ADJOURNED TOWN MEETING


March 15, 1943.


Pursuant to the vote of Adjournment of March 12, 1943, the Town Meeting Members met in the Town Hall on Monday evening, March 15, 1943 notices having been sent to the Town Meeting Members.


Lists of the duly qualified Town Meeting Members were used at the entrances of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.


The check lists filed with the Town Clerk at the close of the meeting showed that one hundred and seventy-four members attended.

The Moderator called the meeting to order at 8:15 P. M.


At the suggestion of the Moderator the Assembly sang one verse of the National Anthem led by Mr. Einzig ac- companied at the piano by Gregg Larkin, High School student.


Town Meeting Members not previously sworn were sworn by the Moderator.


Chairman Estabrook offered the following which was duly seconded,


VOTED : That if all the business of the Meeting as set forth in the Warrant is not disposed of at this session, when the Meeting adjourns it adjourn to Wednesday even- ing, March 17, 1943, at 8 o'clock.


Mr. P. Joseph McManus suggested that as many mem- bers could not attend March 17th that the date be changed to the 18th, but as Chairman Estabrook stated the Hall was engaged that evening, Mr. McManus suggested the 19th, and, on motion duly made and seconded, it was on a rising vote 74 YES and 50 NO


VOTED : That if all the business of the Meeting as set forth in the Warrant is not disposed of at this session, when the Meeting adjourns it adjourn to Friday evening March 19, 1943, at 8 o'clock.


Article 13 taken up. (Relaying the Reservoir Water Main-Massachusetts Avenue)


On motion, duly made and seconded, it was unan- imously


VOTED : That the sum of nine thousand seven hundred seventy-four (9,774) dollars be and hereby is appro- priated for the purpose of relaying the Reservoir Water Main in Massachusetts Avenue from a point near Mill Street to West of the Highland Fire Station, a distance of approximately three thousand four hundred fifty (3,450)

Article 14 taken up. (Sidewalks and Edgestones)


On motion, duly made and seconded, it was unani- mously


VOTED : That the sum of five thousand (5,000) dollars be and hereby is appropriated for the construction of permanent sidewalks and for the installing of edgestones in the year 1943; said sum to be raised by general tax and expended under the direction of the Joint Board of Selectmen and Board of Public Works.


There being no further business under Article 14 the Moderator declared it disposed of.


Article 15 taken up. (Relocation, Alteration, Widening, Construction of Town Ways)


On motion, duly made and seconded, it was unan- imously


VOTED : That the sum of one thousand (1,000) dollars be and hereby is appropriated for maintaining, repairing and improving ways within the Town, said appropriation to be used with any sum or sums which may be allotted by the Commonwealth or the County of Middlesex or both, for such purpose or purposes; and that said sum be raised by general tax and expended under the direction of the Board of Public Works.


There being no further business under Article 15 the Moderator declared it disposed of.


Article 16 taken up. (Claims or Charges of Symmes Arlington Hospital)

VOTED : That the sum of six thousand eight hundred and 95/100 (6,800.95) dollars be and hereby is appro- priated to pay claims and charges of Symmes Arlington Hospital, including such claims and charges for aid, relief or care furnished prior to January 1, 1943, to persons falling into distress and standing in need of immediate relief ; said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 16 the Moderator declared it disposed of.


Article 17 taken up. (Preservation of Health and Protec- tion of Persons and Property)


On motion, duly made and seconded, it was unan- imously


VOTED: That the sum of five thousand (5,000) dol- lars be and hereby is appropriated to provide for such means, within the authorization of the Commonwealth Emergency Defense Act of 1941, or other legislation now in effect or hereafter enacted, as may be necessary in the present national emergency for the preservation of health and the protection of persons and property in the town, and for any purposes incidental to civilian defense; said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 17 the Moderator declared it disposed of.


Article 18 taken up. (Expenses - Arlington Rationing Board No. 49)


The Finance Committee recommended the following:


That the sum of fifteen hundred (1,500) dollars be and hereby is appropriated to defray the necessary expenses of the Arlington Rationing Board No. 49; said sum to be raised by General tax and expended under the direction of the Board of Selectmen.


Mr. Beecy offered the following substitute motion :

That the sum of fifteen hundred (1,500) dollars be and hereby is appropriated to defray the necessary expenses of the Arlington rationing Board No. 49; Five hundred (500) dollars to be given as a gift and to be evenly divided among the personnel who are not on any payroll; said sum to be raised by general tax and expended under the direction of the Board of Selectmen


The Moderator and Acting Town Counsel ruled it illegal, and no further action was taken.


