Drainage was finished on School Street, and new catch basins installed. Drainage on Pleasant Street was also com- pleted with the installation of catch basins. Work was finished on George Street by the drainage at Weber Farm Brook. We have a serious situation on West Bacon Street, about opposite Warren. A start has been made on this drainage, and should be completed during the coming year.


The sidewalk, as provided for on East Bacon Street, was completed as far as the funds appropriated would allow.


In conclusion, the Board wishes to acknowledge the splendid cooperation given by the various Town Departments during the year.

CERTIFICATE RELATING TO CERTAIN MINUTES OF A SELECTMEN'S MEETING


Town of Plainville


I, Ruth R. Fulton, secretary-clerk of the Board of Select- men of the Town of Plainville, Massachusetts, hereby certify that the following is a true copy of excerpts from the minutes of a meeting of said board held December 4, 1950, at 6:45 P. M., at the Town Offices, which meeting was attended by the Town Treasurer and by Arthur W. Washburn, Sydney J. Andrews and LeRoy B. Wilson, being all of the Selectmen.


The meeting considered the $275,000.00 Plainville School Loan, Act of 1950, and $50,000.00 School Loan authorized to be issued by vote of the town duly adopted at a special town meeting held October 23, 1950.


The meeting was informed by the Town Treasurer that he had caused the bonds evidencing these loans to be ad- vertised for sale by circularizing the leading investment bankers and banks dealing in municipal securities situated in New England and New York. He said that Five bids had been received for the purchase of said bonds, each bid includ- ing interest accrued to date of delivery, namely,

$275,000.00 Plainville School Loan, Act of 1950,-$15,000.00 on the first day of December in each of the years 1951 to 1965, inclusive, and $10,000.00 on the first day of December in each of the years of 1966 to 1970 inclusive, $50,000.00 School Loan- $5,000.00 on the first day of December in each of the years 1951 to 1960, inclusive;


that the interest rate of said bonds be and it hereby is fixed at Two per cent per annum; and that the bid of Estabrook & Co. and Lee Higginson Corporation of Boston, Massachusetts to purchase said bonds at an interest rate of Two per cent plus a premium of Five Thousand Seven Hundred Seventy Eight and .... 50/100 Dollars, and interest accrued to date of delivery, being the best bid received for said bonds, be and it hereby is accepted and the Town Treasurer be and he hereby is authorized to deliver said bonds to the aforesaid purchaser or order against payment therefor.".


I further certify that all of the members of the Board of Selectmen were present and voted throughout the aforesaid meeting and that the aforesaid vote has not been amended or rescinded and still remains in full force and effect.

REPORT OF THE BUILDING CODE COMMITTEE


We recommend the following Building Code By-Laws be adopted.


These By-Laws are adopted for the health, safety, con- venience and welfare of the inhabitants of the Town of Plainville, by regulating the use and construction of buildings, structures and premises within the Town of Plainville.


Part I Area Regulations and Lot Sizes


1-Lot Lines and Areas:


(A): No main residential building shall be nearer than twenty feet from the front lot line, and ten feet from the side and rear lot lines. Where there is more than one building located on any lot, the main building shall be the one on that lot which is principally used by the owner thereof.


(B): Commercial buildings may however face on front lot line.


(C): In the case of front lot lines where there are build- ings or structures on either side within one hundred feet of the proposed buildings or structures which are nearer to the street than twenty feet, then and in that case a building or structure may be constructed on a line with existing buildings or structures.


2~Lot Sizes:


Each main building or structure shall be erected on a lot, preferably containing no less than ten thousand (10,000) square feet with one hundred (100) foot frontage, and in no case containing less than seventy-five hundred (7,500) square feet, with seventy-five (75) foot frontage.


Part II Non-Conforming Uses


1-Continuation of Non-Conforming Uses:


Any lawful building or use of a building or premises or part thereof at the time this By-Law or any amendment

thereto is adopted may be continued although such building or use does not conform to the provisions thereto. No such building shall be added to, enlarged, or reconstructed to an extent greater than fifty per cent (50%) of its area at the time of the adoption of this By-Law or such amendment.


2-Limitation on Restoration:


A building which does not conform with these By-Laws which has been damaged by not more than seventy-five per cent (75%) after the adoption of these By-Laws by fire or other cause may be repaired or rebuilt provided that it shall not be extended beyond its former walls in the repair or rebuilding thereof.


3-Lots owned at time of Adoption of this By-Law:


On any lot which is separately owned at the time that this By-Law is adopted by the Town, main buildings may be erected regardless of the width of the lot or the number of square feet contained in the lot provided that any such build- ings so erected shall not be nearer than twenty feet from the front lot line and ten feet from the side and rear lot line.


