ANNUAL TOWN MEETING
Town Hall, Tewksbury, Massachusetts February 9, 1944
At a Meeting of the inhabitants of the Town of Tewksbury, qualified to vote in Town Affairs, held this day, at the Town Hall, Tewksbury, Massachusetts, the following business was transacted :-
The Meeting was called to order by Moderator Melvin G. Rogers at Eight o'clock P.M. and a necessary quorum not being present a recess of ten minutes was called. On a second count the necessary number for a quorum was found to be present and the meeting was opened by a prayer offered by Rev. Fr. Joseph Curtin, O.M.I., pastor of Saint Williams Church, Tewksbury, Mass.
ART. 1. (Acted on at the Meeting held February 2, 1944).
ART. 2. All reports of Town Officers and Committees accepted.
ART. 3. VOTED: To lay on the table.
ART. 4. VOTED: That money arising from licensing dogs for the ensuing year be used in support of the Public Library.
ART. 5. VOTED: That the town treasurer, with the approval of the selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1944, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.
ART. 6. VOTED: To raise and appropriate the sum of $350.00 for the proper observance of Memorial Day and that the Moderator appoint a committee to expend the money. Said committee to be taken from members of Spanish War Veterans, American Legion, or Sons of Veterans.
ART. 7. VOTED: That the Selectmen are hereby authorized to institute suits on behalf of the Town or defend any suits that are,

or may be brought against the Town, and to sign any contracts, or agreements in behalf of the Town.
ART. 8. VOTED: To appropriate the sum of $1,142.72 to pay the County of Middlesex, as required by law, the Town's share of the net cost of the care, maintenance, and repair of the Middlesex County Tuberculosis Hospital, as assessed in accordance with the provisions of Chapter 111 of the General Laws and Acts in amendment thereof and in addition thereto including Chapter 400, Section 23 G (6) (a) of the Acts of 1936.
ART. 9. VOTED: To raise and appropriate the sum of $300 for the purposes outlined in this article.
ART. 10. VOTED: To raise and appropriate the sum of $400 for repairs to and maintenance of the athletic field and structures thereon at the High School and for the maintenance of athletics at the High School.
ART. 11. VOTED: That this article be accepted.
ART. 12. VOTED: That this article be accepted.
ART. 13. VOTED: That the Town establish a Highway Machinery Fund and appropriate the sum of $5,000 for the year 1944, from which fund the Highway Commissioners are hereby authorized to purchase, when in their judgment it becomes necessary, what- ever new equipment, or trucks the said Commissioners deem expedient, the same being consistent with the amount of money appropriated, and to pay from said fund costs arising from repair and maintenance of equipment used in the usual operation of Highway Department. It is further moved tliat all money allotted to the Town for the use of Town owned equipment working in conjunction with the State and County, be set aside under a separate Highway Machinery Fund, from which fund there may be appropriated in the year 1945, the sum to be spent for mainte- nance and renewal of highway equipment in said 1945.
ART. 14. VOTED: To raise and appropriate the sum of $2000 for the Maintenance of Chapter 90, Highways: said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose.

ART. 24. VOTED: To raise and appropriate the sum of $300 for Clerical Services in the office of the Town Treasurer for the year 1944.
ART. 16. VOTED: That this Article be accepted.
ART. 17. VOTED: That $1000 be taken from W.P.A. balance, the balance to revert to the town treasury closing account.
ART. 18. VOTED: That the Town make the following addition to its by-laws:
At least ten days before the annual business meeting of the Town, the Board of Selectmen, the Board of Public Welfare, the Board of Health, the Assessors, the Town Clerk, Collector of Taxes. the School Board, Town Auditor, Chief of Police, Chief of the Fire Department, Tree Warden, and the heads of other town depart- ments shall submit in writing to the Secretary of the Finance Committee an estimate of the prospective expenditures of this or their respective departments. Such estimates shall contain a breakdown of the principal items of proposed expenditures, in- cluding wages, salaries, equipment, supplies and such other items as may be deemed advisable by the department.
If the estimate for wages or salaries includes compensation for employment additional to the employment for the previous year, or any reduction or increase of salary or wages is contemplated such estimates shall state the work contemplated to be performed by such additional employees, and the reduction or increase in compensation of any employees, and the reduction or increase in compensation of any employee or officer of the department shall be stated in the estimate.
Unless such estimates are submitted at the time and in the form provided, no appropriation in excess of the appropriation for the previous year of the department failing to file the estimates as above provided shall be made at the annual town meeting.

