REPORT OF THE TOWN FOREST COMMITTEE


Report of the Town Forest Committee:


The work for the last year has consisted of trimming and also some of the last of the hurricane damage has been cleared away.


During the coming year two acres bordering on Forge Village Road should be reset. If this is done the forest would be in very good condition.


Two small fires occurred during the year. They were promptly extinguished by the Fire Department.

ART. 21. The Finance Committee does not recommend the acceptance of Coolidge Avenue at this time.


ART. 22. The Finance Committee recommends that a committee be appointed to determine the land damages on Hil- dreth street, said committee to report at the next Town Meeting.

To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1st., 1941 and to issue a note or notes therefore, pay- able within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Chap- ter 44, Section 17 of the General Laws.


ART. 5. To see if the Town will vote to appropriate the sum of $300.00 for the Care of Whitney Playground.

ART. 6. To see if the Town will appropriate money to meet the expenses incurred in connection with the W. P. A. or other similar projects.


ART. 7. To see if the Town will vote to remodel the lower Town Hall and act in relation to same.

ART. 11. To see if the Town will vote to accept the land in Forge Village under the deed of the Abbot Worsted Company and act in relation to same.


ART. 12. To see if the Town will vote to move the present Fire House at Forge Village and erect same on Town owned land at Nabnassett and erect a new Fire House at Forge Village on land acquired and act in relation to same.


ART. 13. To see if the Town will vote to install an Air Horn at the Westford Center Fire House and act in relation to same.


ART. 14. To see if the Town will vote to authorize the Selectmen to install additional Street Lights as follows:


Five on Tyngsboro Road


Six on Dunstable Road One on Carlisle Road


ART. 15. To see if the Town will vote to authorize the purchase of a used chassis and have the Town Sprayer mounted on same. Also to have Sprayer housed in the Fire House and used for Forest Fire purposes when not in use by the Moth Department. ART. 16. To see if the Town will vote to authorize the appointment of a man at the Westford Fire House to take care of all Equip- ment at a salary not to exceed $500.00 and free rent of the Fire House Cottage, and act in relation to same.


ART. 17. To see if the Town will vote to appropriate the sum of $400.00 for Band Concerts for the current year.


ART. 18. To see if the Town will vote to appropriate the sum of $900.00 for telephone service for the following named Depart- ments: Fire, Forest Fire, Police, also the Town Nurse and for the No School Signal and engage Mrs. Hilda Bosworth to handle this service.


ART. 19. To see if the Town will accept the layout made by the Selectmen of the ways in Forge Village on file in the Town Clerk's Office on petition of John J. Daly and eleven others.

ART. 20. To see if the Town will accept the layout made by the Selectmen of a way in Westford Center, known as Tadmuck Hill, on file in the Town Clerk's Office on petition of Frederic W. Burnham and eleven others.


ART. 21. To see if the Town will accept the layout made by the Selectmen of a way in Brookside, commonly known as Coolidge Avenue on file in the Town Clerk's Office on petition of Thomas . Johnstone and eleven others.


ART. 22. To see if the Town will vote to appropriate money for land damages on Hildreth Street. Same to be adjusted by a committee of three, one to be appointed by the Selectmen, one by the land owner and a third be chosen by these two.


ART .. 23. To see if the Town will vote to adopt the following by-law, no Town Officer, nor any company or corporation with which a Town Officer or employee is affiliated, shall sell Materials or sup- plies to the Town; nor receive any compensation or commission for services rendered by him for the Town; nor receive any re- muneration for any of his machinery or equipment used by the Town, except his official salary and fees allowed by law; or act in relation thereto.


ART. 24. To see if the Town will adopt the following by-law. All purchases of materials or supplies exceeding the sum of $50.00 shall be based on competition or act in relation thereto.


ART. 25. To see if the Town will vote to adopt the following by-laws and act in relation to same.


Building Law Article VII Section 1 Title and Scope


This by-law shall constitute and be known as the "Building Law" of the Town of Westford, and shall become effective as soon as passed by the Town and approved by the proper authorities of the Common- wealth of Massachusetts. It concerns all matters having to do with bulidings in the Town of Westford, except as limited by the laws of the Commonwealth of Massachusetts.


Section 2 Administration


The power of administration of this by-law shall be vested in an Inspector of Buildings who shall be appointed annually by the Select- men, and subject to removal by them. He shall hold office from the time of his appointment until his successor is appointed and qualified.


His compensation shall be provided by vote of the Town.


The Inspector shall be versed in the practice of modern building and a resident of the Town.

The Inspector shall have the power to carry out the provisions of these by-laws and any amendments or additions thereto.


The Selectnien, may when deemed necessary, appoint a Deputy Inspector, whose qualifications for office shall be the same as those of the Inspector, to act for the Inspector during his absence or dis- ability, and he shall then have all the duties and powers of the In- spector.


The Inspector shall keep a record of all transactions of his office, and make a report in writing on the same to be included in the Annual Town Report.


The Inspector shall not be permitted to pass on any work in which he is in any way interested.


No oversight or neglect of duty on the part of the Inspector shall legalize the erection or alteration of any buildings or part thereof in a manner not in conformity with the provisions of these by-laws.