Thereupon on motion, duly made and seconded, it was


VOTED: That the sum of fifteen hundred (1,500) dol- lars be and hereby is appropriated to defray the necessary expenses of the Arlington rationing Board No. 49; said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 18 the Moderator declared it disposed of.


Article 19 taken up. (Sale, Transfer or Lease of Town Property to the Federal Government)


On motion, duly made and seconded, it was unani- mously


VOTED: That the Board of Selectmen and any other board or elected town officer acting with the approval of the Board of Selectmen be and they hereby are authorized and impowered in behalf of the town, to sell, transfer, or lease to the United States of America or any instrumentality or agency thereof during the existing state of war between the United States and any foreign country, any property of the town in the possession or control of said boards and officers respectively.


There being no further business under Article 19 the Moderator declared it disposed of.


Article 20 taken up. (Amendment of Town By-Law Re Disposal of Town Property)

The Finance Committee recommended the following :


That article 12 of the Town By-Laws be and hereby is amended by striking out section 8 and inserting in place thereof the following :- Section 8. No personal property of the town shall be sold, transferred or otherwise dis- posed of unless under authority of a vote of the town, except that any material or article of personal property which has become obsolete or is no longer required for the use of the town and has a value of not more than fifty (50) dollars may be sold or transferred for its fair value, if any, by the board or officer having control thereof - and any such material or article having a value of more than fifty (50) dollars but less than five hundred (500) dollars may be sold or transferred with the approval of the Board of Selectmen.


MOVED: That the sum of fifty (50) dollars be and hereby is appropriated for the expense of publishing the amendment of Article 12 of the Town By-Laws made at this meeting.


On being put to a vote the Moderator declared the motion lost.


There being no further business under Article 20 the Moderator declared it disposed of.


Article 21 taken up. (Disposal of German Howitzer)


On motion, duly made and seconded, it was unanimously


VOTED: That the Town do approve and confirm the action of the Board of Selectmen in turning over to the United States Army, with the approval of Arlington Post 1775 of the Veterans of Foreign Wars, the 105-millimeter German howitzer accepted as a gift from said Post in 1932.


There being no further business under Article 21 the Moderator declared it disposed of.


Article 22 taken up. (Conversion of Heating Systems - Town Buildings)

ARLINGTON TOWN REPORT


The Finance Committee recommended the following:


That the sum of ten thousand (10,000) dollars be and hereby is appropriated for the purpose of converting the oil heating systems in the buildings owned by the Town to coal; said appropriation to be raised by general tax and expended under the direction of the Board of Selectmen.


NOTE: A substitute motion will be made on this ar- ticle, as the correct amount was not available during the Finance Committee meetings.


Chairman Estabrook offered the following substitute motion, duly seconded


That the sum of twenty-one thousand two hundred sixty and 44/100 dollars ($21,260.44) be and hereby is ap- propriated for the purpose of converting the oil burning heating systems in buildings owned by the town to coal burning systems.


Said appropriation to be raised by general tax and expended as follows :


Seven thousand five hundred twenty-two and 18/100 dollars ($7,522.18) by the School Committee for conversion of the heating systems in the New High School building and the Brackett School building;


Seven thousand nine hundred thirty-five and 16/100 dollars ($7,935.16) by the Board of Selectmen for conver- sion of the heating systems in the Town Hall, the Robbins House and the Police Station ;


Two hundred seventeen and 96/100 dollars ($217.96) by the Board of Public Works for conversion of the heating system in the Public Works building; and


Five thousand five hundred eighty-five and 14/100 dol- lars ($5,585.14) by the Trustees of Robbins Library for conversion of the heating systems in the Robbins Library and the Dallin Branch Library.


and on being put to a vote the Moderator declared it carried.

Thereupon, on motion duly made and seconded it was unanimously


VOTED: That the sum of twenty-one thousand two hundred sixty and 44/100 dollars ($21,260.44) be and here- by is appropriated for the purpose of converting the oil burning heating systems in buildings owned by the town to coal burning systems.


