Philip H. Burt, stenographer, was sworn by the Town Clerk to the faithful performance of his duties.


The meeting was called to order at 8:10 P.M. by the Mod- erator, Ernest W. Davis, who declared a quorum present.


One Town Meeting Member, not previously sworn, was sworn by the Moderator.


There being no objection to the request of Selectman Peterson, permission was granted Mr. Purcell of the Board of Selectmen; Mr. Nicksay, the Secretary of the Board of Selectmen; Messrs. Hauser and Sampson of the Board of Assessors; Mr. Wallace of the Board of Public Works; Messrs.O'Reilly, Fish, Daniels, Wise, Halpin, Farrow and Robson of the Finance Committee, and Mr. Smith, Executive Secretary of the Finance Committee, to sit with him during the meeting.


The Town Clerk read the Call for the Meeting and the Constable's return thereon; the reading of the remainder of the Warrant being waived by consent of the meeting.

William C. Adams presented the report of the Committee appointed to investigate the effect of a 40-hour week on the Town of Arlington and its employees, with particular refer- ence to the provisions of Section 33-A of Chapter 149 of the General Laws, and on motion duly made and seconded, it was


Voted: That the report be accepted and placed on file.


Gordon P. Thompson presented the report of the Commit- tee appointed to study a method for the disposal of rubbish and waste material collected by the Town, and on motion duly made and seconded, it was


Voted: That the report be accepted and placed on file and the committee be discharged.


Edmund L. Frost presented the report of the Committee appointed to investigate the feasibility of utilizing for some beneficial municipal purpose the land laying south of Sum- mer Street, known as Fowles Pond, and adjacent lands own- ed by the Town, and on moton duly made and seconded, it was

Article 2 taken up. (Appointment of Committee - Lib- rary Facilities in East Arlington)


On motion duly made and seconded, it was


Voted: That the Moderator be and hereby is instructed to appoint a committee of six, consisting of one member of the Library Trustees and one member of each of the follow- ing five precincts, Precincts 1-2-3-4 and 5, to investigate the library facilities in East Arlington ; said committee to report its recommendations to the Town at the next Special Town Meeting if any, but not later than the Annual Town Meeting of 1950; and that the sum of one hundred (100) dollars be and hereby is appropriated for the necessary expenses to be incurred by said committee; said sum to be taken from available funds now in the Treasury.


There being no further business under Article 2, the Mod- erator declared it disposed of.


Article 3 taken up. (Lease or Rental - Library in East Arlington)


On motion duly made and seconded, it was


Voted: That the Trustees of the Robbins Library be and hereby are authorized and empowered to lease in that part of Arlington known as East Arlington, such premises to be used as a branch of said Library, as said trustees shall deem advisable; said authorized lease may be for a term not ex- ceeding five years from November 1, 1949, with a right to the Trustees to renew said lease for a further term not exceed- ing five years; all other terms and conditions of said lease shall be within the discretion of said Trustees; and said Trustees are further hereby authorized and empowered to expend such sum or sums as may be herein or may be here- after voted by the Town Meeting for alterations, improve- ments and maintenance of such premises; that the sum of three thousand (3,000) dollars be and hereby is appropriated to be expended by said Trustees in such manner as they may deem advisable for the foregoing and the operation of said branch Library; said sum to be taken from available funds now in the Treasury.


There being no further business under Article 3, the Moderator declared it disposed of.

Article 4 taken up. (Additional Appropriation for Pub- lic Welfare and Old Age Assisstance)


On motion duly made and seconded, it was


Voted: That the amounts hereinafter stated be and here- by are appropriated for the following purposes :


(a) Public Welfare, including Aid and General Relief $20,000.00


(b) Old Age Assistance $20,000.00


and that to meet said appropriations the sum of forty thous- and (40,000.) dollars be taken from available funds now in the Treasury and expended under the direction of the Board of Selectmen.


There being no further business under Article 4, the Moderator declared it disposed of.


Article 5 taken up. (Claim of the General Construction Company)


On motion duly made and seconded, it was


Voted: That the Board of Selectmen be and hereby are authorized and empowered on behalf of the Town to compromise the claim of the General Construction Company for damages resulting from the taking of its land by emi- nent domain for school purposes ; that the sum of $9,875.00 be and hereby is appropriated, said appropriation to be added to the amount appropriated and allocated to said land under Article 40 of the 1946 Annual Town Meeting in the amount of $1,725.00, and making a total of $11,600.00; said $9,875.00 to be taken from available funds now in the treasury and expended under the direction of the Board of Selectmen.


There being no further business under Article 5, the Moderator declared it disposed of.


