(In 1974, the nine members at large are to be appointed by the Selectmen, three for one year terms, three for two year terms, and three for three year terms; thereafter three members elected at each annual Town Meeting to serve three year terms. ) Such Committee is to meet at least quarterly and be enabled to appoint ad hoc subcommittees to assist its work. Article 25: To see if the Town will vote to designate all roads within the Town of Leverett, excepting State Highway Route 63, to be scenic roads pursuant to Chapter 40, Section 15 e of the General Laws of Massachusetts, as follows:


'Upon recommendation or request of the planning board, conservation commission, or historical commission of any city or town, such city or town may designate any road in said city or town other than a numbered route or state highway, as a scenic road.


'After a road has been designated as a scenic road any repair, maintenance, re- construction, or paving work done with respect thereto shall not involve or include the cutting or removal of trees, or the tearing down or destruction of stone walls, or portions thereof, except with the prior written consent of the planning board .. after a public hearing duly advertised twige in a newspaper of general circulation in the area, as to time, date, place, and purpose, the last publication to occur at least seven days prior to such hearing.

'Designation of a road as a seenic road shall not affect the eligibility of a city or town to receive construction or reconstruction aid for such road pursuant to the provisions of chapter ninety." Sponsor - Conservation Comm.


Article 26: To see if the Town will vote to accept the following by-law: No public way or portion of any public way within the Town of Leverett which is unpaved at the time of adoption of this by-law shall be paved at any future time except with the prior written consent of the Planning Board without first being a public hearing regarding such paving; this hearing to be conducted by the Planning Board, which shall notify the Conservation Commission, Historical Commission and Selectmen of the time, date and subject of such hear- ing and advertise same in a newspaper of general circulation in the Town, appearing not less than one week prior to the hearing. Sponsored- Conservation Comm.


Article 27: To see if the Town will vote to discontinue and cease to maintain a section of Rattlesnake Gutter Road as a public way for purposes of motorized traffic while retaining public right of way for recreational and educational purposes, such section to extend northeastward approximately 4,800 feet from a point 1,400 feet more or less from the junction with Montague Road, approximately at the crossing of Gutter Brook, to a point near a junction with logging roads at an elevation of 725 feet, sore 800 feet northeast of the high point of the road.

Article 33: To see if the Town will vote to authorize the Conservation Commission to undertake a study for the prupose of determining the feasibility of generating hydro electric power from the rivers in the town. Sponsor - Citizens Comm.


Article 34: To see if the Town will vote to expend from the Revenue Sharing Account a sum not to exceed $500 to enable the conservation commission to study hydro electric power in the town. Sponsor - Citizens Comm.


Article 35: To see if the Town will vote to expend from the Revenue Sharing Account a sum not to exceed $1000.00 to construct at the Town landfill area, bins and storage sheds for the recycling of waste materials. Sponsor - Citizens Comm.


Article 36: To see whether or not the Town will vote to require of all contracts let, that 50% of the jobs of said contract will be posted in the town for a period of one month before execution of said contract. Sponsor- Citizens Comm.

Article 37: To see if the Town will accept the provisions of Chapter 1140, Sec. 22 of the General Laws and expend the sum of $24,096.00 for highway maintenance and con- struction as appropriated under said law or act otherwise thereon. Sponsor - Selectmen


Article 38: To see if the Town will accept the provisions of Chapter 497 of the General Laws and raise, appropriate or transfer from available funds in anticipation of reimbursement from gas tax revenue, the sum of $8200.00 or act otherwise thereon.

STATEMENT OF LEVERETT GOALS


Recognizing that pressures of change and population within the Connecticut Valley will continue to affect Leverett, and asserting the town's desire to shape its own future, the people of Leverett agree that all public action in the town shall seek to preserve and enhance certain values held in common and residing in the shared experience of this environment.


Specifically, recognizing that much of the town's character is due to a rural landscape, which inspires a sense of freedom and acquaintance with the earth, and which permits opportunities for a diversity of employment and passive recreation within the town, it shall be the goal of public policy in Leverett:


-- to promote the stewardship of agricultural, timber, recreational and other renewable natural resources;


-- to encourage the preservation of rural roadside landscapes;


-- to conserve areas of backland, especially mountain flanks, for open land uses such as watershed protection, wildlife production, forestry, recreation and visual amenity; to protect the town's streams, wetlands and subsurface waters from pollution;


-- to foster the preservation of the town's historical resources and the use of its educational potential.


Further recognizing that much of the town's character relies on the smallness and diversity of its population, which allows people the chance for both isolation and community interaction, it shall be the goal of public policy in Leverett:


-- to maintain a range of earning levels and housing types in keeping with the town's present character;


-- to insure that all building conforms to the natural constraints of the terrain, especially those affecting water supply and waste disposal;


-- to continue the town's traditions of small rural roads and hamlets;


-- to further the town's visual quality;


-- to foster individual involvement in the school, the town government, and other iinstitutions which in turn foster a feeling of identity with the town.

PROPOSED AMENDMENTS TO ZONING BY-LAW LEVERETT, MASS. FEBRUARY 16, 1974


In "SECTION III. DEFINITIONS." after the definition of "STREET LINE." add a new definition as follows :


STRUCTURE. A construction whether or not enclosed, in- cluding any recreational facility, of more than one hundred (100) square feet in area. Excluded from this definition are driveways, sidewalks, and patios.

"A. RESIDENCE DISTRICTS"


"1. Permitted Uses."


