ARTICLE 1
To see if the town will vote to amend its by-laws by striking out the section following Chapter 15 entitled "Increase in Salaries", and vote to adopt the following Salary and Job Classification Plan and designate the same as Chapter 16 of the town by-laws .- Wage, Hour and Classification Committee.
Chapter 16, Section 1-The Plan
There is hereby established a classification and salary plan, here- inafter designated as the plan for the Town of Wakefield under au- thority of Section 108a of Chapter 41 of the General Laws, and all other acts thereto enabling, for positions in the service of the Town classifying certain employees other than those filled by popular election, those under the direction and control of the School Committee and those employed in the Welfare Department, into groups and classes doing sub- stantially similar work or having substantially equal responsibilities.
Sec. 2-Classification of Jobs
The Official Classification plan for positions in the service of the Town shall consist of the classes listed by titles in Section VII of this Chapter which is hereby made a part hereof.
Sec. 3-Personnel Board
(a) There shall be a Personnel Board to administer the plan con- sisting of five members. Three persons, not officers or employees of the Town, shall be appointed by the Moderator, one of whom shall be a member of the Finance Committee of the Town of Wakefield and two employees, other than elective and appointive officers of the Town shall be elected by the employees.
(b) The Personnel Board shall be established as soon as the plan is passed by the Town Meeting and the members can be appointed. Forthwith, after the effective date of this by-law, the Moderator shall appoint three members, one for three years, one for two years, and one for one year. Thereafter, the Moderator, not later than April 1 of the year in which the term of a member will expire, shall appoint his successor for a term of three years.
The employees shall elect two members, one for three years and one for two years. The first year, the employee representations will be appointed by the moderator. Thereafter, the employees, not later than April 1 of the year in which the term of a member will expire, shall elect his successor for a term of three years, such election to be conducted under the jurisdiction of the Board of Selectmen and in accordance with such rules and regulations as the Board of Selectmen may prescribe.
(c) If a member, appointed by the Moderator, resigns or his office becomes vacant by his removal from the Town, or other cause, the Moderator shall appoint his successor for the balance of the unexpired term of such member. Should a vacancy for any reason occur in the membership elected by the employees, the employees shall elect his successor for the balance of the unexpired term of such member.
(d) The Personnel Board shall administer the Plan and shall estab- lish such procedures as it deems necessary for the proper administration of the plan.
(e) Forthwith after its election and annually the Board shall meet

and Organize by electing a Chairman and Clerk. A majority of the Board shall constitute a quorum for the transaction of business. A ma- jority vote of the Board shall determine the action the Board must take on all matters upon which it is authorized or required to pass under the Plan. The Personnel Board may employ assistance and incur expenses as it deems necessary, subject to appropriation of funds there- for.
(f) The Board shall maintain adequate personnel records of all employees subject to this plan, said records shall be kept in the custody of the Personnel Board. Department Heads shall provide such informa- tion as the Personnel Board shall request.
(g) The Personnel Board shall review the work of all employees subject to this plan at intervals of not more than three years. The Board may add a new position, tentatively, to the classification schedule, or reclassify an existing position to a different group, subject to the subsequent ratification of its action by formal amendment of the Plan by vote of Town at a Town Meeting.
(h) The Personnel Board may authorize an entrance rate higher than the minimum upon recommendation of a department head, sup- ported by evidence in writing of special reasons and exceptional circum- stances satisfactory to the Personnel Board and such other variance in the Plan as it may deem necessary for the proper functioning of the service of the Town. No variance shall become effective unless, or until, the necessary funds have been appropriated therefor.
(i) The Personnel Board shall make an annual report in writing to the Board of Selectmen on or before January 20 of each year.
(j) The Plan may be amended from time to time by vote of any Town Meeting.
(k) If any request under the salary schedule is denied by the Per- sonnel Board, the department, the individual, or Branch of the Town involved, the employee may appeal to the Town for a final decision at a subsequent Town Meeting in a special article in the Town Warrant.
(1) The Personnel Board shall maintain written job descriptions of the jobs or positions in the classification schedule of the plan each con- sisting of a statement describing the essential nature of the work, characteristics of the position that distinguish the position from other positions. The description for any position shall be construed solely as a means of identification and not as prescribing what the duties or re- sponsibilities of any position shall be, or as modifying, or in any way affecting, the power of any administrative authority, as otherwise exist- ing, to appoint, to assign duties to, or to direct and control the work of any employee under the jurisdiction of such authority.
Sec .- Civil Service
Nothing in this Classification and Salary Plan shall be construed to conflict with Chapter 31 of the General Laws.
Sec .-- Physical Examination
Every person hereinafter employed by the Town subject to this plan except occasional or substitute employees shall undergo a physical examination. The examining physician shall be appointed by the Board of Selectmen and shall render a sealed report of his findings to the