Any person dissatisfied with any refusal, order, or decision of the Inspector of Buildings may appeal within 10 days from the date of such refusal, order or decision. In such case the Board of Assessors shall act as Board of Appeals. No member shall act in any case in which he is interested. If any member is disqualified or for any reason must be absent, the remaining members shall appoint a substitute. All decisions of the Board shall be in writing, and a unanimous vote shall be necessary to reverse a ruling of the Inspector. In case decision is against the applicant, any expense incurred shall be borne by him.


Non-conforming structures may be approved by the Board of Appeals after a properly advertised public hearing.


Section 3 Permits


Before the erection or alteration of any building or any portion of any building, including garages but excepting one-story auxiliary buildings not used for dwellings, the owner or lessee of such building or his agent shall make application for a permit to the Inspector of Buildings on forms provided by him, furnishing all such information as the Building Inspector shall require concerning the proposed build- ing or alteration, and work shall not be started until a permit is properly issued, signed by the Building Inspector.


The Inspector shall report on all applications within 5 days, except that when the public interest demands, the Selectmen may grant an extension of time, but in no case shall this extension exceed 15 days.


Permits shall become void unless work is started within 90 days, or if work is abandoned for more than 6 months.


The rate of fees to be charged for permits shall be $2.00.


Section 4 Inspection


The builder in charge of construction shall give notice to the Inspector whenever any parts are ready for inspection, if further work

is to conceal these parts. The Inspector shall respond promptly and in no case delay more than 48 hours, exclusive of Sundays and Holi- days.


Section 5 Heights


No building shall be erected in the Town of Westford which shall exceed thirty-five feet in height. This provision shall not apply to churches, public buildings, cupolas, etc., not used for habitation, or to chimneys, ventilators, flagpoles, weather vanes, soil pipes, or similar constructions such as are usually erected above roof lines.


Section 6 Foundations


Foundations of brick or concrete shall be 2 inches thicker than the building wall immediately above, but in no case less than 8 inches thick, for a dwelling.


Rubble stone foundations shall be at least 24 inches thick, at the bottom, and 18 inches thick at the top.


Foundations may be built of "one or two man stones" laid flatwise.


Concrete foundations shall be poured with wooden forms on both sides.


All brick or stone foundations shall be pointed or laid in mortar from 6 inches below grade to the sill.


Non-residence buildings and camps may be built on posts or piers.


Buildings built or altered for use as permanent dwellings shall have cellars at least 7 feet in the clear.


Section 7 Wooden Construction


Sills for one story structures shall be at least 4 x 6 inches laid flat, and for two story structures at least 6 x 6 inches.


Sills shall be laid at least 8 inches above finished grade.


Floor joists and supports shall be of sufficient size and such spacing as the Inspector shall deem necessary, but in no case shall joists be less than 2 x 8 inches, set 16 inches on centers, with 12 foot span for ground floors, nor less than 2 x 6 inches, set 16 inches on centers, with 12 foot span for upper floors. Floor supports shall be at least 6 x 6 inches.


Fire stops, which may be of wood, shall be built in each floor level,


Posts shall be at least 4 x 6 inches.


Girts shall be at least 4 x 6 inches.


Studding shall be of 2 x 4 inch stock, set not more than 16 inches on centers. Inside, non-carrying partitions, may be 2 x 3 inch stock.


Roof rafters shall be at least 2 x 6 inch stock set not more than 24 inches on centers.


Every wooden building hereafter constructed shall have its out- side walls covered with a standard building material such as siding,

clapboards, shingles, etc., which shall be approved by the Inspector. This provision shall apply to garages but not to other one-story aux- iliary buildings.


Section 8 Chimneys


Chimneys shall be of brick or stone laid in mortar. Walls of chim- neys unless 8 inches or more in thickness shall be lined with terra cotta flue lining laid in mortar. Unlined chimneys shall be plastered inside with cement mortar. All chimneys shall be plastered outside with cement mortar except where exposed.


Chimneys shall be topped out not less than 3 feet above the point of highest contact with the roof. All chimneys shall be capped with a one piece cap of stone or concrete.


A cleanout door shall be provided near the base of all chimneys.


No smoke pipe shall pass through a partition unless properly protected by a soap stone or ventilated ring. No smoke pipe of any kind shall pass through a roof, wall or window.


No earthenware flues shall be permitted.


No metal flue or smoke pipe shall pass within 12 inches of any woodwork, and any woodwork above such flue shall be protected by fire-resistant material for 4 inches each side of the pipe.


Section 9 Location of Buildings


No dwelling shall be placed on a lot of less than 7500 square feet, which lot shall have a frontage upon a road of way of at least 75 feet. This provision shall not apply to lots already laid out at the time this by-law goes into effect.


Buildings shall be set back from the road or way upon which they front by a distance of at least the average distance of set back of the two buildings next on either side, and in no case closer than 15 feet from the nearer edge of such road or way.


No building shall be placed with its nearest part closer than 7 feet to the boundary line of the lot on which it is placed.


No garage or other building shall be built in front of the rear line of any dwelling unless it is attached to said dwelling.


Section 10 Penalty


Whoever violates any of the provisions of these by-laws, or of any permit issued thereunder, shall, except where otherwise provided by statute, be punishable by a fine not exceeding Twenty Dollars for each violation thereof.


And you are directed to serve this warrant by posting up true and attested copies thereof at the Town Hall and each Post Office in said Westford, seven days at least before the time of holding said meeting.

Hereof fail not, and make return of this warrant, with your doings thereon, to the Town Clerk, at the time and place of holding the first meeting aforesaid.