Delete all of subsections"a, b, c, d, e, and f" and substitue therefore the following new subsections "a, b, c, d, and e :"


a. Single, detached dwelling trailer, mobile home, or similar residential unit for one-family occupancy .


b. Seasonal dwelling.


c. Recreational occupancy of a camping vehicle or tent for up to fourteen (14) days in any one (1) month period with permission of landowner. Additional occupancy requires approval of Board of Health.


d. Two-family dwelling provided the area of the lot exceeds by a least 20, 000 square feet the minimum area normally required within the zoning district. e. Farm, orchard, greenhouse, tree nursery, truck garden, woodlot, or sugarhouse. May include re- tail sale of agricultural or horticultural products provided the major portion of those products has been raised on the premises. One or more signs with a combined maximum area of thirty (30) square feet may be displayed.


In subsection "g", which begins with the phrase, 11 Accessory uses shall be permitted as follows," delete the designation "g" and substitute therefore the new designation "f", so that the phrase now reads as follows : 11 "f. Accessory uses shall be permitted as follows.

"2. Uses which may be allowed, as a special exception by the Board of Appeals after a public hearing and subject to appropriate regulations if determined to be neither offensive nor detrimental to the neighborhood."


Delete all of subsections "a through l" and substitute there- fore the following new subsections "a through k" :


a . Governmental, educational, religious or other institu- tional use.


b. Private school, nursery school or kindergarten, trade or professional school.


c. Nursing home or sanitarium.


d. Medical or dental center including appropriate lab- oratories.


e. Telephone exchange, natural gas or electric power facility, bus station or other public utility or public carrier use.


f. Commercial dog kennel or veterinary hospital. Sawmill.


h. Conversion of a one-family dwelling, existing at the time of the adoption of this By-Law, into a two- family dwelling provided that all sewage disposal, yard and parking requirements can be met.


i. Cemetery.


j. Outdoor recreation areas, such as picnic grounds, golf courses, riding stables, ski areas, marinas or boat liveries, waterfront or beach areas for swimming and related activities.


k. Commercial piggeries.


Add a new Section 3, as follows :


3. Uses which may be allowed in Rural Residence Districts only, as a special exception by the Board of Anneals after a public hearing and subject to appropriate regulations if determined to be neither offensive nor detrimental to the neighborhood.

uses. Except for supervisory personnel, no part of the premises shall be occupied on a permanent basis. Any such recreational use shall be subject to the granting of an appropriate license by the Board of Health under the provisions of Section 32 A-D of Chapter 140 of the General Laws. Before the granting of a special exception by the Board of Appeals, a cite plan showing all camping and tenting areas, trailer or building sites, water supply and sanitary facilities must be filed with and approved by the Board of Health.

No dumping, filling, dredging, excavation, transfer or removal of any material which will alter the natural flood water storage capacity of the land, interfere with the natural flow of the water over the land or increase stream bank erosion shall be permitted except by written Order of Conditions from the Leverett Conservation Commission.


"SECTION VI. SUPPLEMENTARY PROVISIONS."


Delete all of Section "B" and substitute therefore the following new Section "B" :


B. DRIVEWAY LOCATION:


Except in access strips of less than fifty (50) feet width to rear lots, no driveway shall be located within ten (10) feet of any lot line without written approval of the appropriate abuttor(s), or by special exception from the Board of Appeals.


Delete all of the heading "B. AREA OF LOTS:" and sub- stitute therefore the following new heading:

Delete all of Section "C" and substitute therefore the following new Section "D" :


D. EARTH REMOVAL :


The removal of sod, loam, clay, sand, gravel or quarried stone, except when incidental to and in connection with the construction of a structure for which a nermit has been issued, or incidental to the grading and development of contiguous property, shall be permitted only if written permission of the Board of Appeals after public hearing be obtained. One house trailer, mobile home, camping vehicle, or tent may be used as an accessory to a dwelling on a lot for not more than thirty (30) days in any twelve (12) month period. One house trailer, mobile home, camping trailer or similar vehicle, not used for dwelling purposes, may be stored out of doors on a lot.


In "I. SIGN REGULATIONS :"


Add a new subsection "d" in "1. The following signs are permitted in all Residence Districts :", as follows : d. Temporary signs advertising a political can- didate or public event, provided that each sign does not exceed twelve (12) srurre feet in area, no more than four (4) signs for any single candidate or event are present within the Town, the signs are displayed for no longer than one (1) month prior to each election or public event, and are removed within one (1) week thereafter.


Delete all of the first paragraph of "SECTION VII. ENFORCEMENT. " and substitute a new first paragraph as follows:

CERTIFICATE TO ESTABLISH A CONTRIBUTORY RETIREMENT SYSTEM FOR THE TOWN OF LEVERETT


The voters of the Town of Leverett having voted in conformity with the provisions of Section 28 of Chapter 32 of the General Laws at the State Election in 1946 to accept the provisions of Sections 1 to 28, inclusive, of Chapter 32 of the General Laws establishing a contributory retirement system for the employees of the Town of Leverett: The Commissioner of Insurance hereby issues a certificate de- claring said contributory retirement system to be established as of July 1, 1947 in accordance with the provisions of said Section.


The employees of said Town shall become members of the retirement system of the County of Franklin wherein such Town lies in lieu of the establishment of a re- tirement system within and for such Town as further provided by Section 28 of Chapter 32 of the General Laws.
