Article 8. To see if the Town will authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1950, and to issue a note or notes therefor, payable within one year, and to re- new any note or notes that may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 9. To see if the Town will make an appropria- tion for the Extension of the Sewerage System; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 10. To see if the Town will make an appropria- tion for the Extension of Water Mains; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 11. To see if the Town will make an appropria- tion for the Extension of Storm Drains; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 12. To see if the Town will make an appropria- tion for the construction of permanent sidewalks and for the installing of edgestones ; determine in what manner the money shall be raised; or take any action relating thereto.


Article 13. To see if the Town will make an appropria- tion for maintaining, repairing and improving all or any part of the ways within the town; said appropriation to be used with any sum or sums which may be allotted by the Commonwealth or the County of Middlesex or both for such

purpose or purposes; determine in what manner the money shall be raised and expended; or take any action in any way relative to all or any of the foregoing.


Article 14. To see if the Town will make an appropria- tion for the relocation, alteration and widening, construc- tion of, specific repairs upon and improvement of all or any parts of Massachusetts Avenue, Broadway or Lake Street, within the town as now existing or hereafter relocated, altered or widened, including land damages, if any, under the provisions of law authorizing the assessment of better- ments or otherwise; said appropriation to be used with any sum or sums which may be allotted by the Commonwealth or County of Middlesex or both for such purpose or pur- poses ; determine in what manner the money shall be raised and expended; or take any action in any way relative to all or any of the foregoing.


Article 15. To see if the Town will accept the laying out of a Town way from North Union Street to Gardner Street, substantially in the location of the private way known as Fremont Street, as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works, under the provisions of law authorizing the assess- ment of betterments; establish said way ; make an appropri- ation for said laying out and the construction of said way ; determine in what manner the money shall be raised; or take any action relating thereto.


Said way as so laid out is bounded and described, as follows :

Article 16. To see if the Town will make an appropria- tion under the provisions of law authorizing the assessment of betterments, for the orignal construction of a public way in the Town, the laying out of which is accepted at this meeting, including land damages and the cost of pavement and sidewalks laid at the time of said construction; deter- mine in what manner the money shall be raised and ex- pended; or take any action relating thereto.


Article 17. To see if the Town will authorize the ac- quisition by purchase, eminent domain or otherwise of any land easements or rights therein, including an easement in land adjoining the location of any or all public ways, the laying out of which is accepted at this meeting, con- sisting of a right to have the land of the location protected by having the surface of such adjoining land slope from the boundary of the location; make an appropriation for such acquisition; determine in what manner the money shall be raised and expended; or take any action relating thereto.

Article 19. To see if the Town will make an appropria- tion for the use of the "Committee on Advanced Program- ming and Budgeting"; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 20. To see if the Town will appropriate a sum or sums of money for the purpose of erecting an addition or additions to the present Junior High School West, and the alteration or reconstruction of the present interior of said school; determine in what manner the money shall be raised and expended; or take any action relating to any or all of the foregoing.

Article 22. Article 23. To see if the Town will appropriate a sum or sums of money to be expended under the joint direction of the School Committee and the Board of Park Commis- sioners for the purpose of constructing a field house, in-

cluding public sanitaries and athletic facilities, complete with furnishings, at Warren A. Peirce Field; determine in what manner the money shall be raised; or take any action relating thereto.

Article 24. To see if the Town will transfer the sum of seven thousand five hundred dollars ($7,500.) from (Mt. Pleasant Cemetery) Sale of Lots and Graves Fund to the Cemetery Commissioners for the improvement of the Town Cemetery.

Article 25. To see if the Town will appropriate the sum of two hundred seventy-five dollars ($275.) to be expended under the direction of the Cemetery Commissioners for the purpose of erecting a metal flag pole in Mt. Pleasant Cem- etery as a memorial to men and women who served in the Armed Forces of the United States; determine in what man- ner the money shall be raised; or take any action relating thereto.