Upon request of the Chairman of the Finance Committee such officials and heads of the above named departments shall appear before the Finance Committee to explain the reasons for their respective estimates.
At this time Irving F. French and Bernard H. Greene were sworn in as Tellers by the Moderator and a count was taken to determine the vote under Article 18. 137 were found to be in favor and none opposed.
ART. 19. VOTED: To indefinitely postpone.
ART. 20. VOTED: To indefinitely postpone.
ART. 21. VOTED: To indefinitely postpone.
ART. 22. VOTED: To furnish the telephone for the Collector of Taxes, the expenditure for same to be paid from the appropriation for Collection of Taxes.
ART. 25. VOTED: That the Board of Selectmen be instructed to demand that the Trustees of the Eastern Mass. Railway adjust the Bus Fares as they apply in the Town of Tewksbury to include the following changes.
1. Eliminate the Pike Street Zone and the Zone at Carter's.
2. Adjust the Zone fares as follows.
a. Tewksbury-Wilmington line to Tewksbury Center the fare shall be 5c
b. Tewksbury Center to the Tewksbury-Lowell line the fare shall be 5c
3. Other fares.
a. Tewksbury Center to Kearney Square the cash fare shall be 10c
b. Tewksbury Center to Church St. Wilmington the cash fare shall be 10c
c. The cash fare between the Tewksbury-Wilmington line and the Tewksbury-Lowell Tine shall be 10c
d. The cash fare between the Tewksbury-Wilmington and the Kearney Square shall be 15c
e. The cash fare between the Tewksbury-Lowell line and Church Street Wilmington shall be 15c

4. Adjust the ticket fares so that there will be a saving effected for all regular users on fares of 10c or over.
Also that the Board of Selectmen be further instructed that if the Railroad Trustees do not act favorably that they petition the State Legislature when they next come into Session.
ART. 26. VOTED: That the Selectmen, in case the Trustees do not voluntarily adjust the rates as before mentioned in Art. 25, do demand a hearing before the Board of Trustees in regards to the operation of Eastern Massachusetts buses in Tewksbury.
ART. 27. VOTED: That this article be referred to the Selectmen with the authority to raze.
ART. 28. VOTED: To raise and appropriate the sum of $50 in support of the Trustees for County Aid to Agriculture through the Middlesex County Extension Service, said money to be spent under the direction of the local director.
ART. 29. VOTED: To raise and appropriate the sum of $375 for necessary expenses of the Civilian Defense Committee.
ART. 30. VOTED: To raise and appropriate the sum of $5000 for a reserve fund under Section 6 of Chapter 40 of the General Laws.
ART. 31. VOTED: To lay on the table and take up under Art. 3.
ART. 32. VOTED: To pay the Assessors $5.00 per day and the Tree Warden $6.00 per day, from respective appropriations.
ART. 33. VOTED: To invest $15,000 in war bonds or other bonds that are legal investments for savings bank, in order to establish a post-war rehabilitation fund, in accordance with the provisions of Chapter 5, Acts of 1943.
ART. 34. VOTED: To amend the by-laws of the Town relating to the time of holding the Annual Town Meeting by striking out such by-laws and substituting the following:
"The annual election of Town Officers shall be held on the fourth Wednesday in February. Polls shall be open from 10 A.M. to 8 P.M. All other business shall be transacted on the third Wednesday in February, commencing at 7.30 P.M."
Count of votes in favor 64 and opposed 5 as reported by the Tellers.

ART. 18.
