Report and Recommendation of the Leverett Planning Board relative to Article
TO THE PEOPLE OF LEVERETT, MASSACHUSETTS:
While it is a primary function of the Planning Board to make zoning proposals, it is also possible for any citizen to propose zoning changes. The power to allow or disallow any given use of land in Leverett rests with the voters at Town Meeting. The Planning Board has held the required public hearing upon on Article 5 , which if acted favorably, would prohibit the further use of trailers or mobile homes as dwellings in Leverett. At the hearing 1 has The Board- listened to the discussion relative to this article and given it full consideration. Our recommendation is that the voters reject the proposal.
This recommendation is based upon the Board's opinion that trailers or mobile homes are not detrimental to the Town but rather serve well a real need. Every town should offer housing possibilities to citizens with modest incomes. Many towns allow low-cost apartment complexes intended to meet this need. Often problems are created by those apartments and they still may not provide the genuinely low-cost housing needed. We feel that the mobile home is the solution that best suits Leverett.
In permitting mobile homes on the same terms as any other dwelling, Leverett zoning laws focus on what is important to both Town and resident: adequate water supply and sewage disposal. To prohibit trailers as dwellings would be to discriminate according in
to income level. To prohibit them even \ ' one section of Leverett would serve no good purpose. Leverett is extremely fortunate in its diverse population, and the present zoning by-law supports that diversity.

LEVERETT PLANNING BOARD STATEMENT IN SUPPORT OF THE PROPOSED ZONING CHANGE OFFERED IN ARTICLE 13 OF THE LEVERETT TOWN WARRANT FOR THE TOWN MEETING OF FEBRUARY 19, 1972
The Planning Board believes that the establishment of a Stream and Lake Protection District within the Town serves the vital interests of the residents.
To prevent the use of land boardering streams and lakes in ways which may be harmful to health or which substantially increase erosion or flooding is well within the zoning powers given cities and towns in Massachusetts. Failure to use that power to prevent hazardous development can only result in regret, soon or late, for the curing of pollution and correcting of damage done to water bodies is neither cheap nor easy.
In Leverett's case, serious trouble can be avoided by foresight, and that is both cheap and easy. The cost has been the price of two legal notices and some time spent by interested people. All that is needed now is your vote to adopt the porposed amendment. Then, as population pressure increases over the years, we can be glad we did rather than wishing we had when we first had the chance.

PROPOSED CHANGES IN THE ZONING BY-LAW OF THE TOWN OF LEVERETT
AMENDMENT 1. To add to Section IV, at the end, a new item to read as follows:
D. STREAM AND LAKE PROTECTION DISTRICT: To insure that lands near flowing streams and standing open water bodies shall not be used in such a manner as to endanger the health or safety of Leverett residents, the following areas shall be included in the Stream and Lake Protection District:
1. The land lying within a horizontal distance of 50 feet on each side of the center line of each and every flow- ing stream in the Town of Leverett, as shown on the Leverett section of the base map used in the Franklin County Soil Survey, including both streams shown as solid lines and those shown as broken lines on this map.
A copy of this map, issued by the Soil Conservation Service of the United States Department of Agriculture in cooperation with the Massachusetts Agricultural Experiment Station in February, 1967, is appended to and made an official part of this By-Law.
2. All land that lies within a horizontal distance of 50 feet from the normal highwater line of all standing open bodies of water in the town, except dug ponds of less than one acre of water surface lying outside the Stream and Lake Protection District.
AMENDMENT 2. In Section IV, throughout provisions B and C, to replace the words "district" and "districts" with the words "zoning district" and "zoning districts".
AMENDMENT 3. To add to Section V. Use Regulations, at the end, a new item to read as follows:
D. STREAM AND LAKE PROTECTION DISTRICT:
The Stream and Lake Protection District shall be con- sidered to be superimposed over any Zoning District estab- lished by this By-Law. Land in the Stream and Lake Protection District may be used for any purpose otherwise permitted in the underlying Zoning District, with the following exceptions:

1. No septic tank or septic tank leach field shall be constructed within the Stream and Lake Protection District.
2. No dumping, filling, dredging, excavation, transfer or removal of any material which will alter the natural flood water storage capacity of the land, interfere with the natural flow of the water over the land or increase stream bank erosion shall be permitted except by written permit from the State Department of Natural Resources or from the Leverett Board of Appeals.
3. No building or structure shall be erected in this District except as a Special Exception approved by the Board of Appeals following a Public Hearing.
The Board of Appeals may grant a Special Exception for a building or structure provided that all the following conditions are met:
a. The building or structure is not intended for and shall not be used for human residence.
b. Its construction or use will not:
1. Substantially interfere with the natural flow of water.
2. Constitute a danger to the public safety or health.
The portion of any lot lying within the Stream and Lake Protection District may be used to meet the lot area requirements for the Zoning District in which the lot is located.
AMENDMENT 4. To add to Section VII, Enforcement, at the end, the following new paragraph, to read as follows:
Whenever application is made for a building permit for a lot which the Selectmen believe may involve land lying within the Stream and Lake Protection District, they shall require the applicant of such permit to pro- vide, as part of the permit application, a plan of the lot showing the boundaries of the Stream and Lake Pro- tection District on that lot, as well as the location of the buildings, well, septic tank and leach field as normally required. The Board of Health shall make a site inspection to insure that the location of buildings, excavations, septic tanks and leach fields meet the provisions of this By-Law, before a permit is issued.