Article 6 taken up. (Extra Special Compensation for the Year 1949, for Town Officers and Employees)


The Finance Comm ittee recommended the following: That no action be taken under Article 6 of the Warrant. After discussion by the Town Meeting of the following substitute motion presented by Paul A. Egan:


That effective January 1, 1949 there be paid to each full-time employee of the Town, exclusive of School Teachers, a sum equal to five (5) percent of his or her base pay for the twelve months period of the year 1949, to be paid pro-rata of the amount earned and to each part-time or seasonable employee of the

Town who was employed during the twelve months period of the year 1949 and who was employed on October 1, 1949, there be paid an amount in such proportion to the time worked as the various de- partments shall determine; all elective officials are hereby specifically excluded from receiving any payments hereunder except the Town Clerk and the Town Treasurer; this action shall not be con- strued as permanently increasing salary or wages, nor shall any payment be deemed to be part of the regular compensation of any Town Employee or Town Officer.


The sum of Seventy Two Thousand ($72,000.00) Dollars be and hereby is appropriated for the pur- pose of this article, said sum to be taken from available funds now in the treasury of the Town and expended under the direction of the various boards and heads of Departments of the Town and charged to the appropriation made under this article.


On motion of Harold E. Magnuson, duly seconded, it was Voted: To lay Article 6 on the table.


Article 7 taken up. (Acceptance of General Laws - Forty Hour Week for Town Employees)


On motion duly made and seconded, it was


Voted: That no action be taken under Article 7 of the Warrant.

Article 8 taken up. (Zoning - Winter Street and Broad- way)


John O. Parker of the Planning Board presented the Re- port of the Planning Board, and on motion duly made and seconded, it was

That the Town amend its Zoning By-Law and Map so as to change the area more particularly described in article No. 8 of the Warrant for the Special Town Meeting of Oct- ober 17, 1949 from a Residence B to a Residence C District.

Article 9 taken up. (General Laws - Classification Plan) On motion duly made and seconded, it was


Voted: That in accordance with the provisions of Article 7C, Section 1 of the By-Laws of the Town, the Classifica- tion Plan as presented to this Town Meeting by the Com- mittee on Salaries and Wages be and hereby is adopted as the official Classification Plan for Town Employees, and shall be hereafter known and referred to as "By-Law Article 7C, Section 1, Schedule A" and that the official plan shall at all times be on file with the Personnel Board as established under Section 4 of said Article 7C.


There being no further business under Article 9, the Mod- erator declared it disposed of.


Article 10 taken up. (General Laws - Pay Plan)


On motion duly made and seconded, it was


Voted: That in accordance with the provisions of Article 7C, Section 1 of the By-Laws of the Town, the Pay Plan as presented to this Town Meeting by the Committee on Sal- aries and Wages be and hereby is adopted as the official Pay Plan for Town Employees, and shall be hereafter known and referred to as "By-Law Article 7C, Section 2, Schedule B" and that the official plan shall at all times be on file with the Personnel Board as established under Section 4 of said Article 7C.

Voted: That the sum of forty-two hundred and ninety (4290) dollars be and hereby is appropriated for the pur- pose of making repairs, replacements, or other reconstruc- tion to the Junior High School East Auditorium and adjacent areas; said sum to be taken from available funds now in the Treasury and expended under the direction of the School Committee.


There being no further business under Article 12, the Moderator declared it disposed of.


Article 13 taken up. (Laying Out of Columbia Road) On motion duly made and seconded, it was


Voted: That the laying out of a town way from Mystic Street to Crosby Street, substantially in the location of the private way known as Columbia Road, as more particularly described in Article 13 of the warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works, be accepted, said way established and said Joint Board authorized to take land for the purpose of said way.


There being no further business under Article 13, the Moderator declared it disposed of.


Article 14 taken up. (Laying out of Stowecroft Road)

There being no further business under Article 14, the Moderator declared it disposed of.


Article 15 taken up. (Construction of Ways) On motion duly made and seconded, it was


Voted: That the sum of twenty-six thousand five hundred (26,500) dollars be and hereby is appropriated for the orig- inal construction of ways, the laying out of which is accepted at this meeting, including land damages and the cost of pave- ment and sidewalks laid at the time of such construction, all under the provisions of law authorizing the assessment of betterments ; said sum to be taken from available funds now in the Treasury and expended under the direction of the Board of Public Works substantially as follows, except that such amounts thereof not exceeding a total of one thousand (1,000) dollars, as may be awarded as damages by the Joint Board of Selectmen and Board of Public Works shall be ex- pended under the direction of said Joint Board.

