VOTED: That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to acquire by purchase, eminent domain or otherwise for municipal purposes, all or any portion of the land within the Town hereinafter described and which was originally acquired by the Town by gift allegedly subject to certain trusts, terms and conditions, any interests or easements therein, and any rights or easements of way or otherwise as appurtenant thereto and subject to or with any reservations of any rights or easements therein.

Beginning at a stone bound at the point of intersection of the southeasterly side line of Mystic Street and the southwesterly side line of Chestnut Street, thence southeasterly on said southwesterly side line of Chestnut Street, a distance of 245.76 ft. to a point at land of the Roman Catholic Archbishop of Boston, thence south- westerly by land of Town of Arlington known as Russell School property a distance of 370 ft. more or less to land now or formerly of Goode, thence northwesterly by said land now or formerly of Goode, known as Park Terrace, a distance of 193.76 ft. to a point on the southeasterly side line of Mystic Street, thence northeasterly on said southeasterly side line of Mystic Street, a distance of 285.35 ft. to the point of beginning and containing approximately 67,075 sq. ft.


There being no further business under Article 22, the Moderator declared it disposed of.


Article 23. (Acquisition of Land.)


VOTED: (Unanimously ) That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to acquire by purchase, eminent domain or otherwise for municipal purposes all or any portion of the land within the town hereinafter described, any interests or easements therein, and any rights or easements of way or otherwise as appurtenant thereto and subject to or with any reservations of any rights or easements therein; and for this purpose the sum of five thousand seven hundred thirty-four and 30/100 (5,734.30) dollars be and hereby is appropriated, said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


Said land is bounded and described as follows:


First Section - Beginning at a point on the northwesterly side line of Medford Street, said point being 138.0 feet northeasterly of the point of intersection of the northeasterly side line of Mass. Avenue and the northwesterly side line of Medford Street, thence northwesterly through land now or formerly of Myerson and now or formerly of Webb on a line 10 feet southwesterly of the northeaster- ly boundary line of said properties a distance of 145.09 feet to a point of curve, thence northwesterly and northerly through said land of Webb on a curve to the right with a radius of 44.5 feet a distance of 30.42 feet to the northerly corner of said land now or formerly of Webb, thence southeasterly on the northeasterly bound- ary line of said properties of Webb and Myerson a distance of 173.20 feet to a point on the northwesterly side line of Medford Street, thence southwesterly on said northwesterly side line of Medford Street, a distance of 10.0 feet to the point of beginning and containing 1246 square feet from land of Myerson and 397 square feet from land of Webb.


Second Section - Beginning at a point on the division line between land now or formerly of Goode and the Russell Common at the Russell School property, thence southwesterly by said land now or formerly of Goode a distance of 18 feet more or less to the northerly corner of land now or formerly of Webb, thence northerly and northeasterly through said land of Goode on a curve to the right with a radius of 44.5 feet a distance of 20 feet more or less

There being no further business under Article 23, the Moderator declared it disposed of.


Article 24. (Relocation of Mystic Street and Widening of Chestnut Street. )


VOTED: That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to relocate a portion of Mystic Street, from a point opposite Pleasant Street to Chestnut Street and to abandon the present public portion of Mystic Street between Massachusetts Avenue and Chestnut Street; and to widen Chestnut Street from Mystic Street to Medford Street by laying out and altering the lines of these ways, or by petition to the proper departments of the Commonwealth of Massachusetts and the County of Middlesex, or both, and to take any and all such action as may be required, in order that such land, as may be necessary, may be taken and the streets altered, relocated or con- structed for the improvement and control of traffic flow in said area.


There being no further business under Article 24, the Moderator declared it disposed of.


Article 25. (Acquisition of Land - Mystic Street.)


