ARTICLE 6


To see if the Town will authorize the Board of Public Works to con- struct a sewer in Pleasant Street Extension from existing manhole in Cordis Street approximately 430 feet northerly to a dead end; and/or authorize the treasurer with the approval of the selectmen, to borrow and issue notes or bonds of the town therefor, and authorize the Board of Public Works to purchase or take by right of eminent domain, ease- ments in and over private land necessary in the construction of said sewer .- Board of Health.

At 8.38 P. M. the Moderator called the Annual Town Meeting to order with the Finance Committee's motion under Article 4 still before the meeting.


The Moderator put the motion (which was to approve articles of substance requested by various departments) and the vote was in the affirmative.


ARTICLE 5


To determine how much money the town will raise and appropriate for General Government, Protection of Persons and Property, Health and Sanitation, Public Works, Charities and Veterans' Benefits, Education, Recreation, and Unclassified, Public Service Enterprises, Interest and Maturing Debt, specifying what appropriations shall be taken from the receipts of a department .- Board of Selectmen.


On motion by Finance Committee:


Voted: To postpone consideration of Article 5 until Monday, March 16, 1953, at 7.30 P. M. at the High School Auditorium.


ARTICLE 6


To see if the town will authorize the Board of Selectmen to purchase a new ambulance for use by the Police Department and raise and ap- propriate a sufficient sum of money to provide payment therefor .- Board of Selectmen.

Voted: That the Town authorize the Board of Selectmen to pur- chase a new ambulance for use by the Police Department, and raise and appropriate the sum of $7,400.00 in payment therefor.

Voted: That the Town raise and appropriate the sum of $1,343.45 to carry out the purposes of Article 7.


ARTICLE 8


To see if the town will vote to change to a business district that por- tion of lot No. 19 as shown on a plan of land in said Wakefield surveyed for Deacon Brown, Inc., by H. Kingman Abbott, Surveyor, dated June 1946, recorded with Middlesex South District Deeds end of Book 7049, which now is zoned as part of the single residence district. Said lot No. 19 is bounded and described as follows:


Northeasterly - By Lowell Street, ninety-five (95) feet; Southeast- erly - By lot 18 on said plan, ninety-five (95) feet; Southwesterly - By Lot 20 on said plan, ninety-six and 19/100 (96.19) feet; North- westerly - By Lot 21 on said plan, ninety-four and 76/100 (94.76) feet. - Jeremiah Drinkwater and Others.

ARTICLE 9


To see if the town will vote to amend the town zoning by-laws by changing from a general residence district to an industrial district, the property located in the Town of Wakefield and bounded and described as follows: starting at a point where the southeasterly location line of the Newburyport branch of the Boston & Maine Railroad intersects the northeasterly line of taking made by the Commonwealth of Massachu- setts for highway purposes now known as Route 128 the line runs: north- easterly by Boston & Maine railroad about 500 feet to the Town and County boundary line between the Town of Wakefield and the Town of Lynnfield, being also the division line between Middlesex and Essex counties, thence the line runs along said line in an easterly direction about 4,500 feet to a point: thence the line turns and runs in a general southerly direction by the thread of the Saugus River about 5,400 feet to a point where the center line of said Saugus River intersects the northerly taking line of above mentioned Route 128, thence the line turns and runs in various courses along the northerly and northwesterly taking line of said Route 128 about 6,600 feet to the point of beginning. -Board of Assessors and others.

Article 13. To see if the town will vote to instruct the Selectmen to petition the General Court for legislation to enable the town to change from its present form of government to a city form of government. - Committee on change of Town Government, Philip J. Flanders.

On motion by Finance Committee :


Voted: That the Moderator appoint a committee of five members to carry out the purposes of Article 16, and that the Town raise and appro- priate the sum of $400.00 to carry out the purposes of Article 16.


ARTICLE 17


To see if the town will vote to raise and appropriate an additional sum for the taking by eminent domain of land for the New High School, specified in the vote passed under Article 21 of the warrant for the 1952 annual town meeting, and to meet said appropriation by taxation, by transfer from available funds, by borrowing or otherwise. - John I. Preston, Town Treasurer.


The Finance Committee recommended that the Town appropriate the sum of $7,500.00 by transfer from the Excess and Deficiency Ac- count, and that any additional sum of money necessary to satisfy any judgment that may be rendered against the town be taken from the Bond Issue authorized under Article 19 of the annual town meeting of 1952, to carry out the purposes of Article 17.