Part III


1-Chimneys:


In any building every chimney shall be constructed of brick, stone, or concrete and shall commence from the ground or bottom of cellar, unless corbeled from a masonry wall. The walls shall be at least four inches (4) thick with terra cotta flue lining.


2-Wiring:


All electrical wiring entrances shall not be smaller than one inch (1) conduit, with three (3) wires not smaller than number six (No. 6) or an approved type of service entrance cable with three (3) wires not smaller than number six (No. 6); in either case there must be an identified neutral wire. The service must be grounded with number six (No. 6) armored wire and fastened with an approved clamp to the street side of the water system. In the absence of an outside piping system, a ground rod or pipe driven into a permanently damp earth is acceptable. All electrical wiring shall be inspected before the

current is turned on by an official appointed by the Selectmen, and no wiring shall be enclosed until it has been inspected.


3-Foundations:


The foundations of every structure shall conform to the standard building practice for the type of structure involved, with adequate footing where soil conditions necessitate same.


4-Framing:


The framing of every structure shall be done in accordance with standard building practice.


5-Outside Wall Finish:


No material shall be used for the permanent outside finish of the walls of buildings or structures except stone, brick, clapboards, siding, tile, glass blocks, wood, shingles, composition shingles, concrete or that type of cement which is known as "Stucco."


6-Roof Covering:


Wherever a building is nearer than fifty feet from another building, the covering of the roof of such building must be of fire resistent material. If a building is more than fifty feet from any building, the covering of the roof of such building may be any standard roofing material.


7-Sewerage:


The disposal of sewerage shall be by cesspool or septic tank and in accordance with standard practices.


Part IV Administration and Enforcement


1-Machinery for Administration and Enforcement:


There shall be a Board of Appeals of five members ap- pointed by the Selectmen. The members shall be appointed for a term of five years in such a way that the term of one member shall expire each year, and one appointment shall, therefore, be made by the Selectmen to fill the vacancy each year. The Selectmen shall also appoint one Associate Member

for a term of five years, and this Associate shall serve upon the Board of Appeals in case of the death or disability of any regular member before his term shall have expired. This Board of Appeals shall act upon all matters within its jurisdiction under this By-Law. This Board of Appeals shall, at all times, give consideration to the promotion of the public health, safety, convenience and welfare, and this Board shall permit no building or structure or use of any premises which causes injury to any neighborhood or which is detrimental to any neighborhood, and the Board shall prescribe appropriate conditions and safeguards in each case.


2-Enforcement:


The Board of Selectmen shall appoint a Building Inspector whose duty it shall be to grant permits for construction work under the jurisdiction and subject to the control of the Board of Selectmen. The Building Inspector shall examine any build- ing, structure or premises at the pleasure of the Board and shall report to the Board regarding the same. This person shall be paid for his services by the Town of Plainville in an amount or amounts to be decided by the Board from time to time.


If a permit is refused by the Building Inspector to any applicant, he may appeal to the Board of Appeals for a public hearing and the board of appeals shall hold a public hearing upon such application after posting due notice of the time and place of such public hearing and at least seven (7) days before the proposed date of such public hearing and after such public hearing the Board of Appeals shall make a finding in writing either issuing or refusing the permit.


Part V


1-Permits:


No building or structure shall be constructed, moved or materially altered without first obtaining a permit therefore from the Building Inspector. The Building Inspector may require plans and specifications to be submitted to him before- such permit shall be issued. The fee for such a permit shall be as follow:


1. For construction costing less than $500, no fee.


2. For construction costing more than $500, but less than $10,000, $2.00.

3. For construction costing more than $10,000, $5.00.


4. For alterations to existing building costing less than $500, no permit required.


The permit shall be void unless operations thereunder are commenced within ninety (90) days of the date of the permit, or if the operations are discontinued for a period of more than ninety (90) days.


2-Penalties:


Any person violating or permitting another to violate any of the provisions of this Bay-law shall be punished by a fine not exceeding One hundred dollars ($100) for each separate offense.


Part VI Amendment


These By-laws may be amended, altered, modified or repealed at any town meeting of the Town of Plainville as provided by law.

To see if the Town will vote to relocate and rebuild Taunton Street from Cowell Street to the Wrentham line to meet the new road the Town of Wrentham has built, and raise and appropriate the sum of $2,000.00, or any other sum, to start said construction, or do or act in any manner relative thereto. The estimated cost of this new road in Plain- ville is $20,000.00, of which amount the State will provide $10,000.00, Norfolk County $5,000.00 and the Town $5,000.00.


