In the name of the Commonwealth, you are hereby directed to notify and warn the inhabitants of the Town of Leverett, qualified to vote in Town affairs, to meet in the elementary school auditorium at said Leverett, on Monday, the tenth day of May next, at eight and one half of clock in the evening, then and there to act on the following articles namely:


Article 1. To see if the Town will vote to amend the Amherst-Pelham Regional School District Agreement as proposed by the Regional District School Committee by amendment entitled "Sixth Amendment to Amherst-Pelham Regional School District Agreement", a complete copy of the text of which proposed Amend- ment is appended to and hereby made a part of this Warrant.


Article 2. To see if the Town will vote to create a special unpaid committee to be known as the Regional School District Planning Committee, to consist of three members, including one member of the School Committee, to be appointed by the moderator in accordance with the provisions of Section 14 of Chapter 71 of the General Laws, as amended.


Article 3. To see if the Town will vote to transfer the sum of $1301.00 from Road Machinery Fund to the Road Machinery Account, or act anything thereon.


Article 4. To see if the Town will vote to adopt the following by-law:


A finance committee of five members shall be appointed by the moder- ator for three year overlapping terms. Members shall serve without compensation and no member may hold any other elective or appointive town position during his term of office. The finance committee shall consider all financial articles in warrants for all town meetings and shall report its recommendations in print before each meeting or vote.


The selectmen shall file a proposed budget for the ensuing fiscal year with a summary budget message and supporting documents. The summary budget message shall explain the budget both in fiscal terms and in terms of work programs. It shall outline the proposed financial policies of the town for the ensuing year and shall indicate any major changes from the current year in financial policies, expenditures and revenues. The budget shall indicate proposed expenditures for both current opera- tions and capital projects during the succeeding fiscal year, detailed by purposes, offices, department, commissions and committees.


The moderator may rescind an appointment to the committee if the appointee has failed to attend one-half of its regular meetings and may fill any vacancy for the unexpired term. The committee shall annually choose a chairman, a secretary and any other officers it chooses.

2) To delete from Section V. USE REGULATIONS, under A. Residence Districts, 1. Permitted Uses, paragraph c, which reads as follows: "Single, de- tached trailer, mobile home or similar dwelling unit for one-family occupancy provided that adequate provision is made for water supply, sewage disposal and electric power."

SIXTH AMENDMENT TO AMHERST-PELHAM REGIONAL SCHOOL DISTRICT AGREEMENT


The Amherst-Pelham Regional School District agreement, as amended, is hereby further amended as follows:


(1) By striking out Section II and inserting in place thereof the following section:


Section II - The Regional District School Committee


a. Until April 1, 1972, the regional district school committee, hereinafter sometimes referred to as the Committee, shall consist of nine members, five from the town of Amherst, two from the town of Pelham, one from the town of Leverett and one from the town of Shutesbury. On and after April 1, 1972, membership on the Committee shall be increased to thirteen, seven from the town of Amherst, two from the town of Pelham, two from the town of Leverett and two from the town of Shutesbury.


b. The members holding office on the regional district school committee on April 1, 1971 shall continue to hold office on the said Committee until their terms on their respective local school committees would normally expire or until their successors have been elected and qualified as herein provided. Commencing in 1972 members shall be annually elected directly to the regional district school committee for a term of three years by all the voters of the District at a district election to be held on an annual date agreed upon by the selectmen of the four member towns or, if such agreement is not reached on or before January Ist of each year, on a date prior to June Ist of each year set by vote of the regional district school committee. In 1972, at such a district election, three members shall be elected from the town of Amherst, one member shall be elected from the town of Pelham, one member shall be elected from the town of Leverett and one member shall be elected from the town of Shutesbury; in 1973, two members shall be clected from the town of Amherst and one member shall be elected from the town of Pelham; and in 1974, two members shall be elected from the town of Amherst, one member shall be elected from the town of Shutesbury, and one member shall be elected from the town of Leverett. Thereafter, only that number of members shall be clected annually as shall be necessary to maintain each town's membership on the regional district school committee as provided in subsection Ia. Elected members shall take office ten (10) days after the annual district election beginning in 1973.


Nominations for membership on the Committee shall be made in each member town in accordance with the procedures prescribed by law for nominations for town offices to be voted upon at the annual town meeting or election in such town. In those towns where nomination petitions are used, each nomination petition shall be presented to the registrar of voters of the town from which the candidate resides for certification of signatures within the time prescribed by law for such presentation in connection with a town election. Forthwith upon completion of nominations, and in no event no less than twenty-five (25) days prior to the date fixed for the annual district election, the town clerk of each town from which the term of one or more members of the Committee expires shall certify to the District secretary the names of all persons nominated from that town for election to the Committee.


Not later than thirty days prior to each annual district election, the district secretary shall consult with the selectmen and clerk of each town with respect to the number and location of polling places and the hours during which the polls will be open, which hours shall be the same through the district. The annual district election shall be called pursuant to a warrant issued by order of the Committee which shall set forth the date of the election, the polling place or places in each town, the hours during which the polls shall be open and the office or offices to be filled thereat. Notice of the election shall be given by posting a copy of the warrant therefor in at least one public place in each member town and by publishing a copy thereof at least once in a newspaper of general circulation in the district, such posting and publishing to occur at least seven days before the date of the election. A certificate of the secretary shall be conclusive evidence that the warrant was duly posted and published.


Notwithstanding any provisions of this subsection I b to the contrary, in the event that the annual town election in any one or more of the member towns shall be held on the same day and during the same hours as the annual District election, the following additional provisions shall apply:


(1) The District secretary shall promptly upon receipt thereof certify to the town clerk of any such town the name and address of each candidate nominated for election to the Committee.


(ii) The warrant for the annual district election shall state that said election will be held at the same time and place as the annual town election in such town.


(iii) The ballot, whether printed or by voting machine, may be prepared separately or, with the consent of the selectmen, may be included in and prepared as a part of the ballot for the annual town election.


The clerk of each member town shall within 24 hours after each election certify to the District secretary the result of the voting in that town. The District secretary shall thereupon tabulate, certify and announce the final results of the voting and shall send by registered mail, postage prepaid, his final certification to the town clerk of each Participating Town. Newly elected or appointed members of the Committee shall be sworn to the faithful performance of their duties by the District secretary or by the clerk of the town in which he resides, who shall file a record of such oath with the District secretary. Any recount petitions shall be filed with the District secretary and recounts shall be conducted in each member town in accordance with the laws applicable thereto.


Except as otherwise provided herein, the annual District election shall be conducted and apparatus therefor provided in and by each participating town to the same manner as prescribed by law for annual town elections at which official ballots are used. The town clerk and other election officials in each town shall perform the same duties in connection with the annual district election as provided by law for such annual town elections. All expenses of that part of the annual District election which is held in a participating town shall be paid by such town.
