Article 4 taken up. (Assessment for County Hospital) On motion duly made and seconded, it was


Voted: That payment to the County of Middlesex of amounts assessed upon or otherwise payable by the Town under Warrant issued by the County Commissioners in ac- cordance with Chapter 500, Section 1, of the Acts of 1943 for: (A) the Town's share of the care, maintenance and repair of Middlesex County Tuberculosis Hospital during the last preceding calendar year, including interest on tem- porary notes issued thereof, in accordance with sections of Chapter 111 of the General Laws applicable thereto; (B) the Town's share of any and all other expenses in connec- tion with said hospital, including expenses under section 25G (6) (a) of Chapter 32 of the General Laws inserted by Chapter 400 of the Acts of 1936; be and hereby is au- thorized, ratified and confirmed.


(Assessment total $36,829.66)

Article 5 taken up. (Amendment of Town By-Laws- Classification of Town Employees)


Hollis M. Gott offered the following amendment :


That Section IV entitled "Personnel Board" be stricken out and the following section substituted therefor :


Section IV. Personnel Board. There shall be a Per- sonnel Board consisting of three members to be appointed by the Moderator as follows :


1. An elected town official, who shall be chairman;


2. A town employee;


3. A citizen and registered voter of the Town. The elected town official shall be appointed for one year on or before May first, 1949, and each year thereafter on or be- fore May first. The town employee shall be an employee and a citizen of the Town who is not elected by the Town, and so far as possible one who is nominated by a majority of the employees of the Town present at a meeting duly

called for the purpose of such nomination, and shall be ap- pointed for three years on or before May first, 1949, and every three years thereafter on or before May first. The citizen shall be appointed for three years on or before May first, 1949, and every three years thereafter on or before May first. Vacancies shall be filled by the Moderator. The elected official resigning or removal from the Town or office; the employee ceasing employment and the citizen removing from the Town shall create a vacancy in each in- stance. Said Personnel Board shall have the power to em- ploy and pay an executive secretary.


On being put to a vote, the Moderator declared it carried.


Thereupon on motion duly made and seconded, it was unanimously


Voted: That the By-Laws of the Town be and hereby are amended by inserting after Article 7 a new Article to be known as Article 7-C, and to read as follows :-


Article 7C. Section 1. The Classification Plan. The official classification plan, when established by vote of the Town, shall consist of a classification for positions in the service of the Town and shall be listed in a schedule to be known as Schedule A. and made a part hereof.


Section 2. The Pay Plan. The official pay plan, when established by vote of the Town, shall consist of the min- imum and maximum salaries to be paid to all employees in any position included in the classification plan, as such salaries shall, from time to time, be established by vote of the Town. Said salaries shall be set forth in Schedule B.


Section 3. Amendment of the Plans. The classification plan, or the provisions included herein for the administra- tion thereof, may be amended in the manner provided by law, or in the manner provided by the By-Laws of the Town, whichever is applicable. The minimum and maximum salaries to be set forth in the pay plan may be established or changed by vote of the town at a Town Meeting, or as provided by law, whichever is applicable.


Section 4. Personnel Board. There shall be a Personnel Board consisting of three members to be appointed by the Moderator as follows :-


1. An elected Town Official, who shall be Chairman ;


2. A Town Employee;


3. A citizen and registered voter of the Town.

The elected Town Official shall be appointed for one year on or before May first, 1949, and each year thereafter on or before May first. Section 5. Class Definitions. The Personnel Board shall provide, and may amend from time to time, written defini- tions of the classes in the classification plan, such consisting of a statement describing the essential nature of the work characteristic of positions of the class that distinguished such positions from positions of other classes, with such examples as may be deemed appropriate.


Section 6. Interpretation of Class Definitions. The def- initions of the classes shall be interpreted as descriptive only and not restrictive. The definition for any class shall be construed solely as a means of identifying positions properly pertaining to the class, and not as prescribing what the duties or responsibilities of any position of the class shall be, or as modifying, or in any way affecting, the power of any administrative authority, as otherwise exist- ing, to appoint, to assign duties to, or to direct and control the work of any employee under the jurisdiction of such authority. .