Article 28. To see if the Town will vote to raise and ap- propriate the sum of $682.20, this being the amount appor- tioned to Plainville as its share of the cost of the Norfolk County Retirement System, or do or act in any manner thereto.


Article 29. To see if the Town will vote to raise and ap- propriate the sum of $300.00, or any other sum for repairs to

the Town Office Building, or do or act in any manner relative thereto.


Article 30. To see whether or not the Town will vote to accept the provisions of Chapter 820 of the Acts of 1950 of the General Court of the Commonwealth of Massachusetts, which Chapter provides in substance for an increase in the annual amounts of certain pensions, retirement allowances, annuities and other benefits payable by the Commonwealth and its Political Sub-divisions to certain former employees and persons claiming under them, or do or act in any manner relative thereto.


Article 31. To see if the Town will vote to authorize the School Committee to sell certain used and out-moded equip- ment and accumulated paper. The receipts from such sales to be returned to the Town Treasurer, or do or act in any manner relative thereto.


Article 32. To see if the Town will vote to raise and ap- propriate a sum of money for the use of the athletic depart- ment of the schools, as provided for in Chapter 658, Acts of 1950, a revision of Section 47, of Chapter 71, of the General Laws, or do or act in any manner relative thereto.


Article 33. (Petition) To see if the Town will vote to install 2 Street Lights on Highland Avenue, the money to pay for same to be raised and appropriated under Section 19 of Article 7, or do or act in any manner relative thereto.


Article 34. (Petition) To see if the Town will vote to install 2 Street Lights on Walnut Street, the money to pay for same to be raised and appropriated under Section 19, of Article 7, or do or act in any manner relative thereto.


Article 35. (Petition) To see if the Town will vote to extend the water system on Highland Avenue, to East Bacon Street, 300 feet more or less, and to raise and appropriate the sum of $1000 or any other sum, or do or act in any manner relative thereto.


Article 36. To see if the Town will vote to install the water system on Berry Street, from South Street, 700 feet

more or less, and raise and appropriate the sum of $1,700, or any other sum, or do or act in any manner relative thereto.


Article 37. To see if the Town will vote to raise and ap- propriate the sum of $350, or any other sum, to repair Berry Street after water installation, or do or act in any manner relative thereto.


Article 38. To see if the Town will vote to install the water system on Warren Street, from West Bacon Street, 1800 feet, more or less, and raise and appropriate the sum of $4,250, or any other sum, or do or act in any manner relative thereto.


Article 39. To see if the Town will vote to raise and ap- propriate the sum of $900, or any other sum, to repair Warren Street, after water installation, or do or act in any manner relative thereto.


Article 40. To see if the Town will vote to install water on East Bacon Street Extension, from Washington Street about 1000 feet, more or less, and raise and appropriate the sum of $2,550., or any other sum, or do or act in any manner relative thereto.


Article 41. To see if the Town wil vote to raise and ap- propriate the sum of $500, or any other sum, to repair East Bacon Street Extension, after water installation, or do or act in any manner relative thereto.


Article 42. To see if the Town will vote to accept a private way, now known as Cooney Avenue, from the North Attleboro line at Moran Street to the North Attleboro line at West Street, or do or act in any manner relative thereto.


Article 43. To see if the Town will vote to amend its By-Laws by striking out Section 2 of Article 1, that reads as as follows: 'Warrants for town meetings shall be directed to any constable of the town or some other person, and it shall be the duty of said constables or other person to warn the inhabitants of said meeting by posting attested copies of the warrant in the Post Office of the Town, and in not less than

five other public places, seven days as least, before the day of said meeting', and inserting in its place, the following:


Section 2. "Warrants for town meetings shall be directed to any constable of the town, or some other person, and it shall be the duty of said constable or other person to warn the inhabitants of said meeting, by posting attested copies of the warrant in not less than six public places, seven days at least, before the day of said meeting," or do or act in any manner relative thereto. (This will require a 2/3 vote).


Article 44. To see if the Town will vote to accept the Building Code By-Laws, as printed on Pages 142 to 146 of this Town Report, or do or act in any manner relative thereto. (2/3 vote.)


Article 45. To see if the Town will vote to raise and ap- propriate the sum of $200.00 salary, and $50.00 expenses, for a Building Inspector, or do or act in any manner relative thereto.


Article 46. To choose any committee and to hear the report of any committee and act thereon.


And you are directed to serve this Warrant, by posting up attested copies thereof in the Post Office, and at six (6) other Public Places in said Town, seven (7) days at least before the time of holding said meeting.


Hereof fail not, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at or before the time and place of said meeting as aforsaid.