On motion by Town Treasurer John I. Preston :


Voted: That $26,000.00 be appropriated for the taking by eminent domain of the land specified in the vote passed under Article 21 of the warrant for the 1952 annual town meeting, and that to meet said ap- propriation, $7,500.00 be transferred from the Excess and Deficiency Ac- count and $18,500.00 from the proceeds of the unissued bonds authorized in the vote passed under Article 19 of said warrant.


The vote in the affirmative was unanimous.


On motion by John N. Bill:


Voted: To take up articles 18 to 27 inclusive out of order.

Article 18. To hear and act upon a report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location as shown on a plan approved by the Board of Survey as amended December 3, 1952, said way being an extension of Pine Hill Circle and running over town land and private land from the present line of termination of Pine Hill Circle to Western Avenue about 103 feet .- Board of Public Works.


Article 19. To hear and act upon a report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location of the private way known as Friend Street run- ning westerly and northerly approximately 1,210 feet from Parker Road to a dead end .- Board of Public Works.


Article 20. To hear and act upon a report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location of the private way known as Wiley Street Ex- tension running westerly approximately 615 feet from Wiley Street to a dead end .- Board of Public Works.

Article 22. To hear and act upon the report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location of private way known as Western Avenue run- ning easterly from land formerly of Randall and others 340 feet .- Board of Public Works.


Article 23. To hear and act upon the report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location of the private way known as Muriel Avenue and Muriel Avenue extension running approximately 800 feet from Chapman Road to Eunice Circle .- Board of Public Works.


Article 24. To hear and act upon a report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location of the private way known as Eunice Circle run- ning northerly from Muriel Avenue approximately 190 feet, and also from Muriel Avenue southerly and westerly approximately 455 feet .- Board of Public Works.


Article 25. To hear and act upon a report of the Board of Public Works in laying out a town way under the Betterment Act in substan- tially the same location of the private way known as Pleasant Street running northerly approximately 410 feet from Cordis Street to Pleasant Street Extension .- Board of Public Works.


Article 26. To hear and act upon a report of the Board of Public Works in laying cut a town way under the Betterment Act in substan- tially the same location of the private way known as Harrison Avenue from Pitman Avenue southerly approximately 638 feet .- Board of Public Works.


Article 27. To hear and act upon a report of the Board of Public Works in laying out a town way under the Betterment Act from the east end of Grafton Street easterly to Harrison Avenue so-called approxi- mately 218 feet as shown on a plan drawn by Harry H. Denning, dated December 1952 .- Board of Public Works.


The Moderator announced that the reports and the plans were pres- ent for inspection by any voter who cared to examine them.


On motion by John N. Bill, for the Board of Public Works:


Voted unanimously: That the Town accept and allow the report of the Board of Public Works laying out Town Ways in substantially the locations named in Articles 18, 19, 20, 21, 22, 23, 24, 25, 26 and 27; namely Pine Hill Circle, Friend Street, Wiley Street, Quannapowitt Avenue, Western Avenue, Muriel Avenue, Eunice Circle, Pleasant Street, Harri- son Avenue and Grafton Street, as shown on plans filed with the Town Clerk with said reports.


ARTICLE 28


To see if the town will vote to raise and appropriate a sufficient sum of money for the original construction of public ways or the extension or widening thereof, including land damages and cost of pavement and sidewalks laid at the time of said construction or for the construction of

stone, block, brick or other pavement of similar lasting character under specifications approved by the State Department of Public Works or au- thorize the Treasurer to borrow with the approval of the Selectmen and issue notes or bonds of the town therefor .- Board of Public Works.


The Finance Committee recommended an appropriation $7,300, and a further appropriation of $38,000 by Bond Issue, ten year term, for the construction of any or all of the following streets; work to be done under the Betterment Act: Pine Hill Circle, Western Avenue, Pleasant Street, Harrison Avenue, Grafton Street.


