ANNUAL TOWN MEETING, FEBRUARY 21, 1938


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town House, Monday, February 21, 1938, at one o'clock P. M., the following business was transacted:


Roger H. Hildreth, Town Moderator, was sworn in by the Town Clerk, Charles L. Hildreth, and called the meeting to order.


Voted to dispense with the reading of the Warrant.


Article 1. Voted that the reports of the Finance Committee, other Committees, Boards and Officers be accepted as printed with the fol- lowing changes in the Finance Report; on page 86 under Estimated Receipts, Poll Taxes should be $2162.00 and All Others should be $18,866.59.


Article 2. Voted that the compensation of the Town Officers be as follows: Selectmen, Chairman $150.00, other two members $125.00 each; Board of Public Welfare, Chairman $20.00, other two members $10.00 each; Town Treasurer $550.00; Town Clerk $100.00; Collector of Taxes .75 of 1% of amount collected; Tree Warden 53c per hour; Assessors $4.50 per day.


Article 3. Voted that under this article each item be considered separately.


1. Voted that the sum of $6,885.00 be appropriated for General Government to be divided as follows: Selectmen $550.00; License Ex- penses $60.00; Town Accountant $875.00; Town Treasurer $900.00; Assessors $1200.00; Tax Collector $1,600.00; Town Counsel $200.00; Town Clerk $400.00; Registration and Election $1,100.00.


2. Voted that the sum of $1,600.00 be appropriated for the Town Hall.


3. Voted that the sum of $5,490.00 be appropriated for the Police Department, and also that the sum of $100.00 be appropriated for Safety Signs.

4. Voted that the sum of $3,500.00 be appropriated for the Fire De- partment.


5. Voted that the sum of $3,115.00 be appropriated for Hydrants.


6. Voted that the sum of $125.00 be appropriated for the Sealer of Weights and Measures.


7. Voted that the sum of $75.00 be appropriated to defray the ex- penses and compensation of the Fish and Game Warden.


8. Voted that the sum of $1,000.00 be appropriated to defray the expense of Fighting Forest Fires.


9. Voted that the sum of $75.00 be appropriated to defray the ex- pense of the Maintenance of the Town Forest.


10. Voted that the sum of $250.00 be appropriated to defray the expenses of the Tree Warden.


11. Voted that the sum of $2,375.00 be appropriated to defray the expenses of the Moth Department.


12. Voted that the sum of $4,825.00 be appropriated for the Health Department, to be divided as follows: $4,450.00 for General Expenses and $375.00 for milk furnished underweight and undernourished chil- dren.


13. Voted that the sum of $150.00 be appropriated to defray the compensation and expenses of the Cattle Inspector.


14. Voted that the sum of $10,625.00 be appropriated for Chapter 81 Roads.


Voted that the sum of $1,500.00 be appropriated for Town Roads.


Voted that the sum of $4,000.00 be appropriated for Snow and Ice Removal.


Voted that the sum of $3,000.00 be appropriated for the main- tenance of Existing State and County Roads on condition that like amounts be contributed by either or both the State and County re- spectively, to be used in conjunction therewith.


Voted that the sum of $1,000.00 be appropriated for repairs on the Groton Road on condition that like amounts or more be contributed by the State and County respectively, to be used in conjunction therewith.


15. A motion that it be recommended to the Welfare Board that all future cattle purchased be purchased from an appropriation made for cattle purposes, was lost.

Voted that the sum of $16,000.00 be appropriated for the Wel- fare Department and that $12,000.00 of this amount be taken from Surplus.


Voted that the sum of $4,000.00 be appropriated for Aid to Dependent Children.


Voted that the sum of $7,500.00 be appropriated for Old Age Assistance.


16. Voted that the sum of $6,000.00 be appropriated for Soldiers' Benefits.


17. Voted that the sum of $66,000.00 be appropriated for the School Department.


18. Voted that the sum of $750.00 be appropriated for Vocational Tuition.


19. Voted that the sum of $2,400.00 and the receipts from Dog Licenses in 1937 be appropriated for the expenses of the Public Library.


20. Voted that the sum of $200.00 be appropriated for the Care of the Common.


21. Voted that the sum of $250.00 be appropriated to defray the expense of Commemorating Memorial Day.


22. Voted that the sum of $525.00 be appropriated to defray the expense of Publishing and Distributing the Town Reports.


23. Voted that the sum of $1,500.00 be appropriated for Liability Insurance.


24. Voted that the sum of $3,279.00 be appropriated for Fire Insurance.


25. Voted that the sum of $1,600.00 be appropriated for the Care of the Cemeteries.


26. Voted that the sum of $7,500.00 be appropriated for General Loans.


27. Voted that the sum of $1,547.87 be appropriated for Interest of General Loans.


28. Voted that the sum of $500.00 be appropriated for Interest on Revenue Loans.


29. Voted that Article 12 be taken up before Article 3, Item 29.

Article 12. Voted to install additional street lights as follows: nine on Groton Road; seven on Concord Road; six on Dunstable Road; four on Littleton Road; three on Leland Street; and two on Hartford Road.