That the Joint Board of Selectmen and Board of Public Works be and hereby is authorized and empowered on be- half of the Town, to purchase or take by eminent domain or otherwise acquire, easements in land adjoining the loca- tion of ways, the laying out of which is accepted at this meeting, consisting of the right to have the land of said locations protected by having the surface of such adjoining land slope from the boundaries of said locations; that for this purpose the sum of five hundred (500) dollars be and

hereby is appropriated; said sum to be taken from available funds now in the Treasury and expended under the direction of said Joint Board.

Article 17 taken up. (Additional Appropriation for Ex- tension of Water Mains)

Voted: That the additional sum of seven thousand (7,000.00) dollars be and hereby is appropriated for the ex- tension of water mains, said sum to be taken from available funds now in the Treasury and expended under the direction of the Board of Public Works substantially as follows :


Laying and relaying water mains of not less than six inches in diameter (including Tools and Equipment)


There being no further business under Article 17, the Moderator declared it disposed of.


Article 18 taken up. (Additional Appropriation for the Maintenance of the Water System)


On motion duly made and seconded, it was


Voted: That the additional sum of five thousand (5,000.00) dollars be and hereby is appropriated for Mainten- ance of the Water System; said sum to be taken from avail- able funds now in the Treasury and expended under the direction of the Board of Public Works.


There being no further business under Article 18, the Moderator declared it disposed of.


Article 19 taken up. (Additional Appropriation for the Removal of Ashes, Offal and Rubbish)


On motion duly made and seconded, it was


Voted: That the additional sum of fifteen thousand (15,000.00) dollars be and hereby is appropriated for the re- moval of ashes, offal and rubbish ; said sum to be taken from available funds now in the Treasury and expended under the direction of the Board of Public Works.


There being no further business under Article 19, the Moderator declared it disposed of.

J. Howard Hayes of the Finance Committee offered the following amendment, duly seconded :


That the motion of the Finance Committee be amended by striking out the words "available funds" and substituting the words "parking meter funds".


On being put to a vote, the Moderator declared the motion carried.


Thereupon, on motion duly made and seconded, it was


Voted: That the additional sum of two thousand (2,000) dollars be and hereby is appropriated for the construction of a municipal parking area on the Pierce and Winn property, so-called on Mystic Street; said sum to be taken from park- ing meter funds now in the Treasury and expended under the direction of the Board of Public Works.


There being no further business under Article 20, the Moderator declared it disposed of.


Article 21 taken up. (Additional Appropriation - Exten- sion of the Sewerage System)


On motion duly made and seconded, it was


Voted: That no appropriation be made under Article 21 of the Warrant.

Article 22 taken up. (Purchase of a Power Shovel)


On motion duly made and seconded, it was


Voted: That the sum of twenty-five thousand (25,000) dollars be and hereby is appropriated for the purpose of pur- chasing a power shovel, including parts and equipment; said sum to be taken from available funds now in the Treasury and expended under the direction of the Board of Public Works.


There being no further business under Article 22, the Moderator declared it disposed of.

That compensation heretofore provided for non-elective town employees other than school teachers for the year 1949 be adjusted by paying to all such town employees whose total compensation for the year 1949 as presently provided for, other than overtime pay, is less than the total compen- sation paid to such employees for the year 1948, excluding overtime pay, extra special compensation in addition to that previously provided and authorized for the year 1949 suffi- cient in amount to make the total compensation for all such employees for the year 1949, excluding overtime pay, equal to the total compensation received by such employees for the year 1948, excluding overtime pay ; that this action shall not be construed as permanently increasing the salaries or wages nor shall any payment be deemed part of the regular compensation of any such town employee; that the sum of $35,000 be and hereby is appropriated for the purpose of this article, said sum to be taken from available funds now in the treasury of the town and expended under the direc- tion of the various boards and heads of departments of the town and charged to the appropriation made under this article,


which on being put to a vote, the Moderator declared the motion carried.


Thereupon, on motion duly made and seconded, it was

Report of the Town Clerk's Department


To the Citizens of Arlington :


The following annual report of the Town Clerk for the year ending December 31, 1949, is herewith submitted, in accordance with the Town's By-laws.


With the death of my predecessor, Mr. Earl A. Ryder, with whom I was privileged to enjoy a daily and friendly association throughout his incumbency as Town Clerk, the Town of Arlington lost a valued and faithful citizen and public servant. An adherence has been followed of his policy, which, too, was that of those who preceded him in office whom I knew, to render courteous, honest, efficient and impartial service to our townspeople at all times.


During the year, the Department collected the sum of $11,104.06 for licenses and fees. Of this amount, $2,481. was received from the sale of conservation licenses and $4,468.55 from the issuance of dog licenses.
