GENERAL STATISTICS
Arlington is situated six miles northwest of Boston, in. latitude 42 deg., 25 min. north; longitude 71 deg., 09 min. west, at an elevation about mean tide of from 4 to 377 feet.
Massachusetts Avenue at Cambridge line, elevation 10 feet.
Massachusetts Avenue at Pleasant Street, elevation 48 feet.
Massachusetts Avenue at Park Avenue, elevation 155 feet.
Park Circle at Eastern Avenue (base of standpipe), eleva- tion 377 feet.

The Town and a part of what is now Belmont were set off from Cambridge and incorporated as West Cambridge in 1807. The name was changed from West Cambridge to Arl- ington in 1867.

Report of the Town Counsel

Gentlemen :
I herewith submit my report for the year 1949 in com- pliance with Section 3 of Chapter 3 of the By-laws of the Town.
There have been nineteen accident claims against the Town this year. Two have been settled as authorized by the Selectmen, five have brought suit, and eight are in abeyance. Of the previous year's claims and suits, six were abandoned by the claimants without suit, three at the time they were reached for trial and one was settled as author- ized by the Selectmen. There were no verdicts against the Town, but one case which was tried before a jury, and which resulted in a verdict for the Town, has been appealed by the Plaintiff to the Supreme Judicial Court on a question of law.
Two contract claims against the Town were tried in court resulting in verdicts for the Town. There were nine claims against third persons for damages to property of the Town, and one held over from previous years. Six of these were collected in full, one compromised and three are pending.
There were two civil service hearings, one in which the Town was upheld and the other is now pending in the Superior Court which your council believes will be dismissed in favor of the Town.
The claim of the General Construction Company for damages for the taking of its land for school purposes was compromised as authorized by the Town Meeting and the Board of Selectmen.
The claim of Lillian Y. Rubin for damages for the taking of her land (the so-called Pierce and Winn property) re- sulted in a verdict against the Town in the amount of $71, 552.00, including interest, indicating a value of $64,000.00 and $7,552.00 interest to which she was entitled.

ARLINGTON TOWN REPORT
Under the law the petitioner is entitled to recover fair market value as of the date of taking (July 15, 1946) plus interest at the rate of 4% per annum from the date of taking to the date of the verdict. By agreement of counsel interest was added by the jury at the percentage of 11.8. Experts for the petitioner testified that the property had a value up to $175,000.00, but witnesses and experts for the Town evidently convinced the jury that $64,000.00 was a fair amount. Certain exceptions were taken by the Peti- tioner and a bill of exception is now being prepared for the Supreme Judicial Court. In order to prevent further interest accumulation the Town has paid the petitioner the amount of the verdict plus interest and costs.
The position of the Board of Assessors before the Board of Tax Appeals, the Arlington Board of Appeals before the Emergency Housing Commission, and the Inspector of Buildings and Board of Selectmen before the Outdoor Advertising Authority, has been defended.
Substantial amounts of money for aid rendered by the Board of Health and by the Symmes Arlington Hospital have been collected and turned over to the Town Collector.
The Town Counsel has been available at regular meetings of the Board of Selectmen and the Board of Public Works, has rendered opinions as requested by other boards, depart- ments, committees and officers, has attended hearings at State Boards and Commissions, and has been vigilant in all other matters affecting the interests of the Town.
For the kind consideration and cooperation extended to me by all the officials of the Town during the past year, and especially to the Board of Selectmen and Board of Public Works, I desire to record my sincere appreciation.

Report of the Inspector of Animals
A total of 131 animals were examined and quarantined, which had bitten persons in Arlington during the past year.
There were no cases of rabies in Arlington in 1949.
A total of eight barns were inspected according to the instructions of the Director of Livestock Disease Control. There were nine animals examined during this inspection. All animals and premises were found satis- factory.

Report of the Board of Health
The Board of Health herewith submits its Annual Re- port for the year ending December 31, 1949.
At the Annual Town election held on March 7, 1949 Mr. John S. Crosby was elected a member of the Board of Health for a term of three years.
The Board organized on March 11, 1949 with the unan- imous election of Dr. Ernest R. Brooks as Chairman.
The meetings of the Board are held the first Monday of each month at 8:00 P.M. in the office of the Board of Health. During the year twelve regular and two special meetings were held.