VOTED: (On a standing vote 179 having voted in the affirma- tive and 7 in the negative, more than the required two thirds.) That the Board of Selectmen be and hereby is authorized and em- powered on behalf of the Town to acquire by purchase, eminent do- main or otherwise for municipal purposes all or any portion of the land within the Town (with or without the buildings thereon) hereinafter described, any interests or easements therein, and any rights or easements of way or otherwise as appurtenant thereto, and subject to or with any reservations of any rights, or easements therein, for the purpose of relocating a portion of Mystic Street; and that the sum of sixteen thousand two hundred fifty (16,250.00) dollars be and hereby is appropriated for said purpose, said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


Said land is bounded and described as follows:


Beginning at a point on the northwesterly side line of Mystic Street, at the northeasterly boundary line of premises #44 Mystic Street, thence southwesterly on said northwesterly side line of Mystic Street, distances of 86 feet more or less and 56 feet more or less to a point on the northwesterly side line of Mystic Street, at the southwesterly boundary line of premises #40 Mystic Street, thence northwesterly by said southwesterly boundary line of prem- ises #40 Mystic Street, a distance of 140.81 feet to an angle point, thence northeasterly by Lot A, a distance of 39.27 feet to an angle point, thence southeasterly by Lot 8 and Parts 9 & 10 a distance of 59.19 feet to an angle point, thence northeasterly by said Lot 8 and Parts 9 & 10, a distance of 70.29 feet to an angle point, thence southeasterly on the northeasterly boundary line of premises #44

Mystic Street, a distance of 95.18 feet to the point of beginning and containing approximately 14,869 sq. ft. and being the remaining portion of land owned now or formerly by Annie D. Holbrook and Charlotte H. Page and recorded in the Registry of Deeds, Book 7002-199, and land owned now or formerly by Harold P. and Esther I. Nickerson, and recorded in the Registry of Deeds Book 7858-551.


There being no further business under Article 25, the Moderator declared it disposed of.


At this point, a recess was taken from 9:55 to 10:10 P.M.


Article 26. (Altering Plan of Winslow Street.)


VOTED : (Unanimously ) That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to alter the plan of Winslow Street, from Mystic Street to Russell Terrace, by taking the necessary legal procedure to approve the widening of said way as recommended by the Arlington Development Com- mission; to lay out such way in preparation for its acceptance and construction contingent upon such widening and to take any and all such action as may be required, in order that such land as may be necessary, may be taken and the street altered or constructed for the improvement and control of traffice flow in said area.


There being no further business under Article 26, the Moderator declared it disposed of.


Article 27. (Establish Board of Survey Lines for a New Way - Russell Terrace to Mill Street.)


VOTED: (Unanimously) That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to es- tablish Board of Survey lines for a new way from Russell Terrace to Mill Street, said way being an extension of Winslow Street and recommended by the Arlington Development Commission; to lay out such way in preparation for its acceptance and construction and to take any and all such action as may be expedient in order that such land and buildings, as may be necessary, may be taken and the street constructed for the improvement and control of traffic flow in said area.


There being no further business under Article 27, the Moderator declared it disposed of.


Article 28. (Proposed Alteration of Zoning Map - Area on Summer Street at the intersection of Mill Street.)


John B. Byrne, Jr., Chairman of the Planning Board, reported for the Planning Board on this article and made the following motion :


"That no action be taken under Article 28 of the Warrant."


William A. McMahon of Precinct 14 moved, and it was seconded, that the motion of Mr. Byrne under Article 28 be amended by striking it out and substituting therefor the following:

"That the town amend its zoning by-law altering the zoning map therein referred to so as to include in the Busi- ness "A" District all or any part of the area now included in land owned by the Town of Arlington for Park purposes and located on Summer Street, bounded and described as follows:


Beginning at a point on the southerly side line of Sum- mer Street, at the division line between land now or formerly of Malcolm G. Stevens, Trustee, and land now of the Town of Arlington, thence easterly on said southerly side line of Summer Street, by various courses and curves a distance of 497 feet, more or less, to a point, thence southwesterly on a curve with a radius of 560 feet a distance of 298 feet more or less, to a point on the northerly corner of property now or formerly of R. Wendell Wood, thence westerly, a distance of 40 feet along property now or formerly of R. Stevens, Trustee, thence northerly a distance of 100 feet along property of said Malcolm G. Stevens, Trustee, to the point of beginning and containing about 150,000 square feet, more or less, as shown on two plans on file in the office of the Town Engineer, Arlington, Massachusetts; one entitled "Plan of Land in Arlington, Massachusetts, Taken for Park Purposes, Scale 1"=40', April, 1933, James M. Keane, Town Engineer", and another entitled "Copy of Plan of Fowles Pond, Arlington, Massachusetts, Scale 1"=40', January, 1930, James M. Keane, Town Engineer".


