ART. 50. To see if the Town will vote to instruct the Se- lectmen, to meet with the Lowell Electric Light Corp; Eastern Massachusetts Street Railway Co., for lower rates, or take any other action relative thereto.


ART. 51. To see if the Town will vote that any Citizen of Tewksbury, receiving $25.00 or more per week, cannot collect for services in any other department, or take any other action relative thereto.


ART. 52. To see if the Town will vote to raise and appro- priate the sum of $800.00 for the purchasing of Stop Signs, No Parking Signs and other signs and the erecting of same as recommended by the Department of Public Works in a survey recently made by the Town Safety Committee and Engineers of the Department of Public Works, or take any other action relative thereto.

To see if the Town will vote to raise and appro- priate the sum of $1,550.00 to purchase a General Motors Truck of one and one-half ton, 1311/8 inch wheel base, chassis and cab over, Model A. F. 312, a 350-gallon booster tank, and material for equipping same, or take any other action relative thereto. (Pump, Hose and other equipment to be taken off Number Four (4) Truck.


ART. 54. To see if the Town will vote to raise and appro- priate the sum of six hundred and one dollars ($601.00) to pay counsel fees and other expenses incurred in de- fending the case before the appellate Board of tax ap- peals of Blanche B. Ames against the Board of Assessors.

ART. 55. To see if the Town will vote to raise and appro- priate the sum of $500.00, being the sum appropriated by the Town under Article 15 at the Annual Town Meeting held February 2, 1938 and omitted by the assessors in their levy of that year.


ART. 56. To see if the Town will vote to raise and appro- priate the sum of $50.00 in support of the Trustees for County Aid to Agriculture, through the Middlesex County Extension Service, and elect a director. Said money to be spent under the direction of the local director, or take any other action relative thereto.


ART. 57. To see if the Town will permit in accordance with Section 34 of Chapter 114 of the General Laws the use of the following described parcel of land in Tewksbury for the extension of the cemetery owned by the Tewksbury Cemetery Corporation .-


Said parcel is bounded and described as follows : Begin- ning at the southwesterly corner of the parcel on the northerly side of East Street; thence northerly along the stone wall and land of the Tewksbury Cemetery Corpora- tion about five hundred twenty (520) feet to land formerly of the Lowell and Lawrence Railroad; thence easterly three hundred thirty-four (334) feet to an iron pipe; thence southerly about four hundred and twenty (420) feet to an iron pipe ; thence westerly ninety (90) feet, more or less, to the northeast corner of land of A. W. Pendle- ton ; thence still westerly along the northerly side of said Pendleton land one hundred (100) feet; thence still west- erly thirty (30) feet to an iron pipe ; thence southerly one hundred (100) feet to East Street; thence westerly about one hundred fourteen (114) feet to the point of begin- ning. Being a part of the premises conveyed to Walter J. Robinson by deed of Albert S. Briggs dated July 9, 1912 and recorded in Middlesex North District Registry of Deeds, Book 490, Page 270. attested copies thereof, one at each of the Public Meeting


And you are directed to serve this warrant by posting up Houses, one at the Town Hall, one at each of the Post Offices and leave one hundred copies for the use of the citizens at the Post Offices in said Town, eight days at least and over two Sundays, before the time of said meeting.

At a Meeting of the inhabitants of the Town of Tewksbury, qual- ified to vote in Town Affairs. at the Town Hall, this day, the following business was transacted. Warrant was read by the Presiding Election Officer, Irving F. French, and the Polls were officially opened at ten o'clock A.M. Jeremiah Houlihan, Jesse French, Wallace Farwell, Anna McPhillips, William A. Smith and Thomas Sullivan sworn in as Tellers. Polls closed at eight P.M. with the Register showing 1187 (on three different occasions the Register registered twice on a single ballot), Check List showed one thousand one hundred eighty-four names checked as voted which checked with the eleven hundred and eighty-four ballots counted. ANNUAL TOWN MEETING


