ART. 3. To choose all necessary Town Officers, Com- mittees, Commissioners and Trustees.

To see if the Town for the purposes men- tioned in Articles 16 and 17, or in either or both of the said articles, will borrow any money and authorize the issue of any notes, bonds or script for such indebted- ness under the provisions of Chapter 188 of the Acts of 1872 to an amount not exceeding altogether $10,- 000, payable at a period not exceeding thirty years from the date thereof, with interest payable semi- annually at a rate not exceeding six per cent. per annum, or will make any appropriations of money for any or all of the said purposes, or take any other action in relation thereto.
ART. 19. To see if the Town will accept a gift of land from William S. Briggs and build a road thereon, the same to be an extension of the road past Michael Kennedy's and the Spencer farm to Lincoln Street (so called), and appropriate money therefor, and discon-

tinue the present road from the East schoolhouse towards Lincoln Center to its junction with said Lin- coln Street.
ART. 20. To see if the Town will widen the road at the west end of the three cornered cemetery, or take any action in relation to the same.
ART. 21. To see if the Town will construct and maintain a sidewalk from the Center of the Town to the depot of the Fitchburg Railway.
ART. 22. To see if the Town will place street lights upon the road between the Center of the Town and the depot of the Fitchburg Railway.
ART. 23. To see if the Town will purchase a horse road-roller for use of road-maker.
ART. 24. To see if the Town will adopt a code of By-laws or take any action in relation thereto.

GREETING :
In the name of the Commonwealth of Massachusetts you are hereby required to notify and warn the inhabitants of the Town of Lincoln, duly qualified to vote in Town affairs, to assemble at the Town Hall, on Saturday, January 11 inst., at 1.30 p. M., to act on the following articles, viz. :
ARTICLE 1. To chose a Moderator. Chose Charles S. Wheeler, Moderator.
ART. 2. To see if the Town will take and hold, under the pro- visions of Chapter one hundred and eighty-eight of the Acts of the year eighteen hundred and seventy-two, the waters of Sandy Pond, so-called, in the Town of Lincoln, and the waters which flow into and from the same, for the purpose of supplying itself and its inhabitants with pure water, to extinguish fires, generate steam, and for domestic and other uses ; and if the town will take and hold under the provisions of said act by purchase or other- wise, any lands for raising, flowing, holding, diverting, conduct-
ing, purifying and preserving such waters, and conveying the same to any and all parts of said Town of Lincoln; and if the Town will authorize, direct or instruct the Water Commissioners to take any action with reference thereto, or to exercise any of the rights, powers and privileges granted to the town under the pro- visions of said Act.
Voted, That the Town of Lincoln for the purpose of supplying itself and its inhabitants with pure water, to extinguish fires, generate steam and for domestic and other uses and for the pur- pose of establishing public fountains, and hydrants, hereby takes

the waters of Sandy Pond in the town of Lincoln and the waters which flow into and from the same in accordance with the pro- visions of Chapter one hundred and eighty-eight of the Acts of 1872.
Voted, That in pursuance of chapter one hundred and eighty- eight of the Acts of the year eighteen hundred and seventy-two, the following described parcel of land situated in the town of Lincoln, be and hereby is taken for raising, flowing, holding, diverting, conducting, purifying and preserving and for all other purposes mentioned in said Act the waters of Sandy Pond in the town of Lincoln and the waters which flow into and from the same, to wit: Beginning at a point on the easterly side of the highway to Concord at land of Francis Smith and at the southerly corner of a certain parcel of land taken by the town of Lincoln for said purposes as appears by the certificate of the Water Com- missioners of said town filed and recorded with Middlesex South District Deeds, March 13, 1876, book of executions No. 27, page 230 : thence running northeasterly by land of said Smith through a point one hundred and twenty-three (123) feet easterly from the northeasterly corner of the pumping station, measured from the lowest course of brick at said corner on a line which is the north- erly side of said pumping station, produced easterly to said pond ; thence westerly by said pond to said land formerly taken ; thence southwesterly by said last mentioned land to the point of begin- ning ; containing about one-fourth acre of land and being as shown on a plan drawn by E. A. W. Hammatt, C. E., dated Jan- uary 3, 1896, to be recorded in said Registry of Deeds. The supposed owner of the above described parcel of land is Francis Smith of said Lincoln.
ART. 3. To see what action the town will take to prevent encroachment upon its right to the water of Sandy Pond.
Voted, To lay on the table.
ART. 4. To see if the town will pay to Mr. Lewis E. Smith $100 for damage to his land on account of the new road from Dr. H. C. Chapin's to house of Mrs. Campbell, or take any other action in relation to the matter.
Voted, 'That the matter be referred to the Selectmen to investi- gate and report to next March meeting.

