Acknowledgements .- All conveyances and other instruments required to be acknowledged, if acknowledged within this State, must be acknowledged be- fore some court having a seal, or some judge, justice or clerk thereof, or some justice of the peace, notary public or county clerk, register of deeds, or mayor or clerk of an incorporated city. If acknowledged out of the State the acknowledgment must be before some court of record, or clerk or officer hold- ing the seal thereof, before a commis- sioner to take the acknowledgment of deeds appointed by the governor of this State. or before some notary pub- lic or justice of the peace, or before any consul of the United States, resi- dent in a foreign country. The ac- knowledgment before a justice of the peace of another State must be ac- companied by a certificate of his of- ficial character under the hand of the clerk of some court of record and the seal of the court.
Actions .- Common law forms of ac- tlons are abolished. Under the code there Is but one form of action, which is called a civil action. Personal ac- tions must be brought in the county where the defendant or one of several defendants resides. Real estate actions must be brought in the county where the real estate is situated. Actions against non-residents of the State or foreign corporations, may be brought in any county in which there may be property of or debts owing to said non- resident or foreign corporation.
Affidavits may be made before any person authorized to take depositions.
Allens .- No distinction between citi- zens and aliens in reference to pur- chase, enjoyment or descent of prop- erty.
Appeals may be taken from the de- cisions of the probate court to the dis- trict court of the county. Notice of the appeal must be given in open court and entered on the record, or by written · notice to the opposite party or his at- torney of record. The appellant, or his agent or attorney, must make and file
an affidavit that the appeal is not taken for vexation or delay, but be- cause the affiant belleves that the ap. pellant is aggrieved by the decision of the court. The appellant must also give a bond in such sum and with such security as may be fixed and approved by the probate court, conditioned that he will prosecute the appeal and pay all costs and damages that may be ad- judged against him. An appeal must be taken within the term at which, or within ten days after, the decision is rendered. Appeal lies from justice of the peace to the district court, except in judgments by confession and jury trial, when the amount claimed is less than $20
Arrest .- Debtor may be arrested by civil process before or after judgment, when it appears that he has removed, converted into money, concealed, as- signed, or disposed of property, with intent to defrand his creditors, and when the debt has been fraudn'-tly contracted.
Assignments and Insolvency .- As- signments must be for benefit of all creditors, and do not discharge the debtor. Must be executed and record- ed like conveyances of real property. Creditors (above ten dollars) are noti- fied by Clerk of District Court, and at the meeting held for choice of assig- nee, a majority of such creditors must be present, otherwise appointment rests with the court. Creditors who fail to appear are precluded. Assignee must pay out funds in his hands with- in one month of allowance of demands. Property must be appraised and assig- nee is in all respects subject to order of court and his accounts are passed upon by a commissioner before his dis- charge.
Attachments .- Attachment may be had against the property of a defend- ant debtor, in actions for the recovery of money at or after the commence- ment thereof, In same cases in which he may be arrested. An attachment may be obtained before a debt is due if the debtor has sold. conveyed or dis.

posed of his property or is about to do so, or is abont to remove his property with Intent to defraud or delay hls creditors. But judgment cannot be rendered in the action until the claim is due. The order of attachment in such case may be granted by the court in which the action is brought, or by the judge thereof, or, in his absence from the county, by the probate judge of the county in which the action is brought; but before such action shall be brought or such attachment shall be granted, the plaintiff, or his agent or attorney, shall make an oath in writing, showing the nature and amount of the plaintiff's claim. that it is just, when the same will become due, and the existence of some one of the grounds for an attachment men- tioned. See arrest for grounds for or- der of attachments. (See Garnishment.)
Chattel Mortgages .- Every chattel mortgage or conveyance intended to operate as such, which shall not be ac- companied by an immediate delivery, and followed by an actual and con- tinued change of possession of the thing mortgaged, shall be absolutely void as against the creditors of the mortgagor, and subsequent purchasers and mortgagees in good faith, unless the mortgage, or a true copy thereof, shall be forthwith filed in the office of Register Deeds of the county where the property is situated, or, if the mort- gagor be a resident of the State, then of the county of which he is a resident. And every such mortgage shall be void against creditors of the mortgagor, or subsequent purchasers or mortgagees in good faith, after the expiration of one year after the same is filed. unless within thirty days next preceding the expiration of said year. And each suc- ceeding year, the mortgagee, his agent. or attorney, shall make an affidavit ex- hibiting his interest in the property at that time and the amount yet due thereon, which affidavit shall be at- tached to and filed with such mort- gage. After condition broken, the mortgagee may proceed to sell the mortgaged property, or so much of it as may be necessary to satisfy the mortgage and costs of sale. by giving ten days' notice. If such an affidavit be made and filed before any purchase of such mortgaged property shall be made, or other niortgage deposited, or
Hlen obtained thereon, In good faith, It shall be as valid to continue in effect sich mortgage as If the same had been made and filed within thirty days next preceding the expiration of the terms of one year from the date of the filing of the original mortgage.