Said appropriation to be raised by general tax and ex- pended as follows:


Seven thousand five hundred twenty-two and 18/100 dollars ($7,522.18) by the School Committee for conversion of the heating systems in the New High School building and the Brackett School building;


Seven thousand nine hundred thirty-five and 16/100 dollars ($7,935.16) by the Board of Selectmen for conver- sion of the heating systems in the Town Hall, the Robbins House and the Police Station ;

Article 23 taken up. (Committee on Classification of Posi- tions, etc .; Town Departments)


The Finance Committee recommended the following :


VOTED: That a committee is hereby established to consist of five (5) registered voters of the Town to be ap- pointed by the Moderator, one of whom shall be a Town employee.


The duty of the committee shall be to investigate and study the advisability of establishing, with the approval of

the civil service commission, a classification of positions and a plan for standardization of wages and salaries for all departments of the Town, and to submit a report with recommendations at a town meeting no later than the an- nual town meeting in 1944.


The committee shall hold its first meeting for the pur- pose of organization and the election of a Chairman within thirty (30) days after the dissolution of this meeting and shall promptly report any vacancy in its membership to the Moderator who shall fill the same.


The sum of one hundred fifty (150) dollars to be raised by general tax, is hereby appropriated for the necessary expenses to be incurred by the committee with the approval of the Board of Selectmen.


and on being put to a vote the Moderator declared it carried.


There being no further business under article 23 the Moderator declared it disposed of.


Article 24 taken up. (Purchase of Federal Government or Other Bonds)


The Finance Committee recommended the following :


That the sum of two hundred thousand (200,000) dol- lars be and hereby is appropriated for the purpose of pur- chasing for investment, defense bonds, war bonds or other bonds issued by the Federal Government, as authorized by Chapter 5 of the Acts of 1943; that for the purpose of such purchase the sum of one hundred fifty thousand (150,000) dollars be taken from available funds now in the Treasury and the sum of fifty thousand (50,000) dollars be raised by general tax and expended by the Town Treasurer with the approval of the Board of Selectmen.


Mr. Franklin Moore offered the following substitute motion, duly seconded,

That the sum of one hundred fifty thousand (150,000) dollars be and hereby is appropriated for the purpose of purchasing for investment, defense bonds, war bonds or other bonds issued by the Federal Government, as author- ized by Chapter 5 of the Acts of 1943; that for the purpose of such purchase the sum of one hundred fifty thousand (150,000) dollars be taken from available funds now in the Treasury and expended by the Town Treasurer with the approval of the Board of Selectmen.


After lengthy discussion it was put to a vote and the Moderator declared it carried.


Thereupon, on motion duly made and seconded, it was


VOTED: That the sum of one hundred fifty thousand (150,000) dollars be and hereby is appropriated for the purpose of purchasing for investment, defense bonds, war bonds or other bonds issued by the Federal Government, as authorized by Chapter 5 of the Acts of 1943; that for the purpose of such purchase the sum of one hundred fifty thousand (150,000) dollars be taken from available funds now in the Treasury and expended by the Town Treasurer with the approval of the Board of Selectmen.


There being no further business under Article 24 the Moderator declared it disposed of.


Article 25 taken up. (Acquisition of Land for Fire De- partment Purposes)


The Finance Committee recommended the following :


That no action be taken under Article 25 of the warrant.


NOTE: The information as to the area of the prop- erty to be purchased and the price thereof was not received by the Finance Committee in time to give this article proper consideration.

That the Board of Selectmen be and it is hereby auth- orized and empowered on behalf of the Town to purchase or take in fee by eminent domain or otherwise acquire, for enlargement of the Highland Fire Station lot, that parcel of land within the Town, with the buildings thereon, con- taining about 7040 square feet and bounded substantially as follows :


Beginning at a point in the division line between land of the Town, being the present Highland Fire Station lot, and land now or formerly of George W. and Bessie C. Cor- bett, 97.00 feet northeasterly from the northeasterly side line of Massachusetts Avenue, thence northeasterly by said land of the Town 86.00 feet to land now or formerly of Mary E. Kelly et al, thence southeasterly about 80.00 feet to an angle point, thence southwesterly 90.00 feet more or less to a point in the division line between land now or formerly of Alice M. Kyne and said land now or formerly of George W. and Bessie C. Corbett, said point being 97.00 feet northeasterly from the said northeasterly side line of Massachusetts Avenue, thence northwesterly through said land now or formerly of George W. and Bessie C. Corbett, 80.00 feet to the point of beginning.