Personnel Board having the name of the applicant written on the envelope. After receipt of the report has been entered on the Personnel Board's records, such report shall be deposited with the Retirement Board for safe-keeping, the contents subject to future review only by a physician designated by the Selectmen, otherwise the report shall be confidential.
COMPENSATION PLAN
Sec. 4-Salary Schedule
(a) The salary schedule of the plan, set forth in section 7b of this Chapter, shall consist of the maximum and minimum salaries, step rate salaries, for the groups and positions in the classification plan. The sal- ary range of a group shall be the salary range for all positions classified in such group.
(b) All employees shall continue to be paid on an hourly, weekly, monthly, or other basis, as at present, except as provided in the salary plan, unless otherwise authorized by the Personnel Board or by amend- ment of the salary plan.
(c) No board, officer or head of a department shall fix the salary of any employee in a position so classified except in accordance with such plan.
(d) No person shall be appointed, employed or paid as an employee in any position subject to the provisions of the plan under any title other than those of the classification schedule, or the duties which are actually performed. The job title in the plan shall be the official title of the position and shall be used in all administrative and employment records.
(e) All employees included in the plan shall be eligible for reclassi- fication and pay adjustment subject to the approval of the Board or authority having immediate jurisdiction over such employees and the Personnel Board.
(f) Promotions from minimum to maximum salaries shall be suc- cessive steps annually, but shall not be mandatory. Individual advance- ment shall be on a merit (Not necessarily on length of service) and shall be subject to approval of the Board or authority having immediate jurisdiction over such employee. Any employee denied such an increase has the right of appeal to the Personnel Board. In the event the Per- sonnel Board denies the appeal of the employee, action may be taken as outlined in Section 3, paragraph (k) of this chapter.
(g) Any salary rate which is above the maximum rate for a job as established by this salary administration plan shall apply only to the incumbent at the time the plan is adopted.
(h) The hiring rate shall be the minimum of the rate range of the job for which the new employee is hired, unless otherwise authorized by the Personnel Board.
(i) The first six months of employment for all new personnel shall be a probationary period, at the end of which the employee may ad- vance one step rate, provided such an advance is recommended by the Board, or authority having jurisdiction, to the Personnel Board. Other-

wise he shall be eligible for consideration after one year of continuous full time service. This shall not apply in the case of transfer or promotion from one job to another.
(j) Each department head subject to this plan shall include in his estimates required by the provisions of section 59 of Chapter 41 of the General Laws a pay adjustment section setting forth in detail the amounts which will be required for anticipated pay adjustments during the ensuing year and shall furnish a copy thereof to the Personnel Board.
(k) The work week for Town employees, other than members of the police and fire departments, shall be forty (40) hours or such less number as the department head, with the approval of the Personnel Board, may establish.
(1) Additional compensation shall be paid for any work in excess of the normal hours of employment at such rate not exceeding 11/2 times the established rate of compensation, as the department head, with the approval of the Personnel Board, shall establish; provided, however, that such additional compensation may be paid, at a rate not exceeding twice the established rate of compensation, on Sundays and holidays; and, provided further that in the case of snow removal occurring out- side the regular hours of duty, a supervisor shall be paid straight time and other employees 11% times the rate for regular employment. This section shall not apply to police and fire departments.
Sec. 5-Employment Practices associated with the Salary Plan
(a) Holidays. Town employees shall be entitled to the following holidays with pay at their regular straight time rate when they fall or are observed within the regular work week; January first, February twenty-second, April nineteenth, May thirtieth, July fourth, the first Monday of September, October twelfth, November eleventh, Thanksgiv- ing Day and Christmas Day. Employees, other than the Police and Fire Department, required to work on a legal holiday shall be paid according to the provisions provided for in section 4, par. 1. Members of the Police and Fire Departments required to work on a legal holiday shall be allow- ed compensation time off.
(b) All permanent regular employees, except nursing and library staff, subject to this plan shall be granted two weeks vacation with pay in each calendar year, provided that any such employee who has been in the continuous full time service of the Town for at least six months, but less than one year, next preceding June first in any one year, and who has actually worked at least fifteen weeks during such period, shall in such year receive one week's vacation with pay. After the tenth year and up to the fifteenth year, a day per year may be added.
Employees with fifteen years of service shall be granted three weeks vacation with pay; employees with twenty years and over shall be granted four weeks with pay. Except in situations which are declared unusual by the Personnel Board, vacations of more than two weeks shall be split.
In the case of nursing and library staff, the Personnel Board, after conference with the Library Trustees and Board of Health, may recom- mend a vacation program in accordance with the general customs of those professional groups.