Deeds need not be executed before witnesses. Valid without acknowledg. ment, but must be acknowledged to be entitled to be recorded or to be intro- dueed in evidence. Acknowledgment of wife need not be taken separate from husband. Unth duly deposited for record, deeds and other instru- ments affecting real property are not valid, except between the partles there. to, and such as have actual notice thereof.
Dower .- "The estates of dower and by curtesy are abolished."
Exemptions .- To unmarried person, tools and stock in trade, $400; or li- brary and huplements of professional nien. To head of family, household furniture, $500; also team, wagon, etc. Farming utensils. $300. Stock and tools of mechanics, $400 .. Libraries, ete., of professional men. Homestead, 160 acres farm land, or 1 acre in city, with improvements, without limit as to value.
Garnishment .- Earnings of résident debtor for personal services at any time within three months next pre- ceding issuance of execution. attach- ment. or garnishment process. are ex- empt if necessary to support of debtor's family, affidavit of debtor con- clusive as to necessity.
Interest .- Legal rate. 6 per cent. By agreement in writing .. 10 per cent. Usury: The party forfeits double the sum in excess of 10 per cent.
Judgments in the District Courts of the United States, rendered within this State. are a lien on real estate of the debtors, situated within the. county where judgment is rendered, and not a homestead from first day of term at which rendered, except judgments by confession, and judgments rendered at same term of court in which action was commenced, which become liens from date of rendering judgment. A judgment becomes dormant in five years after its rendition, or after the issuance of the last execution thereon, and ceases to be a lien upon the prop- orty of the debtor. It may be revived

by motion and notice within one year after becoming dormant. Justices' judgments become liens on filing tran- script in District Court of the county in which they were rendered. Tran- scripts of judgments entered in one county may be certified to and en- tered in the. District Court of any other county, and when so filed become a len on the real estate not exempt sit- uated in the county where the tran- script is filed. The lien in such cases dates from the time of the filing of the transcript. Executions on such judgments can issue only from the District Court of the county where the Judgment was rendered.
Justices' Jurisdiction .- For the re- covery of money when the amount claimed does not exceed $300. Justices of the peace have jurisdiction of ac- tions for the recovery of specific per- sonal property. replevin, not exceeding $100 in value. (See License.)
License .- Commercial travelers are not required to procure a license.
Limitations .- Actions for the recov- ery of real property sold on execu- tion, brought by the execution debtor by title acquired after the date of the judgment must be brought within five years after the date of the recording of the deed made in pursuance of the sale. The same rule applies to actions for the recovery of real property sold by executors, brought by heirs, etc. An action for the recovery of real prop- erty sold for taxes must be brought within two years after the date of re- cording the tax deed. An action for the forcible entry and detention, or forcible detention only of real prop- erty, within two years. Actions con- verning real property not above pro- vided for must be brought within fif- teen years; on official bonds, within five years; on contracts in writing within five years, not in writing within three years; trespass to real property, detinue, replevin, fraud or torts, with- in two years. In cases founded on contract, payment of any part of in- terest or principal, or acknowledgment in writing of the existence of the con- fract takes it out of the statute. Per-
sons under any legal disability when the cause of action accrues have two years from date of removal of such disability to bring action concerning real property, and in all other cases one year.
Married Women .- Have same rights as men concerning property and busi- ness.
Mortgages .- A mortgage of real es- tate, to be valid as against subsequent bona fide purchasers or mortgagees, must be duly acknowledged and ro- corded in the office of the Register of Deeds of the county in which the land is situated. Mortgages are foreclosed by suit only. Attorney fee not collect- able.
Proof of Claims .- Parties sending clainis for collection should give full name or names of parties to whom the same belongs. If the claims be- longs to a firm. the full name of each member of the firm should be given. and whether a partnership or a corpor- ation, all claims should be verified. thus saving other proof. when no other defense is made.
Redemption .- No redemption except of lands sold for taxes. then three years.
Revivor .- As relating to judgments. (See Judgments.)
Stay of Execution .- In Justice's Court, on $20 to over $100, thirty to one hundred and twenty days.
Wills .- No man, while married, shall bequeath away from his wife more than one-half of his property, nor shall any woman, while married, bequeath away from her husband more than one-half of her property. But either may consent, in writing, executed in the presence of two witnesses, that the other may bequeath more than one- half of his or her property away from the one so consenting.
Witness .- Parties to the suit, and persons in interest not disqualified. Husband and wife cannot be witness for or against each other in civil ac- tion, except in cases where one acted as agent for the other, or where they are joint parties, and have a joint in- terest in the action.