That for the purpose of such purchase, taking or ac- quisition the sum of forty-five hundred (4500) dollars be and hereby is appropriated ; and that said sum be raised by general tax and expended under the direction of the Board of Selectmen.


On being put to a vote the Moderator declared the motion lost.


Thereupon, on motion duly made and seconded, it was


VOTED: That no action be taken under Article 25 of the Warrant.


There being no further business under Article 25, the Moderator declared it disposed of.


Article 26 taken up. (Acquisition of Land for the Exten- sion of Mount Pleasant Cemetery)

VOTED: That the Board of Cemetery Commissioners be and it hereby is authorized, on behalf of the town, to take by eminent domain or to acquire by purchase or otherwise for the extension of Mount Pleasant Cemetery, that parcel of land within the town containing 135,000 square feet more or less, with the buildings thereon bounded as follows :


Beginning at the northwesterly corner of lot 8 shown on plan entitled : "Plan of House Lots For Sale by Alvin E. Aldrich situated in Arlington, Mass." dated July 18, 1896 and recorded with Middlesex South District Deeds book of plans 102, plan 2, and at land indicated on said plan as land of Fowle and at lot 1 shown on said plan, thence running southerly by lots 1, 2, 3 and 4 shown on said plan 171.50 feet, thence turning and running northeasterly by the southeasterly boundary lines of lots 5 and 6 shown on said plan and by said southeasterly boundary lines of lots 5 and 6 extended northeasterly in the same course to land of the Town of Arlington a distance of approximately 470 feet, thence turning and running north 12º 32" west a distance of 35 feet more or less to a point of curve in the boundary line of said land of Town of Arlington, thence northerly and northwesterly on a curve to the left with a radius of 189.51 feet a distance of 247.54 feet to a point of tangency, thence turning and running north 87° 23" west 109.48 feet to a point of curve, thence northwesterly on a curve to the right with a radius of 213.11 feet a distance of 149.03 feet to land of the Town of Arlington formerly of the devisees of William Stowe, said last three courses being by land conveyed by said Aldrich to the town of Arlington, thence running northwesterly by said land formerly of the devisees of William Stowe 21 feet more or less to land formerly of Samuel A. To meet the cost of such acquisition the sum of five thou- sand seven hundred dollars ($5,700) is hereby transferred from the Sale of Lots and Graves Fund and appropriated therefor.

Article 27 taken up. (Acquisition of land for the Extension of Mount Pleasant Cemetery)


On motion, duly made and seconded, it was unanimously


VOTED: That the Board of Cemetery Commissioners be and hereby is authorized on behalf of the town, to take by eminent domain or to acquire by purchase or otherwise for the extension of Mount Pleasant Cemetery, that parcel of land within the town containing 86,000 square feet, more or less, with the buildings thereon, bounded as follows :


Beginning at the southeasterly corner of lot 44 shown on a plan "Plan of House Lots for sale by Alvin E. Aldrich situated in Arlington, Mass." dated July 18, 1896 and re- corded with Middlesex South District Deeds book of plans 102, plan 2, and at land now or formerly of Irwin, thence running nearly easterly by said land of Irwin 414.15 feet to land of the Town of Arlington, thence running northeasterly by said land of Town of Arlington 82.12 feet to a stone bound, thence running southeasterly by said land of the Town of Arlington 17.35 feet to a stone bound, thence run- ning north 12º 32" west a distance of 185 feet more or less to land now or formerly of Joseph Sztobbe et al, thence turning and running southwesterly by said land now or formerly of Joseph Sztobbe et al., a distance of 470 feet more or less to the southwesterly corner of lot 5 shown on said plan, thence turning and running southeasterly across

VOTED : That the sum of one thousand (1,000) dollars be and hereby is appropriated for the acquisition by pur- chase, of burial rights in unused lots or parts of lots in Mount Pleasant Cemetery ; and that said sum be taken from (Mt. Pleasant Cemetery) Sale of Lots and Graves Fund and expended under the direction of the Board of Cemetery Commissioners.


There being no further business under Article 28 the Moderator declared it disposed of.


Article 29 taken up. (Acquisition of Land for School Pur- poses)


The Finance Committee recommended the following :


That the Board of Selectmen as it is now or may here- after be constituted, be and it is hereby authorized and em- powered on behalf of the town, to take by eminent domain or to acquire by purchase or otherwise for the purpose of erecting a school house thereon, that parcel of land within the town bounded and described as follows :