Town Hall, Tewksbury, Massachusetts


February 14, 1940


At a meeting of the inhabitants of the Town of Tewksbury, qual- ified to vote in Town Affairs, held this day in the Town Hall, Tewks- bury, Massachusetts, the following business was transacted :--


Meeting called to order by Melvin G. Rogers, Moderator, at eight o'clock P.M. Check list used and a necessary quorum was found to be present. Rev. Matthew J. Noonan O.M.I. offered prayer. Moderator Rogers announced that Article 1 had been acted on the week previous in accordance with the By-law adopted by the Town at the last An- nual Town Meeting, and if there were no objections he would pass over Articles 2, 3 and 4 and proceed with Article 5; there were no objections.


ART. 5. VOTED: That the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1940 and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Moderator Rogers then asked the voters if they desired to post- pone the Meeting due to the inclement weather and because of the fact that less than one hundred voters out of a registration of nearly seventeen hundred were present. A motion by Mr. John Belton that the Meeting be postponed until one week from this day at seven-thirty P. M. was unanimously voted. Meeting ad- journed at eight minutes past eight o'clock P.M.

ART. 5. (Voted at Meeting held February 14, 1940)


ART. 6. VOTED: That the present or any succeeding Town Treas- urer, may during his term of office, with the approval of the then Selectmen, sell or assign any tax title held by the Town whether redeemable or unredeemable, for a sum not less than the consider- ation named in the tax deed plus interest thereon at the rate of eight percent (8% ) per annum from the date of the deed to the date of the sale or assignment of the tax title, plus the cost of recording said deed, and plus a sum not less than the taxes of the two years succeeding the year in which the tax was assessed for which the tax sale was made. The Board of Selectmen shall keep a book exclusively for the records of such approvals by them of sales or assignments of tax titles and the secretary of said Board shall, upon such approval by the Board of a sale or assign- ment give notice immediately in writing to the Town Auditor, stating the title which is being sold or assigned, and consideration to be received therefor.


Voted: to raise and appropriate the sum of $500.00 to be used by the Treasurer for assistance in securing tax titles.

Voted: To raise and appropriate the sum of $350.00 for the proper observance of Memorial Day.

ART. 8. VOTED: That the Selectmen be and hereby are authorized to institute suits on behalf of the Town or defend any suits that are, or may be brought against the Town, and to sign any con- tracts or agreements in behalf of the Town.


ART. 9. VOTED: To raise and appropriate the sum of $1,309.48 for the purposes outlined in this Article.


ART. 10. VOTED: That the Selectmen be and hereby are authorized to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale, property taken by the Town under Tax Title procedure provided that the Select- men or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate.


ART. 11. VOTED: That the Selectmen and Treasurer be and hereby are authorized to petition the land court for a foreclosure of Tax Titles held by the Town for more than two years, as provided in Section 65 of Chapter 60, General Laws, and to raise and appro- priate the sum of $250.00 therefor.


ART. 13. VOTED: That the Town appropriate the sum of $1,027.23, being the balance at present in the Highway Machinery Fund, together with all receipts for the use of Road Machinery from any source whatsoever and that the Highway Commissioners be and hereby are authorized to purchase from such fund, whenever in their judgment it becomes necessary, whatever new equipment or trucks the Highway Department may need; and to pay whatever cost of repairs and maintenance that may be incurred in the usual operations of the Highway Department provided that at the time of the above purchases the said Fund necessary shall be in the said Highway Maintenance Fund a sum large enough to pay for the article so purchased.


ART. 12. VOTED: To raise and appropriate the sum of $2,500.00 for the Maintenance of Chapter 90, highways: said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose.

ART. 14. VOTED: To establish a Road Machinery Account, to which shall be accredited all receipts received for the use of rental of road machinery, the proceeds to be appropriated as voted by the Town for road machinery purposes.


ART. 15. VOTED: To accept Myrtle Street, as laid out by the Road Commissioners with the boundaries and measurements as shown on file with the Town Clerk.