Article 3.


29. Voted that the sum of $6,876.00 be appropriated for Street Lights.


30. Voted that the sum of $4,000.00 be appropriated in accordance with the provisions of Section 6 of Chapter 40 of the General Laws as a Reserve Fund.


31. Voted to lay on the table a motion relative to bills outstand- ing December 31, 1937.


Article 4. Voted that the sum of $10.00 be appropriated for Dem- onstration Work in Agriculture and Home Economics and a Director be elected from the floor under the provisions of Section 40-45 of the General Laws, Chapter 128. Mabel M. Nixon was elected Director.


Article 5. Voted that the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1938, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws.


Article 6. Voted that the sum of $1,000.00, this being the Town's share of the principal of the Middlesex County Tuberculosis Hospital Funding Loan, Acts of 1932 bonds maturing in 1938, be and the same is hereby appropriated, and that a further sum of $191.25 be and hereby is appropriated on account of interest and other charges on account thereof. That a further sum of $1,112.70 be and hereby is appropriated for the Town's share of the net cost of care, maintenance and repairs of the Middlesex County Hospital, including interest on temporary notes issued therefor, in accordance with sections of Chapter 111 of the General Laws applicable thereto, including Chapter 400, Section 25 G (6) (a) of the Acts of 1936.


Article 7. Voted that the sum of $1,697.63 be appropriated for the purpose of paying the share of the Town for the cost of making alter- ations and constructing additions in and to the Middlesex County Tu- berculosis Hospital under Chapter 417 of the Acts of 1935, as amended by Chapter 205 of the Acts of 1937.

Article 8. Voted that the sum of $400.00 be appropriated for Band Concerts.


Article 9. Voted that the sum of $100.00 be appropriated for Guide Boards.


Article 10. Voted that the sum of $600.00 be appropriated for the Care of the Whitney Playground.


Article 11. Voted that the sum of $8.000.00 be appropriated to meet the expenses of W. P. A. or similar projects, $3,000.00 of which is to be taken from Surplus.


Article 13. Voted to appropriate the sum of $254.73 for the Road Machinery Account, which sum, together with the funds in the amount of $3,745.27 in said account, be appropriated for Road Machinery Purposes.


Article 14. Voted that the Committee chosen at the last Annual Meeting to make a survey and examination of the land devised under the will of Martina A. Gage, be given an extension of time.


Article 15. Voted to dismiss the article relative to a possible sale of land devised under the will of Martina A. Gage, and of cutting and removing wood and timber thereon.


Article 16. Voted that the Town accept the layout made by the Selectmen of a way in Forge Village on file in the Town Clerk's Office on petition of Edmund D. Rogers and ten others. (This way is com- monly known as Mattawanakee Street.)


Article 17. Voted to dismiss the article relative to accepting the layout made by the Selectmen of a way in Forge Village on file in the Town Clerk's Office on the petition of John J. Daly and eleven others. (Commonly known as Pond Street and Bradford Street.)


Article 18. Voted that a Committee of three be appointed by the Moderator to act with the Selectmen and investigate the advisability of of accepting the layout made by the Selectmen of a way in Forge Vil- lage on file in the Town Clerk's Office on petition of Edmund J. Hunt and seven others and report at a later meeting. (Commonly known as Lincoln Avenue and Elm Street.)

Article 19. Voted to dismiss the article relative to accepting the layout by the Selectmen of a way in Forge Village on file in the Town Clerk's Office on petition of William Kelly and sixteen others. (Com- monly known as Pershing Street and Smith Street.)


Article 3.


31. Voted to take from the table the article relative to Bills Outstanding December 31, 1937.


Voted that the amount of $189.00 be added to the Board of Public Welfare unpaid bills for the year ending December 31, 1937, this being a bill of Dr. Cyril A. Blaney for medical services rendered.


Voted that the sum of $2,858.44 be appropriated for bills out- standing December 31, 1937, to be divided as follows: Registration and Election $56.00; Town Hall $19.93; Police Department $33.52; Fire De- partment $42.33; Health Department $90.00; Temporary Aid $2,121.18; Infirmary $85.11; Soldiers' Benefits $221.37; Public Welfare $189.00.


Article 20. Voted that a committee of three be appointed by the Moderator to bring in names for the new way laid out and accepted and any other unnamed Town ways; said Committee to report at the next Town Meeting.


Voted to take up Articles 22, 23 and 24 before taking up Article 21.


Article 22. Voted that Articles 21, 22, 23 and 24 be referred to the same committee as was appointed in 1937 under Article 17 at the Annual Town Meeting, to investigate and make a report at a special town meeing to be held not later than April 15, 1938; in the case of the failure of any members of this Committee to serve, the Moderator is empowered to fill any such vacancies with members of the group in which the vacancy occurs.