Section 7. Records and Requisitions. The Personnel Board shall keep such records of all employees of the Town, including the name, age, date of employment, Civil Service classification, if any, department in which employed, nature of duties and other information as it deems desirable. All requisitions for persons to fill positions or perform duties classified under the Civil Service Law, all requests for

transfers, increases in salary, changes in rating, or other requests made to the Director of Civil Service or the De- partment of Civil Service shall be cleared through the Per- sonnel Board.


Section 8. Allocation of Positions to Classes. The Per- sonnel Board shall allocate each position subject to the provisions of this By-Law to its appropriate class in the classification plan. Whenever a new position is established, or the duties of any existing position are so changed that, in effect, a new position of a different class is substituted for the old position, the Personnel Board shall allocate such new or changed position to its appropriate class. It shall likewise reallocate any position from class to class whenever it finds such action warranted by reason of error in the allocation then in effect. It shall afford reasonable op- portunity to be heard to any employee or appointing au- thority affected by any allocation or reallocation, upon writ- ten request therefor, and may afford such opportunity in the absence of such request.


Section 9. Titles of Positions. No person shall be ap- pointed, employed, or paid as an employee in any position subject to the provisions of this By-Law, under any title other than that of the class to which the position is allocated. The title of each class shall be the official title of every posi- tion allocated to the class for all purposes having to do with the position as such, and shall be used to designate the posi- tion in all payrolls, budget estimates, and official records and reports, and in every other connection involving per- sonnel and fiscal processes, but any abbreviation or code symbol approved by the Personnel Board may be used in lieu of the title to designate the class of a position in any such connection.


Section 10. Interpretation of Pay Plan. The interpreta- tion and effects of the minimum and maximum salaries at any time hereafter established by vote of the town, and pro- visions for initial adjustments to the pay plan, shall be included in the votes establishing such salaries.


Section 11. Operation of By-law. This By-law shall be operative only as to employees whose positions are classified hereunder and for which positions minimum and maximum salaries have been established by vote of the town at a Town Meeting.


Section 12. Civil Service Law. Nothing in this By-law shall be construed to conflict with Chapter 31 of the Gen- eral Laws.

Article 6 taken up. (Acceptance of General Laws- Forty Hour Week for Town Employees)


The Finance Committee recommended the following :


That no action be taken under Article 6 of the warrant.


J. Howard Hayes of the Finance Committee offered the following substitute motion, duly seconded :


That the Moderator be and hereby is instructed to ap- point a committee of five citizens to investigate the effect of a 40 hour week on the Town of Arlington and its em- ployees, with particular reference to the provisions of section 33-A of Chapter 149 of the General Laws; said committee to report at the next special Town Meeting, if any, and not later than the Annual Town Meeting of 1950.


Harold J. O'Brien offered the following substitute motion for that offered by J. Howard Hayes of the Finance Com- mittee :


That Section 33-A of Chapter 149 of the General Laws, as amended, be and hereby is accepted by the Town of Arling- ton.


Discussion followed. Paul A. Egan then moved the Prev- ious Question, which was duly seconded and carried.


A rising vote was then taken on the motion as offered by Harold J. O'Brien to substitute for that of J. Howard Hayes of the Finance Committee, resulting in 101 voting in the affirmative and 105 voting in the negative, and the Mod- erator declared the motion lost.


The vote was doubted, and more than twenty Town Meet- ing Members asking for a roll call, a roll call was then taken, resulting in 110 voting in the negative and 105 voting in the affirmative, and the Moderator declared the motion lost.


Thereupon, on motion duly made and seconded, it was


Voted: That the Moderator be and hereby is instructed to appoint a committee of five citizens to investigate the effect of a 40-hour week on the Town of Arlington and its employees, with particular reference to the provisions of