Article 26. To hear and act upon the report of the Com- mittee appointed by the Moderator, in pursuance of the vote of the Town passed on March 14, 1947, under Article 33 for the Annual Town Meeting in 1947, "to investigate, study, consider and make recommendations as to the advisability of adopting another form of municipal government, or, of making any reorganization of town departments that would afford a more unified, integrated, efficient and economical administration of executive function and public services, said Committee to report its recommendations to the Town at the next Special Town Meeting, if any, but not later than the Annual Town Meeting of 1948", and to see if the Town will authorize and instruct the Board of Selectmen to peti- tion the General Court for legislation necessary and proper to authorize the said Board of Selectmen to be increased from three to five members, and also to have the said Board of Selectmen act as a Board of Public Works exercising the powers of surveyors of highways, road commissioners, water commissioners, sewer commissioners, tree warden, and Board of Public Survey ; to authorize the said Board to

appoint an Executive Officer and designate his powers, in- cluding the centralization of purchasing under the Execu- tive Officer; and to abolish the Board of Public Works and Tree Warden; all substantially in accordance with the re- port of said Committee, or take any action thereon or re- lating thereto.

Article 27. To see if the Town will appropriate the sum of $2,000.00 for the purpose of studying the Arlington Center area, such sum to be expended under the direction of the Planning Board; determine in what manner the money shall be raised ; or take any action relating thereto.

Article 28. To see if the Town will amend its Zoning By-law in the following respects :


1. By striking out paragraph 2 of section 5 entitled "Amendments" of said Zoning By-law and substituting in place thereof the following new paragraph 2.


2. The Planning Board, upon the request in writing of not less than ten registered voters of the Town shall, or upon its own initiative may, hold a public hearing for the consideration of any proposed amendment, modification or repeal of this by-law, provided that where a petition is filed such petition shall show that copies of the petition have been sent by registered mail to all abutters of the land referred to in the petition. The Planning Board shall report to the Town Meeting its recommendations with respect to the action to be taken thereon. Notice of such hearing shall be given by publication in a newspaper of general circulation in the Town, the first publication to be not less than ten days before the date assigned for the hearing.


2. By striking out the numerals 25 as they appear in the sixth line of paragraph 1 of section 14-A-"Area Reg- ulations" and substituting in place thereof the numerals 35 so that said paragraph 1 as amended will read as follows :


1. Lot Area. In the Residence B districts, no lot shall have a frontage of less than sixty feet or an area of less than six thousand square feet and no building or buildings on any one lot, including garages, and other accessory build- ings, shall be constructed, altered, enlarged, reconstructed or moved so as to have an average gross floor area per story

of more than 35 per cent of the area of the lot, provided, however, that this restriction shall not prohibit the erection of a private garage for not more than two cars which is accessory to and used with a building existing when this by-law takes effect and used as a residence.

Article 29. To see if the Town will amend its zoning by-law by altering the zoning map therein referred to so as to include in the Business A District all or any part of the area now included in the Residence B District, bounded as follows :


Beginning at a point on the southeasterly side line of Bartlett Avenue, said point being located 234.73 feet south- westerly of the point of intersection of said southeasterly side line of Bartlett Avenue and the southwesterly side line of Massachusetts Avenue, thence southeasterly through private lands a distance of 152.50 feet to a point on the southeasterly boundary line of the First National Stores property, thence southwesterly by said southeasterly boun- dary line of the First National Stores property a distance of 140.02 feet to a point, thence northwesterly through land now or formerly of the First National Stores a distance of 153.32 feet to a point on the southeasterly side line of Bart- lett Avenue, thence northeasterly on said southeasterly side line of Bartlett Avenue a distance of 140.00 feet to the point of beginning as shown on a plan entitled, "Plot of Land at Mass. Ave. and Bartlett Ave., Arlington, Mass. showing additional parking area, scale 1"-20'-0", Dec. 28, 1948."

