VOTED: (Unanimously) That the Town amend its zoning by-laws by altering the zoning map therein referred to so as to include in the Residence C District all or any part of the area now included in land owned by the Town of Arlington for park purposes and located between Mill Brook, Boston & Maine Railroad and the Lexington Town Line, bounded and described as follows:


Beginning at a point on northerly boundary of land be- longing to the Boston & Maine Railroad at the intersection of land in Lexington and land of the Town of Arlington; thence easterly on said northerly side line of land belonging to the Boston & Maine Railroad a distance of 400 feet more or less to an angle point; then northeasterly a distance of 160 feet more or less to a point; thence northeasterly again a distance of 160 feet more or less to an angle point; thence north- westerly 50 feet more or less to a point; thence northwesterly 120 feet more or less to a point on the southbank of Mill Brook; thence northwesterly again 190 feet more or less to an angle point on the Lexington Line; thence southwesterly along said Lexington Town Line 620 feet to the point of beginning and containing about 155,100 square feet more or less as shown on plan of land on file with the office of the Town Engineer, Arlington, Mass., and entitled, "Study Plan - Reservoir, Playground & Vicinity - Scale 1" = 80' - January 1955 - James M. Article 40. (Extension of Water Mains.)


VOTED: (Unanimously) That the sum of thirty seven thousand (37,000) dollars be and hereby is appropriated for the extension of water mains; said sum to be raised by general tax and expended under the direction of the Town Manager substantially as follows: Laying and relaying water mains of not less than six inches in di- ameter (including Tools and Equipment).


There being no further business under Article 40, the Moderator declared it disposed of.


Article 41. (Extension of Storm Drains.)


VOTED: That the sum of ten thousand (10,000) dollars be and hereby is appropriated for the extension of storm drains in the year 195S; said sum to be raised by general tax and expended under the direction of the Town Manager substantially as follows:

Article 42. ( Improvement of Volume and Pressure-Water Sys- tem.)

Article 44. (Appropriation-Maintenance of Public Sidewalks.)


VOTED: That the sum of twenty thousand (20,000) dollars be and hereby is appropriated for the reconstruction and maintenance of permanent sidewalks and resetting of edgestones upon the public ways of the Town, said sum to be raised by general tax and expended under the direction of the Town Manager.

VOTED: (Unanimously ) That the sum of twenty eight thousand five hundred and forty (28,540) dollars be and hereby is appropri- ated for the relocation, alteration and widening, construction of, spe- cific repairs upon and improvement of all or any parts of Pleasant Street and Park Avenue, within the town as now existing or here- after relocated, altered or widened, including land damages, if any, under the provisions of law authorizing the assessment of betterments or otherwise; said appropriation to be used with any sum or sums which may be allotted by the Commonwealth or by the County of Middlesex, or both, for such purpose or purposes; said sum to be raised by general tax and expended under the direction of the Town Manager.

Article 49. (Laying Out of Quinn Road.)


VOTED: (Unanimously) That the laying out of a town way from Massachusetts Avenue to Hobbs Court, substantially in the lo- cation of the private way known as Quinn Road, as more particularly described in Article 49 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the pur- pose of said way.

VOTED: (Unanimously) That the laying out of a town way from Washington Street to Gorham Street, substantially in the lo- cation of the private way known as Crawford Street, as more par- ticularly described in Article 50 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be ac- cepted, said way established and said Board authorized to take land for the purpose of said way.


There being no further business under Article 50, the Moderator declared it disposed of.


Article 51. (Laying Out of Gorham Street.)


VOTED: (Unanimously) That the laying out of a town way from Washington Street to Candia Street, substantially in the loca- tion of the private way known as Gorham Street, as more particularly described in Article 51 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the pur- pose of said way.

Article 52. (Laying Out of Washington Street.)


VOTED: (Unanimously) That the laying out of a town way from Summer Street to Brattle Terrace, substantially in the location of the private way known as Washington Street, as more particularly described in Article 52 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the pur- pose of said way.

Article 53. (Laying Out of Brattle Terrace.)


VOTED: (Unanimously) That the laying out of a town way from Washington Street to its end, substantially in the location of the private way known as Brattle Terrace, as more particularly described in Article 53 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way estab- lished and said Board authorized to take land for the purpose of said way.

VOTED: (Unanimously) That the laying out of a town way from Joyce Road to its end, substantially in the location of the priv- ate way known as Ivy Circle, as more particularly described in Article 59 of the Warrant, under the provisions of law authorizing the as- sessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the purpose of said way.

Article 60. (Laying Out of Appleton Place.)


VOTED: (Unanimously) That the laying out of a town way from Quincy Street to Burton Street, substantially in the location of the private way known as Appleton Place, as more particularly described in Article 60 of the Warrant, under the provisions of law authorizing the assessment of betterments, as made and filed in the office of the Town Clerk by the Board of Selectmen, be accepted, said way established and said Board authorized to take land for the pur- pose of said way.


There being no further business under Article 60, the Moderator declared it disposed of.


Article 61. (Construction of Ways.)


