Town of Wayland.


The sidewalk on Pond Street, from Main Street to Granny Pond (so called) has been built as far as advisable at a cost of $512.37.


In regard to the claim of Joseph T. Minon against the Town of Wayland, the Selectmen have employed counsel, and acting on his advice have not paid the claim. The following is a copy of the opinion rendered :

Chairman of the Board of Selectmen of Wayland. DEAR SIR :


I have considered the questions submitted to me by you in relation to the claim of Joseph T. Minon against the town of Wayland, namely :-


1. Whether the vote of March 26, 1906, by which it was voted to appoint Mr Minon " Agent of the town to take care of the rights of our citizens in the matter of boating, skating and fishing on Lake Cochituate " and


2. Whether the vote of March 25, 1907, by which it was voted that " The sum of eight hundred dollars be appropriated and assessed to reimburse Joseph T. Minon as agent of the Town for counsel fees paid in defending the boating rights of the citizens of Wayland in Lake Cochituate "? are valid votes and constitute a legal appropriation of public money which entitles Mr. Minon to demand the money so appropriated from the town.


I find no statute specifically authorizing the appointment of such an agent or allowing public money to be appropriated for such a purpose. If, therefore, the authority exists it must be found in the general clause of the statute giving power to towns to raise money for " all other necessary charges arising in such town."


The " Necessary charges " mentioned in this clause have been uniformly construed and held to be restricted to matters in which the town has in its corporate capacity a duty to perform, an interest to protect, or a right to defend and not to extend beyond what is necessary to accomplish these purposes.


The town of Wayland has no more or greater corporate duty to take care of or protect the boating, skating and fishing rights of

her citizens on Lake Cochituate than it has to protect and take care of any other rights, legal or otherwise, which her citizens may have. Such rights are left by law to be asserted and vindicated by the individuals claiming them and those who wish to indulge in the luxury of counsel to assist them in their controversies have no just cause of complaint if left to discharge the obligation such a luxury entails. Nor has the town in its corporate capacity any interest in Lake Cochituate to protect, or any right to defend. It is a " Great Pond " within the meaning of the law and as such is under the control and is owned by the Commonwealth as public property held in trust for public uses, except in so far as the owner- ship and control has been surrendered for the purposes of a water supply, but whether so surrendered or not the town has no vested property rights or interest in it.


It follows that the town had not authority to pass either vote, that the attempted appropriation of the money was and is invalid, ineffectual and void, and that Mr. Minon has no claim against the town under the votes referred to.

We have perambulated the Town line between Framingham and Wayland. The boundary stones were located and found to be in good condition.


We have been compelled to overdraw the incidental account.


This was made necessary by drawing on this account for insur- ance to the amount of į$682.80, and for new Town Scales at Cochituate to the amount of $243.63.


The following is an extract from the report of the County Commissioners : The repairs ordered by the Board at Sherman's bridge across the Sudbury river between Wayland and Sudbury were not done by the towns up to last spring and the Board called the Selectmen of the two towns in, to endeavor to arrange for the work. It was finally decided in view of the nature of the repairs, that the work should be done by some competent contractor on the basis of actual cost of labor plus 15 per cent. and the actual cost of materials.

Town of Wayland.


Mr H. W. Tarbell of Lowell furnished the necessary labor, and the work was performed under the direction of our engineer. The old wooden bridge, about 100 feet in length, was almost entirely replaced, new piles being driven and new lumber used. The stone abutments were relaid in Portland cement mortar, railings erected and the approaches graded and surfaced. The total cost of the work was $3,239.18 and $1,079.73, or one-third the expense, was borne by each town and by the county respectively.

REPORT OF SURVEYOR OF HIGHWAYS.


WAYLAND, February 29, 1908.


The amount appropriated for Highways and Bridges was two thousand dollars ($2,000.00). There was an unexpended balance from previous year of ninety dollars and seventy-six cents ($90.76) making a total of two thousand and ninety dollars and seventy-six cents ($2,090.76).


The total amount expended was two thousand five hundred and ninety-six dollars and four cents ($2,596.04), making an overdraft of five hundred and five dollars and twenty-eight cents ($505.28).


The snow bills for the year amount to one hundred and thirty- eight dollars and fifty-three cents ($138.53). Itemized bills for above amounts are on file in the Selectmen's office.


The overdraft of $505.28 is explained by the fact that the Natick and Cochituate Street Railway Excise Tax was not paid at the usual time (before close of our Municipal year). When this is turned into the Town Treasury this account will show a balance of $3.07. But the railway people say they cannot pay it before April 1st.

REPORT OF THE BOARD OF HEALTH.


The Board of Health submits the following report : -


During the past year the following diseases have been noticed : Diptheria, one case. Scarlet Fever, two cases. Measles, eight cases ; several not reported. Mumps, two cases ; several not reported.


Improvements have been made in the piggeries, and several cesspools have been put in the past year.


Very few cases of malaria have been observed.
