ART. 10. To see what action the Town will take in regard to improving the ventilation of the Town Hall, or Bemis Hall, and to appropriate the necessary amount of money therefor.

SELECTMEN'S REPORT.
The past year has been an eventful one for the town of Lin- coln, several important events having been set in motion. It may not be generally known that the city of Cambridge has taken by eminent domain and by purchase, about nine hundred and fifty acres of land in the city of Waltham and towns of Lincoln and Lexington, for the purpose of constructing reservoir basins. The westerly boundery of land so taken runs the entire distance of the old County Road and Winter street (so called) from Waltham line to Lexington line, in the town of Lincoln. Certain portions of said County Road, together with portions of other streets that ex- tend through the proposed basin, the city of Cambridge are obliged, on account of grade, to raise before they can allow their basin to fill with water.
The act of 1884, under which the city acquired the land for its water basin, made no provision for alterations in the roads cross- ing and adjoining it. At first the city proposed to make changes without any legislative authority, but the town objected to this, and Cambridge was forced to apply for further legislation. The bill introduced in the Legislature of 1895 by the city was intended to give it the authority to discontinue, alter, change in grade, and construct any roads it saw fit in the vicinity of the water basin, practically without supervision or control. The town appeared at the committee hearings before the Legislature and strenuously op- posed the Cambridge plan, with the result that an entirely differ-
ent bill was passed, whichi offered complete protection to the town by carefully limiting the work which Cambridge should be allowed to do to certain specified roads and parts of roads, and by provid- ing that no work should be done except under the supervision of the County Commissioners, and entirely at the expense of the city. The city was also required by the act to keep places changed in grade in repair for a period not exceeding five years, as the County Commissioners should order, to maintain guard rails for- ever in such places, and to keep in repair forever Lincoln street

over the dam. The most important provision of the act was the authority given to the County Commissioners to determine the bounderies of and locate anew in substantially its present posi- tion, the old County Road above mentioned from Concord Turn- pike in Lexington to the Waltham line on Winter street, a dis- tance of about two miles.
The city of Cambridge, in compliance with the terms of the act, petitioned the Middlesex County Commissioners for the privilege of raising the grade of streets in several low places in Lincoln and Lexington ; also that certain portions of streets in Lincoln and Lexington be discontinued, viz. : All of Brooks street in Lincoln, and a part of the old County Road between Concord Turnpike in Lexington and its intersection in Lincoln with the new road laid out from the premises of John J. Jurada to said Concord Turnpike. The city of Cambridge further petitioned the County Commissioners to determine the bounderies of, and locate anew, the said County Road in Lincoln and Lexington from the town line of Lincoln and Waltham on Winter street to said Con- cord Turnpike in Lexington. The County Commissioners, after viewing the premises and holding several meetings where the par- ties in interest were heard, adjudged that the changes of grade, discontinuance of streets, and said locating anew, were necessary and proper for the purposes set forth in chapter 354 of the Acts of 1895. And in accordance with plans and specifications pre- sented by them, the commissioners determined and ordered that the city of Cambridge shall, at its own expense, on or before the first day of July, 1896, lay open, construct and complete said road, according to said specifications, in a workmanlike manner ; and said commissioners further determined and ordered that the city of Cambridge shall, at its own expense, perform all the work of building said road to the acceptance of said commissioners, also shall perpetually keep in repair that part of road leading from Lincoln to Waltham by the old mill site, known as Lincoln street, the grade of which was changed ; and shall keep in repair for five years next after the completion thereof, certain other por- tions of streets mentioned in their order; and shall perpetually maintain guard rails upon and along certain parts of streets men- tioned in their order ; and shall pay all damages awarded to, or recovered by any person in consequence of anything done under the authority of said order.

The city of Cambridge says that the County Commissioners have exceeded their right in the above order, and said city has appealed to the Supreme Court of Massachusetts for a writ of certiorari to quash the proceedings of the Commissioners.
The case was heard in the Supreme Court before Judge Mor- ton, on Jan. 17th, 1896, and will be presented by him to the full bench of judges for a decision. At the hearing before Judge Morton the city of Cambridge was represented by City Solicitor Peavy and George O. Shattuck, Esq., the County Commissioners by A. A. Strout, Esq., and the towns of Lincoln and Lexington by E. Irving Smith, Esq. The decision is awaited with interest, as it is considered of great importance to this town.
One mile of state road has been nearly completed on the north great road, which is conceded by all who have seen it to be a very great improvement. The committee chosen by the town to construct the road will present a detailed account of the receipts and expenditures of the same. It is expected the work will be extended the coming season.
An important matter of interest to the town is the suit of William A. Burnham and others, trustees, to recover from the town the amount of the tax assessed upon them in 1894, which they have paid under protest. Another important matter is the peti- tion of Julian de Cordova for the abatement of a portion of the tax assessed upon him as trustee in 1894. These matters are now in litigation, and the outcome is of great importance to the town in a financial point of view. Newspaper reports indicate a strained feeling in the town of Concord in relation to Sandy Pond water, a matter of which very little is known at the time of writ- ing. A statement of the receipts and expenditures of the town of Lincoln for the year ending Feb. 1st, 1896, is herewith sub- mitted, together with a statement of the debts of the town.

Report of the Overseers of the Poor.
Since our report to the town in 1895, one of the persons supported by the town has died, viz : John McGrath, and one, viz : Mrs. Mary Craven has been added, so that the number is the same as last year, viz : five. All are in Insane Hospitals. Mrs. Craven was committed to Westborough Insane Hospital from Boston, February 13, 1895. Ten dollars was expended on account of a woman who was found beside the Fitchburg Railroad on the morning of November 21, which it is expected will be reimbursed by the state. In 1894 the town expended for care, support, medical and funeral expenses of Mary Powell the sum of $128.98, which together with interest from date of her death, is due the town of Lincoln. Your Overseers wrote to the adminis- trator of her estate several months since, in regard to the payment of the same, but no answer has been received. We are informed that in order to recover, action must be commenced within two years from the time the administrator of her estate was appointed, which time will expire December 18, 1896.