VOTED: (Unanimously) That the sum of two hundred ninety eight thousand (298,000) dollars be and hereby is appropriated for the original construction of public ways, the laying out of which is accepted at this meeting, including land damages and the cost of pavements and sidewalks laid at the time of such construction, all under the provisions of law authorizing the assessment of better- ments: that for this purpose the sum of forty eight thousand (48,000) dollars be raised by general tax, and for the balance, two hundred fifty thousand (250,000) dollars, the Treasurer, with the approval of the Board of Selectmen, be and hereby is authorized to borrow the said sum of two hundred fifty thousand (250,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be pay- able in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in addition thereto or amendment thereof, so that the whole loan shall be paid in not more than ten (10) years from the issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine; and further

VOTED: (Unanimously) That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town, to pur- chase or take by eminent domain or otherwise acquire, easements in land adjoining the location of ways, the laying out of which is ac- cepted at this meeting, consisting of the right to have the land of said location protected by having the surface of such adjoining land slope from the boundaries of said locations; that for this purpose the sum of eight hundred (800) dollars be and hereby is appropriated; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 62, the Moderator declared it disposed of.


Article 63. (Reconstruction of Certain Streets.)


VOTED: (Unanimously) That the sum of fifty two thousand one hundred twenty nine and 94/100 (52,129.94) dollars be and here- by is appropriated for the reconstruction of any or all parts of the following streets or ways within the Town; Pond Lane, Lewis Ave- nue, Beacon Street, Park Street, Decatur Street and North Union Street; and to meet said appropriation the sum of fifty two thousand one hundred twenty nine and 94/100 (52,129.94) dollars be trans- ferred from the proceeds received from the Commonwealth of Mass- achusetts under the provisions of Chapter 718 of the Acts of 1956 .;


There being no further business under Article 63, the Moderator declared it disposed of.


Article 64. (Proposed Alteration of Zoning Map - Massachusetts Avenue and Allen Street.)

WESTERLY by Massachusetts Avenue, 101 feet;


WESTERLY again by a curved line forming the inter- section of said Massachusetts Avenue and Allen Street, 34.54 feet;


NORTHWESTERLY by said Allen Street, 159.53 feet;


NORTHEASTERLY by Lot 24 and Pt. 23 as shown on plan hereinafter mentioned, 90 feet;

Article 67. (Establish Conservation Commission.)

Article 68. (Acceptance of a Gift of Land.)


VOTED : That the Town of Arlington does accept a gift to the town from Lewis Gordon of a parcel of land at the southeasterly corner of Franklin Street and Broadway. Said land is bounded and described as follows:


Beginning at the point of intersection of the southwester- ly side line of Broadway and the southeasterly side of Franklin Street, thence southeasterly on said southwesterly side line of Broadway, a distance of 13.01 feet to a point on said south- westerly side of Broadway, thence northwesterly, westerly and southwesterly through land formerly No. 248 Broadway on a curve to the left with a radius of 15 feet a distance of 21.43 feet to a point on the southeasterly side line of Franklin Street, thence northeasterly on said southeasterly side line of Franklin Street, a distance of 13.01 feet to the point of be- ginning, containing 34 sq. ft. more or less and shown on a plan on file in the office of the Town Engineer, Arlington, Mass., entitled "Sketch showing proposed alteration, Arlington, Mass., Scale 1 inch = 10 feet, Dec. 1957, W. H. Roby, Town Engineer".

Article 69. (Additional Appropriation - High School Build- ing. )


VOTED : ( Unanimously) That no action be taken under Article 69 of the Warrant.

Article 70. (Appointment of Committee - Re - Voting Machines. )


VOTED: That the Moderator be and hereby is empowered and instructed to appoint a committee of five persons, one of whom shall be the Town Clerk, to investigate, consider and make recommenda- tions as to the advisability of installing voting machines in any or all of the precincts of the Town, said committee to report not later than the Annual Town Meeting of 1959; and that the sum of one hundred (100) dollars be and hereby is appropriated for the use of said committee, said sum to be raised by general tax.


There being no further business under Article 70, the Moderator declared it disposed of.


Article 71. (Appropriation to Determine Title to the Great Meadows. )


VOTED: That no action be taken under Article 71 of the Warrant.

VOTED : (Unanimously ) That the Town does hereby create a Stabilization Fund in accordance with the provisions contained in Massachusetts General Laws (Tercentenary Edition) Chapter 40, Section 5B, as amended; and that the sum of one hundred fifty thousand (150,000) dollars be and hereby is appropriated to estab- lish such fund; said sum to be taken from available funds now in the treasury.


There being no further business under Article 73, the Moderator declared it disposed of.


Article 74. (Re-Draw Precinct Lines. )


VOTED: That no action be taken under Article 74 of the Warrant.


There being no further business under Article 74, the Moderator declared it disposed of.


Article 75. (Federal Aid - Improvement of Arlington Center Business Area. )


VOTED: That this Town Meeting does recommend that the Board of Selectmen cause all necessary action to be taken to deter- mine if Federal Aid can be obtained under existing legislation, and to qualify for such aid, if available, to assist the Town in its pro- gram for the relocation of Mystic Street, the improvement of the Arlington Center business area, and the solution of traffic problems in Arlington Center.


There being no further business under Article 75, the Moderator declared it disposed of.


Article 76. (Transfer of Cemetery Funds. )


VOTED: That the sum of five thousand (5000) dollars be and hereby is transferred from (Mount Pleasant Cemetery) sale of lots and graves funds to the Cemetery Commissioners for the im- provement of the Town Cemetery.


There being no further business under Article 76, the Moderator declared it disposed of.


Article 77. (Advertising Town By-Laws.)