ART. 5. To see if the town will so amend its By-Laws that it may send its truants to the " Middlesex County Truant School " at Chelmsford, Mass., instead of the " Lowell Reform School " at Lowell.
Voted, That the town of Lincoln do so amend their By-Laws that it may send its truants to the Middlesex County Truant School at Chelmsford.
ART. 6. To hear the report of any Committee chosen by the. town, that may be ready to report and act thereon.

ART. 6. To give in their votes by ballot in answer to the ques- tion : "Shall Licenses be granted for the sale of Intoxicating Liquors in this Town ?" The check list shall be used, as provided by Section 5, Chapter 100, of the Public Statutes.

ART. 7. To determine the manner of collecting taxes ; also the compensation of the Collector for the ensuing year.
Voted that the Collector be 'and is hereby authorized to col- lect within one year from the time he received his warrant in a lawful manner, all taxes which shall have been returned to him for collection by warrant from the Assessors, and which shall not have been lawfully abated or in litigation. Otherwise he shall receive no compensation for collecting. Also that 12 per cent. on Iris list be paid him for collection as per above motion.
ART. 8. To see if the Town will authorize the committee chosen by the Town at a former meeting to contract for and build a mile of State road, to contract with the State Highway Commis- sioners to build the remainder of the State Highway in this Town, or any part of the same.
Voted, That the Town do authorize satd Committee to contract with the State Highway Commissioners to build said highway.
ART. 9. To see if the Town will authorize its Treasurer, under the direction of the Selectmen, to borrow money in anticipation of taxes of the current year, and to be paid therefrom.
Voted, That the Treasurer be and is hereby authorized and directed, with the approval of the Selectmen, to borrow tempora- rily, in anticipation of the taxes of the present municipal year, such sums of money as may be from time to time required, and to give the negotiable note or notes of the l'owu for money so bor- rowed, and that all such temporary loans shall be paid from the said taxes.
ART. 10. To see what action the Town will take in regard to improving the ventilation of the Town Hall or Bemis Hall, and to appropriate the necessary amount of money therefor.
Voted, To appropriate the sum of $200, for the Committee to improve the ventilation of the Town Hall or Bemis Hall.
ART. 11. To see if the Town will confirm and ratify the action of the Board of Health, whereby they employed counsel to assist

them in matters pertaining to the prevention of polluting the water of Sandy Pond ; also the action of the Selectmen in approving the bill for payment of said counsel.
Voted, to confirm and ratify the actions named in said article.
ART. 12. To see if the Town will reconsider its vote passed some years since, whereby it voted that the proceeds of sales of lots in the New Cemetery should be invested, and the income of such investment should be used to keep the Cemetery or certain parts thereof in repair.

ART. 13. To see if the Town will have all proceeds of sales of lots in the Cemeteries paid into the Town treasury.

To see if the Town will confirm and ratify the doings of the Water Commissioners, pursuant to the vote of the Town Jan. 11, 1896, and all other votes of the Town thereto enabling them in regard to the taking and holding the waters of Sandy Pond and the waters which flow into and from the same, under the provisions of chapter one hundred and eighty-eight of the Acts of the year eighteen hundred and seventy-two; and if the Town will authorize the Water Commissioners to make any further taking of said waters for the purposes named in said act, or take any action in relation thereto.
Voted, That the town hereby ratifies and confirms the doings of the Water Commissioners pursuant to the vote of the town January 11, 1896, and all other votes of the town them thereto enabling in regard to the taking and holding of the waters of Sandy Pond and the waters which flow into and from the same, under the pro- visions of chapter one hundred and eighty-eight, of the Acts of the year eighteen hundred and seventy-two, without waiving in any respect any right or title to or in said waters otherwise previously acquired. And the said Water Commissioners are hereby author- ized to make in the name and behalf of the town such further and confirmatory takings of said waters as they may from time to time in their discretion deem necessary and proper.
ART. 15. To see if the town will take and hold under the pro- visions of chapter one hundred and eighty-eight of the Acts of the year eighteen hundred and seventy-two by purchase or otherwise,