Considerable discussion ensued and, upon the motion for the previous question being carried, a standing vote was taken on the motion to amend, 116 voted in the affirmative and 58 in the nega- tive, and the Moderator declared Mr. McMahon's motion to substi- tute to have carried.


On the standing vote then taken on the motion of the Planning Board as substituted, 111 voted in the affirmative and 67 in the negative, and the motion was declared lost by the Moderator, it being less than the two-thirds vote required.

ADJOURNED ANNUAL TOWN MEETING - MARCH 21, 1958


Pursuant to the vote of adjournment of March 19, 1958, and written notices sent by mail by the Town Clerk, the town meeting members met in the Town Hall on Friday evening, March 21, 1958, to act upon the remaining articles set forth in the Warrant for the Annual Town Meeting.


Lists of the duly qualified town meeting members were used at the entrances of the meeting place and were in charge of Ann Mahon and James E. Sweeney. The lists contained the names of two hundred fifty (250) town meeting members.


The check lists filed with the Town Clerk at the close of the meeting by the checkers showed that two hundred nine (209) mem- bers and seven (7) members-at-large (86.4% of total-250) attended the meeting.


The Moderator, Lawrence E. Corcoran, declaring a


quorum present, called the meeting to order at 8:05 o'clock P.M.


The meeting was opened with the singing of "The Star Spangled Banner" by the assembly, accompanied by Mr. Augustus Mazzocca and Mr. Walter E. Russell of the School Department, and prayer offered by Rev. John B Kinneen, Curate of St. Agnes' Church.


The town meeting members, who had not previously been sworn, were thereupon sworn by the Moderator.


On motion of Selectman Greeley, duly seconded, it was


VOTED: That if all the business of the meeting as set forth in the Warrant is not disposed of at this session, when the meeting adjourns, it adjourn to Monday evening, March 24, 1958, at 8 o'clock.


The Moderator declared that Article 28 was still before the meeting, inasmuch as it was not disposed of at the last session.


A motion seeking reconsideration of the vote taken under Article 28 was then offered by John N. Loud of Precinct 9 and, upon the motion for the previous question being carried, was declared lost by the Moderator on a standing vote, 122 having voted in the affirm- ative and 97 in the negative, it being less than the two-thirds vote required.


There being no further business under Article 28, the Moderator declared it disposed of.

Article 37. (Petition to the General Court Re Conveyance of Land to Housing Authority.)


On the substitute motion of Kermit C. Streng of the Finance Committee to amend the original motion of the Finance Committee which was seconded and was declared by the Moderator to have carried, it was


VOTED: (Unanimously) that the motion of the Finance Con- mittee be amended by adding the words and figures "for the sum of one ($1.00) dollar" after the word "use" on line eleven of said motion as it appears in the printed report of the Finance Committee so that said motion will read as follows:


That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to petition the General Court for authority to sell, convey or otherwise dispose of the parcel of land hereinafter described, which is now part of the public parks within the Town, to the Arlington Housing Authority for the use of said Housing Authority to erect buildings thereon for housing aged citizens of Arlington. If said authority is granted by the General Court, the Board of Selectmen, acting on behalf of the Town, is hereby authorized and directed to sell said land hereinafter described to the Arlington Housing Authority for the above des- cribed use for the sum of one ($1.00) dollar.


Said parcel of land is bounded and described as follows:


Beginning at a point on northerly boundary of land be- longing to the Boston & Maine Railroad at the intersection of land in Lexington and land of the Town of Arlington; thence easterly on said northerly side line of land belonging to the Boston & Maine Railroad a distance of 400 feet more or less to an angle point; then northeasterly a distance of 160 feet more or less to a point; thence northeasterly again a distance of 160 feet more or less to an angle point; thence northwest- erly 50 feet more or less to a point; thence northwesterly 120 feet more or less to a point on the south bank of Mill Brook; thence northwesterly again 190 feet more or less to an angle point on the Lexington line; thence southwesterly along said Lexington Town Line 620 feet to the point of beginning and containing about 155,100 square feet more or less as shown on plan of land on file with the office of the Town Engineer, Arlington, Mass., and entitled "Study Plan - Reservoir, Play- ground & Vicinity - Scale 1" = 80'- January 1955 - James M. Keane, Town Engineer."