Article 30. To see if the Town will amend its zoning by-laws by altering the Zoning map therein referred to so as to include in the Business A. district all or any part of the area now included in the Residence B district, bounded and described as follows :

To see if the Town will vote to appoint a Committee to investigate the feasibility of utilizing for some beneficial municipal purpose the land lying south of Summer Street known as Fowles Pond and adjacent lands owned by the Town; make an appropriation therefor; de- termine the manner in which said appropriation may be raised and expended; or take any action relating thereto.

Article 35. To see if the Town will vote to authorize the Board of Public Works as it constitutes the Board of Water Commissioners of the Town of Arlington to grant to the Town of Lexington an easement approximately 40 feet in width and approximately 112 feet in length for the purpose of laying, maintaining, repairing and removing and all acts incidental thereto, sewer pipes over a strip of land owned by the Town of Arlington in said Town of Lexington, bounded and described substantially as follows :


The centerline of the said sewer easement begins at a point in the rear lot line of Lot 204 in the Arlington Heights Terrace Development, said point being northeasterly and distant 15 feet from the lot corner between Lots 203 and 204 in said development, thence S 32° 17' 02" E. distant 112.04 feet to a manhole on the trunk line sewer, said man- hole being southwesterly and distant 150.60 feet from a manhole at an angle point on said trunk line sewer, and for a width of 20 feet on each side of the above-described center- line, said easement being on and across property of the Town of Arlington, all as shown on a plan entitled, "Plan of Proposed Sewer Easement, Lexington, Mass., Scale 1 in .- 20 ft., Jan. 14, 1949, William M. Burns, Town Engineer"; or take any action relating thereto.

Article 36. To see if the Town will sell, convey or other- wise dispose of a certain parcel of land hereinafter des- cribed ; or take any action relating thereto.


Said parcel of land is bounded and described as follows :


Beginning at a point of curve in the curbing, located on the southeasterly side of Park Avenue, approximately 50 feet south of the southeasterly side line of Prospect Avenue, thence northeasterly, easterly and southeasterly on a curve to the right with a radius of 22.7 feet and by said curbing, a distance of 52.34 feet to a point of reverse curve in said curbing, thence southeasterly on a curve to the left with a radius of 171.27 feet and by said curbing a distance of 23.52 feet to a point of reverse curve in said curbing, thence south- erly and southwesterly on a curve to the right with a radius of 10 feet and by said curbing, a distance of 19.64 feet to a point of reverse curve in said curbing, thence southwest- erly on a curve to the left with a radius of 200.0 feet and by said curbing a distance of 49.24 feet more or less to a point of reverse curve in said curbing, thence westerly,

Article 37. To see if the Town will accept for care and control for the purpose of a public playground or recreation center, the parcel of land hereinafter described and at pres- ent under the jurisdiction and control of the Commonwealth of Massachusetts, Metropolitan District Commission, any portion thereof; determine by whom the powers conferred by Section 14 of Chapter 45 of the General Laws shall be exercised; make an appropriation of money for all or any of the purpose aforesaid; determine in what manner the money shall be raised and expended ; or take any action re- lating to any or all of the foregoing.

Jones, thence south 28°-16'-52" west by said land now or formerly of William H. To see if the Town will reappoint a Com- mittee to consider the erection of a suitable memorial build- ing in grateful recognition of the sacrifices of all its cit- izens who gave their services and their lives in the defense of their country and people in all Wars; said Committee to be composed of one member of the United Spanish War Veterans, one member of Arlington Post No. 39, American Legion, one member of Arlington Post No. 1775, Veterans of Foreign Wars of United States, one member of the Arlington Chapter Disabled American Veterans, one mem- ber of Stanley G. Benner Detachment, Marine Corps League, one member of the Arlington Chapter, Amvets, and four other members, one an architect, one a Superintendent of Building Maintenance, one a member of the faculty of Ar- lington High School concerned with athletics, and one a rec- reation worker; said Committee of ten (10) to report to the Town at the next Annual Town Meeting ; appropriate a sum of money for the use of said Committee, determine in what manner the money shall be raised; or take any action relat- ing thereto.