(c) 1. Any permanent regular employee, except the members of the Police and Fire Departments subject to this plan suffering from injury, illness or disability rendering him unable to perform his duties and who has served the Town one year shall be granted two work weeks sick-leave, while in the employ of the Town without loss of pay.
2. Employees are to be credited with the unused portion of the reg- ular sick-leave for each year of employment, and such credited days may accumulate up to a maximum of 45 days. It shall be allowable for the Personnel Board to authorize additional leave in unusual cir- cumstances.
3. Sick leave must be authorized by the Head of a Department and must be reported, on blanks provided for same, to the Personnel Board.
4. A physician's certificate of illness, if deemed necessary by the Head of a Department, may be requested for verification.
5. Injury, illness or disability self-imposed, or as a result of alcohol or drugs shall not be considered a proper claim for sick benefits.
6. No sick leave will be paid according to this section, when the provisions of Workingmen's Compensation are applicable.
(d) Emergency leave of four days may be allowed for death in an employee's immediate family (wife, husband, mother, father, or child).
(e) Regular permanent employees required to serve on the Jury may be paid the difference between compensation received from jury duty and regular compensation rates paid the employee by the Town.
(f) Regular permanent employees in the military reserve shall be paid the difference between compensation received while on reserve duty and regular compensation rates paid the employee by the Town.
(g) Nothing in this plan shall be construed to deprive any employee of vacation, or sick leave allowance to which he or she is entitled at the time of the enactment of this plan.
(h) Finding of any invalidity of any part of this plan shall not invalidate any other part of this plan.
Sec. 6-Civil Service
Nothing in this Classification and Salary Plan shall be construed to conflict with Chapter 31 of the General Laws.

On motion by Finance Committee:
That the Town vote to amend its by-laws by striking out that sec- tion following Chapter 15, entitled "Increase in Salaries" and vote to adopt the salary and job classification plan as described in Article 1, with the following amendments, the same to be designated as Chapter 17 under the authority provided by Section 108A of Chapter 41 of the General Laws and other acts thereto enabling.
Strike out the title Chapter 16 so as to read Chapter 17, Section 1, the Plan
Strike out Paragraphs A and B of Section 3 and insert the following:
Section 3, Paragraph A - There shall be a personnel board to ad- minister the plan consisting of five members. Three persons, not officers or employees of the Town, shall be ap- pointed by the Moderator, and two employees, other than elective and appointive officers of the Town, shall be elected by the employees as outlined in Chapter 17, Sec. 3, par (a) of the Town Meeting Warrant for November 30, 1953.
The vote on Mr. Galvin's amendment was in the affirmative.
The original motion by the Finance Committee, as amended, then was voted in the affirmative; no count by tellers was necessary.
ARTICLE 2
To see if the town will appropriate the sum of $13,000.00 for Old Age Assistance recipients for the balance of the year, the same to be transferred from the Excess and Deficiency Account .- Board of Public Welfare.
On motion by Finance Committee:
Voted: That the Town appropriate the sum of $13,000.00 for Old Age Assistance Recipients for the year 1953, funds for same to be trans- ferred from the Excess and Deficiency Account.
ARTICLE 3
To see if the town will appropriate $60.00 to pay a 1950 bill to the City of Chelsea for aid rendered a Wakefield settled case, the same to be taken from the Excess and Deficiency Account .- Board of Public Welfare.