Motion by Town Treasurer John I. Preston:


That, for the original construction of any or all of the following public ways, including land damages and cost of pavement and side- walks, laid at time of construction, or for the construction of stone, block, brick, or other permanent pavement of similar lasting character, under specifications approved by the State Department of Public Works namely: Pine Hill Circle, Western Avenue, Pleasant Street, Harrison Avenue, Grafton Street, the Town raise and appropriate the sum of $7,300.00 by taxation and the Treasurer, with the approval of the Select- men, be and hereby is authorized to borrow the sum of $38,000.00 and issue notes or bonds of the town therefor, payable in annual installments over a period of ten years or at such earlier times as the Treasurer and Selectmen may determine; said work to be done under the Betterment Act.


Amendment, duly made and seconded: .


That the motion of the Treasurer be amended by adding to the streets to be built, the following: Muriel Avenue, Muriel Avenue Exten- sion, Eunice Circle, and the amount to be raised by Bond Issue be in- creased by $32,000.


Amendment to the amendment, duly made and seconded:


That Friend Street be added to the list of streets named in Article 28, and that an additional amount of $38,000.00 be added to the amount to be raised by Bond Issue, making the total for Bond Issue the sum of $108,000.00.


The vote on the amendment to the amendment was in the affirma- tive.


The original motion by Mr. Preston, as amended, then was voted in the affirmative by a unanimous vote.


ARTICLE 29


Article 29. To see if the town will vote to raise and appropriate a sum of money for the maintenance of various streets; built under Chap- ter 90, General Laws, Ter. Ed., said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose or take any other action in relation thereto .- Board of Public Works.


On motion by Finance Committee :


Voted: That the town raise and appropriate the sum of $1,000.00 to carry out the purposes of Article 29.


ARTICLE 30


To see if the town will vote to raise and appropriate a sum of money for the improvement of Main street, under Chapter 90, said money to be

ARTICLE 31


To see if the town will authorize the Board of Public Works to ac- cept on behalf of the town, conveyances or easements from time to time, giving the town the right to slope land back from the street lines and to construct retaining walls .- Board of Public Works.


On motion by Finance Committee:


Voted: That the Board of Public Works be authorized to accept on behalf of the town, conveyances or easements, from time to time, giving the town the right to slope land back from the street lines and to con- struct retaining walls, such authorization to extend until the next an- nual town meeting.


ARTICLE 32


To see if the town will raise and appropriate a sufficient sum of money to rebuild and resurface sidewalks on various public highways in the town .- Board of Public Works.


On motion by Finance Committee:


Voted: That the town raise and appropriate the sum of $5,000.00 to carry out the purposes of Article 32.


ARTICLE 33


To see if the town will vote to raise and appropriate a sufficient sum of money to construct sidewalks on various streets in the town .- Board of Public Works.

Voted: That the town raise and appropriate the sum of $8,500.00 to carry out the purposes of Article 33.


ARTICLE 34


To see if the town will vote to raise and appropriate a sufficient sum of money to replace concrete curbing, with granite curbing, on various streets in the town .- Board of Public Works.

Voted: That the town raise and appropriate the sum of $6,500.00 to carry out the purposes of Article 34.


ARTICLE 35


To see if the town will authorize the Board of Public Works to lay and/or relay water mains of not less than 6 inches but less than 16 inches in diameter in any or all of the following streets or private ways: 5400 feet on Lowell Street, 800 feet on Madison Avenue, 1,000 feet on Oak Street, 800 feet on Francis Avenue and 1,800 feet on Salem Street to Low:1! Street, and for any other work of like construction where pipes of the same dimensions as mentioned above are used; to pay therefor,

raise and appropriate a sufficient sum of money and/or authorize the Treasurer, with approval of the Selectmen to borrow and issue notes or bonds of the town therefor .- Board of Public Works.


The Finance Committee recommended favorable action and an ap- propriation of $50,000.00 by Bond Issue, 15-year term.


On motion by Town Treasurer, John I. Preston :


Voted: That the town authorize the Board of Public Works to lay and/or relay water mains of not less than six inches but less than six- teen inches in diameter in any or all of the streets and private ways named in Article 35 and for work of like construction where pipes of same dimensions are used; and to pay the cost thereof, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to bor- row the sum of $50,000.00 and issue bonds or notes of the town therefor, payable in annual installments within fifteen years or at such earlier times as the Treasurer and Selectmen may determine.


The vote in the affirmative was unanimous.

Voted: That this meeting be adjourned to next Monday evening, at 7.30 P. M., in the High School Auditorium.