any lands for raising, flowing, holding, diverting, conducting, pur- ifying and preserving the waters of Sandy Pond and the waters which flow into and from the same, and for conveying such waters to any and all parts of the town ; or take any action in relation thereto.
Voted, That the Water Commissioners be authorized and direct- ed to take and hold, in the name and in the behalf of the town by purchase or otherwise, under the provisions of chapter one hundred and eighty-eight of the Acts of the year eighteen hundred and seventy-two, all necessary lands which the said Commissioners may from time to time deem necessary and proper for raising, flowing, diverting, conducting, purifying and preserving the waters of Sandy Pond in the Town of Lincoln, and conveying the same to any and all parts of said Town, and for any and all purposes mentioned in said Act.
ART. 16. To see if the Town will make any provision by the choice or appointment of a committee on claims, or otherwise, for the defense of suits, claims and demands against the Town, and for the prosecution of such proceedings as may be necessary for the protection of the rights of the Town, or make any appropriaton therefor, or take any other action in relation thereto.
Voted, That a Committee of three persons to be chosen by the Town, shall constitute a committee on claims, whose powers and duties shall be as follows : To consider all disputed claims and demands of whatever kind which shall be presented to the Town, and to compromise or defend the same before any tribunal ; to bring in the name of the town, such suits at law or equity or institute such other proceedings before any tribunal as may in their judgment be necessary and proper to protect the interests and property of the Town, and to compromise any such suit or other proceeding ; to take necessary and proper measures for the collect- ion and preservation of evidence relating to any controversy in which the Town is or may be, a party ; to represent the Town before the Legislature of the Commonwealth in matters affecting the interests of the Town ; to employ counsel to appear in the name and behalf of the Town for any of the aforesaid objects ; to have charge of the expenditures of any appropriation made for such objects, unless otherwise specifically provided for; and in all matters so far as practicable, to act in connection with the particular board or com- mittee affected thereby.

Voted, That the following suits and controversies be referred to the Committee on Claims :
1. All suits and petitions in regard to the abatement of taxes and the recovery of taxes paid under protest.
2. The suit of Francis Smith vs. Lincoln to recover $5000.
3. All suits, petitions and controversies relating to the alter- ations, changing of grade or locating anew of roads by the city of Cambridge to accommodate the new reservoir in the east part of the Town.
4. All suits and controversies now pending or which may arise during the ensuing year between Lincoln and Concord in regard to the right of said towns respectively in and to the waters of Sandy Pond.
5. All controversies now pending or which may arise during the ensuing year in regard to any taking or acquirement of land for raising, flowing, holding, diverting, conducting, purifying, or preserving the waters of Sandy Pond.
ART. 17. To see if the Town will authorize the Public Im- provement Committee to designate certain trees within the limits of its highways for the purpose of preserving them for shade trees.
Voted, That the matter be referred to the Public Improvement Committee and the Selectmen.
ART. 18. To see if the Town will adopt any by-laws or take any action in relation thereto.
Voted, That the matter be referred to the Committee on Claims to draft suitable by-laws and to report the same to the Town at the next annual meeting.
ART. 19. To see if the Town will make any appropriation of money in anticipation of payment of bills on account of the State road.

Before the adjournment of this meeting, a communication was received from Mr. William Mackintosh, a former resident of this Town, but now resident of Cottage Grove, in the State of Minne- sota, proposing to convey by quit-claim deed to the Town of Lincoln, the lane leading from the road to South Lincoln, to the farm of James Kenna ; and the Town voted as follows :
Resolved. that the Town of Lincoln accept the offer of Mr. - Mackintosh with thanks, and the Town Clerk be directed to for- ward him a copy thereof.

ART. 2. To see if the Town will vote to grant the use of the Lower Town Hall for the purpose of a School Room till other suit- able provisions are made for same. Also to see what further action may be taken in the matter.
Voted, To grant the use of the Town Hall for the purpose of a school-room till other suitable provisions are made for the same. Voted, To grant the School Committee the sum of $75, to im- prove the ventilation of said hall.
ART. 3. To see if the Town will extend the Water Pipes as far as the house of George Flint, and make provision for the pay- ment of the same.
Voted, That the Water Commissioners be authorized to extend the water pipes as far as the house of Mr. George Flint, and that $800 be appropriated therefor.
ART. 4. To see if the Town will appoint a Committee to visit the town of Wakefield, Mass., and inquire into the methods there used for the prevention and control of fires, and report their views to the next town meeting.
Voted, To choose a Committee of three persons to visit the town of Wakefield, Mass., for the purpose named in this article. Said Committee to consist of Samuel H. Pierce and the foreman of Hose Co. No. 1, and the foreman of Hose Co. No. 2.