Article 23. Voted to dismiss the article relative to the installation of a new heating plant at the Frost School.


Article 24. Voted to lay on the table, the article relative to changes, alterations and repairs in the Frost School until the next Town Meeting.


Article 21. Voted unanimously that the Selectmen be and hereby are authorized, empowered and directed on behalf of the Town to petition the Great and General Court for legislation permitting the

Town to borrow not exceeding $20,000.00, payable in a period not ex- ceeding ten years for the purpose of remodeling, enlarging the fioor space, equipping and installing a sufficient heating system in the Wil- liam E. Frost School.


Article 25. Voted that the sum of $22.20 be appropriated to re- imburse Frank G. Kloppenburg for damages sustained to his automo- bile while on a highway in this Town.


Article 26. Voted to accept Section 48 of Chapter 31 of the Gen- eral Laws of the Commonwealth of Massachusetts, Ter. Ed., as set torth in Article 26, as to its permanent police force, (excepting, how- ever, the Chief of Police who is now governed by the Civil Service Laws and regulations.)


Article 27. Voted to accept the minutes of the meeting.


Article 28 Voted to dissolve the meeting.

SPECIAL TOWN MEETING, MAY 12, 1938


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town House, Thurs- day, May 12, 1938, the following business was transacted:


Roger H. Hildreth, Town Moderator, called the Meeting to order at eight o'clock P. M.


1. Voted to accept the written report of the Finance Committee.


2. Voted that the Town authorize the Selectmen to purchase Spraying Eqiupment from the appropriation voted for the use of the Moth Department at the annual meeting of 1938 and also authorize the Selectmen to turn in the old Sprayer for an allowance to be applied to the purchase price of the new Sprayer.


3. Voted that the Town authorize the Selectmen to purchase an automobile from the appropriation voted for the use of the Police De- partment at the annual meeting of 1938 and also authorize the Select- men to turn in the old police car for an allowance to be applied to the purchase price of the new car.


4. Voted that the Town authorize the Whitney Playground Com- mittee to purchase a motor mower from the appropriation voted for the care of the Whitney Playground at the annual meeting of 1938 and also authorize the Committee to sell the old mower, the amount re- ceived for such sale to be applied to the purchase price of the new mower.


5. Voted that the sum of $1900.00 be appropriated for equipment hire, tools and materials for Relief Cases; $400.00 of this to be used for stock and the expenses of painting Public Buildings.


6. Voted that the Town accept the layout made by the Selectmen on petition of Edmund J. Hunt and seven others of a way in Forge Village, as shown on a plan on file in the Town Clerk's Office. (This way is commonly known as Lincoln Avenue and Elm Street.)


7. Voted that the report of the Committee on naming streets and roads be accepted and that their recommendations as to the names and

descriptions of the streets and roads, as set forth in their report, be adopted, and that the Committee be given further time in which to re- port on the other unnamed roads.


8. Voted to accept the report of the Committee chosen to make a survey and examination of the land devised under the will of Martina A. Gage and that said Committee be given time for a further report.


9. Voted 42 to 17 that the Town raise and appropriate for the pur- pose of remodeling the Frost School and to meet said appropriation that the Treasurer with the approval of the Selectmen be and hereby is authorized to borrow up to $20,000.00 and issue bonds or notes of the Town therefore in accordance with the provisions of Chapter 262, Acts of 1938. Said bonds or notes shall be due and payable in ten years.


Voted that the School Committee and the Investigating Committee appointed under Article 22 at the Annual Town Meeting held February 21, 1938, be appointed to serve as a building committee to remodel the Frost School.


10. Voted to accept the minutes of the meeting.


11. Voted to dissolve the meeting.

REPORT OF THE BOARD OF SELECTMEN


Citizens of Westford:


After the February elections the Board of Selectmen organized with Arthur M Whitley as chairman, Arthur L. Healy as secretary, and Dr. Cyril A. Baney as the third member.


The appointments made were the same as those the preceding year with the exception of the Town Counsel, to which position George M. Heathcoate was appointed.


The renewal of insurance on public buildings, machinery and equipment was made and it was recommended that the policy on the Frost School be increased approximately $10,000.


A detailed report of the Police Department may be found in the Police report. Two regular officers have been maintained at no increase in salary. A new car was purchased according to the vote of the Town.


Regarding the highways of the town, a detailed report may be found in the report submitted by the Superintendent of Streets. Trucks that were needed in excess of those owned by the Town have been ap- portioned to the owners in Westford who requested work, at $1.15 an hour. Wages have not been changed during the year. The usual allot- ments have been made by the State and County. An allotment of $3,400 was given by the State to be used for highway work in 1939, but with the permission of the Public Works department we used this for clear- ing our highways of trees which had fallen during the hurricane.
