and pay plan and such rules and regulations regarding the plans that may be promulgated by the per- sonnel Board.
Appeal from any decision of the personnel officer may be made to the personnel Board, should such decision conflict with anything contained herein, or with the rules and regulations adopted by the Board for ad- ministration of the plans.
Section 6 - Class Definitions :- The personnel officer shall provide and may amend from time to time, written definitions of the classes of the classification plan, such consisting of a statement describing the essential nature of the work characteristic of positions of other classes with such examples as may be deemed appropriate.
Section 7 - Interpretation of Class Definitions :- The definition of the classes shall be interpreted as descriptive only and not restrictive. The definition for any class shall be construed solely as a means of identi- fying positions properly pertaining to the class and not as prescribing what the duties or responsibilities of any position of the class shall be, or as modifying or in any way affecting the power of any administrative authority as otherwise existing, to appoint, to assign duties to, or to direct and control the work of any employee under the jurisdiction of such authority.
Section 8 - Records and Requisitions :- The personnel officer shall keep such records of all employees of the Town, including the name, age, date of employment, civil service classification, if any, department in which employed, nature of duties, and other information as it deems de- sirable. All requisitions for persons to fill positions or perform duties classified under the civil service law, all requests for transfers, increases in salary, changes in ratings, or other requests made to the director of civil service or the department of civil service shall be cleared through the personnel officer.
Section 9 - Allocation of Positions to Classes :- The personnel officer shall allocate each position subject to the provisions of this by-law to its appropriate class in the classification plan. Whenever a new position is established of the duties of an existing position are so changed that, in effect, a new position of a different class is substituted for the old posi- tion, the personnel officer shall allocate such new or changed position to its appropriate class. He shall likewise reallocate any position from class to class whenever he finds such action warranted by reason of errors in the allocation then in effect. He shall afford reasonable opportunity to be heard to any employee or appointing authority affected by any al- location or reallocation upon written request therefor, and may afford such opportunity in the absence of such request.
Section 10 - Operation of By-Law :- This by-law shall be operative only as to employees whose positions are classified hereunder and for which positions minimum and maximum salaries have been established by vote of the Town at a Town Meeting.
Section 11 - Civil Service Law :- Nothing in this by-law shall be con- strued to conflict with Chapter 31 of the General Laws.
